Torepealsection221.105,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
incarcerationcosts.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section221.105,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection221.105,toreadasfollows:
221.105.1.Thegoverningbodyofanycountyandofanycitynotwithinacounty
2shallfixtheamounttobeexpendedforthecostofincarcerationofprisonersconfinedinjails
3ormediumsecurityinstitutions.Theperdiemcostofincarcerationoftheseprisoners
4chargeablebythelawtothestateshallbedetermined,subjecttothereviewandapprovalof
5thedepartmentofcorrections.
6 2.Whenthefinaldeterminationofanycriminalprosecutionshallbesuchastorender
7thestateliableforcostsunderexistinglaws,itshallbethedutyofthesherifftocertifytothe
8clerkofthecircuitcourtorcourtofcommonpleasinwhichthecasewasdeterminedthetotal
9numberofdaysanyprisonerwhowasapartyinsuchcaseremainedinthecountyjail.Itshall
10bethedutyofthecountycommissiontosupplythecostperdiemforcountyprisonstothe
11clerkofthecircuitcourtonthefirstdayofeachyear,andthereafterwhenevertheamount
12maybechanged.Itshallthenbethedutyoftheclerkofthecourtinwhichthecasewas
13determinedtoincludeinthebillofcostagainstthestateallfeeswhichareproperly
14chargeabletothestate.Inanycitynotwithinacountyitshallbethedutyofthe
15superintendentofanyfacilityboardingprisonerstocertifytothechiefexecutiveofficerof
16suchcitynotwithinacountythetotalnumberofdaysanyprisonerwhowasapartyinsuch
17caseremainedinsuchfacility.Itshallbethedutyofthesuperintendentsofsuchfacilitiesto
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18supplythecostperdiemtothechiefexecutiveofficeronthefirstdayofeachyear,and
19thereafterwhenevertheamountmaybechanged.Itshallbethedutyofthechiefexecutive
20officertobillthestateallfeesforboardingsuchprisonerswhichareproperlychargeableto
21thestate.Thechiefexecutivemaybynotificationtothedepartmentofcorrectionsdelegate
22suchresponsibilitytoanotherdulyswornofficialofsuchcitynotwithinacounty.Theclerk
23ofthecourtofanycitynotwithinacountyshallnotincludesuchfeesinthebillofcosts
24chargeabletothestate.Thedepartmentofcorrectionsshallreviseitscriminalcostmanualin
25accordancewiththisprovision.
26 3.Exceptasprovidedundersubsection6ofsection217.718,theactualcosts
27chargeabletothestate,includingthoseincurredforaprisonerwhoisincarceratedinthe
28countyjailbecausetheprisoner'sparoleorprobationhasbeenrevokedorbecausethe
29prisonerhas,orallegedlyhas,violatedanyconditionoftheprisoner'sparoleorprobation,and
30suchparoleorprobationisaconsequenceofaviolationofastatestatute,ortheprisonerisa
31fugitivefromtheMissouridepartmentofcorrectionsorotherwiseheldattherequestofthe
32Missouridepartmentofcorrectionsregardlessofwhetherornotawarranthasbeenissued
33shallbetheactualcostofincarceration[nottoexceed] asfollows:
34 (1)UntilJuly1,1996,nottoexceedseventeendollarsperdayperprisoner;
35 (2)OnandafterJuly1,1996,nottoexceedtwentydollarsperdayperprisoner;
36 (3)OnandafterJuly1,1997,uptothirty-sevendollarsandfiftycentsperdayper
37prisoner,subjecttoappropriations; and
38 (4)OnandafterJuly1,2026,aminimumoffortydollarsperdayperprisoner,
39subjecttoappropriations.
40 4.Thepresidingjudgeofajudicialcircuitmayproposeexpensestobereimbursable
41bythestateonbehalfofoneormoreofthecountiesinthatcircuit.Proposedreimbursable
42expensesmayincludepretrialassessmentandsupervisionstrategiesfordefendantswhoare
43ultimatelyeligibleforstateincarceration.Acountymaynotreceivemorethanitsshareofthe
44amountappropriatedinthepreviousfiscalyear,inclusiveofexpensesproposedbythe
45presidingjudge.Anycountyshallconveysuchproposaltothedepartment,andanysuch
46proposalpresentedbyapresidingjudgeshallincludethedocumentedagreementwiththe
47proposalbythecountygoverningbody,prosecutingattorney,atleastoneassociatecircuit
48judge,andtheofficerofthecountyresponsibleforcustodyorincarcerationofprisonersof
49thecountyrepresentedintheproposal.Anycountythatdeclinestoconveyaproposaltothe
50department,pursuanttotheprovisionsofthissubsection,shallreceiveitsperdiemcostof
51incarcerationforallprisonerschargeabletothestateinaccordancewiththeprovisionsof
52subsections1,2,and3ofthissection.
