43.280.Sections43.280to43.286shallbeknownandmaybecitedasthe"Auto
2TheftPreventionCommissionAct".
43.282.1.Thereisherebycreatedthe"AutoTheftPreventionCommission".
2 2.Thecommissionshallbeassignedtothedepartmentofpublicsafety,butthe
3directorofthedepartmentofpublicsafetyshallhavenosupervision,authority,or
4controlovertheactionsordecisionsofthecommission.
5 3.Thecommissionshallconsistofelevenmembers,composedofthefollowing:
6 (1)ThesuperintendentoftheMissouristatehighwaypatrolorhisorher
7designee;
8 (2)Thedirectorofthedepartmentofcommerceandinsuranceorhisorher
9designee;
10 (3)Thedirectorofthedepartmentofrevenueorhisorherdesignee;
11 (4)Theattorneygeneralorhisorherdesignee;
12 (5)Thefollowingpersons,appointedbythegovernor:
13 (a)Acountysheriff;
14 (b)Amunicipalpolicechief;

21 4.Thecommissionshallelectannuallyfromitsmembershipachairandavice
22chair.Aquorumshallconsistofamajorityofappointedmembers,butnotlessthan
23sevenmembers,andmaybemetbyelectronicattendance.
24 5.Thetermofofficeforeachmemberofthecommissionwhoisappointedbythe
25governorshallbefouryears,exceptthatoftheinitialappointments,threemembers
26shallbeappointedforatermoftwoyearsandfourmembersshallbeappointedfora
27termoffouryears.Anymemberappointedbythegovernormayberemovedfrom
28officebythegovernorwithoutcause.Beforetheexpirationofthetermofamember
29appointedbythegovernor,thegovernorshallappointasuccessorwhosetermbeginson
30Julyfirstnextfollowing.Amemberiseligibleforreappointment.Ifthereisavacancy
31foranycause,thegovernorshallmakeanappointmenttobecomeeffectiveimmediately
32fortheunexpiredterm.
33 6.Membersofthecommissionshallservewithoutcompensation,exceptthat
34theyshallbereimbursedfortheirreasonableandnecessaryexpensesincurredinthe
35performanceoftheirduties.
36 7.Thestatehighwaypatrolshallprovidetothecommissionalltechnical,
37clerical,andothernecessarysupportservices.
43.284.1.Thecommissionshall:
2 (1)Establishagrantprogramfortheprovisionoffundstolocallawenforcement
3agenciesandmulti-jurisdictiontaskforcesforthefollowing:
4 (a)Prevention,reduction,andinvestigationofmotorvehicleandmotorvehicle
5partstheft;
6 (b)Prevention,reduction,andinvestigationofmotorvehiclerelatedcrime;
7 (c)Establishmentofmulti-jurisdictiontaskforcesuponrequestoflocallaw
8enforcementagencies;
9 (d)Investigationoffraudrelatedtomotorvehicleinsurance,motorvehicle
10dealerpurchases,andmotorvehiclerentaltransactions,andotherformsoffinancial
11fraudrelatingtomotorvehicles;
12 (e)Hiringofpersonnelbylocallawenforcementagenciesforthepurposeof
13preventing,reducing,andinvestigatingmotorvehiclerelatedcrime;

23 (3)Providesupporttolocalprosecutorshandlingmotorvehicleandmotor
24vehiclepartstheftrelatedprosecutions;and
25 (4)Providesupporttomulti-jurisdictiontaskforcesestablishedbylocallaw
26enforcementagenciesforthepurposeofpreventing,reducing,andinvestigatingmotor
27vehiclerelatedcrime.
28 2.Anygrantawardedundertheprovisionsofthissectionshallbeupon
29recommendationfromandafterconsiderationbythecommission.Eachgrant
30applicationshalldescribethetypeofmotorvehiclerelatedcrimeprevention,reduction,
31investigation,enforcement,prosecution,oroffenderrehabilitationprogramtobe
32implemented.Suchprogramsmayinclude,butshallnotbelimitedto:
33 (1)Multi-jurisdictiontaskforcesandprogramsutilizingtheNationalInsurance
34CrimeBureautaskforcethatreducemotorvehiclerelatedcrimeandincreasethe
35apprehensionofmotorvehicleandmotorvehiclepartsthievesandpersonswhoattempt
36todefraudinsurancecompanies;
37 (2)Motorvehiclerelatedcrimepreventionefforts,activities,andpublic
38awarenesscampaignsintendedtoreducevictimizationbymotorvehiclerelatedcrime
39andfraud;
40 (3)Theprovisionofspecializedtrainingformotorvehiclerelatedcrime
41investigationpersonnelincluding,butnotlimitedto,lawenforcementpersonnel,local
42motorvehicleregistrationagentsandtitleclerks,andportfacilityemployees,inorderto
43enhanceknowledge,skills,procedures,andsystemstodetect,prevent,andcombat
44motorvehiclerelatedcrimeandfraud;
45 (4)Theprovisionofsupportandmaintenancebyoneormorededicated
46prosecutorswhohavethespecificmissionandexpertisetoprovidelegalguidanceand
47prosecutorialcontinuitytocomplexcriminalcasesarisingfromtheactivitiesofamulti-
48jurisdictiontaskforce;and
49 (5)Thepreventionoffuturecriminalbehaviorbyfirst-timeoffenderswhohave
50beencharged,convicted,oradjudicatedforamotorvehiclerelatedcrime.
HB2737	3 51 3.Totheextentpossible,grantsawardedunderthissectionshallbeawardedto
52locallawenforcementagencies,multi-jurisdictiontaskforces,orotherqualified
53applicantsinavarietyofgeographicareasofthestate.Theabilitytocontribute
54additionalmoneysormatchfundingforaprogramshallnotberequiredasacondition
55ofreceiptofagrantunderthissection.
56 4.Thecommissionshallprepareanannualreportrelativetoactivitiesand
57programsofthecommissionandanyfundsreceivedandgrantsawardedunderthis
58section.Suchreportmayincluderecommendationsforchangesinstateprograms,
59statutes,policies,budgets,andstandardsrelatingtoimprovingandsupportingthe
60motorvehiclerelatedcrimepreventioninitiativesoflocallawenforcementagenciesand
61multi-jurisdictiontaskforces.Suchreportshallbesubmittedannuallytothegeneral
62assemblyandthegovernorbyDecemberfirst.
43.286.1.Thereisherebycreatedinthestatetreasurythe"AutoTheft
2PreventionCommissionRevolvingFund",whichshallconsistofmoneyscollectedunder
3subdivision(2)ofsubsection5ofsection301.190.
4 2.Forpurposesofthissection,thecommissionmayacceptandusefederalfunds
5grantedbyCongressorbyExecutiveOrder,aswellasgiftsanddonationsfrom
6individuals,privateorganizations,orfoundations.Theacceptanceanduseoffederal
7fundsshallnotrequirestatematchingfundsnorshallsuchacceptanceplacean
8obligationonthegeneralassemblytocontinuethepurposesforwhichthefederalfunds
9aremadeavailable.
10 3.Thestatetreasurershallbecustodianofthefund.Inaccordancewithsections
1130.170and30.180,thestatetreasurermayapprovedisbursements.Thefundshallbea
12dedicatedfundand,uponappropriation,moneysinthisfundshallbeusedsolelyas
13providedinsections43.280to43.286.Notwithstandingtheprovisionsofsection33.080
14tothecontrary,anymoneysremaininginthefundattheendofthebienniumshallnot
15reverttothecreditofthegeneralrevenuefund.Thestatetreasurershallinvestmoneys
16inthefundinthesamemannerasotherfundsareinvested.Anyinterestandmoneys
17earnedonsuchinvestmentsshallbecreditedtothefund.
301.190.1.Nocertificateofregistrationofanymotorvehicleortrailer,ornumber
2platetherefor,shallbeissuedbythedirectorofrevenueunlesstheapplicantthereforshall
3makeapplicationforandbegrantedacertificateofownershipofsuchmotorvehicleortrailer,
4orshallpresentsatisfactoryevidencethatsuchcertificatehasbeenpreviouslyissuedtothe
5applicantforsuchmotorvehicleortrailer.Applicationshallbemadewithinthirtydaysafter
6theapplicantacquiresthemotorvehicleortrailer,unlessthemotorvehiclewasacquired
7undersection301.213orsubsection5ofsection301.210inwhichcasetheapplicantshall
8makeapplicationwithinthirtydaysafterreceivingtitlefromthedealer,uponablankform
HB2737	4 9furnishedbythedirectorofrevenueandshallcontaintheapplicant'sidentificationnumber,a
10fulldescriptionofthemotorvehicleortrailer,thevehicleidentificationnumber,andthe
11mileageregisteredontheodometeratthetimeoftransferofownership,asrequiredbysection
12407.536,togetherwithastatementoftheapplicant'ssourceoftitleandofanyliensor
13encumbrancesonthemotorvehicleortrailer,providedthatforgoodcauseshownthedirector
14ofrevenuemayextendtheperiodoftimeformakingsuchapplication.Whenanownerwants
15toaddordeleteanameornamesonanapplicationforcertificateofownershipofamotor
16vehicleortrailerthatwouldcauseittobeinconsistentwiththenameornameslistedonthe
17noticeoflien,theownershallprovidethedirectorwithdocumentationevidencingthe
18lienholder'sauthorizationtoaddordeleteanameornamesonanapplicationforcertificateof
19ownership.
20 2.Thedirectorofrevenueshallusereasonablediligenceinascertainingwhetherthe
21factsstatedinsuchapplicationaretrueandshall,totheextentpossiblewithoutsubstantially
22delayingprocessingoftheapplication,reviewanyodometerinformationpertainingtosuch
23motorvehiclethatisaccessibletothedirectorofrevenue.Ifsatisfiedthattheapplicantisthe
24lawfulownerofsuchmotorvehicleortrailer,orotherwiseentitledtohavethesame
25registeredinhisname,thedirectorshallthereuponissueanappropriatecertificateoverhis
26signatureandsealedwiththesealofhisoffice,procuredandusedforsuchpurpose.The
27certificateshallcontainonitsfaceacompletedescription,vehicleidentificationnumber,and
28otherevidenceofidentificationofthemotorvehicleortrailer,asthedirectorofrevenuemay
29deemnecessary,togetherwiththeodometerinformationrequiredtobeputonthefaceofthe
30certificatepursuanttosection407.536,astatementofanyliensorencumbranceswhichthe
31applicationmayshowtobethereon,and,ifownershipofthevehiclehasbeentransferred,the
32nameofthestateissuingthetransferor'stitleandwhetherthetransferor'sodometermileage
33statementexecutedpursuanttosection407.536indicatedthatthetruemileageismaterially
34differentfromthenumberofmilesshownontheodometer,orisunknown.
35 3.Thedirectorofrevenueshallappropriatelydesignateonthecurrentandall
36subsequentissuesofthecertificatethewords"ReconstructedMotorVehicle","MotorChange
37Vehicle","SpeciallyConstructedMotorVehicle",or"Non-USA-StdMotorVehicle",as
38definedinsection301.010.EffectiveJuly1,1990,onalloriginalandallsubsequentissuesof
39thecertificateformotorvehiclesasreferencedinsubsections2and3ofsection301.020,the
40directorshallprintonthefacethereofthefollowingdesignation:"Annualodometerupdates
41maybeavailablefromthedepartmentofrevenue.".Onanyduplicatecertificate,thedirector
42ofrevenueshallreprintonthefacethereofthemostrecentofeither:
43 (1)Themileageinformationincludedonthefaceoftheimmediatelypriorcertificate
44andthedateofpurchaseorissuanceoftheimmediatelypriorcertificate;or
HB2737	5 45 (2)Anyothermileageinformationprovidedtothedirectorofrevenue,andthedate
46thedirectorobtainedorrecordedthatinformation.
47 4.Thecertificateofownershipissuedbythedirectorofrevenueshallbe
48manufacturedinamannertoprohibitasnearlyaspossibletheabilitytoalter,counterfeit,
49duplicate,orforgesuchcertificatewithoutreadydetection.Inordertocarryoutthe
50requirementsofthissubsection,thedirectorofrevenuemaycontractwithanonprofit
51scientificoreducationalinstitutionspecializingintheanalysisofsecuredocumentsto
52determinethemosteffectivemethodsofrenderingMissouricertificatesofownership
53nonalterableornoncounterfeitable.
54 5.(1)Thefeeforeachoriginalcertificatesoissuedshallbe[eight] thirteendollars
55andfiftycents,inadditiontothefeeforregistrationofsuchmotorvehicleortrailer.If
56applicationforthecertificateisnotmadewithinthirtydaysafterthevehicleisacquiredbythe
57applicant,orwherethemotorvehiclewasacquiredundersection301.213orsubsection5of
58section301.210andtheapplicantfailstomakeapplicationwithinthirtydaysafterreceiving
59titlefromthedealer,adelinquencypenaltyfeeoftwenty-fivedollarsforthefirstthirtydays
60ofdelinquencyandtwenty-fivedollarsforeachthirtydaysofdelinquencythereafter,notto
61exceedatotaloftwohundreddollars,butsuchpenaltymaybewaivedbythedirectorfora
62goodcauseshown.Ifthedirectorofrevenuelearnsthatanypersonhasfailedtoobtaina
63certificatewithinthirtydaysafteracquiringamotorvehicleortrailer,orwherethemotor
64vehiclewasacquiredundersection301.213orsubsection5ofsection301.210andthe
65applicantfailstomakeapplicationwithinthirtydaysafterreceivingtitlefromthedealer,or
66hassoldavehiclewithoutobtainingacertificate,heshallcanceltheregistrationofall
67vehiclesregisteredinthenameoftheperson,eitherassoleownerorasaco-owner,andshall
68notifythepersonthatthecancellationwillremaininforceuntilthepersonpaysthe
69delinquencypenaltyfeeprovidedinthissection,togetherwithallfees,chargesandpayments
70whichthepersonshouldhavepaidinconnectionwiththecertificateofownershipand
71registrationofthevehicle.Thecertificateshallbegoodforthelifeofthemotorvehicleor
72trailersolongasthesameisownedorheldbytheoriginalholderofthecertificateandshall
73nothavetoberenewedannually.
74 (2)Thesumoffivedollarsfromeachoriginalcertificatefeesubmittedas
75providedundersubdivision(1)ofthissubsectionshallbetransferredtotheautotheft
76preventioncommissionfundinaccordancewithsection43.286.
77 6.Anyapplicantforacertificateofownershiprequestingthedepartmentofrevenue
78toprocessanapplicationforacertificateofownershipinanexpeditiousmannerrequiring
79specialhandlingshallpayafeeoffivedollarsinadditiontotheregularcertificateof
80ownershipfee.
HB2737	6 81 7.Itisunlawfulforanypersontooperateinthisstateamotorvehicleortrailer
82requiredtoberegisteredundertheprovisionsofthelawunlessacertificateofownershiphas
83beenappliedforasprovidedinthissection.
84 8.BeforeanoriginalMissouricertificateofownershipisissued,aninspectionofthe
85vehicleandaverificationofvehicleidentificationnumbersshallbemadebytheMissouri
86statehighwaypatrolonvehiclesforwhichthereisacurrenttitleissuedbyanotherstateifa
87Missourisalvagecertificateoftitlehasbeenissuedforthesamevehiclebutnoprior
88inspectionandverificationhasbeenmadeinthisstate,exceptthatifsuchvehiclehasbeen
89inspectedinanotherstatebyalawenforcementofficerinamannercomparabletothe
90inspectionprocessinthisstateandthevehicleidentificationnumbershavebeensoverified,
91theapplicantshallnotbeliableforthetwenty-fivedollarinspectionfeeifsuchapplicant
92submitsproofofinspectionandvehicleidentificationnumberverificationtothedirectorof
93revenueatthetimeoftheapplication.Theapplicant,whohassuchatitleforavehicleon
94whichnopriorinspectionandverificationhavebeenmade,shallpayafeeoftwenty-five
95dollarsforsuchverificationandinspection,payabletothedirectorofrevenueatthetimeof
96therequestfortheapplication,whichshallbedepositedinthestatetreasurytothecreditof
97thestatehighwaysandtransportationdepartmentfund.
98 9.EachapplicationforanoriginalMissouricertificateofownershipforavehicle
99whichisclassifiedasareconstructedmotorvehicle,speciallyconstructedmotorvehicle,kit
100vehicle,motorchangevehicle,non-USA-stdmotorvehicle,orothervehicleasrequiredby
101thedirectorofrevenueshallbeaccompaniedbyavehicleexaminationcertificateissuedby
102theMissouristatehighwaypatrol,orotherlawenforcementagencyasauthorizedbythe
103directorofrevenue.Thevehicleexaminationshallincludeaverificationofvehicle
104identificationnumbersandadeterminationoftheclassificationofthevehicle.Theownerof
105avehiclewhichrequiresavehicleexaminationcertificateshallpresentthevehiclefor
106examinationandobtainacompletedvehicleexaminationcertificatepriortosubmittingan
107applicationforacertificateofownershiptothedirectorofrevenue.Notwithstandingany
108provisionofthelawtothecontrary,anownerpresentingamotorvehiclewhichhasbeen
109issuedasalvagetitleandwhichistenyearsofageoroldertoavehicleexaminationdescribed
110inthissubsectioninordertoobtainacertificateofownershipwiththedesignationprior
111salvagemotorvehicleshallnotberequiredtorepairorrestorethevehicletoitsoriginal
112appearanceinordertopassorcompletethevehicleexamination.Thefeeforthevehicle
113examinationapplicationshallbetwenty-fivedollarsandshallbecollectedbythedirectorof
114revenueatthetimeoftherequestfortheapplicationandshallbedepositedinthestate
115treasurytothecreditofthestatehighwaysandtransportationdepartmentfund.Ifthevehicle
116isalsotoberegisteredinMissouri,thesafetyinspectionrequiredinchapter307andthe
HB2737	7 117emissionsinspectionrequiredunderchapter643shallbecompletedandthefeesrequiredby
118section307.365andsection643.315shallbechargedtotheowner.
119 10.WhenanapplicationismadeforanoriginalMissouricertificateofownershipfor
120amotorvehiclepreviouslyregisteredortitledinastateotherthanMissouriorasrequiredby
121section301.020,itshallbeaccompaniedbyacurrentinspectionformcertifiedbyaduly
122authorizedofficialinspectionstationasdescribedinchapter307.Thecompletedformshall
123certifythatthemanufacturer'sidentificationnumberforthevehiclehasbeeninspected,thatit
124iscorrectlydisplayedonthevehicleandshallcertifythereadingshownontheodometerat
125thetimeofinspection.Theinspectionstationshallcollectthesamefeeasauthorizedin
126section307.365formakingtheinspection,andthefeeshallbedepositedinthesamemanner
127asprovidedinsection307.365.IfthevehicleisalsotoberegisteredinMissouri,thesafety
128inspectionrequiredinchapter307andtheemissionsinspectionrequiredunderchapter643
129shallbecompletedandonlythefeesrequiredbysection307.365andsection643.315shallbe
130chargedtotheowner.Thissectionshallnotapplytovehiclesbeingtransferredona
131manufacturer'sstatementoforigin.
132 11.Motorvehiclesbroughtintothisstateinawreckedordamagedconditionorafter
133beingtowedasanabandonedvehiclepursuanttoanotherstate'sabandonedmotorvehicle
134proceduresshall,inlieuoftheinspectionrequiredbysubsection10ofthissection,be
135inspectedbytheMissouristatehighwaypatrolinaccordancewithsubsection9ofthis
136section.Iftheinspectionrevealsthevehicletobeinasalvageorjunkcondition,thedirector
137shallsoindicateonanyMissouricertificateofownershipissuedforsuchvehicle.Any
138salvagedesignationshallbecarriedforwardonallsubsequentlyissuedcertificatesoftitlefor
139themotorvehicle.
140 12.WhenanapplicationismadeforanoriginalMissouricertificateofownershipfor
141amotorvehiclepreviouslyregisteredortitledinastateotherthanMissouri,andthe
142certificateofownershiphasbeenappropriatelydesignatedbytheissuingstateasa
143reconstructedmotorvehicle,motorchangevehicle,speciallyconstructedmotorvehicle,or
144priorsalvagevehicle,thedirectorofrevenueshallappropriatelydesignateonthecurrent
145Missouriandallsubsequentissuesofthecertificateofownershipthenameoftheissuingstate
146andsuchpriordesignation.Theabsenceofanypriordesignationshallnotrelieveatransferor
147ofthedutytoexerciseduediligencewithregardtosuchcertificateofownershippriortothe
148transferofacertificate.Ifatransferorexercisesanyduediligencewithregardtoacertificate
149ofownership,thelegaltransferofacertificateofownershipwithoutanydesignationthatis
150subsequentlydiscoveredtohaveorshouldhavehadadesignationshallbeatransferfreeand
151clearofanyliabilitiesofthetransferorassociatedwiththemissingdesignation.
152 13.WhenanapplicationismadeforanoriginalMissouricertificateofownershipfor
153amotorvehiclepreviouslyregisteredortitledinastateotherthanMissouri,andthe

155stdmotorvehicle,thedirectorofrevenueshallappropriatelydesignateonthecurrent

158 14.ThedirectorofrevenueandthesuperintendentoftheMissouristatehighway
159patrolshallmakeandenforcerulesfortheadministrationoftheinspectionsrequiredbythis
160section.
161 15.EachapplicationforanoriginalMissouricertificateofownershipforavehicle
162whichisclassifiedasareconstructedmotorvehicle,manufacturedfortyormoreyearsprior
163tothecurrentmodelyear,andwhichhasavalueofthreethousanddollarsorlessshallbe
164accompaniedby:
165 (1)Aproperaffidavitsubmittedbytheownerexplaininghowthemotorvehicleor
166trailerwasacquiredand,ifapplicable,thereasonsavalidcertificateofownershipcannotbe
167furnished;
168 (2)Photocopiesofreceipts,billsofsaleestablishingownership,ortitles,andthe
169sourceofallmajorcomponentpartsusedtorebuildthevehicle;
170 (3)Afeeofonehundredfiftydollarsinadditiontothefeesdescribedinsubsection5
171ofthissection.Suchfeeshallbedepositedinthestatetreasurytothecreditofthestate
172highwaysandtransportationdepartmentfund;and
173 (4)Aninspectioncertificate,otherthanamotorvehicleexaminationcertificate
174requiredundersubsection9ofthissection,completedandissuedbytheMissouristate
175highwaypatrol,orotherlawenforcementagencyasauthorizedbythedirectorofrevenue.
176Theinspectionperformedbythehighwaypatrolorotherauthorizedlocallawenforcement
177agencyshallincludeacheckforstolenvehicles.
