12	12	304.016.1.Thefollowingrulesshallgoverntheovertakingandpassingofvehicles
13	13	2proceedinginthesamedirection,subjecttothelimitationsandexceptionshereinafterstated:
14	14	3 (1)Thedriverofavehicleovertakinganothervehicleproceedinginthesame
15	15	4directionshallpasstotheleftthereofatasafedistanceandshallnotagaindrivetotheright
16	16	5sideoftheroadwayuntilsafelyclearoftheovertakenvehicle;and
17	17	6 (2)Exceptwhenovertakingandpassingontherightispermitted,thedriverofan
18	18	7overtakenvehicleshallgivewaytotherightinfavoroftheovertakingvehicleandshallnot
19	19	8increasethespeedofsuchdriver'svehicleuntilcompletelypassedbytheovertakingvehicle.
20	20	9 2.Thedriverofamotorvehiclemayovertakeandpasstotherightofanothervehicle
21	21	10onlyunderthefollowingconditions:
22	22	11 (1)Whenthevehicleovertakenismakingorabouttomakealeftturn;
23	23	12 (2)Uponacitystreetwithunobstructedpavementofsufficientwidthfortwoormore
24	24	13linesofvehiclesineachdirection;
25	25	14 (3)Uponaone-waystreet;
26	26	15 (4)Uponanyhighwayoutsideofacitywithunobstructedpavementofsufficient
27	27	16widthandclearlymarkedforfourormorelinesoftraffic.Thedriverofamotorvehiclemay
28	28	17overtakeandpassanothervehicleupontherightonlyundertheforegoingconditionswhen
29	29	EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
30	30	intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18suchmovementmaybemadeinsafety.Innoeventshallsuchmovementbemadebydriving
31	31	19offthepavedormaintraveledportionoftheroadway.Theprovisionsofthissubsectionshall
32	32	20notrelievethedriverofaslow-movingvehiclefromthedutytodriveascloselyaspracticable

34	34	22 3.Exceptwhenaroadwayhasbeendividedintothreetrafficlanes,novehicleshall
35	35	23bedriventotheleftsideofthecenterlineofahighwayorpublicroadinovertakingand
36	36	24passinganothervehicleproceedinginthesamedirectionunlesssuchleftsideisclearly
37	37	25visibleandisfreeofoncomingtrafficforasufficientdistanceaheadtopermitsuch
38	38	26overtakingandpassingtobecompletelymadewithoutinterferingwiththesafeoperationof
39	39	27anyvehicleapproachingfromtheoppositedirectionoranyvehicleovertaken.
40	40	28 4.Novehicleshallatanytimebedriventotheleftsideoftheroadwayunderthe
41	41	29followingconditions:
42	42	30 (1)Whenapproachingthecrestofagradeoruponacurveofthehighwaywherethe
43	43	31driver'sviewisobstructedwithinsuchdistanceastocreateahazardintheeventanother
44	44	32vehiclemightapproachfromtheoppositedirection;
45	45	33 (2)Whentheviewisobstructeduponapproachingwithinonehundredfeetofany
46	46	34bridge,viaduct,tunnelorwhenapproachingwithinonehundredfeetoforatanyintersection
47	47	35orrailroadgradecrossing;
48	48	36 (3)Whenwithinadistanceofonethousandfeetofadrivewayentrancetoany
49	49	37publicschoollocatedonafederalorstatehighway;exceptthatsuchrestrictionshallnot
50	50	38applywithinthecorporatelimitsofanycity,town,orvillage.
51	51	39 5.ViolationofthissectionshallbedeemedaclassCmisdemeanor.
