Torepealsection87.006,RSMo,andtoenactinlieuthereofonenewsectionrelatingtoline
ofdutyretirementbenefitsforcertainpersonsexposedtohazardousmaterials.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section87.006,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection87.006,toreadasfollows:
87.006.1.Notwithstandingtheprovisionsofanylawtothecontrary,andonlyforthe
2purposeofcomputingretirementbenefitsprovidedbyanestablishedretirementplan,after
3fiveyears'service,anyconditionofimpairmentofhealthcausedbyanyinfectiousdisease,
4diseaseofthelungsorrespiratorytract,hypotension,hypertension,ordiseaseoftheheart
5resultingintotalorpartialdisabilityordeathtoauniformedmemberofapaidfiredepartment
6orpaidfireandexplosioninvestigator, whosuccessfullypassedaphysicalexamination
7withinfiveyearspriortothetimeaclaimismadeforsuchdisabilityordeath,which
8examinationfailedtorevealanyevidenceofsuchcondition,shallbepresumedtohavebeen
9sufferedinthelineofduty,unlessthecontrarybeshownbycompetentevidence.Inorderto
10receivethepresumptionthataninfectiousdiseasewascontractedinthelineofduty,the
11memberorinvestigatorshallsubmittoanannualphysicalexamination,atwhichabloodtest
12isadministered.
13 2.Anyconditionofcanceraffectingtheskinorthecentralnervous,lymphatic,
14digestive,hematological,urinary,skeletal,oral,breast,testicular,genitourinary,liveror
15prostatesystems,aswellasanyconditionofcancerwhichmayresultfromexposuretoheat
16orradiationortoaknownorsuspectedcarcinogenasdeterminedbytheInternationalAgency
17forResearchonCancer,whichresultsinthetotalorpartialdisabilityordeathtoauniformed
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18memberofapaidfiredepartmentorpaidfireandexplosioninvestigator,whosuccessfully
19passedaphysicalexaminationwithinfiveyearspriortothetimeaclaimismadefordisability
20ordeath,whichexaminationfailedtorevealanyevidenceofsuchcondition,shallbe
21presumedtohavebeensufferedinthelineofdutyunlessthecontrarybeshownbycompetent
22evidenceanditcanbeproventoareasonabledegreeofmedicalcertaintythatthecondition
23didnotresultnorwascontributedtobythevoluntaryuseoftobacco.
24 3.(1)Thissectionshallapplytopaidmembersofallfiredepartmentsofallcounties,
25cities,towns,firedistricts,andothergovernmentalunitsandpaidfireandexplosion
26investigators.
27 (2)Forthepurposesofthissection,theterm"paidfireandexplosion
28investigator"meansanypersonwhoisemployedbyapoliticalsubdivisionwhose
29officialjobdutiesinvolveinvestigationoffiresorexplosionstodeterminetheoriginor
30causeofsuchfireorexplosion,orresponsibilityforsuchfireorexplosion.
31 4.Asusedinthissection,theterm"infectiousdisease"meansthehuman
32immunodeficiencyvirus,acquiredimmunodeficiencysyndrome,tuberculosis,hepatitisA,
33hepatitisB,hepatitisC,hepatitisD,diphtheria,meningococcalmeningitis,methicillin-
34resistantstaphylococcusaureus,hemorrhagicfever,plague,rabies,andsevereacute
35respiratorysyndrome.
