BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections544.453and544.455,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections544.453and544.455,toreadasfollows:
544.453.1.Notwithstandinganyprovisionofthelaworcourtruletothecontrary,a
2judgeorjudicialofficer,whensettingbailorconditionsofreleaseinallcourtsinMissourifor
3anyoffensecharged,shallconsider,inadditiontoanyfactorrequiredbylaw,whether:
4 (1)Adefendantposesadangertoavictimofacrime,thecommunity,anywitnessto
5thecrime,ortoanyotherperson;
6 (2)Adefendantisaflightrisk;
7 (3)Adefendanthascommittedamisdemeanoroffenseinvolvingacrimeofviolence,
8sexualoffense,orfelonyoffenseinthisstateoranyotherstateinthelastfiveyears;and
9 (4)Adefendanthasfailedtoappearincourtasarequiredconditionofprobationor
10paroleforamisdemeanorinvolvingacrimeofviolenceorfelonyorasexualoffensewithin
11thelastthreeyears.
12 2.Ifthejudgeorjudicialofficerdeterminesthedefendantisaprioroffenderfor
13offensescommittedundersubdivision(3)ofsubsection1ofthissection,suchdefendant
14shallbepresumedineligibleforbailunlessthedefendant:
15 (1)Hasaseveremedicalconditionrequiringspecializedtreatmentorcareor
16requiresintensivementalhealthtreatmentthatcannotbeprovidedindetention;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)Istheprimarycaregiverforyoungchildren,elderlyparents,ordisabled
18familymembersandanydetentionwouldcausesignificanthardshiptosuch
19dependents;
20 (3)Ispregnantandrequiresprenatalcarethatcannotbesufficientlyprovidedin
21detention;
22 (4)Hasafull-orpart-timejobandhisorherdetentionwouldresultintheloss
23ofemployment;
24 (5)Isenrolledinaneducationalprogramandanydetentionwoulddisrupthisor
25herstudies;
26 (6)Isactivelyparticipatinginarehabilitationprogramforsubstanceuse,anger
27management,oranyotherbehavioralissuesandhisorhercontinuedparticipationis
28deemedcrucialforrehabilitation;or
29 (7)Hasacomprehensivetreatmentplaninplacewhichissupportedbymedical
30ormentalhealthprofessionalsthatrequirehisorherpresenceoutsideofdetention.
31 3.Notwithstandinganyotherprovisionoflaworcourtruletothecontrary,a
32releasehearingshallbeconductedwithinforty-eighthoursofarrestandtheprosecuting
33orcircuitattorneyshallhavetheburdentoprovethedefendantposesaflightriskorisa
34dangertothecommunity.
544.455.1.Anypersonchargedwithabailableoffense,athisorherappearance
2beforeanassociatecircuitjudgeorjudgemaybeorderedreleasedpendingtrial,appeal,or
3otherstageoftheproceedingsagainsthimonhispersonalrecognizance,unlesstheassociate
4circuitjudgeorjudgedetermines,intheexerciseofhisdiscretion,thatsuchareleasewillnot
5reasonablyassuretheappearanceofthepersonasrequired.Whensuchadeterminationis
6made,theassociatecircuitjudgeorjudgemayeitherinlieuoforinadditiontotheabove
7methodsofrelease,imposeanyoranycombinationofthefollowingconditionsofrelease
8whichwillreasonablyassuretheappearanceofthepersonfortrial:
9 (1)Placethepersoninthecustodyofadesignatedpersonororganizationagreeingto
10supervisehim;
11 (2)Placerestrictiononthetravel,association,orplaceofabodeofthepersonduring
12theperiodofrelease;
13 (3)Requiretheexecutionofabailbondwithsufficientsolventsureties,orthedeposit
14ofcashinlieuthereof, andthebailbondshallreflecttheseriousnessofthecurrent
15chargeandensuretheamountissufficientlyhighenoughtodeterflight;
16 (4)Requirethepersontoreportregularlytosomeofficerofthecourt,orpeace
17officer,insuchmannerastheassociatecircuitjudgeorjudgedirectsbutshallbeevery
18thirtydaysifthedefendantisaprioroffenderforoffensescommittedundersubdivision
19(3)ofsubsection1ofsection544.453;
HB1202	2 20 (5)Requiretheexecutionofabondinagivensumandthedepositintheregistryof
21thecourtoftenpercent,orsuchlesserpercentasthejudgedirects,ofthesumincashor
22negotiablebondsoftheUnitedStatesorofthestateofMissourioranypoliticalsubdivision
23thereof;
24 (6)Placethepersononhousearrestwithelectronicmonitoring;exceptthatallcosts
25associatedwiththeelectronicmonitoringshallbechargedtothepersononhousearrest.If
26thejudgefindsthepersonunabletoaffordthecostsassociatedwithelectronicmonitoring,the
27judgemayorderthatthepersonbeplacedonhousearrestwithelectronicmonitoringifthe
28countycommissionagreestopayfromthegeneralrevenueofthecountythecostsofsuch
29monitoring.Ifthepersononhousearrestisunabletoaffordthecostsassociatedwith
30electronicmonitoringandthecountycommissiondoesnotagreetopaythecostsofsuch
31electronicmonitoring,thejudgeshallnotorderthatthepersonbeplacedonhousearrestwith
32electronicmonitoring;
33 (7)Imposeanyotherconditiondeemedreasonablynecessarytoassureappearanceas
34required,includingaconditionrequiringthatthepersonreturntocustodyafterspecified
35hours.
36 2.Indeterminingwhichconditionsofreleasewillreasonablyassureappearance,the
37associatecircuitjudgeorjudgeshall,onthebasisofavailableinformation,takeintoaccount
38thenatureandcircumstancesoftheoffensecharged,theweightoftheevidenceagainstthe
39accused,theaccused'sfamilyties,employment,financialresources,characterandmental
40condition,thelengthofhisresidenceinthecommunity,hisrecordofconvictions,andhis
41recordofappearanceatcourtproceedingsorflighttoavoidprosecutionorfailuretoappearat
42courtproceedings.
43 3.Anassociatecircuitjudgeorjudgeauthorizingthereleaseofapersonunderthis
44sectionshallissueanappropriateordercontainingastatementoftheconditionsimposed,if
45any,shallinformsuchpersonofthepenaltiesapplicabletoviolationsoftheconditionsofhis
46releaseandshalladvisehimthatawarrantforhisarrestwillbeissuedimmediatelyuponany
47suchviolation.
48 4.Apersonforwhomconditionsofreleaseareimposedandwhoaftertwenty-four
49hoursfromthetimeofthereleasehearingcontinuestobedetainedasaresultofhisinability
50tomeettheconditionsofrelease,shall,uponapplication,beentitledtohavethecondition
51reviewedbytheassociatecircuitjudgeorjudgewhoimposedthem.Themotionshallbe
52determinedpromptly.
53 5.Anassociatecircuitjudgeorjudgeorderingthereleaseofapersononany
54conditionspecifiedinthissectionmayatanytimeamendhisordertoimposeadditionalor
55differentconditionsofrelease;exceptthat,iftheimpositionofsuchadditionalordifferent
56conditionsresultsinthedetentionofthepersonasaresultofhisinabilitytomeetsuch
HB1202	3 57conditionsorinthereleaseofthepersononaconditionrequiringhimtoreturntocustody
58afterspecifiedhours,theprovisionsofsubsection4ofthissectionshallapply.
59 6.Informationstatedin,orofferedinconnectionwith,anyorderenteredpursuantto
60thissectionneednotconformtotherulespertainingtotheadmissibilityofevidenceinacourt
61oflaw.
62 7.Nothingcontainedinthissectionshallbeconstruedtopreventthedispositionof
63anycaseorclassofcasesbyforfeitureofcollateralsecuritywheresuchdispositionis
64authorizedbythecourt.
65 8.Personschargedwithviolationsofmunicipalordinancesmaybereleasedbya
66municipaljudgeorotherjudgewhohearsanddeterminesmunicipalordinanceviolationcases
67ofthemunicipalityinvolvedunderthesameconditionsandinthesamemannerasprovidedin
68thissectionforreleasebyanassociatecircuitjudge.
69 9.Acircuitcourtmayadoptalocalruleauthorizingthepretrialreleaseonelectronic
70monitoringpursuanttosubdivision(6)ofsubsection1ofthissectioninlieuofincarceration
71ofindividualschargedwithoffensesspecificallyidentifiedtherein.
