BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section644.021,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection644.021,toreadasfollows: 644.021.1.Thereisherebycreatedawatercontaminantcontrolagencytobeknown 2asthe"CleanWaterCommissionoftheStateofMissouri",whosedomicileforthepurposes 3ofsections644.006to644.141shallbedeemedtobethatofthedepartmentofnatural 4resources.Thecommissionshallconsistofsevenmembersappointedbythegovernorwith 5theadviceandconsentofthesenate.Nomorethanfourofthemembersshallbelongtothe 6samepoliticalparty.Allmembersshallberepresentativeofthegeneralinterestofthepublic 7andshallhaveaninterestinandknowledgeofconservationandtheeffectsandcontrolof 8watercontaminants.Atleasttwomembersshallbeknowledgeableconcerningtheneedsof 9agriculture,industryorminingandinterestedinprotectingtheseneedsinamannerconsistent 10withthepurposesofsections644.006to644.141.Atleastonemembershallbe 11knowledgeableconcerningtheneedsofpubliclyownedwastewatertreatmentworks.No 12morethanfourmembersshallrepresentthepublic.[Nomembershallreceive,orhave 13receivedduringtheprevioustwoyears,asignificantportionofhisorherincomedirectlyor 14indirectlyfrompermitholdersorapplicantsforapermitpursuanttoanyfederalwater 15pollutioncontrolactasamendedandasapplicabletothisstate.] Thecommissionshall 16establishrulesofprocedurethatspecifywhenmembersshallexemptthemselvesfrom 17participatingindiscussionsandfromvotingonissuesbeforethecommissionduetoa 18potentialconflictofinterest.AllmembersappointedonorafterAugust28,2002,shallhave EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19demonstratedaninterestandknowledgeaboutwaterquality.Allmembersappointedonor 20afterAugust28,2002,shallbequalifiedbyinterest,education,trainingorexperienceto 21provide,assessandevaluatescientificandtechnicalinformationconcerningwaterquality, 22financialrequirementsandtheeffectsofthepromulgationofstandards,rulesandregulations. 23Atthefirstmeetingofthecommissionandatyearlyintervalsthereafter,themembersshall 24selectfromamongthemselvesachairmanandavicechairman. 25 2.Themembers'termsofofficeshallbefouryearsanduntiltheirsuccessorsare 26selectedandqualified.Provided,however,thatthefirstthreemembersappointedshallserve 27atermoftwoyears,thenextthreemembersappointedshallserveatermoffouryears, 28thereafterallmembersappointedshallserveatermoffouryears.Thereisnolimitationon 29thenumberoftermsanyappointedmembermayserve.Ifavacancyoccursthegovernormay 30appointamemberfortheremainingportionoftheunexpiredtermcreatedbythevacancy. 31Thegovernormayremoveanyappointedmemberforcause.Themembersofthe 32commissionshallbereimbursedfortravelandotherexpensesactuallyandnecessarily 33incurredintheperformanceoftheirduties. 34 3.Thecommissionshallholdatleastfourregularmeetingseachyearandsuch 35additionalmeetingsasthechairmandeemsdesirableataplaceandtimetobefixedbythe 36chairman.Specialmeetingsmaybecalledbythreemembersofthecommissionupon 37deliveryofwrittennoticetoeachmemberofthecommission.Reasonablewrittennoticeof 38allmeetingsshallbegivenbythedirectortoallmembersofthecommission.Fourmembers 39ofthecommissionshallconstituteaquorum.Allpowersanddutiesconferredspecifically 40uponmembersofthecommissionshallbeexercisedpersonallybythemembersandnotby 41alternatesorrepresentatives.Allactionsofthecommissionshallbetakenatmeetingsopento 42thepublic.Anymemberabsentfromsixconsecutiveregularcommissionmeetingsforany 43causewhatsoevershallbedeemedtohaveresignedandthevacancyshallbefilled 44immediatelyinaccordancewithsubsection1ofthissection. ✔ HCSHB488 2
