5555 43protectedperson.Thecourtshallconsiderthefollowingfactors:
5656 44 (1)Thegravityandseriousnessofharmthatthepersoninflictedontheprotected
5757 45personinthecommissionofanyactofdomesticviolence;
5858 46 (2)Theperson'sprevioushistoryofdomesticviolence;
5959 47 (3)Theperson'shistoryofothercriminalacts,ifany;
6060 48 (4)Whetherthepersonhasaccesstoaweapon;
6161 49 (5)Whetherthepersonhasthreatenedsuicideorhomicide;
6262 50 (6)Whetherthepersonhasahistoryofmentalillnessorhasbeencivillycommitted;

6565 53 5.Unlessthepersonisdeterminedtobeindigentbythecourt,apersonorderedtobe

7070 58beindigentandshallincludeinabilltothedepartmentthecostsassociatedwiththe
7171 59monitoring.Thedepartmentshallestablishbyruleaproceduretodeterminetheportionof
7272 60costseachindigentpersonisabletopaybasedonaperson'sincome,numberofdependents,
7373 61andotherfactorsasdeterminedbythedepartmentandshallseekreimbursementofsuch
7474 62costs.
7575 63 6.Analertfromanelectronicmonitoringdeviceshallbeprobablecausetoarrestthe
7676 64monitoredpersonforaviolationofanexparteorfullorderofprotection.
7777 65 7.Thedepartmentofcorrections,departmentofpublicsafety,Missouristatehighway
7878 66patrol,thecircuitcourts,andcountyandmunicipallawenforcementagenciesshallshare
7979 67informationobtainedviaelectronicmonitoringconductedpursuanttothissection.
8080 68 8.Nosupplierofaproduct,system,orserviceusedforelectronicmonitoringwith
8181 69victimnotificationshallbeliable,directlyorindirectly,fordamagesarisingfromanyinjury
8282 70ordeathassociatedwiththeuseoftheproduct,system,orserviceunless,andonlytothe
8383 71extentthat,suchactionisbasedonaclaimthattheinjuryordeathwasproximatelycausedby
8484 72amanufacturingdefectintheproductorsystem.
