BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section304.016,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection304.016,toreadasfollows: 304.016.1.Thefollowingrulesshallgoverntheovertakingandpassingofvehicles 2proceedinginthesamedirection,subjecttothelimitationsandexceptionshereinafterstated: 3 (1)Thedriverofavehicleovertakinganothervehicleproceedinginthesame 4directionshallpasstotheleftthereofatasafedistanceandshallnotagaindrivetotheright 5sideoftheroadwayuntilsafelyclearoftheovertakenvehicle;and 6 (2)Exceptwhenovertakingandpassingontherightispermitted,thedriverofan 7overtakenvehicleshallgivewaytotherightinfavoroftheovertakingvehicleandshallnot 8increasethespeedofsuchdriver'svehicleuntilcompletelypassedbytheovertakingvehicle. 9 2.Thedriverofamotorvehiclemayovertakeandpasstotherightofanothervehicle 10onlyunderthefollowingconditions: 11 (1)Whenthevehicleovertakenismakingorabouttomakealeftturn; 12 (2)Uponacitystreetwithunobstructedpavementofsufficientwidthfortwoormore 13linesofvehiclesineachdirection; 14 (3)Uponaone-waystreet; 15 (4)Uponanyhighwayoutsideofacitywithunobstructedpavementofsufficient 16widthandclearlymarkedforfourormorelinesoftraffic.Thedriverofamotorvehiclemay 17overtakeandpassanothervehicleupontherightonlyundertheforegoingconditionswhen EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18suchmovementmaybemadeinsafety.Innoeventshallsuchmovementbemadebydriving 19offthepavedormaintraveledportionoftheroadway.Theprovisionsofthissubsectionshall 20notrelievethedriverofaslow-movingvehiclefromthedutytodriveascloselyaspracticable 21totheright-handedgeoftheroadway. 22 3.Exceptwhenaroadwayhasbeendividedintothreetrafficlanes,novehicleshall 23bedriventotheleftsideofthecenterlineofahighwayorpublicroadinovertakingand 24passinganothervehicleproceedinginthesamedirectionunlesssuchleftsideisclearly 25visibleandisfreeofoncomingtrafficforasufficientdistanceaheadtopermitsuch 26overtakingandpassingtobecompletelymadewithoutinterferingwiththesafeoperationof 27anyvehicleapproachingfromtheoppositedirectionoranyvehicleovertaken. 28 4.Novehicleshallatanytimebedriventotheleftsideoftheroadwayunderthe 29followingconditions: 30 (1)Whenapproachingthecrestofagradeoruponacurveofthehighwaywherethe 31driver'sviewisobstructedwithinsuchdistanceastocreateahazardintheeventanother 32vehiclemightapproachfromtheoppositedirection; 33 (2)Whentheviewisobstructeduponapproachingwithinonehundredfeetofany 34bridge,viaduct,tunnelorwhenapproachingwithinonehundredfeetoforatanyintersection 35orrailroadgradecrossing; 36 (3)Whenwithinadistanceofonethousandfeetofadrivewayentrancetoany 37publicschoollocatedonafederalorstatehighway;exceptthatsuchrestrictionshallnot 38applywithinthecorporatelimitsofanycity,town,orvillage. 39 5.ViolationofthissectionshallbedeemedaclassCmisdemeanor. ✔ HB212 2
