| 11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 12 | 12 | | Section A. Chapter 105, RSMo, is amended by addin g thereto 1 |
|---|
| 13 | 13 | | one new section, to be known as section 105.052, to read as 2 |
|---|
| 14 | 14 | | follows:3 |
|---|
| 15 | 15 | | 105.052. 1. No funds shall be expended by any state 1 |
|---|
| 16 | 16 | | department for intradepartmental programs, staffing, or 2 |
|---|
| 17 | 17 | | other initiatives associated with "diversity, equity, and 3 |
|---|
| 18 | 18 | | inclusion" or "diversity, inclusion, and belonging" or any 4 |
|---|
| 19 | 19 | | other initiative that promotes: 5 |
|---|
| 20 | 20 | | (1) The preferential treatment of any individual or 6 |
|---|
| 21 | 21 | | group of individuals based on race, color, religion, sex, 7 |
|---|
| 22 | 22 | | gender, sexual orientation, ethnicity, nationa l origin, or 8 |
|---|
| 23 | 23 | | ancestry; 9 |
|---|
| 24 | 24 | | (2) The concept that disparities between groups are 10 |
|---|
| 25 | 25 | | solely the result of oppression; 11 |
|---|
| 26 | 26 | | (3) Collective guilt ideologies; 12 |
|---|
| 27 | 27 | | (4) Intersectional or divisive identity activism; or 13 |
|---|
| 28 | 28 | | (5) The limiting of freedom of consc ience, thought, or 14 |
|---|
| 29 | 29 | | speech. 15 |
|---|
| 30 | 30 | | 2. The provisions of subsection 1 of this section 16 |
|---|
| 31 | 31 | | shall not prohibit state departments from any of the 17 |
|---|
| 32 | 32 | | following: 18 SB 1314 2 |

| 33 | 33 | | (1) Following federal and state employment and 19 |
|---|
| 34 | 34 | | antidiscrimination laws; or 20 |
|---|
| 35 | 35 | | (2) Complying with the Americans with Disabilities 21 |
|---|
| 36 | 36 | | Act, 42 U.S.C. Section 12101, et seq. 22 |
|---|
| 37 | 37 | | 3. No state department shall mandate, require, or 23 |
|---|
| 38 | 38 | | incentivize private sector employers to implement programs 24 |
|---|
| 39 | 39 | | or initiatives described in subsection 1 of this section as 25 |
|---|
| 40 | 40 | | a condition of awarding a state contract. 26 |
