BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter650,RSMo,isamendedbyaddingtheretotwonewsections,tobe 2knownassections650.900and650.910,toreadasfollows: 650.900.1.Thereisherebyestablishedwithinthedepartmentofpublicsafety 2officeofhomelandsecuritythe"MissouriTaskForceonNonprofitSafetyand 3Security".Thetaskforceshallstudyandmakerecommendationsonthesecurityneeds 4ofnonprofitorganizationsthatareatelevatedriskofterroristattacksinMissouriand 5makerecommendationsonthefollowing: 6 (1)Theadministrationandfundingforeligiblenonprofitentitiestoapplyfor 7federalnonprofitsecuritygrantscoveringsecuritypersonnel,securitytraining,facility 8hardening,andothernecessarysecuritymeasures;and 9 (2)Outreachtoandeducationfornonprofitentitiesaboutthegrantprogram 10andthefederalnonprofitsecuritygrantapplicationprocess,withaparticularfocuson 11engagingandassistingfirst-timegrantapplications. 12 2.Membersofthetaskforceshallbeappointedbythedirectorofthe 13departmentofpublicsafetyandshallinclude: 14 (1)Thedirectoroftheofficeofhomelandsecurityorthedirector'sdesignee; 15 (2)ThesuperintendentoftheMissouristatehighwaypatrolorthe 16superintendent'sdesignee; EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (3)TheexecutivedirectoroftheMissouriSheriffs'Associationortheexecutive 18director'sdesignee; 19 (4)TheexecutivedirectoroftheMissouriPoliceChiefsAssociationorthe 20executivedirector'sdesignee; 21 (5)Theexecutivedirectorofastatewideinterfaithorinterreligiousorganization 22ortheexecutivedirector'sdesignee; 23 (6)Theexecutivedirectorofastatewideassociationofnonprofitorganizations 24ortheexecutivedirector'sdesignee;and 25 (7)Threerepresentativesfromnonprofitorganizationsincludingfaith-based 26groups,academia,ororganizationsthatworkoncounteringdomesticterrorismand 27extremism. 28 3.Membersofthetaskforceshallservewithoutcompensationbutmaybe 29reimbursedfortheiractualandnecessaryexpenses. 30 4.Thetaskforceshallelectachairbyamajorityvoteofitsmembers. 31 5.Thetaskforceshallestablishatimeandplaceforitsmeetingsandshallmeet 32atleastquarterly,withadditionalmeetingshelduponthecallofthechair. 33 6.Amajorityofthetotaltaskforcemembersshallconstituteaquorumandany 34officialactiontakenbythetaskforceshallrequireanaffirmativevoteofamajorityof 35thememberspresentandvoting. 36 7.Thetaskforceshallissueareporttotheofficeofhomelandsecurityofits 37findingsandrecommendationswithrespecttoterroristattacksinMissouri.Thereport 38shallbeissuedannuallyandatsuchothertimesasdeemednecessarybythetaskforce. 39Thereportshallalsobeprovidedtothechairsandrankingmembersofthesenate 40committeeonappropriationsandthehousebudgetcommittee. 650.910.1.(1)Thereisherebycreatedinthestatetreasurythe"Supplemental 2NonprofitSafetyandSecurityFund",whichshallconsistofmoneyscollectedunderthis 3sectionandsection650.900.Thestatetreasurershallbecustodianofthefund.In 4accordancewithsections30.170and30.180,thestatetreasurermayapprove 5disbursements.Thefundshallbeadedicatedfundand,uponappropriation,moneys 6inthisfundshallbeusedsolelyasprovidedinthissectionandsection650.900. 7 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 8remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe 9generalrevenuefund. 10 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 11otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 12creditedtothefund. HB134 2 13 2.Thefundshallbeusedtodefraythecostsofsecurityenhancementsor 14measuresforeligiblenonprofitorganizationsdescribedinsubsection4ofthissection, 15including: 16 (1)Safetyandsecurityplanning,equipment,training,andexercises; 17 (2)Security-relatedtechnology; 18 (3)Threatawarenessandresponsetraining; 19 (4)Upgradestoexistingstructuresthatenhancesafetyandsecurity;and 20 (5)Vulnerabilityandthreatassessments. 21 3.NonprofitorganizationswhoseapplicationsforfundingthroughtheFederal 22EmergencyManagementAgency'snonprofitsecuritygrantprogramhavebeen 23approvedbythedepartmentofpublicsafetyofficeofhomelandsecurityareeligible 24forgrantsfromthefund.Noadditionalapplicationshallberequiredforgrantsfrom 25thefundandanapplicationforagrantfromthefederalprogramisalsoanapplication 26forfundingfromthefund. 27 4.Aneligibleorganizationmayreceiveagrantfromthefundofuptofive 28percentoftheavailablegrantpoolfordistribution.Nograntsunderthefundshallbe 29awardeduntiltheannouncementoftherecipientsandtheamountofthegrants 30awardedunderthefederalnonprofitsecuritygrantprogram. 31 5.Nomorethanfivepercentoftheavailablefundsavailableannuallyshallbe 32usedforadministrationexpensesassociatedwiththefund. 33 6.Thedirectormaypromulgateallnecessaryrulesandregulationsforthe 34administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin 35section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 36becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 37536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable 38andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 39review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 40heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 41adoptedafterAugust28,2025,shallbeinvalidandvoid. SectionB.Becauseimmediateactionisnecessarytoprotectthesecurityofvulnerable 2entities,sectionAofthisactisdeemednecessaryfortheimmediatepreservationofthepublic 3health,welfare,peace,andsafety,andisherebydeclaredtobeanemergencyactwithinthe 4meaningoftheconstitution,andsectionAofthisactshallbeinfullforceandeffectuponits 5passageandapproval. ✔ HB134 3
