AN ACT
To amend chapter 105, RSMo, by adding thereto one new section relating to expenditures by state
departments.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 105, RSMo, is amended by addin g thereto 1
one new section, to be known as section 105.052, to read as 2
follows:3
105.052. 1. No funds shall be expended by any state 1
department for intradepartmental programs, staffing, or 2
other initiatives associated with "diversity, equity, and 3
inclusion" or "diversity, inclusion, and belonging" or any 4
other initiative that promotes: 5
(1) The preferential treatment of any individual or 6
group of individuals based on race, color, religion, sex, 7
gender, sexual orientation, ethnicity, nationa l origin, or 8
ancestry; 9
(2) The concept that disparities between groups are 10
solely the result of oppression; 11
(3) Collective guilt ideologies; 12
(4) Intersectional or divisive identity activism; or 13
(5) The limiting of freedom of consc ience, thought, or 14
speech. 15
2. The provisions of subsection 1 of this section 16
shall not prohibit state departments from any of the 17
following: 18 SB 1314 2
(1) Following federal and state employment and 19
antidiscrimination laws; or 20
(2) Complying with the Americans with Disabilities 21
Act, 42 U.S.C. Section 12101, et seq. 22
3. No state department shall mandate, require, or 23
incentivize private sector employers to implement programs 24
or initiatives described in subsection 1 of this section as 25
a condition of awarding a state contract. 26
