1212 226.030.1.Thehighwaysandtransportationcommissionshallconsistofsix
1313 2members[, whoshallbeappointedbythegovernor,byandwiththeadviceandconsentofthe
1414 3senate,notmorethanthreethereoftobemembersofthesamepoliticalparty] until
1515 4December1,2027,atwhichtimethenumberofmembersmaybechangedasestablished
1616 5bylaw,butthereshallneverbemorethanonememberfromeachcongressionaldistrict
1717 6atthesametime.Ifreapportionmentresultsintheeliminationofacongressional
1818 7district,themostseniormemberofthecommissionshallservetheremainderofthe
1919 8member'sterm,afterwhichtimethatseatwillnolongerexist.Ifreapportionment
2020 9increasesthenumberofcongressionalseats,thenumberofmembersmaybeincreased
2121 10bylawtomatchtheincreaseincongressionalseats.Membersshallbeappointedbythe
2222 11governor,byandwiththeadviceandconsentofthesenate,notmorethanhalfthereofto
2323 12bemembersofthesamepoliticalparty.Nomembershallbeappointedtoreplacea
2424 13memberfromthesamecongressionaldistrictexcepttofillanunexpiredterm.No

3333 21governoriffullysatisfiedofhisorherinefficiency,neglectofduty,ormisconductinoffice.
3434 22Commissionersappointedpursuanttothissectionshallbeappointedfortermsofsixyears,
3535 23exceptasotherwiseprovidedinthissubsection.Upontheexpirationofeachoftheforegoing
3636 24termsofthesecommissionersasuccessorshallbeappointedforatermofsixyearsoruntil
3737 25hisorhersuccessorisappointedandqualifiedwhichtermofsixyearsshallthereafterbethe
3838 26lengthoftermofeachmemberofthecommissionunlessremovedasaboveprovided.The
3939 27membersofthecommissionshallreceiveascompensationfortheirservicestwenty-five
4040 28dollarsperdayforthetimespentintheperformanceoftheirofficialduties,andalsotheir
4141 29necessarytravelingandotherexpensesincurredwhileactuallyengagedinthedischargeof
4242 30theirofficialduties.MemberswhosetermsotherwiseexpireDecember1,2003,shallserve
4343 31withtermsexpiringMarch1,2004,andnewmembersorthemembersreappointedshallbe
4444 32appointedfortermsexpiringMarch1,2005;amemberwhosetermotherwiseexpires
4545 33December1,2005,shallservewithatermexpiringMarch1,2007;amemberwhoseterm

5353 41whohavethemostseniorityincommissionserviceshallserveascommissionleadershipwith
5454 42onememberaschairandtheothermemberasvicechair,respectively,fortermsending
5555 43March1,2005.Thecommissionshallelectoneofthemembersaschairandtheotherasvice
5656 44chair.EffectiveMarch1,2005,thecommissionshallelectthetwomembersofthe
5757 45commission,onefromeachopposingpoliticalpartywhohasthemostseniorityin
5858 46commissionservice,whoshallserveascommissionleadershipwithonememberaschairand
5959 47theothermemberasvicechair,respectively,foroneyear.Attheendofsuchyear,the
6060 48memberscurrentlyservingaschairandvicechairshallhavetheoptiontorotatepositions,
6161 49andthemembercurrentlyservingasvicechairmayserveaschair,andviceversa.Thereafter,
6262 50commissionleadershipshallcontinuetorotateaccordinglywiththetwomembersfrom
6363 51opposingpoliticalpartieswhohavethemostseniorityintermsofcommissionservicebeing
6464 52electedbythecommissiontoserveascommissionleadership.Ifoneofthecommission
6565 53leadershipofficesbecomesvacantduetodeath,resignation,removal,or[refuses] refusalto
6666 54servebeforetheone-yearleadershiptermexpires,thecommissionshallelectoneofits
6767 HB1384 2 55membersthatisofthesamepoliticalpartyasthevacatingofficertoservetheremainderof
6868 56thevacatingofficer'sleadershipterm.Suchelectionshallnotprohibitthatmemberfromlater
6969 57servingaschairandvicechairwhensuchmember'sseniorityincommissionservicequalifies
7070 58himorherforthoseofficesasprovidedinthissubsection.
7171 59 3.Nomorethanone-halfofthemembersofthecommissionshallbeofthesame
7272 60politicalparty.Theselectionandremovalofallemployeesofthedepartmentof
7373 61transportationshallbewithoutregardtopoliticalaffiliation.
7474 62 4.Thepresentmembersofthecommissionshallcontinuetoserveasmembersofthe
7575 63commissionfortheremainderofthetermsforwhichtheywereappointed,exceptasprovided

7777 65 5.Anymemberreappointedshallonlybeeligibletoserveaschairorvicechair
