9 (2)ActingthroughtheConstitutionoftheUnitedStates,thepeopleofthe 10severalstatescreatedthefederalgovernmenttobetheiragentintheexerciseofafew 11definedpowers,whilereservingforthestategovernmentsthepowertolegislateon 12mattersconcerningthelives,liberties,andpropertiesofcitizensintheordinarycourse 13ofaffairs; 14 (3)Thelimitationofthefederalgovernment'spowerisaffirmedunder 15AmendmentXoftheConstitutionoftheUnitedStates,whichdefinesthetotalscopeof EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16federalpowersasbeingthosethathavebeendelegatedbythepeopleoftheseveralstates 17tothefederalgovernmentandallpowersnotdelegatedtothefederalgovernmentinthe 18ConstitutionoftheUnitedStatesarereservedtothestatesrespectivelyorthepeople 19themselves; 41 (6)ThepeopleoftheseveralstateshavegivenCongressthepower"toregulate 42commercewithforeignnations,andamongtheseveralstates",but"regulating 43commerce"doesnotincludethepowertolimitcitizens'righttokeepandbeararmsin 44defenseoftheirfamilies,neighbors,persons,orpropertynortodictatewhatsortsof 45armsandaccessorieslaw-abidingMissouriansmaybuy,sell,exchange,orotherwise 46possesswithinthebordersofthisstate; 47 (7)ThepeopleoftheseveralstateshavealsograntedCongressthepowers"to 48layandcollecttaxes,duties,imports,andexcises,topaythedebts,andprovideforthe 49commondefenseandgeneralwelfareoftheUnitedStates"and"tomakealllawswhich 50shallbenecessaryandproperforcarryingintoexecutionthepowersvestedbythe 51ConstitutionoftheUnitedStatesinthegovernmentoftheUnitedStates,orinany 52departmentorofficethereof".Theseconstitutionalprovisionsmerelyidentifythe HCSHB1175 2 53meansbywhichthefederalgovernmentmayexecuteitslimitedpowersandshallnotbe 54construedtograntunlimitedpowerbecausetodosowouldbetodestroythecarefully 55constructedequilibriumbetweenthefederalandstategovernments.Consequently,the 56generalassemblyrejectsanyclaimthatthetaxingandspendingpowersofCongress 57maybeusedtodiminishinanywaytherightofthepeopletokeepandbeararms; 58 (8)Thegeneralassemblyfindsthatthefederalexcisetaxrateonarmsand 59ammunitionineffectpriortoJanuary1,2025,whichfundsprogramsundertheWildlife 60RestorationAct,doesnothaveachillingeffectonthepurchaseorownershipofsuch 61armsandammunition; 62 (9)ThepeopleofMissourihavevestedthegeneralassemblywiththeauthority 63toregulatethemanufacture,possession,exchange,anduseoffirearmswithinthe 64bordersofthisstate,subjectonlytothelimitsimposedbyAmendmentIIofthe 65ConstitutionoftheUnitedStatesandtheConstitutionofMissouri;and 66 (10)ThegeneralassemblyofthestateofMissouristronglypromotesresponsible 67gunownership,includingparentalsupervisionofminorsintheproperuse,storage,and 68ownershipofallfirearms;thepromptreportingofstolenfirearms;andtheproper 69enforcementofallstategunlaws.ThegeneralassemblyofthestateofMissourihereby 70condemnsanyunlawfultransferoffirearmsandtheuseofanyfirearminanycriminal 71orunlawfulactivity. 1.451.Nopublicofficeroremployeeofthisstateoranypoliticalsubdivisionof 2thisstateshallhavetheauthoritytoenforceorattempttoenforceanyfederalacts,laws, 3executiveorders,administrativeorders,rules,regulations,statutes,orordinances 4regardingfirearms,firearmaccessories,orammunitionagainstlawabidingcitizens. 5Nothinginsections1.451to1.484shallbeconstruedtoprohibitMissouriofficialsfrom 6acceptingaidfromfederalofficialsinanefforttoenforceMissourilaws. 1.461.1.Anypoliticalsubdivisionorlawenforcementagencythatemploysa 2lawenforcementofficerwhoactsknowingly,asdefinedundersection562.016,toviolate 3theprovisionsofsection1.451orotherwiseknowinglydeprivesacitizenofMissouriof 4therightsorprivilegesensuredbyAmendmentIIoftheConstitutionoftheUnited 5StatesorArticleI,Section23oftheConstitutionofMissouriwhileactingunderthe 6colorofanystateorfederallawshallbeliabletotheinjuredpartyinanactionatlaw, 7suitinequity,orotherproperproceedingforredress,andsubjecttoacivilpenaltyof 8fiftythousanddollarsperoccurrence.Anypersoninjuredunderthissectionshallhave 9standingtopursueanactionforinjunctivereliefinthecircuitcourtofthecountyin 10whichtheactionallegedlyoccurredorinthecircuitcourtofColeCountywithrespectto 11theactionsofsuchindividual.Thecourtshallholdahearingonthemotionfora HCSHB1175 3 12temporaryrestrainingorderandpreliminaryinjunctionwithinthirtydaysofserviceof 13thepetition. 14 2.Insuchactions,thecourtmayawardtheprevailingparty,otherthanthestate 15ofMissourioranypoliticalsubdivisionofthestate,reasonableattorney'sfeesandcosts. 16 3.Sovereignimmunityshallnotbeanaffirmativedefenseinanyactionpursuant 17tothissection. 1.471.1.Anypoliticalsubdivisionorlawenforcementagencythatknowingly 2employsanindividualactingorwhopreviouslyactedasanofficial,agent,employee,or 3deputyofthegovernmentoftheUnitedStates,orotherwiseactedunderthecolorof 4federallawwithinthebordersofthisstate,whohasknowingly,asdefinedundersection 5562.016,aftertheadoptionofthissection: 6 (1)Enforced,attemptedtoenforce,orparticipatedinanywayinthe 7enforcementorimplementationofanyfederalacts,laws,executiveorders,rules, 8regulations,statutes,orordinancesregardingfirearms,firearmaccessories,or 9ammunition;or 10 (2)Givenmaterialaidandsupporttotheeffortsofanotherwhoenforcesor 11attemptstoenforceorparticipatesinanywayintheenforcementorimplementationof 12anyfederalacts,laws,executiveorders,rules,regulations,statutes,orordinances 13regardingfirearms,firearmaccessories,orammunition 14 15shallbesubjecttoacivilpenaltyoffiftythousanddollarsperemployeehiredbythe 16politicalsubdivisionorlawenforcementagencyinvolvedinacourseofconduct 17describedinsubdivision(1)or(2)ofthissubsection.Eachsuchcourseofconductshall 18subjectthepoliticalsubdivisionorlawenforcementagencytoaseparatecivilpenalty. 19Anypersonresidinginajurisdictionwhobelievesthatanindividualhastakenaction 20thatwouldviolatetheprovisionsofthissectionshallhavestandingtopursueanaction, 21butmultipleactionsrelatingtothesamecourseofconductshallnotsubjectthepolitical 22subdivisionorlawenforcementagencytopenaltiesthattotalmorethanfiftythousand 23dollarsforeachemployeeinvolvedinthecourseofconduct. 24 2.Anypersonresidingorconductingbusinessinajurisdictionwhobelievesthat 25anindividualhastakenactionthatwouldviolatetheprovisionsofthissectionshallhave 26standingtopursueanactionforinjunctivereliefinthecircuitcourtofthecountyin 27whichtheactionallegedlyoccurredorinthecircuitcourtofColeCountywithrespectto 28theactionsofsuchindividual.Thecourtshallholdahearingonthemotionfora 29temporaryrestrainingorderandpreliminaryinjunctionwithinthirtydaysofserviceof 30thepetition. HCSHB1175 4 31 3.Insuchactions,thecourtmayawardtheprevailingparty,otherthanthestate 32ofMissourioranypoliticalsubdivisionofthestate,reasonableattorney'sfeesandcosts. 33 4.Sovereignimmunityshallnotbeanaffirmativedefenseinanyactionpursuant 34tothissection. 35 5.Nothinginthissectionshallbeconstruedtoprohibitthehiring,orimposeany 36penaltiesforthehiring,ofanyindividualwhosefederalservicewasasamemberofthe 37armedservicesoftheUnitedStates. 1.481.1.Forsections1.451to1.484,theterm"law-abidingcitizen"shallmeana 2personwhoisnototherwiseprecludedunderstatelawfrompossessingafirearmand 3shallnotbeconstruedtoincludeanyonewhoisnotlegallypresentintheUnitedStates 4orthestateofMissouri. 5 2.Forthepurposesofsections1.451to1.484,"materialaidandsupport"shall 6includevoluntarilygivingorallowingotherstomakeuseoflodging;communications 7equipmentorservices,includingsocialmediaaccounts;facilities;weapons;personnel; 8transportation;clothing;orotherphysicalassets.Materialaidandsupportshallnot 9includegivingorallowingtheuseofmedicineorothermaterialsnecessarytotreat 10physicalinjuries,norshallthetermincludeanyassistanceprovidedtohelppersons 11escapeaserious,presentriskoflife-threateninginjury. 12 3.Itshallnotbeconsideredaviolationofsections1.451to1.484toprovide 13materialaidtofederalofficialswhoareinpursuitofasuspectwhenthereisa 14demonstrablecriminalnexuswithanotherstateorcountryandsuchsuspectiseither 15notacitizenofthisstateorisnotpresentinthisstate. 16 4.Itshallnotbeconsideredaviolationofsections1.451to1.484toprovide 17materialaidtofederalprosecutionfor: 18 (1)Felonycrimesagainstapersonwhensuchprosecutionincludesweapons 19violationssubstantiallysimilartothosefoundinchapter570or571solongassuch 20weaponsviolationsaremerelyancillarytosuchprosecution;or 21 (2)ClassAorclassBfelonyviolationssubstantiallysimilartothosefoundin 22chapter579whensuchprosecutionincludesweaponsviolationssubstantiallysimilarto 23thosefoundinchapter570or571solongassuchweaponsviolationsaremerely 24ancillarytosuchprosecution. 25 5.Theprovisionsofsections1.451to1.484shallbeapplicabletooffenses 26occurringonorafterAugust28,2025. 1.484.Ifanyprovisionofsections1.411to1.484ortheapplicationthereoftoany 2personorcircumstanceisheldinvalid,suchdeterminationshallnotaffecttheprovisions 3orapplicationsofsections1.411to1.484thatmaybegiveneffectwithouttheinvalid 4provisionorapplication,andtheprovisionsofsections1.411to1.484areseverable. HCSHB1175 5 [1.410.1.Sections1.410to1.485shallbeknownandmaybecitedas 2 the"SecondAmendmentPreservationAct". 3 2.Thegeneralassemblyfindsanddeclaresthat: 4 (1)ThegeneralassemblyofthestateofMissouriisfirmlyresolvedto 5 supportanddefendtheConstitutionoftheUnitedStatesagainstevery 6 aggression,whetherforeignordomestic,andisduty-boundtoopposeevery 7 infractionofthoseprinciplesthatconstitutethebasisoftheunionofthestates 8 becauseonlyafaithfulobservanceofthoseprinciplescansecuretheunion's 9 existenceandthepublichappiness; 65 (8)Thegeneralassemblyfindsthatthefederalexcisetaxrateonarms 66 andammunitionineffectpriortoJanuary1,2021,whichfundsprograms 67 undertheWildlifeRestorationAct,doesnothaveachillingeffectonthe 68 purchaseorownershipofsucharmsandammunition;
