11	11	2thereof,tobeknownassection226.030,toreadasfollows:
12	12	226.030.1.Thehighwaysandtransportationcommissionshallconsistofsix
13	13	2members[, whoshallbeappointedbythegovernor,byandwiththeadviceandconsentofthe
14	14	3senate,notmorethanthreethereoftobemembersofthesamepoliticalparty] until
15	15	4December1,2027,atwhichtimethenumberofmembersmaybechangedasestablished
16	16	5bylaw,butthereshallneverbemorethanonememberfromeachcongressionaldistrict
17	17	6atthesametime.Ifreapportionmentresultsintheeliminationofacongressional
18	18	7district,themostseniormemberofthecommissionshallservetheremainderofthe
19	19	8member'sterm,afterwhichtimethatseatwillnolongerexist.Ifreapportionment
20	20	9increasesthenumberofcongressionalseats,thenumberofmembersmaybeincreased
21	21	10bylawtomatchtheincreaseincongressionalseats.Membersshallbeappointedbythe
22	22	11governor,byandwiththeadviceandconsentofthesenate,notmorethanhalfthereofto
23	23	12bemembersofthesamepoliticalparty.Nomembershallbeappointedtoreplacea
24	24	13memberfromthesamecongressionaldistrictexcepttofillanunexpiredterm.No
25	25	14membershallbeappointedfromacongressionaldistrictuntileachdistricthasbeen
26	26	15representedbyamemberatleastonce.Upontheexpirationofamember'sterm,a
27	27	16memberappointedbythegovernortobeginanewtermshallresideinacongressional
28	28	17districtthatisdifferentfromthecongressionaldistrictsinwhichtheothermembers

32	32	20atleastfiveyearspriortohisorherappointment.Anycommissionermayberemovedbythe
33	33	21governoriffullysatisfiedofhisorherinefficiency,neglectofduty,ormisconductinoffice.
34	34	22Commissionersappointedpursuanttothissectionshallbeappointedfortermsofsixyears,
35	35	23exceptasotherwiseprovidedinthissubsection.Upontheexpirationofeachoftheforegoing
36	36	24termsofthesecommissionersasuccessorshallbeappointedforatermofsixyearsoruntil
37	37	25hisorhersuccessorisappointedandqualifiedwhichtermofsixyearsshallthereafterbethe
38	38	26lengthoftermofeachmemberofthecommissionunlessremovedasaboveprovided.The
39	39	27membersofthecommissionshallreceiveascompensationfortheirservicestwenty-five
40	40	28dollarsperdayforthetimespentintheperformanceoftheirofficialduties,andalsotheir
41	41	29necessarytravelingandotherexpensesincurredwhileactuallyengagedinthedischargeof
42	42	30theirofficialduties.MemberswhosetermsotherwiseexpireDecember1,2003,shallserve
43	43	31withtermsexpiringMarch1,2004,andnewmembersorthemembersreappointedshallbe
44	44	32appointedfortermsexpiringMarch1,2005;amemberwhosetermotherwiseexpires
45	45	33December1,2005,shallservewithatermexpiringMarch1,2007;amemberwhoseterm

53	53	41whohavethemostseniorityincommissionserviceshallserveascommissionleadershipwith
54	54	42onememberaschairandtheothermemberasvicechair,respectively,fortermsending
55	55	43March1,2005.Thecommissionshallelectoneofthemembersaschairandtheotherasvice
56	56	44chair.EffectiveMarch1,2005,thecommissionshallelectthetwomembersofthe
57	57	45commission,onefromeachopposingpoliticalpartywhohasthemostseniorityin
58	58	46commissionservice,whoshallserveascommissionleadershipwithonememberaschairand
59	59	47theothermemberasvicechair,respectively,foroneyear.Attheendofsuchyear,the
60	60	48memberscurrentlyservingaschairandvicechairshallhavetheoptiontorotatepositions,
61	61	49andthemembercurrentlyservingasvicechairmayserveaschair,andviceversa.Thereafter,
62	62	50commissionleadershipshallcontinuetorotateaccordinglywiththetwomembersfrom
63	63	51opposingpoliticalpartieswhohavethemostseniorityintermsofcommissionservicebeing
64	64	52electedbythecommissiontoserveascommissionleadership.Ifoneofthecommission
65	65	53leadershipofficesbecomesvacantduetodeath,resignation,removal,or[refuses] refusalto
66	66	54servebeforetheone-yearleadershiptermexpires,thecommissionshallelectoneofits
67	67	HB1384 2 55membersthatisofthesamepoliticalpartyasthevacatingofficertoservetheremainderof
68	68	56thevacatingofficer'sleadershipterm.Suchelectionshallnotprohibitthatmemberfromlater
69	69	57servingaschairandvicechairwhensuchmember'sseniorityincommissionservicequalifies
70	70	58himorherforthoseofficesasprovidedinthissubsection.
71	71	59 3.Nomorethanone-halfofthemembersofthecommissionshallbeofthesame
72	72	60politicalparty.Theselectionandremovalofallemployeesofthedepartmentof

74	74	62 4.Thepresentmembersofthecommissionshallcontinuetoserveasmembersofthe
