8.981.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Constructionproject",anypubliclyfundedconstruction,renovation,or
3improvementofpublicinfrastructure,buildings,orworksincluding,butnotlimitedto,
4roads,bridges,orothertransportationprojects,thatarefundedinwholeorinpartbya
5politicalsubdivisionofthisstate;
6 (2)"Electronicbidprocurementsystem",anysecure,government-approved
7platformorsystemthatfacilitatestheelectronicsubmissionofbidsincluding,butnot
8limitedto,aplatformorsystemsimilartoanyelectronicprocurementsystemusedby
9theofficeofadministrationontheeffectivedateofthissection;
10 (3)"Politicalsubdivision",anycounty,municipality,city,town,orother
11governmentalentitywithinthestateofMissouriauthorizedtoundertakepublicly
12fundedconstructionprojects.
13 2.(1)Allpoliticalsubdivisionsundertakingconstructionprojectsshallallow
14contractorsandvendorstheoptiontosubmitbidselectronicallyusinganelectronicbid
15procurementsystemorothersecureelectronicdeliverymethods.

17electronictransactionsactestablishedinsections432.200to432.295andshallensurethe
18enforceabilityofelectronicrecordsandsignaturesundersection432.230.
19 3.(1)Eachpoliticalsubdivisionadvertisingforbidsonapplicableconstruction
20projectsshall:
21 (a)Publishanoticeonapubliclyaccessibleonlineportal,suchasthepolitical
22subdivision'sofficialwebsiteoranelectronicbidprocurementsystem;and
23 (b)Providenotificationthroughanelectronicmedium,suchasapublice-
24procurementplatformorrelevantonlinebidboards,toensureaccessibilityto
25prospectivebidders.
26 (2)Atthediscretionofthepoliticalsubdivision,additionalnoticemaybeposted
27inlocalorregionalnewspapersofgeneralcirculationorannouncedthroughpublicor
28minoritybusinessoutreachchannels.
29 (3)Thesolicitationnoticeshallincludeallnecessaryinformationregardingthe
30bidsubmissionprocess,deadlines,electronicsubmissioninstructions,andanyother
31requirementsforprospectivebidders.
32 4.(1)Politicalsubdivisionsshallimplementsecuritymeasuresto:
33 (a)Verifytheidentityofbidders;
34 (b)Ensureconfidentialityofbidcontents;and
35 (c)Preventunauthorizedaccessortampering.
36 (2)Acceptablesecuritymeasuresmayinclude,butarenotlimitedto:
37 (a)Digitalsignaturescompliantwithsection432.230;
38 (b)Encryptionprotocols;or
39 (c)Othersecuritytechnologiesadheringtoindustrystandards.
40 (3)Allelectronicbidsubmissionsshallremainsecureandaccessibletothe
41publicatthespecifiedtimefortheopeningofbidsincompliancewithchapter34.
42 5.(1)Politicalsubdivisionsacceptingelectronicbidsubmissionsshallprovidean
43electronicreceipttothebidderatthetimeofsubmission.
44 (2)Thereceiptshallincludethedateandtimeofsubmissionandmaybe:
45 (a)Immediatelytransmittedtothebidderviaemailorotherelectronic
46notification;or
47 (b)Accessibletothebidderinanonlinesystemwhereitcanbeviewedand
48printed.
49 6.(1)Theofficeofadministrationshalldevelopandissueguidelinestoassist
50politicalsubdivisionsinimplementingsecureelectronicbidsubmissionprocesses.Such
51guidelinesshallbeissuednolaterthanoneyearaftertheeffectivedateofthissection.

53securityprotocols,andcompliancemeasurestoensurecompliancewiththissection.
54Anyelectronicprocurementsystemusedbytheofficeofadministrationontheeffective
55dateofthissectionorsimilarsystemsmaybereferencedasexamplesofcompliant
56platforms.
57 (3)Theofficeofadministrationshallconsultwithpoliticalsubdivisions,
58contractors,andindustryexpertsduringthedevelopmentofsuchguidelinestoensure
59practicalandeffectiveimplementation.
