84.012.Inallcitiesofthisstatenotwithinacounty,thecommoncouncilor
2municipalassemblyofsuchcitiesmaypassordinancesforpreservingorder;securing
3propertyandpersonsfromviolence,danger,ordestruction;protectingpublicand
4privateproperty;andpromotingtheinterestsandensuringthegoodgovernanceofthe
5cities,butnocharteramendmentorordinancesheretoforepassed,orthatmayhereafter
6bepassed,bythecommoncouncilormunicipalassemblyofthecities,orenactedby
7initiativepetition,shall,inanymanner,conflictorinterferewiththepowersorthe

9section84.020,norshallthecitiesoranyofficeroragentofthecorporationofthecities,
10orthemayorthereof,inanymannerimpede,obstruct,hinder,orinterferewiththe
11boardsofpolicecommissioners,oranyofficer,agent,orservantthereoforthereunder.
84.015.Venueforanycivilactioninvolvingtheboardofpolicecommissionersin
2theirofficialcapacity, establishedpursuanttosection84.020,shallbeappropriateinthe
3twenty-secondjudicialcircuit.
84.020.1.Inallcities[ofthisstatethatnowhave,ormayhereafterattain,a
2populationoffivehundredthousandinhabitantsorover]notwithinacounty, thereshallbe,
3andisherebyestablished,withinandforsaidcities,aboardofpolicecommissioners, to
4consistoffourcitizencommissioners,asprovidedinsections84.040to84.080,tobethe
5governingbodyofthepermanentpoliceforcepursuanttosection84.100,togetherwith
6themayorofsaidcitiesforthetimebeing,orwhosoevermaybeofficiallyactinginthat
7capacity,andsaidboardshallannuallyappointoneofitsmembersaspresident,[and]one
8memberwhoshallactasvicepresident[duringtheabsenceofthepresident], andone
9memberwhoshallactasboardsecretary; andsuchpresidentorvicepresidentshallbethe
10executiveofficeroftheboardandshallactforitwhentheboardisnotinsession.
11 2.Theboardshallconsistoffivecommissioners,oneofwhomisthemayorofa
12citynotwithinacounty,onecitizencommissionerappointedatthesolediscretionofthe
13governor,andthreecitizencommissionersappointedasprovidedundersubdivision(2)
14ofthissubsection.Citizencommissionersshallberesidentsofthecityfornotlessthan
15threeyearsprecedingtheirappointment.Exceptforthemayor,nocommissionershall
16benominatedfororholdanyotherelectiveorappointedpoliticaloffice.Ifanycitizen
17commissionerisnominatedfororelectedtoanyelectiveorappointedpoliticaloffice,
18suchcommissionershallforfeittheappointmentandshallimmediatelyvacatehisorher
19office.Themayorofacitynotwithinacountyshallautomaticallybeamemberofthe
20board,whiletheremaininginauguralcommissionersshallbeappointedasfollows:
21 (1)Onecitizencommissionertobeappointedatthesolediscretionofthe
22governor;and
23 (2)Theremainingthreecitizencommissionersshallbeappointedbythe
24governorfromthreeseparatepanelsofcandidatessubmittedtothegovernor,including
25onecandidatesubmittedbythemayorofacitynotwithinacountyanduptofour
26candidatessubmittedbythelocalfraternalorganizationsrepresentingtherankofpolice
27officerwithinthecitynotwithinacounty.Thenumberofcandidatessubmittedbythe
28localfraternalorganizationsshallbebasedononeselectionpertwohundredfiftytotal
29activemembersofwhichtheyrepresentfromtheSt.LouisMetropolitanPolice
30Department,nottoexceedatotalofthreeselectionsperorganization.
HB494	2 31 3.Anymemberoftheboardmayberemovedforcausewiththeapprovalofa
32majorityoftheotherboardmembers,butsuchmembershallfirstbepresentedwitha
33writtenstatementofthereasonsforremovalandshallhavetheopportunityfora
34hearingbytheboardtoestablishcauseforremoval.Thedecisionforremovalofa
35boardmemberisfinal.However,theremovedmembermayappealtheirremovaltothe
36twenty-secondjudicialcircuitcourt.
37 4.Amajorityoftheboardshallconstituteaquorumforthetransactionof
38business,butnoactionshallbetakenbytheboardordeemedvalidunlessthree
39concurringvotesarecast.
40 5.Theboardshallhavethepowertosummonandcompeltheattendanceof
41witnessesbeforetheboardandtocompeltheproductionofdocumentsandother
42evidence,whenevernecessaryinthedischargeofitsduties,andshallhavethepowerto
43administeroathsoraffirmationstoanypersonappearingorcalledbeforeit.
44 6.Theboardshallhavethefollowingpowersandduties:
45 (1)Toreceiveinputfromthechiefofpolice,inordertoformulateandapprove
46policiesgoverningtheoperationandconductofthepermanentpoliceforcepursuantto
47section84.100;
48 (2)Toappointasachiefofpoliceanypersonwhoshallberesponsibletothe
49boardforproperexecutionofthepolicies,duties,andresponsibilitiesestablishedbythe
50boardfortheadministrationofthepolicedepartment,andtoremovethechiefpursuant
51tosection106.273;
52 (3)Tohearanddetermineappealsfromthedecisionsofthechiefofpoliceon
53disciplinarymattersarisingwiththedepartment,pursuanttosection590.502;however,
54atthetimeoftheeffectivedateofthisactanduntilsuchtimeastheboardadoptsother
55investigativeanddisciplinarypoliciesandproceduresnotinconsistentwithsection
56590.502,disciplineandinvestigativeproceduresforcommissionedandcivilian

59conflictwithsection590.502,theboardshallcomplywiththerequirementsofsection
60590.502.Undernocircumstancesshalltheboardinitiallyorhereafteradopt
61investigativeanddisciplinaryproceduresthatdonotincludethesummaryhearing
62boardproceduresprovidedforinrule7ofthepolicemanualofthepolicedepartmentin
63effectasofNovember4,2013;
64 (4)Topromulgateamanualofrulesandregulationsforthequalificationsand
65conductofpersonnelofthepolicedepartmentanditsoperation;
66 (5)Tohavesuchotherpowersanddutieswithrespecttopoliceadministration
67andlawenforcementasprovidedbystatute;
HB494	3 68 (6)Toregulateandlicenseallprivatewatchmen,privatedetectives,andprivate
69policeservingoractinginthecityandnopersonshallactassuchwithoutfirsthaving
70obtainedsuchlicense.Penaltiesfortheviolationofregulationspromulgatedbythe
71boardunderthissubsectionshallbeprescribedbyordinance.
84.030.1.Beginningon[January9,1989,thegovernorofthestateofMissouri,by
2andwiththeadviceandconsentofthesenate,shallappointthefourcommissionersprovided
3forinsection84.020,andonecommissionershallbeappointedforatermofoneyear;one
4commissionershallbeappointedforatermoftwoyears;onecommissionershallbe
5appointedforatermofthreeyears;onecommissionershallbeappointedforatermoffour
6years] August28,2025,andnolaterthanSeptember28,2025,thefourcitizen
7commissionersshallbeappointedasprovidedundersection84.020andshallserveas
8follows:
9 (1)Onecitizencommissionerappointedbythegovernorshallserveforatermof
10oneyear;and
11 (2)Ofthethreeremainingcitizencommissionersselectedbythegovernor,one
12shallserveforatermoftwoyears,oneshallserveforatermofthreeyears,andone
13shallserveforatermoffouryears.

15Theirsuccessorsshalleachbeappointedforatermoffouryears,andsaidcommissioners
16shallholdofficefortheirtermofappointmentanduntiltheirsuccessorsshallhavebeen
17appointedandqualified.[Incaseofavacancyinsaidboardforanycausewhatsoever,itshall
18befilledbyappointmentfortheunexpiredterm,inthesamemannerasinthecaseoforiginal
19appointments.Thegovernorshallissuecommissionstothepersonssoappointed,designating
20thetimeforwhichtheyareappointedincasetheappointmentistofillanunexpiredterm
21occasionedbydeath,resignationoranyothercause,andwheneverthetermofofficeofany
22commissionerexpires,theappointmentofhissuccessorshallbeforfouryears.The
23commissionersnowholdingofficesunderexistinglawsinanycityofthisstatetowhich
24sections84.010to84.340applyaretoholdtheirofficesuntiltheexpirationoftheirterms,and
25theirsuccessorsaredulyappointedandqualified.]
26 2.Withtheexceptionofthecitizencommissionerappointedatthesolediscretion
27ofthegovernor,wheneveravacancyoccursonthecommissionthegovernorshallfillthe
28vacancyfortheunexpiredtermfromapanelofnamesdeterminedbytheformula
29establishedundersubsection2ofsection84.020.
84.040.The[said] citizencommissionersshallbe[citizens] residentsofthestateof
2Missouri,andshallhavebeenresidentsofthecitiesforaperiodof[four] threeyearsnext
3precedingtheirappointment;theyshall,exceptasspecifiedinsections84.020and84.030
4[and84.080], holdtheirofficesforfouryears,anduntiltheirrespectivesuccessorsshallhave
HB494	4 5beenappointedandqualified,andreceiveeachasalaryofonethousanddollarsperannum,
6payablemonthly;beforeenteringuponthedutiesoftheirsaidoffices,thesaidcommissioners
7andthesaidmayorshalltakeandsubscribebeforeacircuitorassociatecircuitjudgeofthe
8circuitcourtofjudicialcircuitinwhichsaidcitiesshallbelocated,ortheclerkthereof,the
9oathoraffirmationprescribedbytheConstitutionofthestateofMissouri,andshallalsotake
10andsubscribebeforethesamejudgeorclerkthefurtheroathoraffidavitthatinanyandevery
11appointmentorremovaltobemadebythemtoorfromthepoliceforcecreatedandtobe
12organizedbythemundersections[84.010to84.340] 84.012to84.342, theywillinnocase
13andundernopretextappointorremoveanypolicemanorofficerofpolice,orotherperson
14underthem,onaccountofthepoliticalopinionsofsuchpoliceofficerorotherperson,orfor
15anyothercauseorreasonthanthefitnessorunfitnessofsuchaperson,inthebestjudgment
16ofsuchcommissioners,fortheplaceforwhichheshallbeappointed,orfromtheplacefrom
17whichheshallberemoved.Thesaidoathsoraffirmationsshallberecordedandpreserved
18amongtherecordsofthesaidcircuitcourt.
84.060.1.Theboardshallappointasecretaryto[actassuchfor]stafftheboardof
2policecommissioners,tobeappointedinthesamemannerasotherofficers,andsuch
3appointmentshallbeadditionaltothenumberofboardappointmentshereinprovided.The
4secretaryshallserveatthepleasureoftheboard.
5 2.Thesalaryofthesecretaryoftheboardshallbedeterminedandfixedbytheboard
6ofpolicecommissioners,andnootherprovisionsofthischaptershallapplyinthe
7determinationoftheamountofthesalaryofthesecretary.
8 3.Everypersonappointedtoserveassecretaryshallbearesidentofthecity.
84.090.Thedutiesoftheboardsofpoliceherebycreatedshallbeasfollows:They
2shall,atalltimesofthedayandnight,withintheboundariesofsaidcities,aswellonwateras
3onland,
4 (1)Preservethepublicpeace,preventcrimeandarrestoffenders;
5 (2)Protecttherightsofpersonsandproperty;
6 (3)Guardthepublichealth;
7 (4)Preserveorderateverypublicelection,andatallpublicmeetingsandplaces,and
8onallpublicoccasions;
9 (5)Preventandremovenuisancesonallstreets,highways,watersandotherplaces;
10 (6)Provideaproperpoliceforceateveryfirefortheprotectionoffiremenand
11property;
12 (7)Protectemigrantsandtravelersatsteamboatlandingsandrailwaystations;
13 (8)SeethatalllawsrelatingtoelectionsandtotheobservanceofSunday,and
14regulatingpawnbrokers,gamblers,intemperance,lotteriesandlotterypolicies,vagrants,
15disorderlypersons,andthepublichealthareenforced;
HB494	5 16 (9)Theyshallalsoenforcealllawsandallordinancespassedorwhichmayhereafter
17bepassedbythecommoncouncilormunicipalassemblyofsaidcities,notinconsistentwith
18theprovisionsofsections[84.010to84.340] 84.012to84.342, oranyotherlawofthestate,
19whichmaybeproperlyenforceablebyapoliceforce;
20 (10)Incasetheyshallhaveanyreasontobelievethatanypersonwithinsaidcities
21intendstocommitanybreachesofthepeace,orviolationofthelawororderbeyondthecity
22limits,anypersonchargedwiththecommissionofcrimeinsaidcitiesandagainstwhom
23criminalprocessshallhaveissued,maybearresteduponthesameinanypartofthisstateby
24thepoliceforcecreatedorauthorizedbysections[84.010to84.340] 84.012to84.342;
25provided,however,thatbeforethepersonsoarrestedshallberemovedfromthecountyin
26whichsucharrestismadeheshallbetakenbeforesomejudge,towhomthepapers
27authorizingsucharrestshallbesubmitted;andthepersonsoarrestedshallnotberemoved
28fromsaidcounty,butshallforthwithbedischarged,unlesssuchjudgeshallendorseand
29approvesaidpapers;
30 (11)Thesaidpolicecommissioners,oreitherofthem,shallhavethepowerto
31administeroathsoraffirmationsinthepremises,toanypersonappearingorcalledbefore
32them;
33 (12)Theyshallalsohavethepowertosummonandcompeltheattendanceof
34witnessesbeforethem,wheneveritmaybenecessaryforthemoreeffectualdischargeoftheir
35duties.
84.100.Toenabletheboardstoperformthedutiesimposeduponthem,theyare
2herebyauthorizedandrequiredtoappoint,enrollandemploy[a]onlyonepermanentpolice
3forceforthecitieswhichtheyshallequipandarmastheymayjudgenecessary.[Exceptas
4providedbelow,thenumberofpatrolmentobeappointedshallnotbemorethanonethousand
5sixhundredeighty-threeofwhichnumbernotmorethantwohundredfiftyaretobe
6probationarypatrolmen.Anyincreaseinthenumberofpatrolmenauthorized,inadditionto
7thatprovidedforabove,shallbepermitteduponrecommendationbytheboardofpolice
8commissioners,withtheapprovalofthemunicipalboardofestimateandapportionment.The
9numberofturnkeystobeappointedshallbesixty-five,exceptthatforeachpatrolman
10hereafterpromoted,demoted,removed,resignedorotherwiseseparatedfromtheforce,an
11additionalturnkeymaybeappointed,butundernocircumstancesshallmorethanone
12hundredfiftyturnkeysbeappointed.Aseachadditionalturnkeyisappointed,themaximum
13numberofpatrolmentobeappointedshallbereducedaccordinglysothatwhenonehundred
14fiftyturnkeyshavebeenappointed,thenumberofpatrolmentobeappointedshallnotbe
15morethanonethousandfivehundredninety-eight.] Allpoliceofficersshallbehired,
16employed,orundercontractbythepermanentpoliceforce.Theboardmaycontinueto
17employasmanycommissionedpoliceofficers,probationarypoliceofficers,and
HB494	6 18noncommissionedcivilians,whichshallincludecitymarshalsandparkrangers,asit
19deemsnecessaryinordertoperformthedutiesimposeduponit.Theboardshall
20determinethenumberofpoliceofficersineachrank.Theboardshalldeterminethe
21termsofregularserviceforallmembersofthepermanentpoliceforceasprovidedby
22law.
84.120.1.Nopersonshallbeappointedoremployedas[policeman,turnkey,or]
2policeofficer[ofpolice] whoshallhavebeenconvictedof,oragainstwhomanyindictment
3maybepending,foranyoffense,thepunishmentofwhichmaybeconfinementinthe
4penitentiary;norshallanypersonbesoappointedwhoisnotofgoodcharacter,orwhoisnot
5acitizenoftheUnitedStates,orwhoisnotabletoreadandwritetheEnglishlanguage,or
6whodoesnotpossessordinaryphysicalstrengthandcourage.The[patrolmenandturnkeys]
7policeofficershereafterappointedshallservewhiletheyshallfaithfullyperformtheirduties
8andpossessmentalandphysicalabilityandbesubjecttoremovalonlyforcause[aftera
9hearingbytheboards,whoareherebyinvestedwiththejurisdictioninthepremises]
10pursuanttosection590.502.
11 2.Theboardshallhavethesolediscretionwhethertodelegateportionsofits
12jurisdictiontohearingofficers.Theboardshallretainfinalandultimateauthorityoversuch
13mattersandoverthepersontowhomthedelegationmaybemade.Inanyhearingbeforethe
14boardunderthissection,thememberinvolvedmaymakeapplicationtotheboardtowaivea
15hearingbeforetheboardandrequestthatahearingbeheldbeforeahearingofficer.
16 3.Nothinginthissectionorchaptershallbeconstruedtoprohibittheboardofpolice
17commissionersfromdelegatinganytaskrelatedtodisciplinarymatters,disciplinaryhearings,
18oranyotherhearingorproceedingwhichcouldotherwisebeheardbytheboardor
19concerninganydeterminationrelatedtowhetheranofficerisabletoperformthenecessary
20functionsoftheposition.Tasksrelatedtotheprecedingmattermaybedelegatedbytheboard
21toahearingofficerundertheprovisionsofsubsection4ofthissection.
22 4.(1)Thehearingofficertowhomadelegationhasbeenmadebytheboardmay,at
23thesolediscretionoftheboard,performcertainfunctions,includingbutnotlimitedtothe
24following:
25 (a)Presidingoveradisciplinarymatterfromitsinceptionthroughtothefinalhearing;
26 (b)Preparingareporttotheboardofpolicecommissioners;and
27 (c)Makingrecommendationstotheboardofpolicecommissionersastothe
28allegationsandtheappropriatenessoftherecommendeddiscipline.
29 (2)Theboardshallpromulgaterules,whichmaybechangedfromtimetotimeas
30determinedbytheboard,andshallmakesuchrulesknowntothehearingofficerorothers.
HB494	7 31 (3)Theboardshallatalltimesretaintheauthoritytorenderthefinaldecisionaftera
32reviewoftherelevantdocuments,evidence,transcripts,videotapedtestimony,orreport
33preparedbythehearingofficer.
34 5.Hearingofficersshallbeselectedinthefollowingmanner:
35 (1)Theboardshallestablishapanelofnotlessthanfivepersons,allwhoaretobe
36licensedattorneysingoodstandingwiththeMissouriBar.Thecompositionofthepanelmay
37changefromtimetotimeattheboard'sdiscretion;
38 (2)Fromthepanel,therelevantmemberorofficerandapolicedepartment
39representativeshallalternativelyandindependentlystrikenamesfromthelistwiththelast
40remainingnamebeingthedesignatedhearingofficer.Theboardshallestablishaprocessto
41beutilizedforeachhearingwhichwilldeterminewhichpartymakesthefirststrikeandthe
42processmaychangefromtimetotime;
43 (3)Afterthehearingofficerischosenandpresidesoveramatter,suchhearingofficer
44shallbecomeineligibleuntilallhearingofficerslistedhavebeenutilized,atwhichtimethe
45listshallrenew,subjecttoofficers'availability.
46 6.Nothinginthissectionshallbeconstruedtoauthorizetheboardofpolice
47commissionerstoremoveordischargeanychief,[asthattermisdefined] exceptasprovided
48insection106.273.
84.130.Theboardsmayreappointallmembersofthepoliceforcewhohave
2heretofore,orshallhereafter,resigntoenterthemilitaryserviceoftheUnitedStatesduring
3anywarinwhichtheUnitedStatesisengaged,withoutlossofrank,andwiththesameeffect
4asifanindefiniteleaveofabsencehadbeengrantedsuchmembers,uponconditionthatan
5applicationforsuchreappointmentshallbemadewithinninetydaysaftertheapplicant's
6dischargefrommilitaryserviceandthattheapplicantismentallyandphysicallyqualifiedfor
7policeduty.[Theboardsmaymakesuchreappointmentsnotwithstandingthatitmaycause
8thenumberofpolicemenemployedtotemporarilyexceedthenumberhereinauthorized.All
9necessaryreductionsinrankshallbemadetoenabletheboardstoreappointofficersabove
10therankofpatrolmenasaforesaidtotheendthatthenumberofsuchofficersshallnotexceed
11thatprovidedforinsection84.150.]
84.150.[Theofficersofthepoliceforceineachsuchcityshallbeasfollows:one
2chiefofpolicewiththerankofcolonel;lieutenantcolonels,nottoexceedfiveinnumberand
3othersuchranksandnumberofmemberswithinsuchranksastheboardfromtimetotime
4deemsnecessary.]Theofficersofthepoliceforceshallhavecommissionsissuedtothemby
5theboardsofpolicecommissioners,andthoseheretoforeandthosehereaftercommissioned
6shallservesolongastheyshallfaithfullyperformtheirdutiesandpossessthenecessary
7mentalandphysicalability,andbesubjecttoremovalonlyforcause[afterahearingbythe
HB494	8 8board,whoareherebyinvestedwithexclusivejurisdictioninthepremises] pursuantto
9section590.520.
84.160.1.AsofAugust28,[2006] 2025, theboardofpolicecommissionersshall
2havetheauthoritytocomputeandestablishtheannualsalaryofeachmemberofthepolice
3forcewithoutreceivingpriorauthorizationfromthegeneralassembly, whichshallnotbe
4lessthantheannualsalarypaidtoanymemberatthetimeoftheenactmentofthisact.
5 2.Eachofficerofpoliceandpatrolmanwhoseregularassignmentrequires
6nonuniformedattiremayreceive,inadditiontohisorhersalary,anallowancenottoexceed
7threehundredsixtydollarsperannumpayablebiweekly.Notwithstandingtheprovisionsof
8subsection1ofthissectiontothecontrary,noadditionalcompensationorcompensatorytime
9offforovertime,courttime,orstandbycourttimeshallbepaidorallowedtoanyofficerof
10therankof[sergeant] lieutenantorabove.Notwithstandinganyotherprovisionoflawtothe
11contrary,nothinginthissectionshallprohibitthepaymentofadditionalcompensation
12pursuanttothissubsectiontoofficersoftheranksofsergeantsandabove,providedthat
13fundingforsuchcompensationshallnot:
14 (1)Bepaidfromthegeneralfundsofeitherthecityortheboardofpolice
15commissionersofthecity;or
16 (2)Beviolativeofanyfederallaworotherstatelaw.
17 3.Itisthedutyofthemunicipalassemblyorcommoncouncilofthecitiestomake
18thenecessaryappropriationfortheexpensesofthemaintenanceofthepoliceforceinthe
19mannerhereinandhereafterprovided;provided,thatinnoeventshallsuchmunicipal
20assemblyorcommoncouncilberequiredtoappropriateforsuchpurposes(including,butnot
21limitedto,costsoffundingpensionsorretirementplans)foranyfiscalyearasuminexcessof
22anylimitationimposedbyarticleX,section21,MissouriConstitution;andprovidedfurther,
23thatsuchmunicipalassemblyorcommoncouncilmayappropriateasuminexcessofsuch
24limitationforanyfiscalyearbyanappropriationsordinanceenactedinconformitywiththe
25provisionsofthecharterofsuchcities.
26 4.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the
27boardofpolicecommissionersshallpayadditionalcompensationforallhoursofservice
28renderedbyprobationarypatrolmen[and],patrolmen, andsergeantsinexcessofthe
29establishedregularworkingperiod,andtherateofcompensationshallbeoneandone-half
30timestheregularhourlyrateofpaytowhicheachmembershallnormallybeentitled;except
31that,thecourttimeandcourtstandbytimeshallbepaidattheregularhourlyrateofpayto
32whicheachmembershallnormallybeentitled.Nocreditshallbegivenordeductionsmade
33frompaymentsforovertimeforthepurposeofretirementbenefits.
34 5.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,
35probationarypatrolmen[and], patrolmen, andsergeantsshallreceiveadditional
HB494	9 36compensationforauthorizedovertime,courttimeandcourtstandbytimewheneverthetotal
37accumulatedtimeexceedsfortyhours.Theaccumulatedfortyhoursshallbetakenas
38compensatorytimeoffattheofficer'sdiscretionwiththeapprovalofhissupervisor.
39 6.Theallowanceofcompensationorcompensatorytimeoffforcourtstandbytime
40shallbecomputedattherateofone-thirdofonehourforeachhourspentoncourtstandby
41time.
42 7.Theboardofpolicecommissioners[may] shalleffectprogramstoprovide
43additionalcompensationtoitsemployeesforsuccessfulcompletionofacademicworkatan
44accreditedcollegeoruniversity,inamountsnottoexceedtenpercentoftheiryearlysalaries
45orforfieldtrainingofficerandleadofficerresponsibilitiesinamountsnottoexceedthree
46percentoftheiryearlysalariesforfieldtrainingofficerresponsibilitiesandanadditionalthree
47percentoftheiryearlysalariesforleadofficerresponsibilities.Theboardmaydesignateup
48toonehundredfiftyemployeesasfieldtrainingofficersanduptofiftyemployeesaslead
49officers.
50 8.Theboardofpolicecommissioners:
51 (1)Shallprovideorcontractforlifeinsurancecoverageandforinsurancebenefits
52providinghealth,medicalanddisabilitycoverageforofficersandemployeesofthe
53department;
54 (2)Shallprovideorcontractforinsurancecoverageprovidingsalarycontinuation
55coverageforofficersandemployeesofthepolicedepartment;
56 (3)Shallprovidehealth,medical,andlifeinsurancecoverageforretiredofficersand
57employeesofthepolicedepartment.Health,medicalandlifeinsurancecoverageshallbe

65 9.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the
66boardofpolicecommissionersshallpayadditionalcompensationtomembersofthepolice
67forceuptoandincludingtherankofpoliceofficerforanyfullhourworkedbetweenthe
68hoursof11:00p.m.and7:00a.m.,inamountsequalto[five]tenpercentoftheofficer'sbase
69hourlypay.
70 10.Theboardofpolicecommissioners,fromtimetotimeandinitsdiscretion,may
71payadditionalcompensationtopoliceofficers,sergeantsandlieutenantsbypaying
72commissionedofficersintheaforesaidranksforaccumulated,unusedvacationtime.Any
HB494	10 73suchpaymentsshallbemadeinincrementsofnotlessthanfortyhours,andatrates
74equivalenttothebasestraight-timeratesbeingearnedbysaidofficersatthetimeofpayment;
75exceptthat,nosuchofficershallberequiredtoacceptpaymentforaccumulatedunused
76vacationtime.
84.170.1.Whenanyvacancyshalltakeplaceinanygradeofofficers,itshallbe
2filledfromthenextlowestgrade;provided,however,thatprobationarypatrolmenshallserve
3atleastsixmonthsassuchbeforebeingpromotedtotherankofpatrolman;patrolmenshall
4serveatleastthreeyearsassuchbeforebeingpromotedtotherankofsergeant;sergeants
5shallserveatleastoneyearassuchbeforebeingpromotedtotherankoflieutenant;
6lieutenantsshallserveatleastoneyearassuchbeforebeingpromotedtotherankofcaptain;
7andinnocaseshallthe[chiefor]assistantchiefbeselectedfrommennotmembersofthe
8forceorbelowthegradeofcaptain.Patrolmenshallserveatleastthreeyearsassuchbefore
9promotiontotherankofdetective;theinspectorshallbetakenfrommenintheranknot
10belowthegradeoflieutenant.
11 2.Theboardsofpoliceareherebyauthorizedtomakeallsuchrulesandregulations,
12notinconsistentwithsections[84.010to84.340] 84.012to84.342, orotherlawsofthestate,
13astheymayjudgenecessary,fortheappointment,employment,uniforming,discipline,trial
14andgovernmentofthepolice.Thesaidboardsshallalsohavepowertorequireofanyofficer
15orpolicemanbondwithsuretieswhentheymayconsideritdemandedbythepublicinterests.
16Alllawfulrulesandregulationsoftheboardshallbeobeyedbythepoliceforceonpainof
17dismissalorsuchlighterpunishment,eitherbysuspension,fine,reductionorforfeitureof
18pay,orotherwiseastheboardsmayadjudge.
19 [3.Theauthoritypossessedbytheboardofpoliceincludes,butisnotlimitedto,the
20authoritytodelegateportionsofitspowersauthorizedinsection84.120,includingpresiding
21overadisciplinaryhearing,toahearingofficerasdeterminedbytheboard.]
84.180.Noofficerofpoliceorpolicemanshallbeallowedtoreceiveanymoneyor
2gratuityorcompensationforanyservicehemayrenderwithouttheconsentofthesaid
3boards;andallsuchmoneysasanypolicemanorpoliceofficermaybesopermittedtoreceive
4shallbepaidovertotheboards,andtogetherwithalltheproceedsofallfines,forfeituresand
5unreclaimedpropertywhichmaycometothepossessionofsaidboards,ortoberecoveredby
6themundertheprovisionsofsections[84.010to84.340] 84.012to84.342, oranyotherlaw
7orordinance,shallbedisposedofinaccordancewithrulesadoptedbythesaidboards,subject
8totheprovisionsofthelawsofthisstatecontrollinganddirectingthedispensationofsuch

84.190.1.Theboardsofpolicecommissionersareherebyauthorizedtoprovide
2themselveswithsuchofficeandofficefurniture,andsuchclerksandsubordinatesasthey
3shallneed;andtohaveanduseacommonseal.Theymaydividesuchcitiesintonotmore

10accommodationsandthingsprovidedbysuchcities,fortheuseandserviceofthepolice,as
11fullyandtothesameextentasthesamearenowusedbyorforanypresentpolice,orasfully
12andtothesameextentasthesamemaybeusedbyanypoliceforceinanyofthecitiesto
13whichsections[84.010to84.340] 84.012to84.342mayhereafterapplyatthediscretionof
14theboard; andthemayorandcommoncouncilormunicipalassembly,andallpersonsand
15municipalofficersinchargethereof,areherebyorderedandrequiredtoallowsuchuse
16[accordingly] ofallfacilities,technology,andequipment. Incasethemayorandcommon
17councilormunicipalassemblyofanyofsuchcities,oritsofficersoragents,refuseorneglect
18toallowsuchuse,asandwheneverthesameshallberequiredbytheboardscreatedby
19sections[84.010to84.340] 84.012to84.342, orrefusetosetasideandappropriatethe
20revenuenecessarytocarryouttheprovisionsofsections[84.010to84.340] 84.012to84.342,
21orplaceobstructionsorhindrancesinthewayoftheproperdischargeofthepowersofsuch
22boards,theboardsmayapplytothecircuitcourtsofthejudicialcircuitinwhichsuchcities
23maybelocated,inthenameofthestate,foramandamustocompelacompliancewiththe
24provisionsofthissection,andtheapplicationthereofshallbeheardanddecidedbythecourt.
25Oneweek'snoticeoftheapplicationshallbegiven,andtherespondentorrespondentsshall
26havetherighttoanswerwithintheweek;andiftestimonybeneededoneitherside,thesame
27shallbetakenwithintendaysafterthesameisfiled,ortheweekshallbeexpired.Fromthe
28decisioninthecircuitcourtinthepremiseseitherpartymayappealwithintendays;andit
29shallbethedutyoftheclerkofsuchcourtstosenduptherecordimmediately,andtheappeal
30shallbeheardimmediatelybythesupremecourt,iftheninsession,andifnotinsession,at
31thenextterm.Inbothcourtsthecaseshallbetakenupandtriedinpreferencetoallothers.
84.200.Itshallbethedutyofthesheriffofthecountyorcityinwhichanyofthe
2citiestowhichsections[84.010to84.340] 84.012to84.342mayapplyshallbelocated,
3whenevercalledonforthatpurposebysaidboards,toactundertheircontrolforthe
4preservationofthepublicpeaceandquiet;and,iforderedbythemtodoso,heshallsummon
5thepossecomitatusforthatpurpose,andholdandemploysuchpossesubjecttotheir
6direction;whenevertheexigencyorcircumstancesmay,intheirjudgment,warrantit,thesaid
7boardsshallhavethepowertoassumethecontrolandcommandofallconservatorsofthe
8peaceofthecountyorcityinwhichanyofthecitiestowhichsections[84.010to84.340]

84.210.1.Itshallbethedutyofsaidboards,annuallyonorbeforethelastdayof
2Februaryofeachyeartoprepare,inwriting,onsuchformsasmaybeprescribedforbudget
3preparationpurposesbysuchcitiesfordepartmentsofcitygovernment,anestimateofthe
4sumofmoneywhichwillbenecessaryforthesubsequentfiscalyear,toenablethemto
5dischargethedutiesherebyimposeduponthem,andtomeettheexpensesofthepolice
6department.Suchestimateshallinclude,butnotbelimitedto,allreasonablyanticipated
7revenuesofsuchboardsfromallsourcesincluding,butnotlimitedto,grantsfromthefederal
8orstategovernments,governmentalagenciesorothergrantorsandforfeituresofpropertyand
9proceedsofforfeitedproperty,atableoforganization,lineitemsforpersonnel,supplies,
10maintenance,repairs,servicesandcontractualrequirements,andastatementcomparing
11receiptsandexpensesforthelastpriorfullfiscalyear,thecurrentfiscalyear,andthefiscal
12yeartowhichtheestimatepertains.Saidboardsshallforthwithcertifysuchestimatetothe
13boardofcommoncouncilormunicipalassembly,asthecasemaybe,ofsaidcities,whoare
14herebyrequiredtosetapartandappropriatetheamountsocertified,payableoutofthe
15revenueofsaidcities,afterhavingfirstdeductedtheamountnecessarytopaytheinterest
16upontheindebtednessofsaidcities,theamountnecessaryfortheexpensesofthecity
17hospitalandhealthdepartment,theamountnecessaryforlightingthecity,andanysum
18requiredbylawtobeplacedtothecreditofthesinkingfundofsaidcities.Duringafiscal
19yearforwhichanappropriationhasbeensomade,saidboardsshallnottransferfunds
20appropriatedforonelineitemofsuchappropriationtoanyotherlineitemwithouttheprior
21approvalofthemunicipalboardofestimateandapportionment.
22 2.Thesaidboardsofpolicecommissionersshallpassuponallclaimspresented
23againstthemfortheexpensesincurredinthedischargeoftheirdutiesashereinprovided,and
24shallcertify,bytheirpresidentandsecretary,allsuchclaimsasareentitledtopaymentandall
25salaryrollsforsalariesasprovidedinsections[84.010to84.340] 84.012to84.342, andsuch
26claimsandsalaryrolls,whensocertified,shallbedulyauditedandpaidbytheproper
27disbursingofficerorofficersofsaidcitieswithinfivedaysafterbeingaudited,outofany
28moneysinthecitytreasurynotappropriatedtothespecificpurposesaboveenumerated;
29provided,however,thattheamountofsaidclaimsandsalaryrollssocertifiedshallnot
30exceed,inanyoneyear,theamountso,asaforesaid,estimatedforthatyeartothecommon
31councilormunicipalassemblyofsaidcitiesaforesaid.Thecommoncouncilormunicipal

7anypoliceforceotherthantheonethereinprovidedfor,orwhodelaysorhindersthe
8dueenforcementofsections84.012to84.342byfailingorneglectingtoperformthe
9dutiesbysuchsectionsimposeduponhimorher,shallbesubjecttoapenaltyofone
10thousanddollarsforeachoffense,recoverablebytheboardsbyactionatlawinthe
11nameofthestate,andshallforeverthereafterbedisqualifiedfromholdingorexercising
12anyofficeoremploymentwhatsoeverunderthemayororcommoncouncilormunicipal

84.325.1.OnAugust28,2025,theboardofpolicecommissionersshallassume
2controlofanymunicipalpoliceforceestablishedwithinanycitynotwithinacounty,
3accordingtotheproceduresandrequirementsofthissectionandanyrulespromulgated
4undersubsection6ofthissection.Thepurposeoftheseproceduresandrequirementsis

6forceandprovideforanequitableemploymenttransitionforcommissionedandcivilian
7personnel.
8 2.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder
9subsection1ofthissection,anymunicipalpolicedepartmentwithinanycitynotwithin
10acountyshallconvey,assign,andotherwisetransfertotheboardtitleandownershipof
11allindebtednessandassets,including,butnotlimitedto,allfundsandrealandpersonal
12propertyheldinthenameoforcontrolledbythemunicipalpolicedepartment.The
13citiesshallexecutealldocumentsreasonablyrequiredtotransfer,convey,orassign
14ownershipandobligationsasprovidedherein.Suchcityshallthereafterceasethe
15operationofanypolicedepartmentorpoliceforce.
16 3.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder
17subsection1ofthissection,theboardshallacceptresponsibility,ownership,andliability
18assuccessor-in-interestforcontractualobligationsandotherlawfulobligationsofthe
19municipalpolicedepartment.
20 4.Theboardofpolicecommissionersshallinitiallyemploy,withoutareduction
21inrank,salary,orbenefits,allcommissionedandcivilianpersonnelofthemunicipal
22policedepartmentwhowereemployedbythemunicipalpolicedepartmentimmediately
23priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued
24yearsofservicethatsuchcommissionedandcivilianpersonnelhadwiththemunicipal
25policedepartment,aswellasallaccruedyearsofservicethatsuchcommissionedand
26civilianpersonnelhadpreviouslywiththeboardofpolicecommissioners.Such
27personnelshallbeentitledtonolessthantheholidays,vacation,sickleave,sickbonus
28time,andannualstep-increasestheywereentitledtoasemployeesofthemunicipal
29policedepartmentasofAugust28,2025.
30 5.Thecommissionedandcivilianpersonnelwhoretirefromservicewiththe
31municipalpolicedepartmentbeforetheboardofpolicecommissionersassumedcontrol
32ofthedepartmentundersubsection1ofthissectionshallcontinuetobeentitledtothe
33samepensionbenefitsprovidedasemployeesofthemunicipalpolicedepartmentand
34thesamebenefitssetforthinsubsection4ofthissection.Anypolicepensionsystem

84.340.Exceptasprovidedundersection590.750,thepolice[commissioner] chiefof
2thesaidcitiesshallhavepowertoregulateandlicenseallprivatewatchmen,private

29 immediatelypriortothedatethemunicipalpoliceforcewasestablished.Such
30 commissionedpersonnelwhopreviouslywereemployedbytheboardmay
31 onlybeinvoluntarilyterminatedbythecitynotwithinacountyforcause.The
32 cityshallalsorecognizeallaccruedyearsofservicethatsuchcommissioned
33 andcivilianpersonnelhadwiththeboardofpolicecommissioners.Such

45 8.Ifthecitynotwithinacountyelectstoestablishamunicipalpolice
46 forceunderthissection,thecityshallestablishaseparatedivisionforthe
47 operationofitsmunicipalpoliceforce.Thecivilservicecommissionofthe
48 citymayadoptrulesandregulationsappropriatefortheuniqueoperationofa
49 policedepartment.Suchrulesandregulationsshallreserveexclusive
50 authorityoverthedisciplinaryprocessandproceduresaffectingcommissioned
51 officerstothecivilservicecommission;however,untilsuchtimeasthecity
