BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section226.030,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection226.030,toreadasfollows: 226.030.1.Thehighwaysandtransportationcommissionshallconsistofsix 2members[, whoshallbeappointedbythegovernor,byandwiththeadviceandconsentofthe 3senate,notmorethanthreethereoftobemembersofthesamepoliticalparty] until 4December1,2027,atwhichtimethenumberofmembersmaybechangedasestablished 5bylaw,butthereshallneverbemorethanonememberfromeachcongressionaldistrict 6atthesametime.Ifreapportionmentresultsintheeliminationofacongressional 7district,themostseniormemberofthecommissionshallservetheremainderofthe 8member'sterm,afterwhichtimethatseatwillnolongerexist.Ifreapportionment 9increasesthenumberofcongressionalseats,thenumberofmembersmaybeincreased 10bylawtomatchtheincreaseincongressionalseats.Membersshallbeappointedbythe 11governor,byandwiththeadviceandconsentofthesenate,notmorethanhalfthereofto 12bemembersofthesamepoliticalparty.Nomembershallbeappointedtoreplacea 13memberfromthesamecongressionaldistrictexcepttofillanunexpiredterm.No 14membershallbeappointedfromacongressionaldistrictuntileachdistricthasbeen 15representedbyamemberatleastonce.Upontheexpirationofamember'sterm,a 16memberappointedbythegovernortobeginanewtermshallresideinacongressional 17districtthatisdifferentfromthecongressionaldistrictsinwhichtheothermembers EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18resideandisdifferentfromthecongressionaldistrictinwhichthememberpreviously 19fillingtheofficeresided. Eachcommissionershallbeataxpayerandresidentofthestatefor 20atleastfiveyearspriortohisorherappointment.Anycommissionermayberemovedbythe 21governoriffullysatisfiedofhisorherinefficiency,neglectofduty,ormisconductinoffice. 22Commissionersappointedpursuanttothissectionshallbeappointedfortermsofsixyears, 23exceptasotherwiseprovidedinthissubsection.Upontheexpirationofeachoftheforegoing 24termsofthesecommissionersasuccessorshallbeappointedforatermofsixyearsoruntil 25hisorhersuccessorisappointedandqualifiedwhichtermofsixyearsshallthereafterbethe 26lengthoftermofeachmemberofthecommissionunlessremovedasaboveprovided.The 27membersofthecommissionshallreceiveascompensationfortheirservicestwenty-five 28dollarsperdayforthetimespentintheperformanceoftheirofficialduties,andalsotheir 29necessarytravelingandotherexpensesincurredwhileactuallyengagedinthedischargeof 30theirofficialduties.MemberswhosetermsotherwiseexpireDecember1,2003,shallserve 31withtermsexpiringMarch1,2004,andnewmembersorthemembersreappointedshallbe 32appointedfortermsexpiringMarch1,2005;amemberwhosetermotherwiseexpires 33December1,2005,shallservewithatermexpiringMarch1,2007;amemberwhoseterm 34otherwiseexpiresDecember1,2007,shallservewithatermexpiringMarch1,2009;andone 35memberwhosetermotherwiseexpiresOctober13,2007,shallservewithatermexpiring 36March1,2007;andonememberwhosetermotherwiseexpiresOctober13,2007,shallserve 37withatermexpiringMarch1,2009.Ifavacancyoccursinanytermofacommissionerdue 38todeath,resignation,orremoval,asuccessorshallbeappointedforonlytheremainderofthe 39unexpiredterm. 40 2.Thetwomembersofthecommission,oneeachfromopposingpoliticalparties, 41whohavethemostseniorityincommissionserviceshallserveascommissionleadershipwith 42onememberaschairandtheothermemberasvicechair,respectively,fortermsending 43March1,2005.Thecommissionshallelectoneofthemembersaschairandtheotherasvice 44chair.EffectiveMarch1,2005,thecommissionshallelectthetwomembersofthe 45commission,onefromeachopposingpoliticalpartywhohasthemostseniorityin 46commissionservice,whoshallserveascommissionleadershipwithonememberaschairand 47theothermemberasvicechair,respectively,foroneyear.Attheendofsuchyear,the 48memberscurrentlyservingaschairandvicechairshallhavetheoptiontorotatepositions, 49andthemembercurrentlyservingasvicechairmayserveaschair,andviceversa.Thereafter, 50commissionleadershipshallcontinuetorotateaccordinglywiththetwomembersfrom 51opposingpoliticalpartieswhohavethemostseniorityintermsofcommissionservicebeing 52electedbythecommissiontoserveascommissionleadership.Ifoneofthecommission 53leadershipofficesbecomesvacantduetodeath,resignation,removal,or[refuses] refusalto 54servebeforetheone-yearleadershiptermexpires,thecommissionshallelectoneofits HB1384 2 55membersthatisofthesamepoliticalpartyasthevacatingofficertoservetheremainderof 56thevacatingofficer'sleadershipterm.Suchelectionshallnotprohibitthatmemberfromlater 57servingaschairandvicechairwhensuchmember'sseniorityincommissionservicequalifies 58himorherforthoseofficesasprovidedinthissubsection. 59 3.Nomorethanone-halfofthemembersofthecommissionshallbeofthesame 60politicalparty.Theselectionandremovalofallemployeesofthedepartmentof 61transportationshallbewithoutregardtopoliticalaffiliation. 62 4.Thepresentmembersofthecommissionshallcontinuetoserveasmembersofthe 63commissionfortheremainderofthetermsforwhichtheywereappointed,exceptasprovided 64insubsection1ofthissection. 65 5.Anymemberreappointedshallonlybeeligibletoserveaschairorvicechair 66duringthefinaltwoyearsofsuchmember'sreappointment. ✔ HB1384 3
