290.502.1.Exceptasmaybeotherwiseprovidedpursuanttosections290.500to
2290.530,effectiveJanuary1,2007,everyemployershallpaytoeachemployeewagesatthe
3rateof$6.50perhour,orwagesatthesamerateorratessetundertheprovisionsoffederal
4lawastheprevailingfederalminimumwageapplicabletothosecoveredjobsininterstate
5commerce,whicheverrateperhourishigher.
6 2.TheminimumwageshallbeincreasedordecreasedonJanuary1,2008,andon
7January1ofsuccessiveyears,bytheincreaseordecreaseinthecostofliving.OnSeptember
830,2007,andoneachSeptember30ofeachsuccessiveyear,thedirectorshallmeasurethe
9increaseordecreaseinthecostoflivingbythepercentageincreaseordecreaseasofthe
10precedingJulyoverthelevelasofJulyoftheimmediatelyprecedingyearoftheConsumer
11PriceIndexforUrbanWageEarnersandClericalWorkers(CPI-W)orsuccessorindexas
12publishedbytheU.S.DepartmentofLabororitssuccessoragency,withtheamountofthe
13minimumwageincreaseordecreaseroundedtothenearestfivecents.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 14 3.Exceptasmaybeotherwiseprovidedpursuanttosections290.500to290.530,and
15notwithstandingsubsection1ofthissection,effectiveJanuary1,[2025] 2019, every
16employershallpaytoeachemployeewagesattherateofnotlessthan[$13.75] $8.60per
17hour,orwagesatthesamerateorratessetundertheprovisionsoffederallawasthe
18prevailingfederalminimumwageapplicabletothosecoveredjobsininterstatecommerce,
19whicheverrateperhourishigher.Thereafter,theminimumwageestablishedbythis
20subsectionshallbeincreasedeachyearby[$1.25] $0.85perhour,[to$15.00perhour]
21effectiveJanuary1ofeachofthenextfouryearsuntilitreaches$12.00perhour,
22effectiveJanuary1,[2026] 2023. Thereafter,theminimumwageestablishedbythis
23subsectionshallbeincreasedordecreasedonJanuary1,[2027] 2024, andonJanuary1of
24successiveyears,perthemethodsetforthinsubsection2ofthissection.Ifatanytimethe
25federalminimumwagerateisaboveoristhereafterincreasedabovetheminimumwagethen
26ineffectunderthissubsection,theminimumwagerequiredbythissubsectionshallcontinue
27tobeincreasedpursuanttothissubsection,butthehigherfederalrateshallimmediately
28becometheminimumwagerequiredbythissubsectionandshallbeincreasedordecreased
29perthemethodsetforthinsubsection2forsolongasitremainshigherthanthestate
30minimumwagerequiredandincreasedpursuanttothissubsection.
31 4.Forpurposesofthissection,theterm"publicemployer"meansanemployerthatis
32thestateorapoliticalsubdivisionofthestate,includingadepartment,agency,officer,bureau,
33division,board,commission,orinstrumentalityofthestate,oracity,county,town,village,
34schooldistrict,orotherpoliticalsubdivisionofthestate.Subsection3ofthissectionshallnot
35applytoapublicemployerwithrespecttoitsemployees.Anypublicemployerthatissubject
36tosubsections1and2ofthissectionshallcontinuetobesubjecttothosesubsections.

95 (b)Foremployeeswhoarepaidmultiplehourlyratesofpayfromthe
96 sameemployer,thesamehourlyrateshallbeeither:
97 a.Thewagestheemployeewouldhavebeenpaidforthehoursabsent
98 duringuseofearnedpaidsicktimeiftheemployeehadworked;or,
99 b.Theweightedaverageofallhourlyratesofpayduringtheprevious
100 payperiod.

102 Whatevermethodtheemployeruses,theemployermustuseaconsistent
103 methodforeachemployeethroughoutayear;
104 (c)Foremployeeswhoarepaidasalary,thesamehourlyrateshallbe
105 determinedbydividingthewagestheemployeeearnsinthepreviouspay
106 periodbythetotalnumberofhoursworkedduringthepreviouspayperiod.
107 Fordeterminingtotalnumberofhoursworkedduringthepreviouspayperiod,
108 employeeswhoareexemptfromovertimerequirementsunder29U.S.C.§213
109 (a)(1),theFairLaborStandardsAct,shallbeassumedtoworkfortyhoursin
110 eachworkweekunlesstheirnormalworkweekislessthanfortyhours,in
111 whichcaseearnedpaidsicktimeshallaccrueandthesamehourlyrateshallbe
112 calculatedbasedontheemployee'snormalworkweek.Regardlessofthebasis

114 specifiedinsection290.502;
115 (d)Foremployeespaidonapiecerateorafee-for-servicebasis,the
116 samehourlyrateshallbeareasonablecalculationofthewagesorfeesthe
117 employeewouldhavereceivedforthepiecework,service,orpartthereof,if
118 theemployeehadworked.Regardlessofthebasisused,thesamehourlyrate
119 shallnotbelessthantheeffectiveminimumwagespecifiedinsection

121 (e)Foremployeeswhoarepaidonacommissionbasis(whetherbase

[290.603.1.Employeesofanemployerwithfifteenormore
2 employeesshallaccrueaminimumofonehourofearnedpaidsicktimefor
3 everythirtyhoursworked,butsuchemployeesshallnotbeentitledtouse
4 morethanfifty-sixhoursofearnedpaidsicktimeperyear,unlessthe
5 employerselectsahigherlimit.
6 2.Employeesofanemployerwithfewerthanfifteenemployeesshall
7 accrueaminimumofonehourofearnedpaidsicktimeforeverythirtyhours
8 worked,butsuchemployeesshallnotbeentitledtousemorethanfortyhours
9 ofearnedpaidsicktimeperyear,unlesstheemployerselectsahigherlimit.
10 3.Indeterminingthenumberofemployeesofanemployer,all
11 employeesperformingworkinthestateforanemployerforcompensationon
12 afull-time,part-time,ortemporarybasisshallbecounted.Insituationsin
13 whichthenumberofemployeesperformingworkinthestateforanemployer
14 forcompensationperweekfluctuatesaboveandbelowfifteenemployeesper
15 weekoverthecourseofayear,anemployerisrequiredtoprovideearnedpaid
16 sicktimepursuanttosubsection1ofthissectionifitmaintainedfifteenor
17 moreemployeesinthestateonthepayrollforsomeportionofaworkingday
18 ineachoftwentyormoredifferentcalendarweeks,includinganyperiodsof
19 leave,andwhetherornottheweekswereconsecutive,ineitherthecurrentor
20 theprecedingyear(irrespectiveofwhetherthesameindividualswerein
21 employmentineachworkingday).
22 4.Allemployeesshallaccrueearnedpaidsicktimeasfollows:
23 (1)Earnedpaidsicktimeasprovidedinthissectionshallbeginto
24 accrueatthecommencementofemploymentorMay1,2025,whicheveris
25 later.Anemployeeshallbeentitledtouseearnedpaidsicktimeasitis
HB1577	5 26 accrued.Anemployermayprovideallearnedpaidsicktimethatanemployee
27 isexpectedtoaccrueinayearatthebeginningoftheyear;
28 (2)Employeeswhoareexemptfromovertimerequirementsunder29
29 U.S.C.§213(a)(1)oftheFederalFairLaborStandardsActwillbeassumedto
30 workfortyhoursineachworkweekforpurposesofearnedpaidsicktime
31 accrualunlesstheirnormalworkweekislessthanfortyhours,inwhichcase
32 earnedpaidsicktimeaccruesbaseduponthatnormalworkweek;
33 (3)Uptoeightyhoursofearnedpaidsicktimeshallbecarriedoverto
34 thefollowingyeariftheemployeehasanyunusedaccruedearnedpaidsick
35 timeattheendoftheyear,butthislawdoesnotrequireanemployertopermit
36 anemployeetousemorethantheapplicablenumberofhoursofearnedpaid
37 sicktimeperyearassetforthinsubsections1and2ofthissection.
38 Alternatively,inlieuofcarryoverofunusedearnedpaidsicktimefromone
39 yeartothenext,anemployermaypayanemployeeforunusedearnedpaid
40 sicktimeattheendofayearwhichcouldbecarriedoverandprovidethe
41 employeewithanamountofpaidsicktimethatmeetsorexceedsthe
42 requirementsofsections290.600through290.642thatisavailableforthe
43 employee'simmediateuseatthebeginningofthesubsequentyear;
44 (4)Ifanemployeeistransferredtoaseparatedivision,entity,or
45 location,butremainsemployedbythesameemployer,theemployeeisentitled
46 toallearnedpaidsicktimeaccruedatthepriordivision,entity,orlocationand
47 isentitledtouseallearnedpaidsicktimeasprovidedinthissection.When
48 thereisaseparationfromemploymentandtheemployeeisrehiredwithinnine
49 monthsofseparationbythesameemployer,previouslyaccruedearnedpaid
50 sicktimethathadnotbeenusedshallbereinstated.Further,theemployee
51 shallbeentitledtouseaccruedearnedpaidsicktimeandaccrueadditional
52 earnedpaidsicktimeattherecommencementofemployment;
53 (5)Whenadifferentemployersucceedsortakestheplaceofan
54 existingemployer,allemployeesoftheoriginalemployerwhoremain
55 employedbythesuccessoremployerareentitledtoallearnedpaidsicktime
56 theyaccruedwhenemployedbytheoriginalemployer,andareentitledtouse
57 earnedpaidsicktimepreviouslyaccrued;
58 (6)Atitsdiscretion,anemployermayloanearnedpaidsicktimetoan
59 employeeinadvanceofaccrualbysuchemployee.
60 5.Anyemployerwithapaidleavepolicy,suchasapaidtimeoff
61 policy,whomakesavailableanamountofpaidleavesufficienttomeetthe
62 accrualrequirementsofthissectionthatmaybeusedforthesamepurposes
63 andunderthesameconditionsasearnedpaidsicktimeundersections290.600
64 through290.642isnotrequiredtoprovideadditionalpaidsicktimeunderthis
65 section.
66 6.Exceptasspecificallyprovidedinthissection,nothinginthis
67 sectionshallbeconstruedasrequiringfinancialorotherreimbursementtoan
68 employeefromanemployerupontheemployee'stermination,resignation,
69 retirement,orotherseparationfromemploymentforaccruedearnedpaidsick
70 timethathasnotbeenused.
71 7.EmployeesshallnotaccrueearnedpaidsicktimebeforeMay1,
72 2025.Employeeswhoareemployedorwhocommenceemploymentonor
73 afterMay1,2025shallaccrueearnedpaidsicktimeandbeentitledtouse

75 through290.642.Thedepartmentmaydevelopmodelpostersandnotices,
76 engageinrulemaking,initiateoutreachprograms,andengageinother

78 290.642asauthorizedbythosesectionsbeforeMay1,2025.]
[290.606.1.Earnedpaidsicktimeshallbeprovidedtoanemployee
2 byanemployerfor:
3 (1)Anemployee'smentalorphysicalillness,injury,orhealth
4 condition;anemployee'sneedformedicaldiagnosis,care,ortreatmentofa
5 mentalorphysicalillness,injury,orhealthcondition;anemployee'sneedfor
6 preventativemedicalcare;
7 (2)Careofafamilymemberwithamentalorphysicalillness,injury,
8 orhealthcondition;careofafamilymemberwhoneedsmedicaldiagnosis,
9 care,ortreatmentofamentalorphysicalillness,injury,orhealthcondition;
10 careofafamilymemberwhoneedspreventativemedicalcare;
11 (3)Closureoftheemployee'splaceofbusinessbyorderofapublic
12 officialduetoapublichealthemergency,oranemployee'sneedtocarefora
13 childwhoseschoolorplaceofcarehasbeenclosedbyorderofapublic
14 officialduetoapublichealthemergency,orcareforoneselforafamily
15 memberwhenithasbeendeterminedbythehealthauthoritieshaving
16 jurisdictionorbyahealthcareproviderthattheemployee'sorfamily
17 member'spresenceinthecommunitymayjeopardizethehealthofothers
18 becauseofhisorherexposuretoacommunicabledisease,whetherornotthe
19 employeeorfamilymemberhasactuallycontractedthecommunicable
20 disease;or
21 (4)Absencenecessaryduetodomesticviolence,sexualassault,or
22 stalking,providedtheleaveistoallowtheemployeetoobtainforthe
23 employeeortheemployee'sfamilymember:
24 (a)Medicalattentionneededtorecoverfromphysicalorpsychological
25 injuryordisabilitycausedbydomesticviolence,sexualassault,orstalking;
26 (b)Servicesfromavictimservicesorganization;
27 (c)Psychologicalorothercounseling;
28 (d)Relocationortakingstepstosecureanexistinghomeduetothe
29 domesticviolence,sexualassault,orstalking;or
30 (e)Legalservices,includingpreparingfororparticipatinginanycivil
31 orcriminallegalproceedingrelatedtoorresultingfromthedomesticviolence,
32 sexualassault,orstalking.
33 2.Earnedpaidsicktimeshallbeprovidedupontherequestofan
34 employee.Suchrequestmaybemadeorally,inwriting,byelectronicmeans,
35 orbyanyothermeansacceptabletotheemployer.Whenpossible,therequest
36 shallincludetheexpecteddurationoftheabsence.
37 3.Whentheuseofearnedpaidsicktimeisforeseeable,theemployee
38 shallmakeagoodfaithefforttoprovidenoticeoftheneedforsuchtimetothe
39 employerinadvanceoftheuseoftheearnedpaidsicktimeandshallmakea
40 reasonableefforttoscheduletheuseofearnedpaidsicktimeinamannerthat
41 doesnotundulydisrupttheoperationsoftheemployer.Wheresuchneedis
HB1577	7 42 notforeseeable,anemployermayrequireanemployeetoprovidenoticeofthe
43 needfortheuseofearnedpaidsicktimeassoonaspracticable.
44 4.Anemployerthatrequiresnoticeoftheneedtouseearnedpaidsick
45 timewheretheneedisnotforeseeableshallprovideawrittenpolicythat
46 containsproceduresfortheemployeetoprovidenotice.Anemployerthathas
47 notprovidedtotheemployeeacopyofitswrittenpolicyforprovidingsuch
48 noticeshallnotdenyearnedpaidsicktimetotheemployeebasedon
49 noncompliancewithsuchapolicy.
50 5.Anemployermaynotrequire,asaconditionofanemployee's
51 takingearnedpaidsicktime,thattheemployeesearchfororfinda
52 replacementworkertocoverthehoursduringwhichtheemployeeisusing
53 earnedpaidsicktime.
54 6.Earnedpaidsicktimemaybeusedinthesmallerofhourly
55 incrementsorthesmallestincrementthattheemployer'spayrollsystemusesto
56 accountforabsencesoruseofothertime.
57 7.Forearnedpaidsicktimeofthreeormoreconsecutiveworkdays,
58 anemployermayrequirereasonabledocumentationthattheearnedpaidsick
59 timehasbeenusedforapurposecoveredbysubsection1ofthissection.
60 (1)Documentationsignedbyaheathcareprofessionalindicatingthat
61 earnedpaidsicktimeisnecessaryshallbeconsideredreasonable
62 documentationforpurposesofthissection.
63 (2)Incasesofdomesticviolence,sexualassault,orstalking,ifthe
64 employerrequests,oneofthefollowingtypesofdocumentationselectedby
65 theemployeeshallbeconsideredreasonabledocumentation:(i)apolice
66 reportindicatingthattheemployeeortheemployee'sfamilymemberwasa
67 victimofdomesticviolence,sexualassault,orstalking;(ii)awrittenstatement
68 fromanemployeeoragentofavictimserviceprovideraffirmingthatthe
69 employeeoremployee'sfamilymemberisorwasreceivingservicesfroma
70 victimserviceprovider;(iii)documentationsignedbyahealthcare
71 professionalfromwhomtheemployeeoremployee'sfamilymembersought
72 assistancerelatingtodomesticviolence,sexualassault,orstalkingorthe
73 effectsthereof;(iv)acourtdocumentindicatingthatanemployeeor
74 employee'sfamilymemberisorwasinvolvedinalegalactionrelatedto
75 domesticviolence,sexualassault,orstalking;or(v)awrittenstatementfrom
