86allegestobehomeschooled,thejuvenileofficershallcontactaparentorparentsofsuchchild 87toverifythatthechildisbeinghomeschooledandnotinviolationofsection167.031before 88makingareportofsuchaviolation.Anyreportofaviolationofsection167.031madebya HB2880 3 89juvenileofficerregardingachildwhoisbeinghomeschooledshallbemadetothe 90prosecutingattorneyofthecountywherethechildlegallyresides. 91 5.Thedisabilityordiseaseofaparentshallnotconstituteabasisforadetermination 92thatachildisachildinneedofcareorfortheremovalofcustodyofachildfromtheparent 93withoutaspecificshowingthatthereisacausalrelationbetweenthedisabilityordiseaseand 94harmtothechild. 211.071.1.Ifapetitionallegesthatachildbetweentheagesoftwelveandeighteen 2hascommittedanoffensewhichwouldbeconsideredafelonyifcommittedbyanadult,the 17offensewouldbeconsideredafelonyoffenseifcommittedbyanadult,orhascommitted 18twoormorepriorunrelatedoffenseswhichwouldbefeloniesifcommittedbyanadult,the 19courtshallorderahearing,andmayinitsdiscretion,dismissthepetitionandtransferthe 20childtoacourtofgeneraljurisdictionforprosecutionunderthegenerallaw. 21 2.Uponapprehensionandarrest,jurisdictionoverthecriminaloffenseallegedly 22committedbyanypersonbetweeneighteenandtwenty-oneyearsofageoverwhomthe 23juvenilecourthasretainedcontinuingjurisdictionshallautomaticallyterminateandthat 24offenseshallbedealtwithinthecourtofgeneraljurisdictionasprovidedinsection211.041. 25 3.Knowingandwillfulagemisrepresentationbyajuvenilesubjectshallnotaffect 26anyactionorproceedingwhichoccursbaseduponthemisrepresentation.Anyevidence 27obtainedduringtheperiodoftimeinwhichachildmisrepresentshisorheragemaybeused 28againstthechildandwillbesubjectonlytorulesofevidenceapplicableinadultproceedings. 29 4.Writtennotificationofatransferhearingshallbegiventothejuvenileandhisor 30hercustodianinthesamemannerasprovidedinsections211.101and211.111.Noticeofthe 31hearingmaybewaivedbythecustodian.Noticeshallcontainastatementthatthepurposeof HB2880 4 32thehearingistodeterminewhetherthechildisapropersubjecttobedealtwithunderthe 33provisionsofthischapter,andthatifthecourtfindsthatthechildisnotapropersubjecttobe 34dealtwithundertheprovisionsofthischapter,thepetitionwillbedismissedtoallowfor 35prosecutionofthechildunderthegenerallaw. 36 5.Thejuvenileofficermayconsultwiththeofficeofprosecutingattorneyconcerning 37anyoffenseforwhichthechildcouldbecertifiedasanadultunderthissection.The 38prosecutingorcircuitattorneyshallhaveaccesstopolicereports,reportsofthejuvenileor 39deputyjuvenileofficer,statementsofwitnessesandallotherrecordsorreportsrelatingtothe 40offenseallegedtohavebeencommittedbythechild.Theprosecutingorcircuitattorneyshall 41haveaccesstothedispositionrecordsofthechildwhenthechildhasbeenadjudicated 42pursuanttosubdivision(3)ofsubsection1ofsection211.031.Theprosecutingattorneyshall 43notdivulgeanyinformationregardingthechildandtheoffenseuntilthejuvenilecourtata 44judicialhearinghasdeterminedthatthechildisnotapropersubjecttobedealtwithunderthe 45provisionsofthischapter. 46 6.Awrittenreportshallbepreparedinaccordancewiththischapterdevelopingfully 47allavailableinformationrelevanttothecriteriawhichshallbeconsideredbythecourtin 48determiningwhetherthechildisapropersubjecttobedealtwithundertheprovisionsofthis 49chapterandwhethertherearereasonableprospectsofrehabilitationwithinthejuvenilejustice 50system.Thesecriteriashallincludebutnotbelimitedto: 51 (1)Theseriousnessoftheoffenseallegedandwhethertheprotectionofthe 52communityrequirestransfertothecourtofgeneraljurisdiction; 53 (2)Whethertheoffenseallegedinvolvedviciousness,forceandviolence; 54 (3)Whethertheoffenseallegedwasagainstpersonsorpropertywithgreaterweight 55beinggiventotheoffenseagainstpersons,especiallyifpersonalinjuryresulted; 56 (4)Whethertheoffenseallegedisapartofarepetitivepatternofoffenseswhich 57indicatesthatthechildmaybebeyondrehabilitationunderthejuvenilecode; 58 (5)Therecordandhistoryofthechild,includingexperiencewiththejuvenilejustice 59system,othercourts,supervision,commitmentstojuvenileinstitutionsandotherplacements; 60 (6)Thesophisticationandmaturityofthechildasdeterminedbyconsiderationofhis 61orherhomeandenvironmentalsituation,emotionalconditionandpatternofliving; 62 (7)Theageofthechild; 63 (8)Theprogramandfacilitiesavailabletothejuvenilecourtinconsidering 64disposition; 65 (9)Whetherornotthechildcanbenefitfromthetreatmentorrehabilitativeprograms 66availabletothejuvenilecourt;and 67 HB2880 5 68 7.Ifthecourtdismissesthepetitiontopermitthechildtobeprosecutedunderthe 69generallaw,thecourtshallenteradismissalordercontaining: 70 (1)Findingsshowingthatthecourthadjurisdictionofthecauseandoftheparties; 71 (2)Findingsshowingthatthechildwasrepresentedbycounsel; 72 (3)Findingsshowingthatthehearingwasheldinthepresenceofthechildandhisor 73hercounsel;and 74 (4)Findingsshowingthereasonsunderlyingthecourt'sdecisiontotransfer 75jurisdiction. 76 8.Acopyofthepetitionandorderofthedismissalshallbesenttotheprosecuting 77attorney. 78 9.Whenapetitionhasbeendismissedtherebypermittingachildtobeprosecuted 79underthegenerallawandtheprosecutionofthechildresultsinaconviction,thejurisdiction 80ofthejuvenilecourtoverthatchildisforeverterminated,exceptasprovidedinsubsection10 81ofthissection,foranactthatwouldbeaviolationofastatelawormunicipalordinance. 82 10.Ifapetitionhasbeendismissedtherebypermittingachildtobeprosecutedunder 83thegenerallawandthechildisfoundnotguiltybyacourtofgeneraljurisdiction,thejuvenile 84courtshallhavejurisdictionoveranylateroffensecommittedbythatchildwhichwouldbe 85consideredamisdemeanororfelonyifcommittedbyanadult,subjecttothecertification 86provisionsofthissection. 87 11.Ifthecourtdoesnotdismissthepetitiontopermitthechildtobeprosecutedunder 88thegenerallaw,itshallsetadateforthehearinguponthepetitionasprovidedinsection 89211.171. 211.321.1.Recordsofjuvenilecourtproceedingsaswellasallinformationobtained 2andsocialrecordspreparedinthedischargeofofficialdutyforthecourtshallnotbeopento 3inspectionortheircontentsdisclosed,exceptbyorderofthecourttopersonshavinga 4legitimateinteresttherein,unlessapetitionormotiontomodifyissustainedwhichcharges 5thechildwithanoffensewhich,ifcommittedbyanadult,wouldbeaclassAfelonyunderthe 6criminalcodeofMissouri,orcapitalmurder,firstdegreemurder,orseconddegreemurderor 7exceptasprovidedinsubsection2or3ofthissection.Inaddition,wheneverareportis 8requiredundersection557.026,thereshallalsobeincludedacompletelistofcertain 9violationsofthejuvenilecodeforwhichthedefendanthadbeenadjudicatedadelinquent 10whileajuvenile.Thislistshallbemadeavailabletotheprobationofficerandshallbe 11includedinthepresentencereport.Theviolationstobeincludedinthereportarelimitedto 12thefollowing:rape,sodomy,murder,kidnapping,robbery,arson,burglaryoranyacts 13involvingtherenderingorthreatofseriousbodilyharm.Thesupremecourtmaypromulgate 14rulestobefollowedbythejuvenilecourtsinseparatingtherecords. HB2880 6 15 2.Inallproceedingsundersubdivision(2)ofsubsection1ofsection211.031,the 16recordsofthejuvenilecourtaswellasallinformationobtainedandsocialrecordspreparedin 17thedischargeofofficialdutyforthecourtshallbekeptconfidentialandshallbeopento 18inspectiononlybyorderofthejudgeofthejuvenilecourtorasotherwiseprovidedbystatute. 19Inallproceedingsundersubdivision(3)ofsubsection1ofsection211.031therecordsofthe 20juvenilecourtaswellasallinformationobtainedandsocialrecordspreparedinthedischarge 21ofofficialdutyforthecourtshallbekeptconfidentialandmaybeopentoinspectionwithout 22courtorderonlyasfollows: 23 (1)Thejuvenileofficerisauthorizedatanytime: 24 (a)Toprovideinformationtoordiscussmattersconcerningthechild,theviolationof 25laworthecasewiththevictim,witnesses,officialsatthechild'sschool,lawenforcement 26officials,prosecutingattorneys,anypersonoragencyhavingorproposedtohavelegalor 27actualcare,custodyorcontrolofthechild,oranypersonoragencyprovidingorproposedto 28providetreatmentofthechild.Informationreceivedpursuanttothisparagraphshallnotbe 29releasedtothegeneralpublic,butshallbereleasedonlytothepersonsoragencieslistedin 30thisparagraph; 31 (b)Tomakepublicinformationconcerningtheoffense,thesubstanceofthepetition, 32thestatusofproceedingsinthejuvenilecourtandanyotherinformationwhichdoesnot 33specificallyidentifythechildorthechild'sfamily; 34 (2)Afterachildhasbeenadjudicateddelinquentpursuanttosubdivision(3)of 35subsection1ofsection211.031,foranoffensewhichwouldbeafelonyifcommittedbyan 36adult,therecordsofthedispositionalhearingandproceedingsrelatedtheretoshallbeopento 37thepublictothesameextentthatrecordsofcriminalproceedingsareopentothepublic. 38However,thesocialsummaries,investigationsorupdatesinthenatureofpresentence 39investigations,andstatusreportssubmittedtothecourtbyanytreatingagencyorindividual 40afterthedispositionalorderisenteredshallbekeptconfidentialandshallbeopenedto 41inspectiononlybyorderofthejudgeofthejuvenilecourt; 42 (3)Asotherwiseprovidedbystatute; 43 (4)Inallotherinstances,onlybyorderofthejudgeofthejuvenilecourt. 44 3.Thenameandphotographofachildmaybereleasedtothepublicifthechild 45escapesfromthecustodyofajuveniledetentionfacilitywhilethechildisinthecustody 46ofthejuveniledetentionfacilityforanoffensethatwouldbeconsideredafelonyoffense 47ifcommittedbyanadult. 48 4.Peaceofficers'records,ifanyarekept,ofchildrenshallbekeptseparatefromthe 49recordsofpersonseighteenyearsofageoroverandshallnotbeopentoinspectionortheir 50contentsdisclosed,exceptbyorderofthecourt.Thissubsectiondoesnotapplytochildren 51whoaretransferredtocourtsofgeneraljurisdictionasprovidedbysection211.071orto HB2880 7 52juvenilesconvictedundertheprovisionsofsections578.421to578.437.Thissubsection 53doesnotapplytotheinspectionordisclosureofthecontentsoftherecordsofpeaceofficers 54forthepurposeofpursuingacivilforfeitureactionpursuanttotheprovisionsofsection 55195.140. 56 [4.]5.Nothinginthissectionshallbeconstruedtopreventthereleaseofinformation 57anddatatopersonsororganizationsauthorizedbylawtocompilestatisticsrelatingto 58juveniles.Thecourtshalladoptprocedurestoprotecttheconfidentialityofchildren'snames 59andidentities. 60 [5.]6.Thecourtmay,eitheronitsownmotionoruponapplicationbythechildorhis 61orherrepresentative,oruponapplicationbythejuvenileofficer,enteranordertodestroyall 62socialhistories,records,andinformation,otherthantheofficialcourtfile,andmayenteran 63ordertosealtheofficialcourtfile,aswellasallpeaceofficers'records,atanytimeafterthe 64childhasreachedhisorhereighteenthbirthdayifthecourtfindsthatitisinthebestinterest 65ofthechildthatsuchactionoranypartthereofbetaken,unlessthejurisdictionofthecourtis 66continuedbeyondthechild'seighteenthbirthday,inwhicheventsuchactionoranypart 67thereofmaybetakenbythecourtatanytimeaftertheclosingofthechild'scase. 68 [6.]7.Nothinginthissectionshallbeconstruedtopreventthereleaseofgeneral 69informationregardingtheinformaladjustmentorformaladjudicationofthedispositionofa 70child'scasetoavictimoramemberoftheimmediatefamilyofavictimofanyoffense 71committedbythechild.Suchgeneralinformationshallnotbespecificastolocationand 72durationoftreatmentordetentionorastoanytermsofsupervision. 73 [7.]8.Recordsofjuvenilecourtproceedingsaswellasallinformationobtainedand 74socialrecordspreparedinthedischargeofofficialdutyforthecourtshallbedisclosedtothe 75childfatalityreviewpanelreviewingthechild'sdeathpursuanttosection210.192unlessthe 76juvenilecourtonitsownmotion,oruponapplicationbythejuvenileofficer,entersanorder 77tosealtherecordsofthevictimchild. 571.070.1.Apersoncommitstheoffenseofunlawfulpossessionofafirearmifsuch 2personknowinglyhasanyfirearminhisorherpossessionand: 3 (1)Suchpersonhasbeenconvictedofafelonyunderthelawsofthisstate,orofa 4crimeunderthelawsofanystateoroftheUnitedStateswhich,ifcommittedwithinthisstate, 5wouldbeafelony;[or] 6 (2)Suchpersonisafugitivefromjustice,ishabituallyinanintoxicatedordrugged 7condition,oriscurrentlyadjudgedmentallyincompetent;
