electronicmonitoringwithvictimnotification,withapenaltyprovision.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section455.095,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection455.095,toreadasfollows:
455.095.1.Forpurposesofthissection,thefollowingtermsmean:
2 (1)"Electronicmonitoringwithvictimnotification",anelectronicmonitoringsystem
3thathasthecapabilitytotrackandmonitorthemovementofapersonandimmediately
4transmitthemonitoredperson'slocationtotheprotectedpersonandthelocallaw
5enforcementagencywithjurisdictionovertheprotectedpremisesthroughanappropriate
6means,includingthetelephone,anelectronicbeeper,orpagingdevicewheneverthe
7monitoredpersonenterstheprotectedpremisesasspecifiedintheorderbythecourt;
8 (2)"Informedconsent",theprotectedpersonisgiventhefollowinginformation
9beforeconsentingtoparticipateinelectronicmonitoringwithvictimnotification:
10 (a)Theprotectedperson'srighttorefusetoparticipateinsuchmonitoringandthe
11processforrequestingthecourttoterminatehisorherparticipationafterithasbeenordered;
12 (b)Themannerinwhichtheelectronicmonitoringtechnologyfunctionsandtherisks
13andlimitationsofthattechnology;
14 (c)Theboundariesimposedonthepersonbeingmonitoredduringtheelectronic
15monitoring;
16 (d)Thesanctionsthatthecourtmayimposeforviolationsoftheorderissuedbythe
17court;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (e)Theprocedurethattheprotectedpersonistofollowifthemonitoredperson
19violatesanorderoriftheelectronicmonitoringequipmentfails;
20 (f)Identificationofsupportservicesavailabletoassisttheprotectedpersonin
21developingasafetyplantouseifthemonitoredpersonviolatesanorderoriftheelectronic
22monitoringequipmentfails;
23 (g)Identificationofcommunityservicesavailabletoassisttheprotectedpersonin
24obtainingshelter,counseling,education,childcare,legalrepresentation,andotherhelpin
25addressingtheconsequencesandeffectsofdomesticviolence;and
26 (h)Thenonconfidentialnatureoftheprotectedperson'scommunicationswiththe
27courtconcerningelectronicmonitoringandtherestrictionstobeimposeduponthemonitored
28person'smovements.
29 2.Whenapersonisfoundguiltyofviolatingthetermsandconditionsofanexparte
30orfullorderofprotectionundersection455.085or455.538,thecourtmay,inadditiontoor
31inlieuofanyotherdisposition:
32 (1)Sentencethepersontoelectronicmonitoringwithvictimnotification;or
33 (2)Placethepersononprobationand,asaconditionofsuchprobation,order
34electronicmonitoringwithvictimnotification.
35 3.Whenapersonchargedwithviolatingthetermsandconditionsofanexparteor
36fullorderofprotectionundersection455.085or455.538isreleasedfromcustodybeforetrial
37pursuanttosection544.455,thecourtmay,asaconditionofrelease,orderelectronic
38monitoringofthepersonwithvictimnotification.
39 4.Electronicmonitoringwithvictimnotificationshallbeorderedonlywiththe
40protectedperson'sinformedconsent.Indeterminingwhethertoplaceapersononelectronic
41monitoringwithvictimnotification,thecourtmayholdahearingtoconsiderthelikelihood
42thattheperson'sparticipationinelectronicmonitoringwilldeterthepersonfrominjuringthe
43protectedperson.Thecourtshallconsiderthefollowingfactors:
44 (1)Thegravityandseriousnessofharmthatthepersoninflictedontheprotected
45personinthecommissionofanyactofdomesticviolence;
46 (2)Theperson'sprevioushistoryofdomesticviolence;
47 (3)Theperson'shistoryofothercriminalacts,ifany;
48 (4)Whetherthepersonhasaccesstoaweapon;
49 (5)Whetherthepersonhasthreatenedsuicideorhomicide;
50 (6)Whetherthepersonhasahistoryofmentalillnessorhasbeencivillycommitted;
51and
52 (7)Whetherthepersonhasahistoryofalcoholorsubstanceabuse.
53 5.Unlessthepersonisdeterminedtobeindigentbythecourt,apersonorderedtobe
54placedonelectronicmonitoringwithvictimnotificationshallbeorderedtopaytherelated
HB1209	2 55costsandexpenses.Ifthecourtdeterminesthepersonisindigent,thepersonmaybeplaced
56onelectronicmonitoringwithvictimnotification,andtheclerkofthecourtinwhichthecase
57wasdeterminedshallnotifythedepartmentofcorrectionsthatthepersonwasdeterminedto
58beindigentandshallincludeinabilltothedepartmentthecostsassociatedwiththe
59monitoring.Thedepartmentshallestablishbyruleaproceduretodeterminetheportionof
60costseachindigentpersonisabletopaybasedonaperson'sincome,numberofdependents,
61andotherfactorsasdeterminedbythedepartmentandshallseekreimbursementofsuch
62costs.
63 6.Analertfromanelectronicmonitoringdeviceshallbeprobablecausetoarrestthe
64monitoredpersonforaviolationofanexparteorfullorderofprotection.
65 7.Thedepartmentofcorrections,departmentofpublicsafety,Missouristatehighway
66patrol,thecircuitcourts,andcountyandmunicipallawenforcementagenciesshallshare
67informationobtainedviaelectronicmonitoringconductedpursuanttothissection.
68 8.Nosupplierofaproduct,system,orserviceusedforelectronicmonitoringwith
69victimnotificationshallbeliable,directlyorindirectly,fordamagesarisingfromanyinjury
70ordeathassociatedwiththeuseoftheproduct,system,orserviceunless,andonlytothe
71extentthat,suchactionisbasedonaclaimthattheinjuryordeathwasproximatelycausedby
72amanufacturingdefectintheproductorsystem.
73 9.Nothinginthissectionshallbeconstruedaslimitingacourt'sabilitytoplacea
74persononelectronicmonitoringwithoutvictimnotificationundersection544.455or
75557.011.
76 10.Apersonshallbefoundguiltyoftheoffenseoftamperingwithelectronic
77monitoringequipmentundersection575.205ifheorshecommitstheactionsprohibited
78undersuchsectionwithanyequipmentthatacourtordersthepersontowearunderthis
79section.
80 11.Thedepartmentofcorrectionsshallpromulgaterulesandregulationsforthe
81implementationofsubsection5ofthissection.Anyruleorportionofarule,asthattermis
82definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
83becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536
84and,ifapplicable,section536.028.Thissectionandchapter536arenonseverableandifany
85ofthepowersvestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
86effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then
87thegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2018,
88shallbeinvalidandvoid.
89 12.TheprovisionsofthissectionshallexpireonAugust28,[2024] 2034.
