BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section161.670,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection161.670,toreadasfollows: 161.670.1.Notwithstandinganyotherlaw,priortoJuly1,2007,thestateboardof 2educationshallestablishthe"MissouriCourseAccessandVirtualSchoolProgram"toserve 3school-agestudentsresidinginthestate.TheMissouricourseaccessandvirtualschool 4programshalloffernonclassroom-basedinstructioninavirtualsettingusingtechnology, 5intranet,orinternetmethodsofcommunication.Anystudentundertheageoftwenty-onein 6gradeskindergartenthroughtwelvewhoresidesinthisstateshallbeeligibletoenrollinthe 7Missouricourseaccessandvirtualschoolprogrampursuanttosubsection3ofthissection. 8 2.(1)Forpurposesofcalculationanddistributionofstateschoolaid,students 9enrolledintheMissouricourseaccessandvirtualschoolprogramshallbeincludedinthe 10studentenrollmentoftheschooldistrictinwhichthestudentisenrolledundertherelevant 11provisionsofsubsection3ofthissection[; providedthatanysuch] forsuchenrollment. 12Studentattendanceforfull-timevirtualprogramstudentsshallonlybeincludedinanydistrict 13pupilattendancecalculationunderchapter163[andanycharterschoolpupilattendance 14calculationundersection160.415,] usingcurrent-yearpupilattendanceforsuchfull-time 15virtualprogrampupils[; andfurtherprovidedthat].Forthepurposeofcalculatingaverage 16dailyattendanceinfulltimevirtualprogramsunderthissection,averagedaily EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17attendanceshallbedefinedasthequotientorthesumofthequotientsobtainedby 18dividingthetotalnumberofhoursattendedinatermbyenrolledpupilsbetweenthe 19agesoffiveandtwenty-onebytheactualnumberofhoursthattheprogramwasin 20sessioninthatterm,andtheprovisionsofsection162.1250shallnotapplytosuch 21fundingcalculation.Suchcalculationshallbegeneratedbythevirtualproviderand 22providedtothehostdistrictforsubmissiontothedepartmentofelementaryand 23secondaryeducation.Suchstudentsmaycompletetheirinstructionalactivities,as 24definedinsubsection4ofthissection,duringanyhourofthedayandduringanydayof 25theweek.Thehoursattendedforeachenrolledpupilshallbedocumentedbythepupil's 26weeklyprogressintheeducationalprogramaccordingtoaprocessdeterminedbythe 27virtualprogramandpublishedannuallyinthevirtualprogram'senrollmenthandbook 28orpolicy.Totheaveragedailyattendanceofthefollowingschooltermshallbeadded 29thefull-timeequivalentaveragedailyattendanceofsummerschoolstudents.Inthecase 30ofahostschooldistrictenrollingoneormorefull-timevirtualschoolstudents,suchenrolling 31districtshall, aspartofitsmonthlystateallocation,receivenolessunderthestateaid 32calculationforsuchstudentsthananamountequaltothestateadequacytargetmultipliedby 33theweightedaveragedailyattendanceofsuchfull-timestudents.Studentsresidingin 34Missouriandenrolledinafull-timevirtualschoolprogramoperatedbyapublicinstitutionof 35highereducationinthisstateshallbecountedforastateaidcalculationbythedepartment, 36andthedepartmentshallpay,fromfundsdedicatedtostateschoolaidpaymentsmadeunder 37section163.031,tosuchinstitutionanamountequaltothestateadequacytargetmultipliedby 38theweightedaveragedailyattendanceofsuchfull-timestudents. 39 (2)TheMissouricourseaccessandvirtualschoolprogramshallreporttothedistrict 40ofresidencethefollowinginformationabouteachstudentservedbytheMissouricourse 41accessandvirtualschoolprogram:name,address,eligibilityforfreeorreduced-pricelunch, 42limitedEnglishproficiencystatus,specialeducationneeds,andthenumberofcoursesin 43whichthestudentisenrolled.TheMissouricourseaccessandvirtualschoolprogramshall 44promptlynotifytheresidentdistrictwhenastudentdiscontinuesenrollment.A"full-time 45equivalentstudent"isastudentwhoisenrolledintheinstructionalequivalentofsixcredits 46perregularterm.EachMissouricourseaccessandvirtualschoolprogramcourseshallcount 47asoneclassandshallgeneratethatportionofafull-timeequivalentthatacomparablecourse 48offeredbytheschooldistrictwouldgenerate. 49 (3)Pursuanttoaneducationservicesplanandcollaborativeagreementunder 50subsection3ofthissection,full-timeequivalentstudentsmaybeallowedtouseaphysical 51locationoftheresidentschooldistrictforallorsomeportionofongoinginstructionalactivity, 52andtheenrollmentplanshallprovideforreimbursementofcostsoftheresidentdistrictfor 53providingsuchaccesspursuanttorulespromulgatedunderthissectionbythedepartment. HB2287 2 54 (4)Innocaseshallmorethanthefull-timeequivalencyofaregulartermof 55attendanceforasinglestudentbeusedtoclaimstateaid.Full-timeequivalentstudentcredit 56completedshallbereportedtothedepartmentofelementaryandsecondaryeducationinthe 57mannerprescribedbythedepartment.Nothinginthissectionshallprohibitstudentsfrom 58enrollinginadditionalcoursesunderaseparateagreementthatincludestermsforpaying 59tuitionorcoursefees. 60 (5)Afull-timevirtualschoolprogramservingfull-timeequivalentstudentsshallbe 61consideredanattendancecenterinthehostschooldistrictandshallparticipateinthe 62statewideassessmentsystemasdefinedinsection160.518.Theacademicperformanceof 63studentsenrolledinafull-timevirtualschoolprogramshallbeassignedtothedesignated 64attendancecenterofthefull-timevirtualschoolprogramandshallbeconsideredinlike 65mannertootherattendancecenters.Theacademicperformanceofanystudentwhodisenrolls 66fromafull-timevirtualschoolprogramandenrollsinapublicschoolorcharterschoolshall 67notbeusedindeterminingtheannualperformancereportscoreoftheattendancecenteror 68schooldistrictinwhichthestudentenrollsfortwelvemonthsfromthedateofenrollment. 69 (6)Forthepurposesofthissection,apublicinstitutionofhighereducationoperating 70afull-timevirtualschoolprogramshallbesubjecttoallrequirementsapplicabletoahost 71schooldistrictwithrespecttoitsfull-timeequivalentstudents. 72 3.(1)AstudentwhoresidesinthisstatemayenrollinMissouricourseaccessand 73virtualschoolprogramcoursesofhisorherchoiceasapartofthestudent'sannualcourse 74loadeachschoolyear,withanycostsassociatedwithsuchcourseorcoursestobepaidbythe 75schooldistrictorcharterschoolif: 76 (a)Thestudentisenrolledfull-timeinapublicschool,includinganycharterschool; 77and 78 (b)PriortoenrollinginanyMissouricourseaccessandvirtualschoolprogram 79course,astudenthasreceivedapprovalfromhisorherschooldistrictorcharterschool 80throughtheproceduredescribedundersubdivision(2)ofthissubsection. 81 (2)Eachschooldistrictorcharterschoolshalladoptapolicythatdelineatesthe 82processbywhichastudentmayenrollincoursesprovidedbytheMissouricourseaccessand 83virtualschoolprogramthatissubstantiallysimilartothetypicalprocessbywhichadistrict 84studentwouldenrollincoursesofferedbytheschooldistrictandacharterschoolstudent 85wouldenrollincoursesofferedbythecharterschool.Thepolicymayincludeconsultation 86withtheschool'scounselorandmayincludeparentalnotificationorauthorization.Thepolicy 87shallensurethatavailableopportunitiesforin-personinstructionareconsideredpriorto 88movingastudenttovirtualcourses.Thepolicyshallallowforcontinuousenrollment 89throughouttheschoolyear.Iftheschooldistrictorcharterschooldisapprovesastudent's 90requesttoenrollinacourseorcoursesprovidedbytheMissouricourseaccessandvirtual HB2287 3 91schoolprogram,thereasonshallbeprovidedinwritinganditshallbeforgoodcause.Good 92causejustificationtodisapproveastudent'srequestforenrollmentinacourseshallbea 93determinationthatdoingsoisnotinthebesteducationalinterestofthestudent,andshallbe 94consistentwiththedeterminationthatwouldbemadeforsuchcourserequestunderthe 95processbywhichadistrictstudentwouldenrollinasimilarcourseofferedbytheschool 96districtandacharterschoolstudentwouldenrollinasimilarcourseofferedbythecharter 97school,exceptthatthedeterminationmayconsiderthesuitabilityofvirtualcoursesforthe 98studentbasedonpriorparticipationinvirtualcoursesbythestudent.Appealsofanycourse 99denialsunderthissubsectionshallbeconsideredunderapolicythatissubstantiallysimilarto 100thetypicalprocessbywhichappealswouldbeconsideredforastudentseekingtoenrollin 101coursesofferedbytheschooldistrictandacharterschoolstudentseekingtoenrollincourses 102offeredbythecharterschool. 103 (3)ForstudentsenrolledinanyMissouricourseaccessandvirtualschoolprogram 104courseinwhichcostsassociatedwithsuchcoursearetobepaidbytheschooldistrictor 105charterschoolasdescribedunderthissubdivision,theschooldistrictorcharterschoolshall 106paythecontentproviderdirectlyonaproratamonthlybasisbasedonastudent'scompletion 107ofassignmentsandassessments.Ifastudentdiscontinuesenrollment,thedistrictorcharter 108schoolmaystopmakingmonthlypaymentstothecontentprovider.Noschooldistrictor 109charterschoolshallpay,foranyonecourseforastudent,morethanthemarketnecessary 110costsbutinnocaseshallpaymorethanfourteenpercentofthestateadequacytarget,as 111definedundersection163.011,ascalculatedattheendofthemostrecentschoolyearforany 112single,year-longcourseandnomorethansevenpercentofthestateadequacytargetas 113describedaboveforanysinglesemesterequivalentcourse. 114 (4)[Forstudentsenrollinginafull-timevirtualprogram,thedepartmentof 115elementaryandsecondaryeducationshalladoptapolicythatdelineatestheprocessbywhich] 116(a)Astudentwholivesinthisstatemayenrollinavirtualprogramoftheirchoiceas 117providedinthissubdivision, andtheprovisionsofsubdivisions1to3ofthissubsection 118shallnotapplytosuchenrollmentinafull-timevirtualprogram. Eachhostschool 119districtoperatingafull-timevirtualprogramunderthissectionshalladopt,operateand 120implement[thestate]anenrollmentpolicy[, subjectto]asspecifiedbytheprovisionsofthis 121subdivision.[Thepolicyshall: 122 (a)Requirethegoodfaithcollaborationof]Thestudent,thestudent'sparentor 123guardianifthestudentisnotconsideredhomeless,thevirtualprogram,thehostdistrict,and 124theresidentdistrict[;] shallcollaborateingoodfaithtoimplementtheenrollmentpolicy 125regardingthestudent'senrollment,andtheresidentschooldistrictandthehostschool 126districtmaymutuallyagreethattheresidentdistrictshallofferorcontinuetooffer 127servicesforthestudentunderanagreementthatincludesfinancialtermsfor HB2287 4 128reimbursementbythehostschooldistrictforthenecessarycostsoftheresidentschool 129districtprovidingsuchservices.Anenrollmentpolicyspecifiedunderthissubsection 130shall: 131 [(b)]a.Requireastudent'sparentorguardian,ifthestudentisnotconsidered 132homeless,toapplyforenrollmentinafull-timevirtualprogramdirectlywiththevirtual 133program; 134 b.Specifytimelinesfortimelyparticipationbythevirtualprogram,thehostdistrict, 135andresidentdistrict;providedthattheresidentdistrictshallprovideanyrelevantinformation 136andinputontheenrollmentwithintenbusinessdaysofnoticefromthevirtualprogramofthe 137enrollmentapplication; 138 [(c)]c.Includeasurveyofthereasonsforthestudent'sandparent'sinterestsin 139participatinginthevirtualprogram; 140 [(d)]d.Includeconsiderationofavailableopportunitiesforin-personinstructionprior 141toenrollingastudentinavirtualprogram; 142 [(e)]e.Evaluaterequestsforenrollmentbasedonmeetingtheneedsforastudentto 143besuccessfulconsideringallrelevantfactors; 144 [(f)]f.Ensurethat,foranyenrollingstudentwithacovereddisability, an 151admitted,basedontheenrollmentpolicy,inconsiderationofallrelevantfactorsandprovide 152thebasisforitsdeterminationandanyserviceplanforthestudent,inwriting,tothestudent, 153thestudent'sparentorguardian,thehostdistrict,andtheresidentdistrict;and 154 [(h)]h.Provideaprocessforreviewingappealsofdecisionsmadeunderthis 155subdivision[; and]. 156 [(i)Require] (b)Thedepartment[to]shallpublishanannualreportbasedonthe 157enrollmentsandenrollmentsurveysconductedunderthissubdivisionthatprovidesdataatthe 158statewideanddistrictlevelsofsufficientdetailtoallowanalysisoftrendsregardingthe 159reasonsforparticipationinthevirtualprogramatthestatewideanddistrictlevels;provided 160thatnosuchsurveyresultswillbepublishedinamannerthatrevealsindividualstudent 161information.Thedepartmentshallalsoinclude,intheannualreport,dataatthestatewideand 162districtlevelsofsufficientdetailtoallowdetectionandanalysisoftheracial,ethnic,and 163socio-economicbalanceofvirtualprogramparticipationamongschoolsanddistrictsatthe HB2287 5 164statewideanddistrictlevels,providedthatnosuchsurveyresultswillbepublishedina 165mannerthatrevealsindividualstudentinformation. 166 (5)InthecaseofastudentwhoisacandidateforA+tuitionreimbursementand 167takingavirtualcourseunderthissection,theschoolshallattributenolessthanninety-five 168percentattendancetoanysuchstudentwhohascompletedsuchvirtualcourse. 169 (6)TheMissouricourseaccessandvirtualschoolprogramshallensurethat 170individuallearningplansdesignedbycertifiedteachersandprofessionalstaffaredeveloped 171forallstudentsenrolledinmorethantwofull-timecourseaccessprogramcoursesorafull- 172timevirtualschool. 173 (7)Virtualschoolprogramsshallmonitorindividualstudentsuccessandengagement 174ofstudentsenrolledintheirprogram[,] and,forstudentsenrolledinvirtualcoursesona 175part-timebasis,thevirtualschoolprogramshallprovideregularstudentprogressreports 176foreachstudentatleastfourtimesperschoolyeartotheschooldistrictorcharterschool, 177providethehostschooldistrictandtheresidentschooldistrictongoingaccesstoacademic 178andotherrelevantinformationonstudentsuccessandengagement,andshallterminateor 179alterthecourseofferingifitisfoundthecourse[orfull-timevirtualschool] isnotmeetingthe 180educationalneedsofthestudentsenrolledinthecourse. 181 (8)Thedepartmentofelementaryandsecondaryeducationshallmonitorthe 182aggregateperformanceofprovidersandmakesuchinformationavailabletothepublicunder 183subsection11ofthissection. 184 (9)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand 185secondaryeducation,whenastudenttransfersintoaschooldistrictorcharterschool,credits 186previouslygainedthroughsuccessfulpassageofapprovedcoursesundertheMissouricourse 187accessandvirtualschoolprogramshallbeacceptedbytheschooldistrictorcharterschool. 188 (10)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand 189secondaryeducation,ifastudenttransfersintoaschooldistrictorcharterschoolwhile 190enrolledinaMissouricourseaccessandvirtualschoolprogramcourseorfull-timevirtual 191school,thestudentshallcontinuetobeenrolledinsuchcourseorschool. 192 (11)Nothinginthissectionshallprohibithomeschoolstudents,privateschool 193students,orstudentswishingtotakeadditionalcoursesbeyondtheirregularcourseloadfrom 194enrollinginMissouricourseaccessandvirtualschoolprogramcoursesunderanagreement 195thatincludestermsforpayingtuitionorcoursefees. 196 (12)Nothinginthissubsectionshallrequireanyschooldistrict,charterschool,virtual 197program,orthestatetoprovidecomputers,equipment,orinternetaccesstoanystudent 198unlessrequiredundertheeducationservicesplancreatedforaneligiblestudentunder 199subdivision(4)ofthissubsectionorforaneligiblestudentwithadisabilitytocomplywith 200federallaw.Aneducationservicesplanmayrequireaneligiblestudenttohaveaccessto HB2287 6 201schoolfacilitiesoftheresidentschooldistrictduringregularschoolhoursforparticipation 202andinstructionalactivitiesofavirtualprogramunderthissection,andtheeducationservices 203planshallprovideforreimbursementoftheresidentschooldistrictforsuchaccesspursuantto 204rulesadoptedbythedepartmentunderthissection. 205 (13)Theauthorizationprocessshallprovideforcontinuousmonitoringofapproved 206providersandcourses.Thedepartmentshallrevokeorsuspendortakeothercorrectiveaction 207regardingtheauthorizationofanycourseorprovidernolongermeetingtherequirementsof 208theprogram.Unlessimmediateactionisnecessary,priortorevocationorsuspension,the 209departmentshallnotifytheproviderandgivetheproviderareasonabletimeperiodtotake 210correctiveactiontoavoidrevocationorsuspension.Theprocessshallprovideforperiodic 211renewalofauthorizationnolessfrequentlythanonceeverythreeyears. 212 (14)CoursesapprovedasofAugust28,2018,bythedepartmenttoparticipateinthe 213Missourivirtualinstructionprogramshallbeautomaticallyapprovedtoparticipateinthe 214Missouricourseaccessandvirtualschoolprogram,butshallbesubjecttoperiodicrenewal. 215 (15)Anyonlinecourseorvirtualprogramofferedbyaschooldistrictorcharter 216school,includingthoseofferedpriortoAugust28,2018,whichmeetstherequirementsof 217section162.1250shallbeautomaticallyapprovedtoparticipateintheMissouricourseaccess 218andvirtualschoolprogram.Suchcourseorprogramshallbesubjecttoperiodicrenewal.A 219schooldistrictorcharterschoolofferingsuchacourseorvirtualschoolprogramshallbe 220deemedanapprovedprovider. 221 (16)Ahostdistrictmaycontractwithaprovidertoperformanyrequired 222servicesinvolvedwithdeliveringafull-timevirtualeducation. 223 4.(1)Asusedinthissubsection,theterm"instructionalactivities"meansclassroom- 224basedornonclassroom-basedactivitiesthatastudentshallbeexpectedtocomplete, 225participatein,orattendduringanygivenschoolday,suchas: 226 (a)Onlineloginstocurriculaorprograms; 227 (b)Offlineactivities; 228 (c)Completedassignmentswithinaparticularprogram,curriculum,orclass; 229 (d)Testing; 230 (e)Face-to-facecommunicationsormeetingswithschoolstaff; 231 (f)Telephoneorvideoconferenceswithschoolstaff; 232 (g)School-sanctionedfieldtrips;or 233 (h)Orientation. 234 (2)Afull-timevirtualschoolshallsubmitanotificationtotheparentorguardianof 235anystudentwhoisnotconsistentlyengagedininstructionalactivitiesandshallprovide 236regularstudentprogressreportsforeachstudentatleastfourtimesperschoolyear. HB2287 7 237 (3)Eachfull-timevirtualschoolshalldevelop,adopt,andpostontheschool'swebsite 238apolicysettingforththeconsequencesforastudentwhofailstocompletetherequired 239instructionalactivities.Suchpolicyshallstate,ataminimum,thatifastudentfailsto 240completetheinstructionalactivitiesafterreceivinganotificationundersubdivision(2)ofthis 241subsection,andafterreasonableinterventionstrategieshavebeenimplemented,thatthe 242studentshallbesubjecttocertainconsequenceswhichmayincludedisenrollmentfromthe 243school.Priortoanydisenrollment,theparentorguardianshallhavetheopportunityto 244presentanyinformationthattheparentdeemsrelevant,andsuchinformationshallbe 245consideredpriortoanyfinaldecision. 246 (4)Ifafull-timevirtualschooldisenrollsastudentundersubdivision(3)ofthis 247subsection,theschoolshallimmediatelyprovidewrittennotificationtosuchstudent'sschool 248districtofresidence.Thestudent'sschooldistrictofresidenceshallthenprovidetothe 249parentsorguardianofthestudentawrittenlistofavailableeducationaloptionsandpromptly 250enrollthestudentintheselectedoption.Anystudentdisenrolledfromafull-timevirtual 251schoolshallbeprohibitedfromreenrollinginthesamevirtualschoolfortheremainderofthe 252schoolyear. 253 5.Schooldistrictsorcharterschoolsshallinformparentsoftheirchild'srightto 254participateintheprogram.Availabilityoftheprogramshallbemadeclearintheparent 255handbook,registrationdocuments,andfeaturedonthehomepageoftheschooldistrictor 256charterschool'swebsite. 257 6.Thedepartmentshall: 258 (1)Establishanauthorizationprocessforcourseorfull-timevirtualschoolproviders 259thatincludesmultipleopportunitiesforsubmissioneachyear; 260 (2)Pursuanttothetimelineestablishedbythedepartment,authorizecourseorfull- 261timevirtualschoolprovidersthat: 262 (a)Submitallnecessaryinformationpursuanttotherequirementsoftheprocess;and 263 (b)Meetthecriteriadescribedinsubdivision(3)ofthissubsection; 264 (3)Review,pursuanttotheauthorizationprocess,proposalsfromprovidersto 265provideacomprehensive,full-timeequivalentcourseofstudyforstudentsthroughthe 266Missouricourseaccessandvirtualschoolprogram.Thedepartmentshallensurethatthese 267comprehensivecoursesofstudyaligntostateacademicstandardsandthatthereis 268consistencyandcompatibilityinthecurriculumusedbyallprovidersfromonegradelevelto 269thenextgradelevel; 270 (4)Withinthirtydaysofanydenial,provideawrittenexplanationtoanycourseor 271full-timevirtualschoolprovidersthataredeniedauthorization; 272 (5)Allowacourseorfull-timevirtualschoolproviderdeniedauthorizationtoreapply 273atanypointinthefuture. 306 (7)Thecostspercourse; 307 (8)Evaluationofin-schoolcourseavailabilitycomparedtocourseaccessavailability 308toensuregapsincourseaccessarebeingaddressedstatewide. 309 11.(1)ThedepartmentshallberesponsibleforcreatingtheMissouricourseaccess 310andvirtualschoolprogramcatalogprovidingalistingofallcoursesauthorizedandavailable HB2287 9 311tostudentsinthestate,detailedinformation,includingcostspercourse,aboutthecoursesto 312informstudentenrollmentdecisions,andtheabilityforstudentstosubmittheircourse 313enrollments. 314 (2)OnorbeforeJanuary1,2023,thedepartmentshallpublishonitswebsite,and 315distributetoallschooldistrictsandcharterschoolsinthisstate,aguidancedocumentthat 316detailstheoptionsforvirtualcourseaccessandfull-timevirtualcourseaccessforallstudents 317inthestate.Theguidancedocumentshallincludeacompleteandreadilyunderstood 318descriptionoftheapplicableenrollmentprocessesincludingtheopportunityforstudentsto 319enrollandtherolesandresponsibilitiesofthestudent,parent,virtualprovider,schooldistrict 320ordistricts,andcharterschools,asappropriate.Theguidancedocumentshallbedistributed 321inwrittenandelectronicformtoallschooldistricts,charterschools,andvirtualproviders. 322Schooldistrictsandcharterschoolsshallprovideacopyoftheguidancedocumenttoevery 323pupilandparentorlegalguardianofeverypupilenrolledinthedistrictorcharterschoolat 324thebeginningofeachschoolyearanduponenrollmentforeverypupilenrollingatadifferent 325timeoftheschoolyear.Schooldistrictsandcharterschoolsshallprovideareadilyviewable 326linktotheelectronicversionoftheguidancedocumentonthemainpageofthedistrict'sor 327charterschool'swebsite. 328 12.Thestateboardofeducationthroughtherulemakingprocessandthedepartment 329ofelementaryandsecondaryeducationinitspoliciesandproceduresshallensurethat 330multiplecontentprovidersandlearningmanagementsystemsareallowed,ensuredigital 331contentconformstoaccessibilityrequirements,provideaneasilyaccessiblelinkforproviders 332tosubmitcoursesorfull-timevirtualschoolsontheMissouricourseaccessandvirtualschool 333programwebsite,andallowanyperson,organization,orentitytosubmitcoursesorfull-time 334virtualschoolsforapproval.Nocontentprovidershallbeallowedthatisunwillingtoaccept 335paymentsintheamountandmannerasdescribedundersubdivision(3)ofsubsection3ofthis 336sectionordoesnotmeetperformanceorqualitystandardsadoptedbythestateboardof 337education. 338 13.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 339createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 340withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 341Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 342generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 343disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 344rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2006,shallbeinvalid 345andvoid. ✔ HB2287 10
