7 (2)Thefullyautonomousvehicleiscapableofoperatingincompliancewiththe 8applicabletrafficandmotorvehiclesafetylawsandregulationsofthisstatewhen HB1166 2 9reasonabletodosounlessanexemptionhasbeengrantedbythedepartmentofpublic 10safety; 11 (3)Whenrequiredbyfederallaw,thevehiclebearstherequiredmanufacturer's 12certificationlabelindicatingthatatthetimeofitsmanufactureithasbeencertifiedto 13beincompliancewithallapplicableFederalMotorVehicleSafetyStandards,including 14referencetoanyexemptiongrantedbytheNationalHighwayTrafficSafety 15Administration. 16 2.Priortooperatingafullyautonomousvehicleonthepublicroadsofthisstate 17withoutahumandriver,apersonshallsubmitalawenforcementplantothe 18departmentofpublicsafetythatdescribes: 19 (1)Howtocommunicatewithafleetsupportspecialistwhoisavailableduring 20thetimesthevehicleisinoperation; 21 (2)Howtosafelyremovethefullyautonomousvehiclefromtheroadwayand 22stepstosafelytowthevehicle; 23 (3)Howtorecognizewhetherthefullyautonomousisinautonomousmode;and 24 (4)Anyadditionalinformationthemanufacturerorownerdeemsnecessary 25regardinghazardousconditionsorpublicsafetyrisksassociatedwiththeoperationof 26thefullyautonomousvehicle. 304.926.1.Whenanautomateddrivingsysteminstalledonamotorvehicleis 2engaged: 3 (1)Theautomateddrivingsystemisconsideredthedriveroroperator,forthe 4purposeofassessingcompliancewithapplicabletrafficormotorvehiclelawsandshall 5bedeemedtosatisfyelectronicallyallphysicalactsrequiredbyadriveroroperatorof 6thevehicle;and 7 (2)Theautomateddrivingsystemisconsideredtobelicensedtooperatethe 8vehicle. 9 2.Beforeoperatingafullyautonomousvehicleonpublicroadsinthisstate 10withoutahumandriver,apersonshallsubmittothedepartmentofrevenueproofof 11financialresponsibility,asdefinedinsection303.020,forthevehicle. 12 3.Intheeventofacrash: 13 (1)Thefullyautonomousvehicleshallremainonthesceneofthecrashwhen 14requiredundersection303.040,consistentwithitscapabilityundersection304.923;and 15 (2)Theownerofthefullyautonomousvehicle,orapersononbehalfofthe 16vehicleowner,shallreportanycrashesorcollisionsconsistentwithsection303.040. 304.927.Anon-demandautonomousvehiclenetworkshallbepermittedto 2operatepursuanttostatelawsgoverningtheoperationoftransportationnetwork 3companies,taxis,oranyothergroundtransportationfor-hireofpassengers,withthe HB1166 3 4exceptionthatanyprovisionofthischapterthatreasonablyappliesonlytoahuman 5driverwouldnotapplytotheoperationoffullyautonomousvehicleswiththeautomated 6drivingsystemengagedonanon-demandautonomousvehiclenetwork. 304.928.1.Afullyautonomousvehicleshallbeproperlyregisteredin 2accordancewithchapter301.Ifafullyautonomousvehicleisregisteredinthisstate,the 3vehicleshallbeidentifiedontheregistrationasafullyautonomousvehicle. 4 2.Afullyautonomousvehicleshallbeproperlytitledinaccordancewithchapter 5301.Ifafullyautonomousvehicleistitledinthisstate,thevehicleshallbeidentifiedon 6thetitleasafullyautonomousvehicle. 304.929.1.Apersonmayoperateamotorvehicleequippedwithanautomated 2drivingsystemcapableofperformingtheentiredynamicdrivingtaskif: 3 (1)Suchautomateddrivingsystemwillissuearequesttointervenewheneverthe 4automateddrivingsystemisnotcapableofperformingtheentiredynamicdrivingtask 5withtheexceptionthatthepersonwillrespondappropriatelytosucharequest;and 6 (2)Theautomateddrivingsystemiscapableofbeingoperatedincompliance 7withthischapterwhenreasonabletodosounlessanexemptionhasbeengrantedbythe 8departmentofpublicsafety. 9 2.Nothinginsections304.920to304.932prohibitsorrestrictsahumandriver 10fromoperatingafullyautonomousvehicleequippedwithcontrolsthatallowforthe 11humandrivertocontrolallorpartofthedynamicdrivingtask. 304.930.Afullyautonomousvehiclethatisalsoacommercialvehicleasdefined 2insection301.010mayoperatepursuanttostatelawsgoverningtheoperationof 3commercialmotorvehicles,exceptthatanyprovisionthatbyitsnaturereasonably 4appliesonlytoahumandriverdoesnotapplytosuchavehicleoperatingwiththe 5automateddrivingsystemengaged. 304.931.Afullyautonomousvehiclethatisdesignedtobeoperatedexclusively 2bytheautomateddrivingsystemforalltripsisnotsubjecttomotorvehicleequipment 3lawsorregulationsofthisstatethat: 4 (1)Relatetoorsupportmotorvehicleoperationbyahumandriverseatedinthe 5vehicle;and 6 (2)Arenotrelevanttoanautomateddrivingsystem. 304.932.1.Unlessotherwiseprovidedinthischapterandnotwithstandingany 2otherprovisionoflaw,fullyautonomousvehiclesandautomateddrivingsystemsare 3governedexclusivelybysections304.920to304.932.Thedirectorofthedepartmentof 4publicsafetymaypromulgaterulesnecessarytoimplementthesesections.The 5departmentshallbethesoleagencythatmayimplementtheprovisionsofthesesections. 6Anyruleorportionofarule,asthattermisdefinedinsection536.010thatiscreated HB1166 4 7undertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 8withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section 9536.028.Thissectionandchapter536arenonseverableandifanyofthepowersvested 10withthegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate, 11ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant 12ofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2025,shall 13beinvalidandvoid. 14 2.Nostateagency,politicalsubdivision,municipality,orlocalentityshall 15prohibittheoperationoffullyautonomousvehicles,automateddrivingsystems,oron- 16demandautonomousvehiclenetworks,orotherwiseenactorkeepinforcerulesor 17ordinancesthatwouldimposetaxes,fees,orotherrequirements,includingperformance 18standards,specifictotheoperationoffullyautonomousvehicles,automateddriving 19systems,oron-demandautonomousvehiclenetworksinadditiontotherequirementsof 20sections304.920to304.932. ✔ HB1166 5
