1212 221.105.1.Thegoverningbodyofanycountyandofanycitynotwithinacounty
1313 2shallfixtheamounttobeexpendedforthecostofincarcerationofprisonersconfinedinjails
1414 3ormediumsecurityinstitutions.Theperdiemcostofincarcerationoftheseprisoners
1515 4chargeablebythelawtothestateshallbedetermined,subjecttothereviewandapprovalof
1616 5thedepartmentofcorrections.
1717 6 2.Whenthefinaldeterminationofanycriminalprosecutionshallbesuchastorender

2525 14chargeabletothestate.Inanycitynotwithinacountyitshallbethedutyofthe
2626 15superintendentofanyfacilityboardingprisonerstocertifytothechiefexecutiveofficerof
2727 16suchcitynotwithinacountythetotalnumberofdaysanyprisonerwhowasapartyinsuch
2828 17caseremainedinsuchfacility.Itshallbethedutyofthesuperintendentsofsuchfacilitiesto

4545 33shallbetheactualcostofincarceration[nottoexceed] asfollows:
4646 34 (1)UntilJuly1,1996,nottoexceedseventeendollarsperdayperprisoner;
4747 35 (2)OnandafterJuly1,1996,nottoexceedtwentydollarsperdayperprisoner;
4848 36 (3)OnandafterJuly1,1997,uptothirty-sevendollarsandfiftycentsperdayper
4949 37prisoner,subjecttoappropriations; and
5050 38 (4)OnandafterJuly1,2026,aminimumoffortydollarsperdayperprisoner,
5151 39subjecttoappropriations.
5252 40 4.Thepresidingjudgeofajudicialcircuitmayproposeexpensestobereimbursable
5353 41bythestateonbehalfofoneormoreofthecountiesinthatcircuit.Proposedreimbursable
5454 42expensesmayincludepretrialassessmentandsupervisionstrategiesfordefendantswhoare
5555 43ultimatelyeligibleforstateincarceration.Acountymaynotreceivemorethanitsshareofthe
5656 44amountappropriatedinthepreviousfiscalyear,inclusiveofexpensesproposedbythe
5757 45presidingjudge.Anycountyshallconveysuchproposaltothedepartment,andanysuch
5858 46proposalpresentedbyapresidingjudgeshallincludethedocumentedagreementwiththe
5959 47proposalbythecountygoverningbody,prosecutingattorney,atleastoneassociatecircuit
6060 48judge,andtheofficerofthecountyresponsibleforcustodyorincarcerationofprisonersof
6161 49thecountyrepresentedintheproposal.Anycountythatdeclinestoconveyaproposaltothe
6262 50department,pursuanttotheprovisionsofthissubsection,shallreceiveitsperdiemcostof
6363 51incarcerationforallprisonerschargeabletothestateinaccordancewiththeprovisionsof
6464 52subsections1,2,and3ofthissection.
