58 b.Lightswitches,electricaloutlets,thermostats,andotherenvironmentalcontrolsin 59accessiblelocations; 60 c.Reinforcementsinbathroomwallstoallowlaterinstallationofgrabbars;and 61 d.Usablekitchensandbathroomssuchthatanindividualinawheelchaircan 62maneuveraboutthespace. 63 3.Asusedinsubdivision(3)ofsubsection2ofthissection,theterm"covered 64multifamilydwelling"means: 65 (1)Buildingsconsistingoffourormoreunitsifsuchbuildingshaveoneormore 66elevators;and 67 (2)Groundfloorunitsinotherbuildingsconsistingoffourormoreunits. 68 4.CompliancewiththeappropriaterequirementsoftheAmericanNationalStandard 69forBuildingsandFacilitiesprovidingaccessibilityandusabilityforpeoplewithphysical 70disabilities,commonlycitedas"ANSIA117.1",sufficestosatisfytherequirementsof 71paragraph(a)ofsubdivision(3)ofsubsection2ofthissection. 72 5.Whereaunitofgenerallocalgovernmenthasincorporatedintoitslawsthe 73requirementssetforthinsubdivision(3)ofsubsection2ofthissection,compliancewithsuch 74lawsshallbedeemedtosatisfytherequirementsofthatsubdivision.Suchcomplianceshall 75besubjecttothefollowingprovisions: 76 (1)Aunitofgenerallocalgovernmentmayreviewandapprovenewlyconstructed 77coveredmultifamilydwellingsforthepurposeofmakingdeterminationsastowhetherthe 78designandconstructionrequirementsofsubdivision(3)ofsubsection2ofthissectionare 79met; 80 (2)Thecommissionshallencourage,butmaynotrequire,theunitsoflocal 81governmenttoincludeintheirexistingproceduresforthereviewandapprovalofnewly 82constructedcoveredmultifamilydwellings,determinationsastowhetherthedesignand 83constructionofsuchdwellingsareconsistentwithsubdivision(3)ofsubsection2ofthis HB1460 8 84section,andshallprovidetechnicalassistancetounitsoflocalgovernmentandotherpersons 85toimplementtherequirementsofsubdivision(3)ofsubsection2ofthissection; 86 (3)Nothinginthischaptershallbeconstruedtorequirethecommissiontoreviewor 87approvetheplans,designsorconstructionofallcovereddwellings,todeterminewhetherthe 88designandconstructionofsuchdwellingsareconsistentwiththerequirementsofsubdivision 89(3)ofsubsection2ofthissection. 90 6.Nothinginthischaptershallbeconstruedtoinvalidateorlimitanylawofthestate 91orpoliticalsubdivisionofthestate,orotherjurisdictioninwhichthischaptershallbe 92effective,thatrequiresdwellingstobedesignedandconstructedinamannerthataffords 93personswithdisabilitiesgreateraccessthanisrequiredbythischapter. 94 7.Nothinginthissectionandsections213.045and213.050requiresthatadwelling 95bemadeavailabletoanindividualwhosetenancywouldconstituteadirectthreattothehealth 96orsafetyofotherindividualsorwhosetenancywouldresultinsubstantialphysicaldamageto 97thepropertyofothers. 98 8.Nothinginthissectionandsections213.045and213.050limitstheapplicabilityof 99anyreasonablelocalorstaterestrictionregardingthemaximumnumberofoccupants 100permittedtooccupyadwelling,nordoesanyprovisioninthissectionandsections213.045 101and213.050regardingfamilialstatusapplywithrespecttohousingforolderpersons. 102 9.Asusedinthissectionandsections213.045and213.050,"housingforolder 103persons"meanshousing: 104 (1)Providedunderanystateorfederalprogramthatthecommissiondeterminesis 105specificallydesignedandoperatedtoassistelderlypersons,asdefinedinthestateorfederal 106program; 107 (2)Intendedfor,andsolelyoccupiedby,personssixty-twoyearsofageorolder;or 108 (3)Intendedandoperatedforoccupancybyatleastonepersonfifty-fiveyearsofage 109orolderperunit.Indeterminingwhetherhousingqualifiesashousingforolderpersons 110underthissubsection,thecommissionshalldevelopregulationswhichrequireatleastthe 111followingfactors: 112 (a)Theexistenceofsignificantfacilitiesandservicesspecificallydesignedtomeet 113thephysicalorsocialneedsofolderpersons,oriftheprovisionofsuchfacilitiesandservices 114isnotpracticable,thatsuchhousingisnecessarytoprovideimportanthousingopportunities 115forolderpersons;and 116 (b)Thatatleasteightypercentoftheunitsareoccupiedbyatleastonepersonfifty- 117fiveyearsofageorolderperunit;and 118 (c)Thepublicationof,andadherenceto,policiesandprocedureswhichdemonstrate 119anintentbytheownerormanagertoprovidehousingforpersonsfifty-fiveyearsofageor 120older. 67disabilityinanycommunity,state,section,orotherarea,orintheavailableworkforceinany 68community,state,section,orotherarea. 69 4.Notwithstandinganyotherprovisionofthischapter,itshallnotbeanunlawful 70employmentpracticeforthestateoranypoliticalsubdivisionofthestatetocomplywiththe 71provisionsof29U.S.C.Section623relatingtoemploymentasfirefightersorlaw 72enforcementofficers. 3.Theprovisionsofthissectionshallnotapplytoaprivateclub,aplaceof 14accommodationownedbyoroperatedonbehalfofareligiouscorporation,associationor 15society,orotherestablishmentwhichisnotinfactopentothepublic,unlessthefacilitiesof 16suchestablishmentsaremadeavailabletothecustomersorpatronsofaplaceofpublic 17accommodationasdefinedinsection213.010andthissection. 213.070.1.Itshallbeanunlawfuldiscriminatorypractice[foranemployer, 2employmentagency,labororganization,orplaceofpublicaccommodation]: 3 (1)Toaid,abet,incite,compel,orcoercethecommissionofactsprohibitedunderthis 4chapterortoattempttodoso; HB1460 13 5 (2)Toretaliateordiscriminateinanymanneragainstanyotherpersonbecausesuch 6personhasopposedanypracticeprohibitedbythischapterorbecausesuchpersonhasfileda 7complaint,testified,assisted,orparticipatedinanymannerinanyinvestigation,proceeding 8orhearingconductedpursuanttothischapter; 9 (3)Forthestateoranypoliticalsubdivisionofthisstatetodiscriminateonthebasis 10ofrace,color,religion,nationalorigin,sex,sexualorientation,genderidentity,ancestry, 11age,asitrelatestoemployment,disability,veteranstatus,orfamilialstatusasitrelatesto 12housing;or 13 (4)Todiscriminateinanymanneragainstanyotherpersonbecauseofsuchperson's 14associationwithanypersonprotectedbythischapter. 15 2.Thischapter,inadditionto[chapter] chapters285and[chapter] 287,shallprovide 6accommodationallegedtohavecommittedtheunlawfuldiscriminatorypracticeandwhich 7shallsetforththeparticularsthereofandsuchotherinformationasmayberequiredbythe 8commission.Thecomplainant'sagent,attorneyortheattorneygeneralmay,inlikemanner, 9make,signandfilesuchcomplaint.Thefailuretotimelyfileacomplaintwiththe 10commissionshalldeprivethecommissionofjurisdictiontoinvestigatethecomplaint.The 11commissionshallmakeadeterminationastoitsjurisdictionwithrespecttoallcomplaints.
