SectionA.Section34.040,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection34.040,toreadasfollows:
34.040.1.Allpurchasesinexcessoftenthousanddollarsshallbebasedon
2competitivebids,exceptasotherwiseprovidedinthischapter.
3 2.Onanypurchasewheretheestimatedexpenditureshallbeonehundredthousand
4dollarsorover,exceptasprovidedinsubsection6ofthissection,thecommissionerof
5administrationshall:
6 (1)Advertiseforbidsinatleasttwodailynewspapersofgeneralcirculationinsuch
7placesasaremostlikelytoreachprospectivebiddersandmayadvertiseinatleasttwoweekly
8minoritynewspapersandmayprovidesuchinformationthroughanelectronicmedium
9availabletothegeneralpublicatleastfivedaysbeforebidsforsuchpurchasesaretobe
10opened.Othermethodsofadvertisement,whichmayincludeminoritybusinesspurchase
11councils,however,maybeadoptedbythecommissionerofadministrationwhensuchother
12methodsaredeemedmoreadvantageousforthesuppliestobepurchased;
13 (2)Postanoticeoftheproposedpurchaseinhisorheroffice;and
14 (3)Solicitbidsbymailorotherreasonablemethodgenerallyavailabletothepublic
15fromprospectivesuppliers.Allbidsforsuchsuppliesshallbemailedordeliveredtothe
16officeofthecommissionerofadministrationsoastoreachsuchofficebeforethetimesetfor
17openingbids.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 3.Thecontractshallbelettothelowestandbestbidder.Thecommissionerof
19administrationshallhavetherighttorejectanyorallbidsandadvertisefornewbids,or
20purchasetherequiredsuppliesontheopenmarketiftheycanbesopurchasedatabetter
21price.Whenbidsreceivedpursuanttothissectionareunreasonableorunacceptableasto
22termsandconditions,noncompetitive,orthelowbidexceedsavailablefundsanditis
23determinedinwritingbythecommissionerofadministrationthattimeorothercircumstances
24willnotpermitthedelayrequiredtoresolicitcompetitivebids,acontractmaybenegotiated
25pursuanttothissection,providedthateachresponsiblebidderwhosubmittedsuchbidunder
26theoriginalsolicitationisnotifiedofthedeterminationandisgivenareasonableopportunity
27tomodifytheirbidandsubmitabestandfinalbidtothestate.Incaseswherethebids
28receivedarenoncompetitiveorthelowbidexceedsavailablefunds,thenegotiatedpriceshall
29belowerthanthelowestrejectedbidofanyresponsiblebidderundertheoriginalsolicitation.
30 4.Thedirectorofthedepartmentofrevenueshallfollowbiddingproceduresas
31containedinthischapterandmaypromulgaterulesnecessarytoestablishsuchprocedures.
32Nopointsshallbeawardedonarequestforproposalforacontractlicenseofficetoabidder
33forareturn-to-the-stateprovisionoffer.
34 5.Allbidsshallbebasedonstandardspecificationswhereversuchspecifications
35havebeenapprovedbythecommissionerofadministration.Thecommissionerof
36administrationshallmakerulesgoverningthedelivery,inspection,storageanddistributionof
37allsuppliessopurchasedandgoverningthemannerinwhichallclaimsforsuppliesdelivered
38shallbesubmitted,examined,approvedandpaid.Thecommissionershalldeterminethe
39amountofbondordepositandthecharacterthereofwhichshallaccompanybidsorcontracts.
40 6.Thedepartmentofnaturalresourcesmay,withouttheapprovalofthe
41commissionerofadministrationrequiredpursuanttothissection,enterintocontractsofup
42tofivehundredthousanddollarstoabateillegalwastetiresitespursuanttosection260.276
43whenthedirectorofthedepartmentdeterminesthaturgentactionisneededtoprotectpublic
44health,safety,naturalresourcesortheenvironment.Thedepartmentshallfollowbidding
45procedurespursuanttothissectionandmaypromulgaterulesnecessarytoestablishsuch
46procedures.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
47createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
48withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
49Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
50generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto
51disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
52rulemakingauthorityandanyruleproposedoradoptedafterAugust28,1999,shallbeinvalid
53andvoid.

55purchasinglawappliesshallnotcontractforgoodsorserviceswithavendorifthevendoror
56anaffiliateofthevendormakessalesatretailoftangiblepersonalpropertyorforthepurpose
57ofstorage,use,orconsumptioninthisstatebutfailstocollectandproperlypaythetaxas
58providedinchapter144.Forthepurposesofthissection,"affiliateofthevendor"shallmean
59anypersonorentitythatiscontrolledbyorisundercommoncontrolwiththevendor,whether
60throughstockownershiporotherwise.
61 8.Thecommissionerofadministrationmayholdreverseauctionstoprocure
62merchandise,supplies,rawmaterials,orfinishedgoodsifpriceistheprimaryfactorin
63evaluatingbids,excludingitemsinsection34.047.Theofficeofadministrationshall
64promulgaterulesregardingthehandlingofthereverseauctionprocess.
65 9.Anystatedepartmentshallhavetheauthoritytoconductitsownpurchasing
66accordingtotheproceduresandrequirementssetforthinthischapter.The
67commissionerofadministrationshallcooperatewithandassistanystatedepartment
68requestingtoconductitsownpurchasing.
69 10.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
70createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
71withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
