333.041.1.[Eachapplicantforalicensetopracticefuneraldirectingshallfurnish
2evidencetoestablishtothesatisfactionoftheboardthatheorsheisatleasteighteenyearsof
3age,andpossessesahighschooldiploma,ageneralequivalencydiploma,orequivalent
4thereof,asdetermined,atitsdiscretion,bytheboard.
5 2.Everypersondesiringtoentertheprofessionofembalmingdeadhumanbodies
6withinthestateofMissouriandwhoisenrolledinaprogramaccreditedbytheAmerican
7BoardofFuneralServiceEducation,anysuccessororganization,orotheraccreditingentityas
8approvedbytheboardshallregisterwiththeboardasapracticumstudentupontheform
9providedbytheboard.Aftersuchregistration,astudentmayassist,underthedirect
10supervisionofMissourilicensedembalmersandfuneraldirectors,inMissourilicensed
11funeralestablishments,whileservinghisorherpracticum.Theformforregistrationasa
12practicumstudentshallbeaccompaniedbyafeeinanamountestablishedbytheboard.
13 3.]Eachapplicantforastudentlicensetopracticeembalmingshallsubmitan
14applicationtothestateboardofembalmersandfuneraldirectors,payallapplication
15fees,andfurnishevidencetoestablishtothesatisfactionoftheboardthatheorshe:
16 (1)Isatleasteighteenyearsofage,andpossessesahighschooldiploma,ageneral
17equivalencydiploma,orequivalentthereof,asdetermined,atitsdiscretion,bytheboard;and

29custody,shelteranddispositionofdeadhumanbodiesandthetransportationthereoforhas
30passedthenationalboardexaminationoftheConferenceofFuneralServiceExamining
31Boards.Ifanyapplicantfailstopassthestateexamination,heorshemayretakethe
32examinationatthenextregularexaminationmeeting.Theapplicantshallnotifytheboard
33officeofhisorherdesiretoretaketheexaminationatleastthirtydayspriortothedateofthe
34examination.Eachtimetheexaminationisretaken,theapplicantshallpayanew
35examinationfeeinanamountestablishedbytheboard;
36 (4)Hasbeenemployedfulltimeinfuneralserviceinalicensedfuneralestablishment
37andhaspersonallyembalmedatleasttwenty-fivedeadhumanbodiesunderthepersonal
38supervisionofanembalmerwhoholdsacurrentandvalidMissouriembalmer'slicense
39duringanapprenticeshipofnotlessthantwelveconsecutivemonths."Personalsupervision"
40meansthatthelicensedembalmershallbephysicallypresentduringtheentireembalming
41processinthefirstsixmonthsoftheapprenticeshipperiodandphysicallypresentatthe

46 4.Iftheapplicantdoesnotcompletetheapplicationprocesswithinthefiveyears
47afterhisorhercompletionofanapprovedprogram,thenheorshemustfileanewapplication
48andnofeespaidpreviouslyshallapplytowardthelicensefee.
49 5.Examinationsrequiredbythissectionandsection333.042shallbeheldatleast
50twiceayearattimesandplacesfixedbytheboard.Theboardshallbyruleandregulation
51prescribethestandardforsuccessfulcompletionoftheexaminations.
52 6.Uponestablishmentofhisorherqualificationsasspecifiedbythissectionor
53section333.042,theboardshallissuetotheapplicantalicensetopracticefuneraldirectingor
54embalming,asthecasemayrequire,andshallregistertheapplicantasadulylicensedfuneral

58 7.Theboardshall,uponrequest,waiveanyrequirementofthischapterandissuea
59temporaryfuneraldirector'slicense,validforsixmonths,tothesurvivingspouseornextof
60kinorthepersonalrepresentativeofalicensedfuneraldirector,ortothespouse,nextofkin,
61employeeorconservatorofalicensedfuneraldirectordisabledbecauseofsickness,mental
62incapacityorinjury.]
63 2.Afterastudent'sapplicationhasbeenapprovedbytheboard,astudent
64licenseewhoisenrolledinorhascompletedafuneralserviceeducationprogrammay
65assist,underthedirectsupervisionofanembalmerlicensedunderthischapter,inan
66establishmentlicensedforembalmingunderthischapter.Studentlicenseesshallnot
67assistwhennotundersuchsupervision.Eachstudentlicenseeisauthorizedtowork
68onlyatthelocationorlocationsregisteredwiththeboardandunderonlythose
69supervisorsregisteredwiththeboard.
70 3.Inordertobeeligibleforfulllicensuretopracticeembalming,astudent
71licenseeshall,aftercompletingafuneralserviceeducationprogramaccreditedbythe
72AmericanBoardofFuneralServiceEducationoranysuccessororganizationorany
73otheraccreditingentityasapprovedbytheboard:
74 (1)Submitanapplicationwithhisorherofficialtranscripttotheboard;
75 (2)Demonstratethatheorshehascompletedaqualifyingembalmer's
76apprenticeshipofnolessthansixmonthsandhaspersonallyembalmedatleasttwenty-
77fivedeadhumanbodiesunderthesupervisionofanembalmerwhoislicensedunder
78thischapter,withthefirsttwelvebodiesembalmedunderthedirectsupervisionofthe
79licensedembalmerandallbodiesembalmedbythestudentlicenseeinspectedbythe
80licensedembalmer;and

82 (a)TheNationalBoardSciencesexaminationandtheMissourilawexamination;

86 4.Uponwrittenrequesttotheboard,anypersonlicensedunderthissection
87may,athisorherelection,atanytime,sitfortheNationalBoardArtsexaminationif
88thepersonhasnotpreviouslypassedsuchexamination.
89 5.Astudentlicenseeshallhavefiveyearstosuccessfullycompletethe
90requirementsforfulllicensuresetforthinsubsection3ofthissection.Ifthestudent
91licenseesuccessfullycompletessuchrequirementsbeforetheexpirationofthefive-year

93failstocompletesuchrequirementsinfiveyears,anyapplicationshallbecancelled,and
94thestudentlicenseeshallberequiredtosubmitanewapplicationandpayapplicable
95fees.Nopreviousapprenticeshipshallbeconsideredforthenewapplication.
96 6.Forpurposesofthissection,thefollowingtermsmean:
97 (1)"Directsupervision",supervisioninwhichthelicensedembalmeris
98physicallypresentwiththeapprenticeandthedeadhumanbodyatthebeginningofthe
99embalmingprocessandavailableforconsultationwithinonehourfortheremainderof
100theembalmingprocess;
101 (2)"Qualifyingembalmer'sapprenticeship",anapprenticeshipinwhichthe
102apprentice:
103 (a)Completedtheminimumnumberofhoursrequiredbytheboard;and
104 (b)Obtainedtheminimalrequiredskillstopracticeembalming,asattestedtoby
105thesupervisingembalmer.
333.042.1.Everypersondesiringto[entertheprofessionoffuneraldirectinginthis
2stateshallmakeapplicationwiththestateboardofembalmersandfuneraldirectorsandpay
3thecurrentapplicationandexaminationfees.Exceptasotherwiseprovidedinsection41.950,
4applicantsnotentitledtoalicensepursuanttosection333.051or324.009shallservean
5apprenticeshipforatleasttwelveconsecutivemonthsinafuneralestablishmentlicensedfor
6thecareandpreparationforburialandtransportationofthehumandeadinthisstateorin
7anotherstatewhichhasestablishedstandardsforadmissiontopracticefuneraldirectingequal
8to,ormorestringentthan,therequirementsforadmissiontopracticefuneraldirectinginthis
9state.Theapplicantshalldevoteatleastfifteenhoursperweektohisorherdutiesasan
10apprenticeunderthesupervisionofaMissourilicensedfuneraldirector.Suchapplicantshall
11submitprooftotheboard,onformsprovidedbytheboard,thattheapplicanthasarrangedand
12conductedtenfuneralservicesduringtheapplicant'sapprenticeshipunderthesupervisionofa
13Missourilicensedfuneraldirector.Uponcompletionoftheapprenticeship,theapplicantshall
14appearbeforetheboardtobetestedontheapplicant'slegalandpracticalknowledgeof
15funeraldirecting,funeralhomelicensing,preneedfuneralcontractsandthecare,custody,
16shelter,dispositionandtransportationofdeadhumanbodies.Uponacceptanceofthe
17applicationandfeesbytheboard,anapplicantshallhavetwenty-fourmonthstosuccessfully
18completetherequirementsforlicensurefoundinthissectionortheapplicationforlicensure
19shallbecancelled.
20 2.Ifapersonappliesforalimitedlicensetoworkonlyinafuneralestablishment
21whichislicensedonlyforcremation,includingtransportationofdeadhumanbodiestoand
22fromthefuneralestablishment,heorsheshallmakeapplication,paythecurrentapplication
23andexaminationfeeandsuccessfullycompletetheMissourilawexamination.Heorshe
HCSHBs2322&1774 4 24shallbeexemptfromthetwelve-monthapprenticeshiprequiredbysubsection1ofthis
25sectionandthepracticalexaminationbeforetheboard.Ifapersonhasalimitedlicense
26issuedpursuanttothissubsection,heorshemayobtainafullfuneraldirector'slicenseifheor
27shefulfillstheapprenticeshipandsuccessfullycompletesthefuneraldirectorpractical
28examination.
29 3.IfanindividualisaMissourilicensedembalmerorhascompletedaprogram
30accreditedbytheAmericanBoardofFuneralServiceEducation,anysuccessororganization,
31orotheraccreditingentityasapprovedbytheboardorhassuccessfullycompletedacourseof
32studyinfuneraldirectingofferedbyaninstitutionaccreditedbyarecognizednational,
33regionalorstateaccreditingbodyandapprovedbythestateboardofembalmersandfuneral
34directors,anddesirestoentertheprofessionoffuneraldirectinginthisstate,theindividual
35shallcomplywithalltherequirementsforlicensureasafuneraldirectorpursuantto
36subsection1ofsection333.041andsubsection1ofthissection;however,theindividualis
37exemptfromthetwelve-monthapprenticeshiprequiredbysubsection1ofthissection]
38engageinthepracticeoffuneraldirectingasanapprenticeinthisstateshallobtaina
39provisionalfuneraldirectorlicensefromtheboard.Toapplyforaprovisionallicense,
40theapplicantshallsubmitanapplicationtothestateboardofembalmersandfuneral
41directors,paythecurrentapplicationfees,andfurnishevidencetoestablishtothe
42satisfactionoftheboardthatheorshe:
43 (1)Isatleasteighteenyearsofage;
44 (2)Possessesahighschooldiploma,ageneralequivalencydiploma,or
45equivalentthereof,asdetermined,atitsdiscretion,bytheboard;and
46 (3)Willworkasanapprenticefuneraldirectorunderpersonalsupervisionofa
47funeraldirectorlicensedunderthischapter.Theapplicantshallprovidetotheboard
48thenameandlicensenumberofthefuneraldirectorwhowillperformhisorher
49supervisionandthelocationwheretheapplicantwillpractice.Thesupervisingfuneral
50directorshallattesttotheboardthattheapprenticeshipwillmeettherequirementsof
51thissection.
52 2.Aprovisionallicenseeshallhavethirty-sixmonthstocompletethe
53requirementsforfulllicensureundersubsection3ofthissection.Iftheprovisional
54licenseefailstocompletetherequirementswithinsuchperiod,theapplicationfor
55licensureshallbecancelled.Iftheapplicationiscancelled,theapplicantshallbe
56requiredtosubmitanewapplicationandpayapplicablefees.Noprevious
57apprenticeshipshallbeconsideredforthenewapplication.
58 3.Everypersondesiringtoentertheprofessionoffuneraldirectinginthisstate
59shallsubmitanapplicationtothestateboardofembalmersandfuneraldirectors,pay
