SENATE JOINT RESOLUTION NO. 83

JOINT RESOLUTION 
Submitting to the qualified voters of Missouri, an amendment repealing sections 2(b) and 3(c) of 
article XII of the Constitution of Missouri, and adopting six new sections in lieu thereof 
relating to constitutional amendments. 
 
Be it resolved by the Senate, the House of Representatives concurring therein: 
     That at the next general election to be held in the 1 
state of Missouri, on Tuesday next following the first Monday 2 
in November, 2024, or at a special election to be called by 3 
the governor for that purpose, there is hereby submitted to 4 
the qualified voters of this state, for adoption or 5 
rejection, the following amendment to article XII of the 6 
Constitution of the state of Missouri:7 
     Section A. Sections 2( b) and 3(c), article XII, 1 
Constitution of Missouri, are repealed and six new sections 2 
adopted in lieu thereof, to be known as sections 2(b), 2(c), 3 
2(d), 2(e), 2(f), and 3(c), to read as follows:4 
     Section 2(b).  All amendments proposed by the general 1 
assembly or by the initiative shall be submitted to the 2 
electors for their approval or rejection by official ballot 3 
title as may be provided by law, on a separate ballot 4 
without party designation, at the next general election, or 5 
at a special election called by the governor prior thereto, 6 
at which he may submit any of the amendments.  No such  7 
proposed amendment shall contain more than one amended and 8 
revised article of this constitution, or one new article 9   SJR 83 	2 
which shall not contain more than one subje ct and matters  10 
properly connected therewith.  If possible, each proposed 11 
amendment shall be published once a week for two consecutive 12 
weeks in two newspapers of different political faith in each 13 
county, the last publication to be not more than thirty n or  14 
less than fifteen days next preceding the election.  If  15 
there be but one newspaper in any county, publication for 16 
four consecutive weeks shall be made.  Notwithstanding the 17 
provisions of article III, section 51 of this constitution,  18 
if a majority of the votes cast thereon statewide and also a 19 
majority of votes cast thereon in each of more than half of 20 
the state house of representatives districts is in favor of  21 
any amendment, the same shall take effect at the end of 22 
thirty days after the election .  More than one amendment at 23 
the same election shall be so submitted as to enable the 24 
electors to vote on each amendment separately. 25 
     Section 2(c).  No amendment to this constitution shall 1 
be proposed by the general assembly, by the i nitiative, or  2 
by constitutional convention, that would be used for the 3 
purpose of permitting a public official to receive gifts 4 
from lobbyists. 5 
     Section 2(d).  It shall be unlawful for: 1 
     (1)  A government of a foreign country or a foreign  2 
political party to sponsor an initiative petition proposing 3 
an amendment to this constitution; 4 
     (2)  A government of a foreign country or a foreign 5 
political party to directly or indirectly make: 6 
     (a)  A contribution or donation of money or other thing  7 
of value, or make an express or implied promise to make a 8 
contribution or donation, in connection with an election on 9 
a proposed amendment to this constitution; 10   SJR 83 	3 
     (b)  A contribution or donation to a political 11 
committee or a politica l party favoring or opposing a 12 
proposed amendment to this constitution; or 13 
     (c)  An expenditure, independent expenditure, or 14 
disbursement for an electioneering communication whether 15 
print, broadcast, or digital media, or otherwise, related to 16 
a proposed amendment to this constitution; or 17 
     (3)  A person to solicit, accept, or receive a 18 
contribution or donation from a government of a foreign 19 
country or a foreign political party in connection with a 20 
proposed amendment to this constitution. 21 
     Section 2(e).  No person shall be eligible to vote on 1 
any measure submitted to the people that amends, repeals, or 2 
replaces this constitution, whether pursuant to this article 3 
or section 50, article III of this constitution, unless s uch  4 
person is a legal resident of the state of Missouri and a 5 
citizen of the United States of America. 6 
     Section 2(f).  The general assembly shall have  1 
exclusive authority to enact laws enforcing provisions in  2 
this constitution relating to initiative petitions proposing  3 
amendments to this constitution. 4 
     Section 3(c).  Any proposed constitution or 1 
constitutional amendment adopted by the convention shall be 2 
submitted to a vote of the electors of the state at such 3 
time, in such manner and containing such separate and 4 
alternative propositions and on such official ballot as may 5 
be provided by the convention, at a special election not 6 
less than sixty days nor more than six months after the 7 
adjournment of the conventio n.  Upon the approval of the 8 
constitution or constitutional amendments by a majority of  9 
the votes cast thereon statewide and also a majority of 10 
votes cast thereon in each of more than half of the state 11   SJR 83 	4 
house of representatives districts, the same shall take  12 
effect at the end of thirty days after the election.  The  13 
result of the election shall be proclaimed by the governor. 14 
     Section B.  Pursuant to chapter 116, and other 1 
applicable constitutional provisions and laws of this state 2 
allowing the general assembly to adopt ballot language for 3 
the submission of this joint resolution to the voters of 4 
this state, the official summary statement of this 5 
resolution shall be as follows:   6 
     "Shall the Missouri Constitution be amended to: 7 
●  Allow only U.S. citizens to vote on 8 
constitutional amendments; 9 
●  Forbid foreign countries from funding 10 
constitutional amendments; 11 
●  Ban constitutional amendments allowing 12 
lobbyists' gifts to lawmakers; and 13 
●  Pass constitutional amendments by a majo rity  14 
vote in a majority of state house districts?". 15 

