1212 304.016.1.Thefollowingrulesshallgoverntheovertakingandpassingofvehicles
1313 2proceedinginthesamedirection,subjecttothelimitationsandexceptionshereinafterstated:
1414 3 (1)Thedriverofavehicleovertakinganothervehicleproceedinginthesame
1515 4directionshallpasstotheleftthereofatasafedistanceandshallnotagaindrivetotheright
1616 5sideoftheroadwayuntilsafelyclearoftheovertakenvehicle;and
1717 6 (2)Exceptwhenovertakingandpassingontherightispermitted,thedriverofan
1818 7overtakenvehicleshallgivewaytotherightinfavoroftheovertakingvehicleandshallnot
1919 8increasethespeedofsuchdriver'svehicleuntilcompletelypassedbytheovertakingvehicle.

2727 16widthandclearlymarkedforfourormorelinesoftraffic.Thedriverofamotorvehiclemay
2828 17overtakeandpassanothervehicleupontherightonlyundertheforegoingconditionswhen
2929 EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
3030 intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18suchmovementmaybemadeinsafety.Innoeventshallsuchmovementbemadebydriving

3737 25visibleandisfreeofoncomingtrafficforasufficientdistanceaheadtopermitsuch
3838 26overtakingandpassingtobecompletelymadewithoutinterferingwiththesafeoperationof
3939 27anyvehicleapproachingfromtheoppositedirectionoranyvehicleovertaken.
4040 28 4.Novehicleshallatanytimebedriventotheleftsideoftheroadwayunderthe
4141 29followingconditions:
4242 30 (1)Whenapproachingthecrestofagradeoruponacurveofthehighwaywherethe
4343 31driver'sviewisobstructedwithinsuchdistanceastocreateahazardintheeventanother
4444 32vehiclemightapproachfromtheoppositedirection;
4545 33 (2)Whentheviewisobstructeduponapproachingwithinonehundredfeetofany
4646 34bridge,viaduct,tunnelorwhenapproachingwithinonehundredfeetoforatanyintersection
4747 35orrailroadgradecrossing;
4848 36 (3)Whenwithinadistanceofonethousandfeetofadrivewayentrancetoany
4949 37publicschoollocatedonafederalorstatehighway;exceptthatsuchrestrictionshallnot
5050 38applywithinthecorporatelimitsofanycity,town,orvillage.
5151 39 5.ViolationofthissectionshallbedeemedaclassCmisdemeanor.
