81 a.Thewagestheemployeewouldhavebeenpaidforthehoursabsentduringuseof
82earnedpaidsicktimeiftheemployeehadworked;or,
83 b.Theweightedaverageofallhourlyratesofpayduringthepreviouspayperiod.

85Whatevermethodtheemployeruses,theemployermustuseaconsistentmethodforeach
86employeethroughoutayear;
87 (c)Foremployeeswhoarepaidasalary,thesamehourlyrateshallbedeterminedby
88dividingthewagestheemployeeearnsinthepreviouspayperiodbythetotalnumberof

90duringthepreviouspayperiod,employeeswhoareexemptfromovertimerequirementsunder
9129U.S.C.§213(a)(1),theFairLaborStandardsAct,shallbeassumedtoworkfortyhoursin
92eachworkweekunlesstheirnormalworkweekislessthanfortyhours,inwhichcaseearned
93paidsicktimeshallaccrueandthesamehourlyrateshallbecalculatedbasedonthe
94employee'snormalworkweek.Regardlessofthebasisused,thesamehourlyrateshallnotbe
95lessthantheeffectiveminimumwagespecifiedinsection290.502;
96 (d)Foremployeespaidonapiecerateorafee-for-servicebasis,thesamehourlyrate
97shallbeareasonablecalculationofthewagesorfeestheemployeewouldhavereceivedfor
98thepiecework,service,orpartthereof,iftheemployeehadworked.Regardlessofthebasis
99used,thesamehourlyrateshallnotbelessthantheeffectiveminimumwagespecifiedin
100section290.502;
101 (e)Foremployeeswhoarepaidonacommissionbasis(whetherbasewageplus
102commissionorcommissiononly),thesamehourlyrateshallbethegreaterofthebasewage
103ortheeffectiveminimumwagespecifiedinsection290.502;
104 (f)Foremployeeswhoreceiveandretaincompensationintheformofgratuitiesin
105additiontowages,thesamehourlyrateshallbethegreateroftheemployee'sregularhourly
