88 To amend chapter 105, RSMo, by adding thereto one new section relating to expenditures by state

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Chapter 105, RSMo, is amended by addin g thereto 1
1313 one new section, to be known as section 105.052, to read as 2
1414 follows:3
1515 105.052. 1. No funds shall be expended by any state 1
1616 department for intradepartmental programs, staffing, or 2
1717 other initiatives associated with "diversity, equity, and 3
1818 inclusion" or "diversity, inclusion, and belonging" or any 4
1919 other initiative that promotes: 5
2020 (1) The preferential treatment of any individual or 6
2121 group of individuals based on race, color, religion, sex, 7
2222 gender, sexual orientation, ethnicity, nationa l origin, or 8
2323 ancestry; 9
2424 (2) The concept that disparities between groups are 10
2525 solely the result of oppression; 11
2626 (3) Collective guilt ideologies; 12
2727 (4) Intersectional or divisive identity activism; or 13
2828 (5) The limiting of freedom of consc ience, thought, or 14
2929 speech. 15
3030 2. The provisions of subsection 1 of this section 16
3131 shall not prohibit state departments from any of the 17
3232 following: 18 SB 1314 2
3333 (1) Following federal and state employment and 19
3434 antidiscrimination laws; or 20
3535 (2) Complying with the Americans with Disabilities 21
3636 Act, 42 U.S.C. Section 12101, et seq. 22
3737 3. No state department shall mandate, require, or 23
3838 incentivize private sector employers to implement programs 24
3939 or initiatives described in subsection 1 of this section as 25
4040 a condition of awarding a state contract. 26
