232028,andthereafter,allpoliceofficersofthisstate,thesheriffandeachdeputysheriffof
24eachcounty,andthechieflawenforcementofficialofacitynotwithinacountyandhis
25orherofficersshallsubmitreferralsforanytrafficviolation,ordinanceviolation,or
26misdemeanororfelonyoffensereferredtoaprosecutingorcircuitattorneyintheform
27andmannerapprovedbytheMissouriofficeofprosecutionservicesasrequiredby
28subdivision(7)ofsubsection1ofsection56.750.Ataminimum,anyreferraltoa

35byanadult,thearrestingofficershalltakefingerprintsforthecentralrepository.These
36fingerprintsshallbetakenonfingerprintcardssuppliedbyorapprovedbythehighwaypatrol
37ortransmittedelectronicallyinaformatandmannerapprovedbythehighwaypatrolandin
38compliancewiththestandardssetbytheFederalBureauofInvestigationinitsAutomated
39FingerprintIdentificationSystemoritssuccessorprogram.Thefingerprintcardsshallbeso
40constructedthatthenameofthejuvenileshouldnotbemadeavailabletothecentral
41repository.Theindividual'snameandtheuniquenumberassociatedwiththefingerprintsand
42otherpertinentinformationshallbeprovidedtothecourtofjurisdictionbytheagencytaking
43thejuvenileintocustody.Thejuvenile'sfingerprintsandotherinformationshallbe
44forwardedtothecentralrepositoryandthecourtswithoutunduedelay.Thefingerprint
45informationfromthecardshallbecapturedandstoredintheautomatedfingerprint
46identificationsystemoperatedbythecentralrepository.Intheeventthefingerprintsare
47foundtomatchothertenprintsorunsolvedlatentprints,thecentralrepositoryshallnotifythe
48submittingagencywhoshallnotifythecourtofjurisdictionasperlocalagreement.Under
49section211.031,ininstanceswhereajuvenileoverfifteenandone-halfyearsofageisalleged
50tohaveviolatedastateormunicipaltrafficordinanceorregulation,whichdoesnotconstitute
51afelony,andthejuvenilecourtdoesnothavejurisdiction,thejuvenileshallnotbe
52fingerprintedunlesscertifiedasanadult.
53 [4.]5.Uponcertificationoftheindividualasanadult,thecertifyingcourtshallorder
54alawenforcementagencytoimmediatelyfingerprintandphotographtheindividualand
55certificationpaperswillbeforwardedtotheappropriatelawenforcementagencywiththe
56orderforfingerprinting.Thelawenforcementagencyshallsubmitsuchfingerprints,
57photograph,andcertificationpaperstothecentralrepositorywithinfifteendaysandshall
58furnishtheoffensecyclenumberassociatedwiththefingerprintstotheprosecutingattorney
59orthecircuitattorneyofacitynotwithinacountyandtotheclerkofthecourtorderingthe

7 (1)Develop,operateandmaintainaninformationsystemforthecollection,storage,
8maintenance,analysisandretrievalofcrimeincidentandarrestreportsfromMissourilaw
9enforcementagencies;

11BureauofInvestigationortheappropriateDepartmentofJusticeagencyinaccordancewith

13 (3)Providetheforms,formats,procedures,standardsandrelatedtrainingortraining
14assistancetoalllawenforcementagenciesinthestateasnecessaryforsuchagenciestoreport
15incidentandarrestactivityfortimelyinclusionintothestatewidesystem;
16 (4)Annuallypublishareportonthenatureandextentofcrimeandsubmitsuch
17reporttothegovernorandthegeneralassembly.Suchreportandotherstatisticalreportsshall
18bemadeavailabletostateandlocallawenforcementagenciesandthegeneralpublicthrough
19anelectronicormanualmedium;
20 (5)Maintaintheprivacyandsecurityofinformationinaccordancewithapplicable
21stateandfederallaws,regulationsandorders;and
22 (6)Establishsuchrulesandregulationsasarenecessaryforimplementingthe
23provisionsofthissection.Anyruleorportionofarule,asthattermisdefinedinsection
24536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecomeeffective
25onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
26section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
27vestedwiththegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate
28ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
29rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2000,shallbeinvalid
30andvoid.
31 3.Everylawenforcementagencyinthestateshall:
32 (1)Submitcrimeincidentreportstothedepartmentofpublicsafetyonformsorinthe
33formatprescribedbythedepartment;and
34 (2)Submitanyothercrimeincidentinformationwhichmayberequiredbythe
35departmentofpublicsafety, includinginformationpertainingtothecitizenor
36immigrationstatusofanypersonarrestedforanoffensethatisreportableunder
37section43.506.
38 4.AnylawenforcementagencythatviolatesthissectionafterDecember31,2021,
39maybeineligibletoreceivestateorfederalfundswhichwouldotherwisebepaidtosuch
40agencyforlawenforcement,safetyorcriminaljusticepurposes.
44.087.1.Thechieflawenforcementexecutiveforanylawenforcementagency,
2orsuchexecutive'sdesignee,mayrequestassistancefromalawenforcementagencyof
3anotherjurisdiction,includingajurisdictionoutsidethestateofMissouributwithinthe
4UnitedStates.
5 2.Ifalawenforcementofficermakesanarrestorapprehensionoutsidesuch
6officer'sjurisdiction,theoffendershallbedeliveredtothefirstavailablelaw

8made.Theofficermakingtheinitialarrestorapprehensionshallassistinthe
9preparationofanyaffidavitsfiledwiththecomplaintorbasedonotherevidencethat
10thereisprobablecausetobelievethatbothacrimehasbeencommittedandthe
11defendanthascommittedsuchcrime.
12 3.Forthepurposeofliability,workers'compensation,andanyother
13employment-relatedmatter,lawenforcementofficersremainemployeesoftheir
14respectivelawenforcementagencythroughoutanyrequestforassistance.Qualified
15immunity,sovereignimmunity,officialimmunity,andthepublicdutyruleshallapplyto
16theprovisionsofthissectionasinterpretedbythefederalandstatecourtsofthe
17respondingagency.
18 4.Nothinginthissectionshallbeconstruedtolimittheactionsoflaw
19enforcementofficersoragenciesconductedinaccordancewithsection44.095or44.098,
20oranyothermutualaidagreementmadeunderthischapter.
21 5.Theprovisionsofchapter544areapplicabletoanylawenforcementofficers
22fromjurisdictionslocatedoutsidethestateofMissouri,butwithintheUnitedStates,
23whoareactingpursuanttoarequestmadeunderthissection.
[56.265.1.Thecountyprosecutingattorneyinanycounty,otherthan
2 inacharteredcounty,shallreceiveanannualsalarycomputedusingthe
3 followingschedule,whenapplicable.Theassessedvaluationfactorshallbe
4 theamountthereofasshownfortheyearimmediatelyprecedingtheyearfor
5 whichthecomputationisdone.
6 (1)Forafull-timeprosecutortheprosecutorshallreceive
7 compensationequaltothecompensationofanassociatecircuitjudge;
8 (2)Forapart-timeprosecutor:

35 4.Theprosecutingattorneyofanycountywhichbecomesacountyof
36 thefirstclassificationduringafour-yeartermofofficeoracountywhich
37 passedthepropositionauthorizedbysubsection1ofsection56.363shallnot
38 berequiredtodevotefulltimetosuchofficepursuanttosection56.067until
39 thebeginningoftheprosecutingattorney'snexttermofofficeoruntilthe
40 propositionotherwisebecomeseffective.
41 5.Theprovisionsofsection56.066shallnotapplytofull-time

31 3.Eachcalendaryear,fivethousanddollarsofthesalaryshallbepayabletoany
32prosecutingattorneyonlyiftheprosecutingattorneyhascollectedthedatadescribedin
33subsection2ofsection56.750inamannerapprovedbytheprosecutorscoordinators
34trainingcouncilandmakesthedatadescribedinsubsection2ofsection56.750readily
35accessibletotheMissouriofficeofprosecutionservices.TheMissouriofficeof
36prosecutionservicesshallprovideacertificateofcompliancetoeachprosecuting
37attorneywhocomplieswiththissubsectionandshallsendalistofanycertified
38prosecutingattorneytotherespectivetreasurerofeachcountyorcitynotwithina
39county.

6issuedtothembytheboardsofpolicecommissioners,andthoseheretoforeandthose
7hereaftercommissionedshallservesolongastheyshallfaithfullyperformtheirdutiesand
8possessthenecessarymentalandphysicalability,andbesubjecttoremovalonlyforcause
9afterahearingbytheboard,whoareherebyinvestedwithexclusivejurisdictioninthe
10premises.
84.160.1.Asof[August28,2006] theeffectivedateofthisact,theboardofpolice
2commissionersshallhavetheauthoritytocomputeandestablishtheannualsalaryofeach
3memberofthepoliceforcewithoutreceivingpriorauthorizationfromthegeneralassembly,
4whichshallnotbelessthantheannualsalarypaidtoanymemberatthetimeofthe
5effectivedateofthisact.
6 2.Eachofficerofpoliceandpatrolmanwhoseregularassignmentrequires
7nonuniformedattiremayreceive,inadditiontohisorhersalary,anallowancenottoexceed
8threehundredsixtydollarsperannumpayablebiweekly.Notwithstandingtheprovisionsof
9subsection1ofthissectiontothecontrary,noadditionalcompensationorcompensatorytime
10offforovertime,courttime,orstandbycourttimeshallbepaidorallowedtoanyofficerof
11therankof[sergeant] lieutenantorabove.Notwithstandinganyotherprovisionoflawtothe
12contrary,nothinginthissectionshallprohibitthepaymentofadditionalcompensation
13pursuanttothissubsectiontoofficersoftheranksofsergeantsandabove,providedthat
14fundingforsuchcompensationshallnot:
15 (1)Bepaidfromthegeneralfundsofeitherthecityortheboardofpolice
16commissionersofthecity;or
17 (2)Beviolativeofanyfederallaworotherstatelaw.
18 3.Itisthedutyofthemunicipalassemblyorcommoncouncilofthecitiestomake
19thenecessaryappropriationfortheexpensesofthemaintenanceofthepoliceforcegoverned
20bytheboardofpolicecommissioners,inthemanner[hereinandhereafter] providedin
21section84.210;[ provided,thatinnoeventshallsuchmunicipalassemblyorcommoncouncil
22berequiredtoappropriateforsuchpurposes(including,butnotlimitedto,costsoffunding
23pensionsorretirementplans)foranyfiscalyearasuminexcessofanylimitationimposedby]
24except,pursuanttosubsection2ofsection21ofarticleX[,section21,]oftheMissouri
25Constitution[; andprovidedfurther,that],suchmunicipalassemblyorcommoncouncil[may]
26shallappropriateaminimumsum[inexcessofsuchlimitationforanyfiscalyearbyan
27appropriationsordinanceenactedinconformitywiththeprovisionsofthecharterofsuch
28cities] equaltothefollowingpercentagesofthecity'sgeneralrevenue:
29 (1)Twenty-twopercentfortheperiodendingDecember31,2025;
30 (2)Twenty-threepercentfortheperiodbeginningonJanuary1,2026,and
31endingonDecember31,2026;

41 4.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the
42boardofpolicecommissionersshallpayadditionalcompensationforallhoursofservice
43renderedbyprobationarypatrolmen[and],patrolmen, andsergeantsinexcessofthe
44establishedregularworkingperiod,andtherateofcompensationshallbeoneandone-half
45timestheregularhourlyrateofpaytowhicheachmembershallnormallybeentitled;except
46that,thecourttimeandcourtstandbytimeshallbepaidattheregularhourlyrateofpayto
47whicheachmembershallnormallybeentitled.Nocreditshallbegivenordeductionsmade
48frompaymentsforovertimeforthepurposeofretirementbenefits.
49 5.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,
50probationarypatrolmen[and], patrolmen, andsergeantsshallreceiveadditional
51compensationforauthorizedovertime,courttimeandcourtstandbytimewheneverthe
52totalaccumulatedtimeexceedsfortyhours.Theaccumulatedfortyhoursshallbetakenas
53compensatorytimeoffattheofficer'sdiscretionwiththeapprovalofhissupervisor.
54 6.Theallowanceofcompensationorcompensatorytimeoffforcourtstandbytime
55shallbecomputedattherateofone-thirdofonehourforeachhourspentoncourtstandby
56time.
57 7.Theboardofpolicecommissioners[may] shalleffectprogramstoprovide
58additionalcompensationtoitsemployeesforsuccessfulcompletionofacademicworkatan
59accreditedcollegeoruniversity,inamountsnottoexceedtenpercentoftheiryearlysalaries
60orforfieldtrainingofficerandleadofficerresponsibilitiesinamountsnottoexceedthree
61percentoftheiryearlysalariesforfieldtrainingofficerresponsibilitiesandanadditionalthree
62percentoftheiryearlysalariesforleadofficerresponsibilities.Theboardmaydesignateup
63toonehundredfiftyemployeesasfieldtrainingofficersanduptofiftyemployeesaslead
64officers.
65 8.Theboardofpolicecommissioners:

82forceuptoandincludingtherankofpoliceofficerforanyfullhourworkedbetweenthe
83hoursof11:00p.m.and7:00a.m.,inamountsequalto[five]tenpercentoftheofficer'sbase
84hourlypay.
85 10.Theboardofpolicecommissioners,fromtimetotimeandinitsdiscretion,may
86payadditionalcompensationtopoliceofficers,sergeantsandlieutenantsbypaying
87commissionedofficersintheaforesaidranksforaccumulated,unusedvacationtime.Any
88suchpaymentsshallbemadeinincrementsofnotlessthanfortyhours,andatrates
89equivalenttothebasestraight-timeratesbeingearnedbysaidofficersatthetimeofpayment;
90exceptthat,nosuchofficershallberequiredtoacceptpaymentforaccumulatedunused
91vacationtime.
84.170.1.Whenanyvacancyshalltakeplaceinanygradeofofficers,itshallbe
2filledfromthenextlowestgrade;provided,however,thatprobationarypatrolmenshallserve
3atleastsixmonthsassuchbeforebeingpromotedtotherankofpatrolman;patrolmenshall
4serveatleastthreeyearsassuchbeforebeingpromotedtotherankofsergeant;sergeants
5shallserveatleastoneyearassuchbeforebeingpromotedtotherankoflieutenant;
6lieutenantsshallserveatleastoneyearassuchbeforebeingpromotedtotherankofcaptain;
7andinnocaseshallthechieforassistantchiefbeselectedfrommennotmembersoftheforce
8orbelowthegradeofcaptain.Patrolmenshallserveatleastthreeyearsassuchbefore
9promotiontotherankofdetective;theinspectorshallbetakenfrommenintheranknot
10belowthegradeoflieutenant.
11 2.Theboardsofpoliceareherebyauthorizedtomakeallsuchrulesandregulations,
12notinconsistentwithsections84.010to84.340,orotherlawsofthestate,astheymayjudge
13necessary,fortheappointment,employment,uniforming,discipline,trialandgovernmentof
14thepolice.Atthetimeoftheeffectivedateofthisactanduntilsuchtimeastheboard

16section590.502,disciplineandinvestigativeproceduresforcommissionedandcivilian
17employeesofthepoliceforceshallberegulatedbyrule7ofthepolicemanualofthe
18policedepartmentineffectasofNovember4,2013;exceptthat,whererule7isin
19conflictwithsection590.502,theboardshallcomplywiththerequirementsofsection
20590.502.Undernocircumstancesshalltheboardinitiallyorhereafteradopt
21investigativeanddisciplinaryproceduresthatdonotincludethesummaryhearing
22boardproceduresprovidedforinrule7ofthepolicemanualofthepolicedepartmentin
23effectasofNovember4,2013.Thesaidboardsshallalsohavepowertorequireofany
24officerorpolicemanbondwithsuretieswhentheymayconsideritdemandedbythepublic
25interests.Alllawfulrulesandregulationsoftheboardshallbeobeyedbythepoliceforceon
26painofdismissalorsuchlighterpunishment,eitherbysuspension,fine,reductionor
27forfeitureofpay,orotherwiseastheboardsmayadjudge.
28 3.Theauthoritypossessedbytheboardofpoliceincludes,butisnotlimitedto,the
29authoritytodelegateportionsofitspowersauthorizedinsection84.120,includingpresiding
30overadisciplinaryhearing,toahearingofficerasdeterminedbytheboard.
84.225.Anyofficerorservantofthemayororcommoncouncilormunicipal
2assemblyofthecities,orotherpersonswhatsoever,whoforciblyresistsorobstructsthe

8undersubsection6ofthissectionandasdeterminedincoordinationwiththetransition
9director,localofficials,andtheboardofpolicecommissioners.Thepurposeofthese
10proceduresandrequirementsistoensurethecontinuityofoperationsofthemunicipal
11policeforcewithminimizeddisruptionstotheresidentsofanycitynotwithinacounty,
12toprovideforanorderlyandappropriatetransitioninthegovernanceofthepolice
13force,andtoprovideforanequitableemploymenttransitionforcommissionedand
14civilianpersonnel.
15 2.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder
16subsection1ofthissection,anymunicipalpolicedepartmentwithinanycitynotwithin
17acountyshallconvey,assign,andotherwisetransfertotheboardtitleandownershipof
18allindebtednessandassets,including,butnotlimitedto,allfundsandrealandpersonal
19propertyheldinthenameoforcontrolledbythemunicipalpolicedepartment.Such
20cityshallthereafterceasetheoperationofanypolicedepartmentorpoliceforce.
21 3.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder
22subsection1ofthissection,thestateshallacceptresponsibility,ownership,andliability
23assuccessor-in-interestforcontractualobligationsandotherlawfulobligationsofthe
24municipalpolicedepartment.
25 4.Theboardofpolicecommissionersshallinitiallyemploy,withoutareduction
26inrank,salary,orbenefits,allcommissionedandcivilianpersonnelofthemunicipal
27policedepartmentwhowereemployedbythemunicipalpolicedepartmentimmediately
28priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued
29yearsofservicethatsuchcommissionedandcivilianpersonnelhadwiththemunicipal
30policedepartment,aswellasallaccruedyearsofservicethatsuchcommissionedand
31civilianpersonnelhadpreviouslywiththeboardofpolicecommissioners.Such

26 commissionedandcivilianpersonneloftheboardofpolicecommissioners
27 createdundersections84.010to84.340thatwereemployedbytheboard
28 immediatelypriortothedatethemunicipalpoliceforcewasestablished.Such
29 commissionedpersonnelwhopreviouslywereemployedbytheboardmay
30 onlybeinvoluntarilyterminatedbythecitynotwithinacountyforcause.The
31 cityshallalsorecognizeallaccruedyearsofservicethatsuchcommissioned
32 andcivilianpersonnelhadwiththeboardofpolicecommissioners.Such
33 personnelshallbeentitledtothesameholidays,vacation,andsickleavethey
34 wereentitledtoasemployeesoftheboardofpolicecommissioners.
35 6.Commissionedandcivilianpersonnelofamunicipalpoliceforce
36 establishedunderthissectionshallnotbesubjecttoaresidencyrequirementof
37 retainingaprimaryresidenceinacitynotwithinacountybutmayberequired
38 tomaintainaprimaryresidencelocatedwithinaone-hourresponsetime.
39 7.Thecommissionedandcivilianpersonnelwhoretirefromservice
40 withtheboardofpolicecommissionersbeforetheestablishmentofa
41 municipalpoliceforceundersubsection1ofthissectionshallcontinuetobe
42 entitledtothesamepensionbenefitsprovidedunderchapter86andthesame
43 benefitssetforthinsubsection5ofthissection.
44 8.Ifthecitynotwithinacountyelectstoestablishamunicipalpolice
45 forceunderthissection,thecityshallestablishaseparatedivisionforthe
46 operationofitsmunicipalpoliceforce.Thecivilservicecommissionofthe
47 citymayadoptrulesandregulationsappropriatefortheuniqueoperationofa
48 policedepartment.Suchrulesandregulationsshallreserveexclusive
49 authorityoverthedisciplinaryprocessandproceduresaffectingcommissioned
50 officerstothecivilservicecommission;however,untilsuchtimeasthecity
51 adoptssuchrulesandregulations,thecommissionedpersonnelshallcontinue
52 tobegovernedbytheboardofpolicecommissioner'srulesandregulationsin
