SectionA.Chapter99,RSMo,isamendedbyaddingtheretofournewsections,tobe
2knownassections99.1220,99.1223,99.1226,and99.1230,toreadasfollows:
99.1220.1.Sections99.1220to99.1230shallbeknownandmaybecitedasthe
2"MissouriEntertainmentFacility-CapitalAssistanceProgram"or"MEF-CAP".
3 2.Insofarastheprovisionsofsections99.1220to99.1230areinconsistentwith
4theprovisionsofanyotherlaw,theprovisionsofsections99.1220to99.1230shallbe
5controlling.
6 3.Asusedinsections99.1220to99.1230,thefollowingtermsshallmean:
7 (1)"Department",theMissouridepartmentofeconomicdevelopment;
8 (2)"Entertainmentfacility",anysportsstadium,arena,orrelatedfacilitywhich
9hasasitsprimarypurposeuseforprofessionalsportsorentertainmentevents;
10 (3)"MDFB",theMissouridevelopmentfinanceboard;
11 (4)"Professionalsportsfranchise",anyprofessionalsportsteamthatisa
12memberofMajorLeagueBaseball,theNationalFootballLeague,theNational
13BasketballAssociation,theNationalHockeyLeague,MajorLeagueSoccer,the
14Women'sNationalBasketballAssociation,ortheNationalWomen'sSoccerLeague;
15 (5)"Projectcosts",thecostsofacquiring,constructing,improving,or
16renovatinganentertainmentfacility,including:
17 (a)Landacquisitionandsitepreparation;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (b)Constructionandmaterials;

21 (e)Infrastructureimprovementsdirectlyrelatedtothefacility;
22 (6)"Qualifiedproject",anentertainmentfacilityprojectthatmeetsalleligibility
23requirementsundersection99.1223;
24 (7)"Stateassistance",financialsupportprovidedpursuanttosections99.1220
25to99.1230throughanycombinationofstatetaxincrementfinancingrevenues,
26withholdingtaxretention,ormatchinggrants.
99.1223.1.Thereisherebyestablishedthe"MissouriEntertainmentFacility
2CapitalAssistanceProgram"tobeadministeredbythedepartmentwithoversightfrom
3theMDFB.
4 2.Tobeeligibleforstateassistancepursuanttosections99.1220to99.1230,a
5projectshallmeetallofthefollowingcriteria:
6 (1)Havetotalprojectcostsofatleasttwohundredfiftymilliondollars;
7 (2)Includeanentertainmentfacilitywithseatingcapacityofatleasttwenty
8thousandpersons;
9 (3)Havecommittedprivatefundingofatleastthirty-threepercentoftotal
10projectcosts;
11 (4)Havelocalgovernmentsupportthrougharesolutionfromthelocal
12governingbodycommittingtoeither:
13 (a)Provideatleasttenpercentofprojectcosts;or
14 (b)Provideothersupportandexpressingadesirethatthestateprovidesupport;
15 (5)Demonstratesignificanteconomicimpactthroughanindependenteconomic
16impactstudyshowing:
17 (a)Thecreationorretentionofpermanentjobs;
18 (b)Netneweconomicactivityorretentionofeconomicactivity;and
19 (c)IncreasedtaxrevenuetothestateofMissouri;
20 (6)Includeabindingcommitmentfromanyprofessionalsportsfranchisethat
21willbetheprimarytenantto:
22 (a)Enterintoaleaseofatleasttwenty-fiveyears;
23 (b)Maintaintheteam'sprimaryoperationsinMissouriforatleasttwenty-five
24years;and
25 (c)Repayallstateassistancereceivediftheteamrelocatesduringthe
26commitmentperiod.
27 3.(1)Forqualifiedprojects,stateassistancemayinclude:
HB1560	2 28 (a)Uptofiftypercentofincrementalstatesalesandincometaxesgeneratedby
29theprojectthroughstatetaxincrementfinancingforuptotwenty-fiveyears;
30 (b)Retentionoffiftypercentofstatewithholdingtaxesfromnewjobscreated
31foruptotwenty-fiveyears;and
32 (c)Statematchinggrantsofuptotwenty-fivepercentoftotalprojectcosts,not
33toexceedonehundredmilliondollarsperproject.
34 (2)Totalstateassistancethroughallprogramsauthorizedbysections99.1220to
3599.1230shallnotexceedthirty-threepercentoftotalprojectcosts.
36 (3)Stateassistanceprovidedpursuanttosections99.1220to99.1230maybe
37usedincombinationwithlocaleconomicdevelopmentincentives,taxabatements,
38federalgrantsorincentives,orothereconomicdevelopmentprograms,providedthat
39thetotalamountofpublicassistancefromallsourcesshallnotexceedseventy-five
40percentoftotalprojectcosts,ortheprojectshallbedeemedineligible.
41 4.(1)Projectsreceivingassistancepursuanttosections99.1220to99.1230shall
42beeligibleforexpeditedconsiderationfor:
43 (a)Uptotenmilliondollarsannuallyfromthetaximposedpursuanttosection
44143.183foruptothirtyyears;and
45 (b)UptofiftymilliondollarsoverthreeyearsfromtheMDFB.
46 (2)Thedepartmentshallcreateproceduresforprojectsreceivingassistance
47pursuanttosections99.1220to99.1230toengageinapreferredapplicationprocessfor
48thefundsprovidedinthissubsection.
49 (3)Fundingpursuanttothissubsectionshallbeinadditiontootherstate
50assistanceauthorizedpursuanttosections99.1220to99.1230.
51 5.Thereisherebycreatedinthestatetreasurythe"StateSupplemental
52EntertainmentFacilityFund",whichshallconsistofanymoneysappropriatedbythe
53generalassembly,aswellasfromanygrants,gifts,bequests,orotherpaymentsfrom
54anysource.Thestatetreasurershallbecustodianofthefund.Inaccordancewith
55sections30.170and30.180,thestatetreasurermayapprovedisbursements.
56Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
57remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
58generalrevenuefund.Thestatetreasurershallinvestmoneysinthefundinthesame
59mannerasotherfundsareinvested.Anyinterestandmoneysearnedonsuch
60investmentsshallbecreditedtothefund.Thefundshallbeadministeredbythe
61department,whichshallusethefundtoprovideassistanceauthorizedbysections
6299.1220to99.1230.
99.1226.1.Applicationsforstateassistanceshallbesubmittedtothe
2departmentinsuchformandmannerasprescribedbythedepartment.
HB1560	3 3 2.Applicationsshallinclude,butnotbelimitedto:
4 (1)Detailedprojectplansandspecifications;
5 (2)Projectbudgetandtimeline;
6 (3)Evidenceofmeetingalleligibilityrequirements;
7 (4)Economicimpactanalysis;
8 (5)Financialprojectionsandfundingcommitments;
9 (6)Aclearoutlineofthetypeortypesofstateassistancerequested,andthe
10amountofeachtypeofstateassistancerequested;
11 (7)Abindingcommitmentfromanyprofessionalsportsfranchisethatwillbe
12theprimarytenantto:
13 (a)Enterintoaleaseofatleasttwenty-fiveyears;
14 (b)Maintaintheteam'sprimaryoperationsinMissouriforatleasttwenty-five
15years;and
16 (c)Repayallstateassistancereceivediftheteamrelocatesduringthe
17commitmentperiod;and
18 (8)Anyotherinformationrequiredbythedepartment.
19 3.(1)Thedepartmentshallreviewapplicationsandmakerecommendationsto
20theMDFBwithinninetydaysofreceivingacompletedapplication.
21 (2)TheMDFBshallapproveordenyapplicationswithinsixtydaysofreceiving
22thedepartment'srecommendation.
23 (3)Uponapproval,thedepartmentshallissueacertificateoutliningtheterms
24andconditionsofstateassistance.
99.1230.1.Anyqualifiedprojectreceivingassistancepursuanttosections
299.1220to99.1230shallsubmitannualreportstothedepartment,whichshallinclude
3suchinformationasthedepartmentdeemsappropriate.
4 2.Thedepartmentshallestablishproceduresformonitoringcompliancewith
5therequirementsofsections99.1220to99.1230.
6 3.Anystateassistancereceivedshallbesubjecttorepaymentwithinterestif:
7 (1)Aprofessionalsportsfranchiserelocatesduringitscommitmentperiod;
8 (2)Theprojectfailstomaintaineligibilityrequirements;or
9 (3)Therecipientisfoundtohaveviolatedtheprovisionsofsections99.1220to
1099.1230ormadeamisrepresentationontheirapplication.
11 4.Thedepartmentshallpromulgaterulestoimplementtheprovisionsof
12sections99.1220to99.1230.Anyruleorportionofarule,asthattermisdefinedin
13section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
14becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
15536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable
HB1560	4 16andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
17review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently
18heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
19adoptedafterAugust28,2025,shallbeinvalidandvoid.
