SectionA.Chapter167,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection167.192,toreadasfollows:
167.192.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Parent",astudent'sparent,guardian,orotherpersonhavingcontrolor
3custodyofthestudent;
4 (2)"Student",achildwhoisenrolledforthefirsttimeineitherkindergartenor
5gradeone.
6 2.Forthe2026-27schoolyearandallsubsequentschoolyears,eachpublic,
7private,parochial,orparishschoolshallconductahearingscreeningforeachstudentas
8providedinthissection.
9 3.(1)BeforeAugustfirstoftheschoolyearinwhichastudentisrequiredto
10receiveahearingscreeningunderthissection,theschoolboardshallprovidethe
11student'sparentwithinformationabouttheschooldistrict'shearingscreeningprogram.
12 (2)ThehearingscreeningshalloccurbeforeNovemberfirstoftheschoolyearin
13whichthehearingscreeningisrequiredtooccurunderthissection.
14 (3)Theschoolboardmay:
15 (a)Conductanyelementofthehearingscreeningprogram;
16 (b)Contractwithanyindividualorgovernmentalentitytoprovideanyelement
17ofthehearingscreeningprogram;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (c)Requestthestudent'sparenttoobtainanyelementofthehearingscreening
19programfromaproviderselectedbytheparent;or
20 (d)Providethehearingscreeningbyanycombinationofthemethodsdescribed
21inparagraphs(a)to(c)ofthissubdivision.
22 (4)Iftheboarditselfconductsthehearingscreeningorcontractsforthehearing
23screening,thehearingscreeningshallbeconductedasrequiredunderstatelaw.
24 (5)(a)Iftheschoolboardchoosestorequestthestudent'sparenttoobtainany
25elementofthehearingscreeningprogram,theschoolboardshallprovidealistof
26providerstothestudent'sparentwithinformationabouthearingscreeningservices
27availableinthecommunitytoparentswhocannotaffordsuchservices.
28 (b)Aparentrequestedtoobtainanyelementofthehearingscreeningprogram
29maysignawrittenstatementindicatingthattheparentdeclinesthehearingscreening
30fortheparent'sstudent.Uponreceivingthewrittenrequest,theschoolboardshall
31refrainfromconductingthehearingscreeningonthestudent.
32 4.Iftheresultsofthehearingscreeningrevealapossibleneedforspecial
33educationalservices,theschoolboardshallconductfurtherassessmentasrequired
34understatelaw.
35 5.Astudentshallbeexemptfromthehearingscreeningrequiredunderthis
36sectionifthestudent'sparentpresentstotheschoolboardacertificateorsimilar
37writtennoticethatthestudenthasbeenexaminedbyaregularlylicensedphysician
38duringthetwelvemonthsimmediatelyprecedingthedateofthehearingscreening
39requiredunderthissection.
40 6.Thedepartmentofelementaryandsecondaryeducation,inconsultationwith
41thedepartmentofhealthandseniorservices,shalldevelopamodelhearingscreening
42programthatsatisfiesallrequirementsofthissection.Aschooldistrictmayadoptor
43adaptsuchmodelpolicytoconductthehearingscreeningsrequiredunderthissection.
44 7.Thedepartmentofelementaryandsecondaryeducation,inconsultationwith
45thedepartmentofhealthandseniorservices,maypromulgateallnecessaryrulesand
46regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
47termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
48sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
49provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
50536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
51pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
52arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority

54andvoid.
