SectionA.Sections260.205and260.225,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections260.205and260.225,toreadasfollows:
260.205.1.Itshallbeunlawfulforanypersontooperateasolidwasteprocessing
2facilityorsolidwastedisposalareaofasolidwastemanagementsystemwithoutfirst
3obtaininganoperatingpermitfromthedepartment.Itshallbeunlawfulforanypersonto
4constructasolidwasteprocessingfacilityorsolidwastedisposalareawithoutfirstobtaining
5aconstructionpermitfromthedepartmentpursuanttothissection.Acurrentauthorizationto
6operateissuedbythedepartmentpursuanttosections260.200to260.345shallbeconsidered
7tobeapermittooperateforpurposesofthissectionforallsolidwastedisposalareasand
8processingfacilitiesexistingonAugust28,1995.Apermitshallnotbeissuedforasanitary
9landfilltobelocatedinafloodarea,asdeterminedbythedepartment,wherefloodwatersare
10likelytosignificantlyerodefinalcover.Apermitshallnotberequiredtooperateawaste
11stabilizationlagoon,settlingpondorotherwatertreatmentfacilitywhichhasavalidpermit
12fromtheMissouricleanwatercommissioneventhoughthefacilitymayreceivesolidor
13semisolidwastematerials.
14 2.Nopersonoroperatormayapplyfororobtainapermittoconstructasolidwaste
15disposalareaunlessthepersonhasrequestedthedepartmenttoconductapreliminarysite
16investigationandobtainedpreliminaryapprovalfromthedepartment.Thedepartmentshall,
17withinsixtydaysofsuchrequest,conductapreliminaryinvestigationandapproveor
18disapprovethesite.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19 3.Allproposedsolidwastedisposalareasforwhichapreliminarysiteinvestigation
20requestpursuanttosubsection2ofthissectionisreceivedbythedepartmentonorafter
21August28,1999,shallbesubjecttoapublicinvolvementactivityaspartofthepermit
22applicationprocess.Theactivityshallconsistofthefollowing:
23 (1)Theapplicantshallnotifythepublicofthepreliminarysiteinvestigationapproval
24withinthirtydaysafterthereceiptofsuchapproval.Suchpublicnotificationshallbeby
25certifiedmailtothegoverningbodyofthecountyorcityinwhichtheproposeddisposalarea
26istobelocatedandbycertifiedmailtothesolidwastemanagementdistrictinwhichthe
27proposeddisposalareaistobelocated;
28 (2)Withinninetydaysafterthepreliminarysiteinvestigationapproval,the
29departmentshallconductapublicawarenesssessioninthecountyinwhichtheproposed
30disposalareaistobelocated.Thedepartmentshallprovidepublicnoticeofsuchsessionby
31bothprintedandbroadcastmediaatleastthirtydayspriortosuchsession.Printed
32notificationshallincludepublicationinatleastonenewspaperhavinggeneralcirculation
33withinthecountyinwhichtheproposeddisposalareaistobelocated.Broadcastnotification
34shallincludepublicserviceannouncementsonradiostationsthathavebroadcastcoverage
35withinthecountyinwhichtheproposeddisposalareaistobelocated.Theintentofsuch
36publicawarenesssessionshallbetoprovidegeneralinformationtointerestedcitizensonthe
37designandoperationofsolidwastedisposalareas;
38 (3)Atleastsixtydayspriortothesubmissiontothedepartmentofareportonthe
39resultsofadetailedsiteinvestigationpursuanttosubsection4ofthissection,theapplicant
40shallconductacommunityinvolvementsessioninthecountyinwhichtheproposeddisposal
41areaistobelocated.Departmentstaffshallattendanysuchsession.Theapplicantshall
42providepublicnoticeofsuchsessionbybothprintedandbroadcastmediaatleastthirtydays
43priortosuchsession.Printednotificationshallincludepublicationinatleastonenewspaper
44havinggeneralcirculationwithinthecountyinwhichtheproposeddisposalareaistobe
45located.Broadcastnotificationshallincludepublicserviceannouncementsonradiostations
46thathavebroadcastcoveragewithinthecountyinwhichtheproposeddisposalareaistobe
47located.Suchpublicnoticesshallincludetheaddressesoftheapplicantandthedepartment
48andinformationonapubliccommentperiod.Suchpubliccommentperiodshallbeginonthe
49dayofthecommunityinvolvementsessionandcontinueforatleastthirtydaysaftersuch
50session.Theapplicantshallrespondtoallpersonssubmittingcommentsduringthepublic
51commentperiodnomorethanthirtydaysafterthereceiptofsuchcomments;
52 (4)Ifaproposedsolidwastedisposalareaistobelocatedinacountyorcitythathas
53localplanningandzoningrequirements,theapplicantshallnotberequiredtoconducta
54communityinvolvementsessionifthefollowingconditionsaremet:
55 (a)Thelocalplanningandzoningrequirementsincludeapublicmeeting;

57thecommunityinvolvementsessionatleastthirtydayspriortosuchmeeting;
58 (c)Therequirementsofsuchmeetingincludeprovidingpublicnoticebyprintedor
59broadcastmediaatleastthirtydayspriortosuchmeeting;
60 (d)Suchmeetingisheldatleastthirtydayspriortothesubmissiontothedepartment
61ofareportontheresultsofadetailedsiteinvestigationpursuanttosubsection4ofthis
62section;
63 (e)Theapplicantsubmitstothedepartmentarecordofsuchmeeting;
64 (f)Apubliccommentperiodbeginsonthedayofsuchmeetingandcontinuesforat
65leastfourteendaysaftersuchmeeting,andtheapplicantrespondstoallpersonssubmitting
66commentsduringsuchpubliccommentperiodnomorethanfourteendaysafterthereceiptof

68 4.Nopersonmayapplyfororobtainapermittoconstructasolidwastedisposalarea
69unlessthepersonhassubmittedtothedepartmentaplanforconductingadetailedsurfaceand
70subsurfacegeologicandhydrologicinvestigationandhasobtainedgeologicandhydrologic
71siteapprovalfromthedepartment.Thedepartmentshallapproveordisapprovetheplan
72withinthirtydaysofreceipt.Theapplicantshallconducttheinvestigationpursuanttothe
73planandsubmittheresultstothedepartment.Thedepartmentshallprovideapprovalor
74disapprovalwithinsixtydaysofreceiptoftheinvestigationresults.
75 5.(1)Everypersondesiringtoconstructasolidwasteprocessingfacilityorsolid
76wastedisposalareashallmakeapplicationforapermitonformsprovidedforthispurposeby
77thedepartment.Everyapplicantshallsubmitevidenceoffinancialresponsibilitywiththe
78application.Anyapplicantwhoreliesinpartuponaparentcorporationforthisdemonstration
79shallalsosubmitevidenceoffinancialresponsibilityforthatcorporationandanyother
80subsidiarythereof.
81 (2)Everyapplicantshallprovideafinancialassuranceinstrumentorinstrumentsto
82thedepartmentpriortothegrantingofaconstructionpermitforasolidwastedisposalarea.
83Thefinancialassuranceinstrumentorinstrumentsshallbeirrevocable,meetallrequirements
84establishedbythedepartmentandshallnotbecancelled,revoked,disbursed,releasedor
85allowedtoterminatewithouttheapprovalofthedepartment.Afterthecessationofactive
86operationofasanitarylandfill,orothersolidwastedisposalareaasdesignedbythe
87department,neithertheguarantornortheoperatorshallcancel,revokeordisbursethe
88financialassuranceinstrumentorallowtheinstrumenttoterminateuntiltheoperatoris
89releasedfrompostclosuremonitoringandcareresponsibilitiespursuanttosection260.227.
90 (3)Theapplicantforapermittoconstructasolidwastedisposalareashallprovide
91thedepartmentwithplans,specifications,andsuchotherdataasmaybenecessarytocomply
92withthepurposeofsections260.200to260.345.Theapplicationshalldemonstrate
HCSHB2801	3 93compliancewithallapplicablelocalplanningandzoningrequirements.Thedepartmentshall
94makeaninvestigationofthesolidwastedisposalareaanddeterminewhetheritcomplieswith
95theprovisionsofsections260.200to260.345andtherulesandregulationsadoptedpursuant
96tosections260.200to260.345.Withintwelveconsecutivemonthsofthereceiptofan
97applicationforaconstructionpermitthedepartmentshallapproveordenytheapplication.
98Thedepartmentshallissuerulesandregulationsestablishingtimelimitsforpermit
99modificationsandrenewalofapermitforasolidwastedisposalarea.Thetimelimitshallbe
100consistentwiththischapter.
101 (4)Theapplicantforapermittoconstructasolidwasteprocessingfacilityshall
102providethedepartmentwithplans,specificationsandsuchotherdataasmaybenecessaryto
103complywiththepurposeofsections260.200to260.345.Withinonehundredeightydaysof
104receiptoftheapplication,thedepartmentshalldeterminewhetheritcomplieswiththe
105provisionsofsections260.200to260.345.Withintwelveconsecutivemonthsofthereceipt
106ofanapplicationforapermittoconstructanincineratorasdescribedinthedefinitionofsolid
107wasteprocessingfacilityinsection260.200oramaterialrecoveryfacilityasdescribedinthe
108definitionofsolidwasteprocessingfacilityinsection260.200,andwithinsixmonthsfor
109permitmodifications,thedepartmentshallapproveordenytheapplication.Permitsissued
110forsolidwastefacilitiesshallbefortheanticipatedlifeofthefacility.
111 (5)Ifthedepartmentfailstoapproveordenyanapplicationforapermitorapermit
112modificationwithinthetimelimitsspecifiedinsubdivisions(3)and(4)ofthissubsection,the
113applicantmaymaintainanactioninthecircuitcourtofColeCountyorthatofthecountyin
114whichthefacilityislocatedoristobesited.Thecourtshallorderthedepartmenttoshow
115causewhyithasnotactedonthepermitandthecourtmay,uponthepresentationofevidence
116satisfactorytothecourt,orderthedepartmenttoissueordenysuchpermitorpermit
117modification.Permitsforsolidwastedisposalareas,whetherissuedbythedepartmentor
118orderedtobeissuedbyacourt,shallbefortheanticipatedlifeofthefacility.
119 (6)Theapplicantforapermittoconstructasolidwasteprocessingfacilityshallpay
120anapplicationfeeofonethousanddollars.Uponcompletionofthedepartment'sevaluation
121oftheapplication,butbeforereceivingapermit,theapplicantshallreimbursethedepartment
122forallreasonablecostsincurredbythedepartmentuptoamaximumoffourthousanddollars.
123Theapplicantforapermittoconstructasolidwastedisposalareashallpayanapplicationfee
124oftwothousanddollars.Uponcompletionofthedepartment'sevaluationsoftheapplication,
125butbeforereceivingapermit,theapplicantshallreimbursethedepartmentforallreasonable
126costsincurredbythedepartmentuptoamaximumofeightthousanddollars.Applicantswho
127withdrawtheirapplicationbeforethedepartmentcompletesitsevaluationshallberequiredto
128reimbursethedepartmentforcostsincurredintheevaluation.Thedepartmentshallnot

131 (7)Whenthereviewrevealsthatthefacilityorareadoesconformwiththeprovisions
132ofsections260.200to260.345andtherulesandregulationsadoptedpursuanttosections
133260.200to260.345,thedepartmentshallapprovetheapplicationandshallissueapermitfor
134theconstructionofeachsolidwasteprocessingfacilityorsolidwastedisposalareaasset
135forthintheapplicationandwithanypermittermsandconditionswhichthedepartmentdeems
136appropriate.Intheeventthatthefacilityorareafailstomeettherulesandregulations
137adoptedpursuanttosections260.200to260.345,thedepartmentshallissueareporttothe
138applicantstatingthereasonfordenialofapermit.
139 6.Plans,designs,andrelevantdatafortheconstructionofsolidwasteprocessing
140facilitiesandsolidwastedisposalareasshallbesubmittedtothedepartmentbyaregistered
141professionalengineerlicensedbythestateofMissouriforapprovalpriortotheconstruction,
142alterationoroperationofsuchafacilityorarea.
143 7.(1)Anypersonoroperatorasdefinedinsection260.200whointendstoobtaina
144constructionpermitinasolidwastemanagementdistrictwithanapprovedsolidwaste
145managementplanshallrequestarecommendationinsupportoftheapplicationfromthe
146executiveboardcreatedinsection260.315.Theexecutiveboardshallconsidertheimpactof
147theproposalon,andtheextenttowhichtheproposalconformsto,theapproveddistrictsolid
148wastemanagementplanpreparedpursuanttosection260.325.Theexecutiveboardshallact
149upontherequestforarecommendationwithinsixtydaysofreceiptandshallsubmita
150resolutiontothedepartmentspecifyingitspositionanditsrecommendationregarding

156 (2)Onceapprovalofthedetailedsiteinvestigationhasbeengrantedbythe
157departmentundersubsection4ofthissection,thepermitprocessshallbeheldin
158abeyanceuntilthedepartmenthascompletedandpublishedanupdateofthestatewide
159solidwastemanagementplanrequiredundersubdivision(4)ofsubsection1ofsection
160260.225.Thissubdivisionshallapplyonlytoapplicationsthathavenotreceived
161detailedsiteinvestigationapprovalsbeforeAugust28,2024,andshallnotapplytothe
162expansionofexistingsolidwastedisposalareas.
163 8.Ifthesiteproposedforasolidwastedisposalareaisnotownedbytheapplicant,
164theownerorownersofthesiteshallacknowledgethatanapplicationpursuanttosections
165260.200to260.345istobesubmittedbysignatureorsignaturesthereon.Thedepartment
HCSHB2801	5 166shallprovidetheownerwithcopiesofallcommunicationwiththeoperator,including
167inspectionreportsandordersissuedpursuanttosection260.230.
168 9.Thedepartmentshallnotissueapermitfortheoperationofasolidwastedisposal
169areadesignedtoserveacitywithapopulationofgreaterthanfourhundredthousandlocated
170inmorethanonecounty,ifthesiteislocatedwithinone-halfmileofanadjoining
171municipality,withouttheapprovalofthegoverningbodyofsuchmunicipality.The
172governingbodyshallconductapublichearingwithinfifteendaysofnotice,shallpublicize
173thehearinginatleastonenewspaperhavinggeneralcirculationinthemunicipality,andshall
174votetoapproveordisapprovethelanddisposalfacilitywithinthirtydaysafterthecloseofthe
175hearing.
176 10.(1)Uponreceiptofanapplicationforapermittoconstructasolidwaste
177processingfacilityordisposalarea,thedepartmentshallnotifythepublicofsuchreceipt:
178 (a)Bylegalnoticepublishedinanewspaperofgeneralcirculationintheareaofthe
179proposeddisposalareaorprocessingfacility;
180 (b)Bycertifiedmailtothegoverningbodyofthecountyorcityinwhichthe
181proposeddisposalareaorprocessingfacilityistobelocated;and
182 (c)Bymailtothelastknownaddressofallrecordownersofcontiguousrealproperty
183orrealpropertylocatedwithinonethousandfeetoftheproposeddisposalareaand,fora
184proposedprocessingfacility,noticeasprovidedinsection64.875orsection89.060,
185whicheverisapplicable.
186 (2)Ifanapplicationforaconstructionpermitmeetsallstatutoryandregulatory
187requirementsforissuance,apublichearingonthedraftpermitshallbeheldbythedepartment
188inthecountyinwhichtheproposedsolidwastedisposalareaistobelocatedpriortothe
189issuanceofthepermit.Thedepartmentshallprovidepublicnoticeofsuchhearingbyboth
190printedandbroadcastmediaatleastthirtydayspriortosuchhearing.Printednotification
191shallincludepublicationinatleastonenewspaperhavinggeneralcirculationwithinthe
192countyinwhichtheproposeddisposalareaistobelocated.Broadcastnotificationshall
193includepublicserviceannouncementsonradiostationsthathavebroadcastcoveragewithin
194thecountyinwhichtheproposeddisposalareaistobelocated.
195 11.Aftertheissuanceofaconstructionpermitforasolidwastedisposalarea,but
196priortothebeginningofdisposaloperations,theownerandthedepartmentshallexecutean
197easementtoallowthedepartment,itsagentsoritscontractorstoenterthepremisesto
198completeworkspecifiedintheclosureplan,ortomonitorormaintainthesiteortotake
199remedialactionduringthepostclosureperiod.Afterissuanceofaconstructionpermitfora
200solidwastedisposalarea,butpriortothebeginningofdisposaloperations,theownershall
201submitevidencethatsuchownerhasrecorded,intheofficeoftherecorderofdeedsinthe
202countywherethedisposalareaislocated,anoticeandcovenantrunningwiththelandthatthe
HCSHB2801	6 203propertyhasbeenpermittedasasolidwastedisposalareaandprohibitsuseofthelandinany
204mannerwhichinterfereswiththeclosureand,whereappropriate,postclosureplansfiledwith
205thedepartment.
206 12.Everypersondesiringtoobtainapermittooperateasolidwastedisposalareaor
207processingfacilityshallsubmitapplicableinformationandapplyforanoperatingpermitfrom
208thedepartment.Thedepartmentshallreviewtheinformationanddetermine,withinsixty
209daysofreceipt,whetheritcomplieswiththeprovisionsofsections260.200to260.345and
210therulesandregulationsadoptedpursuanttosections260.200to260.345.Whenthereview
211revealsthatthefacilityorareadoesconformwiththeprovisionsofsections260.200to
212260.345andtherulesandregulationsadoptedpursuanttosections260.200to260.345,the
213departmentshallissueapermitfortheoperationofeachsolidwasteprocessingfacilityor
214solidwastedisposalareaandwithanypermittermsandconditionswhichthedepartment
215deemsappropriate.Intheeventthatthefacilityorareafailstomeettherulesandregulations
216adoptedpursuanttosections260.200to260.345,thedepartmentshallissueareporttothe
217applicantstatingthereasonfordenialofapermit.
218 13.Eachsolidwastedisposalarea,exceptutilitywastelandfillsunlessotherwiseand
219totheextentrequiredbythedepartment,andthosesolidwasteprocessingfacilities
220designatedbyrule,shallbeoperatedunderthedirectionofacertifiedsolidwastetechnician
221inaccordancewithsections260.200to260.345andtherulesandregulationspromulgated
222pursuanttosections260.200to260.345.
223 14.Basedataforthequalityandquantityofgroundwaterinthesolidwastedisposal
224areashallbecollectedandsubmittedtothedepartmentpriortotheoperationofanewor
225expansionofanexistingsolidwastedisposalarea.Basedatashallincludeachemical
226analysisofgroundwaterdrawnfromtheproposedsolidwastedisposalarea.
227 15.Leachatecollectionandremovalsystemsshallbeincorporatedintonewor
228expandedsanitarylandfillswhicharepermittedafterAugust13,1986.Thedepartmentshall
229assesstheneedforaleachatecollectionsystemforalltypesofsolidwastedisposalareas,
230otherthansanitarylandfills,andtheneedformonitoringwellswhenitevaluatesthe
231applicationforallneworexpandedsolidwastedisposalareas.Thedepartmentmayrequire
232anoperatorofasolidwastedisposalareatoinstallaleachatecollectionsystembeforethe
233beginningofdisposaloperations,atanytimeduringdisposaloperationsforunfilledportions
234ofthearea,orforanyportionofthedisposalareaasapartofaremedialplan.The
235departmentmayrequiretheoperatortoinstallmonitoringwellsbeforethebeginningof
236disposaloperationsoratanytimeduringtheoperationallifeorpostclosurecareperiodifit
237concludesthatconditionsattheareawarrantsuchmonitoring.Theoperatorofademolition
238landfillorutilitywastelandfillshallnotberequiredtoinstallaleachatecollectionand
239removalsystemormonitoringwellsunlessotherwiseandtotheextentthedepartmentso
HCSHB2801	7 240requiresbasedonhazardouswastecharacteristiccriteriaorsitespecificgeohydrological
241characteristicsorconditions.
242 16.Permitsgrantedbythedepartment,asprovidedinsections260.200to260.345,
243shallbesubjecttosuspensionforadesignatedperiodoftime,civilpenaltyorrevocation
244wheneverthedepartmentdeterminesthatthesolidwasteprocessingfacilityorsolidwaste
245disposalareais,orhasbeen,operatedinviolationofsections260.200to260.345ortherules
246orregulationsadoptedpursuanttosections260.200to260.345,orhasbeenoperatedin
247violationofanypermittermsandconditions,oriscreatingapublicnuisance,healthhazard,
248orenvironmentalpollution.Intheeventapermitissuspendedorrevoked,thepersonnamed
249inthepermitshallbefullyinformedastothereasonsforsuchaction.
250 17.Eachpermitforoperationofafacilityorareashallbeissuedonlytotheperson
251namedintheapplication.Permitsaretransferableasamodificationtothepermit.An
252applicationtotransferownershipshallidentifytheproposedpermittee.Adisclosure
253statementfortheproposedpermitteelistingviolationscontainedinthedefinitionof
254disclosurestatementfoundinsection260.200shallbesubmittedtothedepartment.The
255operationanddesignplansforthefacilityorareashallbeupdatedtoprovidecompliancewith
256thecurrentlyapplicablelawandrules.Afinancialassuranceinstrumentinsuchanamount
257andformasprescribedbythedepartmentshallbeprovidedforsolidwastedisposalareasby
258theproposedpermitteepriortotransferofthepermit.Thefinancialassuranceinstrumentof
259theoriginalpermitteeshallnotbereleaseduntilthenewpermittee'sfinancialassurance
260instrumenthasbeenapprovedbythedepartmentandthetransferofownershipiscomplete.
261 18.ThosesolidwastedisposalareaspermittedonJanuary1,1996,shall,upon
262submissionofarequestforpermitmodification,begrantedasolidwastemanagementarea
263operatingpermitiftherequestmeetsreasonablerequirementssetoutbythedepartment.
264 19.Incaseapermitrequiredpursuanttothissectionisdeniedorrevoked,theperson
265mayrequestahearinginaccordancewithsection260.235.
266 20.Everyapplicantforapermitshallfileadisclosurestatementwiththeinformation
267requiredbyandonaformdevelopedbythedepartmentofnaturalresourcesatthesametime
268theapplicationforapermitisfiledwiththedepartment.
269 21.Uponrequestofthedirectorofthedepartmentofnaturalresources,theapplicant
270forapermit,anypersonthatcouldreasonablybeexpectedtobeinvolvedinmanagement
271activitiesofthesolidwastedisposalareaorsolidwasteprocessingfacility,oranypersonwho
272hasacontrollinginterestinanypermitteeshallberequiredtosubmittoacriminal
273backgroundcheckundersection43.543.
274 22.Allpersonsrequiredtofileadisclosurestatementshallprovideanyassistanceor
275informationrequestedbythedirectororbytheMissouristatehighwaypatrolandshall
276cooperateinanyinquiryorinvestigationconductedbythedepartmentandanyinquiry,
HCSHB2801	8 277investigationorhearingconductedbythedirector.If,uponissuanceofaformalrequestto
278answeranyinquiryorproduceinformation,evidenceortestimony,anypersonrequiredtofile
279adisclosurestatementrefusestocomply,theapplicationofanapplicantorthepermitofa
280permitteemaybedeniedorrevokedbythedirector.

64 (4)Expandstatecontractsforprocurementofitemsmadefromrecoveredmaterials;
65 (5)Initiaterecyclingprogramswithinstategovernment;
66 (6)Provideaclearinghouseofconsumerinformationregardingtheneedtosupport
67resourcerecovery,utilizeanddevelopnewresourcerecoveryprogramsaroundexisting
68enterprises,requestandpurchaserecycledproducts,participateinresourceconservation
69activitiesandotherrelevantissues;
70 (7)Identifybarrierstoresourcerecoveryandresourceconservation,andpropose
