12[or] 13 (2)Involuntarymanslaughterasaresultofoperatingamotorvehiclewhileinan 14intoxicatedconditionasdefinedinsection[565.024] 577.001; 15 (3)Twoormoreviolationsofstuntdrivingorstreettakeoverasprovidedin 16section304.145committedonseparateoccasionswhereineachviolationthepersonwas 17operatingavehicleandanotherpersonwasinjuredorkilled;or 18 (4)Theoffenseofaggravatedfleeingastopordetentionofamotorvehicleas 19providedinsection575.151. 20 21Suchforfeiturepursuanttothissubsectionshallonlybeallowedifsuchpersonoperatesa 22motorvehiclewhiletheperson'slicensetooperateamotorvehicleisundersuchasuspension 23orrevocation. 24 2.Theordinanceallowingforfeiturespursuanttothissectionmayalsoprovideforthe 25impoundmentandforfeitureofamotorvehicleoperatedbyanypersonwhoisclassifiedasa 26prioroffenderorpersistentoffenderpursuanttosection577.023aftertheeffectivedateof 27suchordinance,exceptthatajudgmentofforfeituremayonlyberenderedifthereisa 28convictionofanintoxication-relatedtrafficoffensewhichcausestheownerofthemotor 29vehicletobeclassifiedasapriororpersistentoffender. 30 3.Theordinanceallowingtheforfeiturespursuanttothissectionmayalsoprovidefor 31theimpoundmentandforfeitureofamotorvehicleoperatedbyanypersonwhohas 32previouslybeenconvictedoftwoormoreintoxication-relatedtrafficoffenses,asdefinedin 33section[577.023] 577.001, andwhothereafter,pursuanttoachemicaltestconductedin 34accordancewithsections577.020to577.041,isdetermineduponprobablecausetohavebeen 35drivingamotorvehiclewithablood-alcoholconcentrationequaltoorgreaterthantheblood- 36alcoholpercentageconcentrationspecifiedinsubsection1ofsection302.520,oranysuch 37personwho,pursuanttosection577.041,hasbeenrequestedtosubmittoachemicaltestas 38describedpursuanttothatsection,andrefusedtosubmittosuchtest. SS#2SCSHCS#2HB495 13 39 4.Allforfeitureproceedingspursuanttothissectionshallbeconductedinaccordance 40withsections513.600to513.645,excepttheforfeitureproceedingshallbebroughtbythe 41cityattorneyforthecitywhichenactedsuchordinances. 42 5.Theordinanceshallalsoprovidethatanypersonclaiminganownershipinterestin 43themotorvehiclesubjecttoforfeitureshallhaveallthedefensestotheforfeitureproceeding 44availabletothemwhichtheymaybeentitledtoraisepursuanttosections513.600to513.645. 45Theordinanceshallfurtherprovidethat,intheeventthetitledocumentsregisteredwiththe 46departmentofrevenueforthemotorvehiclesubjecttoforfeiture,atthetimeoftheaction 47givingrisetotheforfeitureproceeding,listpersonsasownersorco-ownersofthevehiclein 48additiontoorotherthantheoperator,andthenonoperatorownerofthemotorvehiclehasnot 49previouslybeentheoperatorortheownerof,amotorvehiclewhichhasbeenthesubjectofa 50forfeitureproceedingauthorizedbythissection,themotorvehicleshallbereturnedtothe 51nonoperatorregisteredownerandallcostsassociatedwiththeseizure,towing,storageand 52impoundmentofthevehicle,andthepaymentofallcourtcostsandreasonableattorneyfees 53associatedwiththeforfeitureproceedingshallbepaidbytheownersortheoperatorofthe 54vehicle.Tobeentitledtoreturnofthevehicleallownersshallexecuteawrittenagreement 55withthemunicipalitystipulatingandconsentingtotheseizureandforfeitureofthemotor 56vehicleintheeventsuchmotorvehicleissubsequentlyoperatedbythesameoperatorunder 57circumstanceswhichwouldallowthemunicipalitytoseekforfeitureofsuchvehiclepursuant 58toanordinanceauthorizedbythissection. 84.012.Inallcitiesofthisstatenotwithinacounty,thecommoncouncilor 2municipalassemblyofsuchcitiesmaypassordinancesforpreservingorder;securing 3propertyandpersonsfromviolence,danger,ordestruction;protectingpublicand 4privateproperty;andpromotingtheinterestsandensuringthegoodgovernanceofthe 5cities,butnoordinancesheretoforepassed,orthatmayhereafterbepassed,bythe 6commoncouncilormunicipalassemblyofthecitiesshall,inanymanner,conflictor 7interferewiththepowersortheexerciseofthepowersoftheboardsofpolice 8commissionersofthecitiesascreatedbysection84.020,norshallthecitiesoranyofficer 9oragentofthecorporationofthecities,orthemayorthereof,inanymannerimpede, 10obstruct,hinder,orinterferewiththeboardsofpolice,anyofficer,agent,orservant 11thereoforthereunder. 84.020.1.Inallcities[ofthisstatethatnowhave,ormayhereafterattain,a 2populationoffivehundredthousandinhabitantsorover]notwithinacounty, thereshallbe, 3andisherebyestablished,withinandforsaidcities,aboardofpolicecommissioners, to 4consistoffourcitizencommissioners,asprovidedinsections84.040to84.080,tobethe 5governingbodyofthepermanentpoliceforcepursuanttosection84.100,togetherwith 6themayorofsaidcitiesforthetimebeing,orwhosoevermaybeofficiallyactinginthat SS#2SCSHCS#2HB495 14 7capacity,andsaidboardshallannuallyappointoneofitsmembersaspresident,[and]one 8memberwhoshallactasvicepresident[duringtheabsenceofthepresident], andone 9memberwhoshallactasboardsecretary; andsuchpresidentorvicepresidentshallbethe 10executiveofficeroftheboardandshallactforitwhentheboardisnotinsession. 11 2.Theboardshallconsistofsixcommissioners,oneofwhomisthemayorofa 12citynotwithinacounty,fourcitizencommissioners,andonenonvotingcommissioner. 13Thenonvotingcommissionershallbearesidentofacitynotwithinacountyorshallbe 14aresidentofanycountyofthisstatethatadjoinsthecitylimitsofacitynotwithina 15countyandwhoownsrealpropertywithinacitynotwithinacountyandpaystaxeson 16suchrealproperty.Thenonvotingcommissionershallnotvoteonmattersbeforethe 17commission,butmaybecountedforpurposesofestablishingaquorumanddiscussion, 18includingdiscussioninanyclosedmeetingoftheboard.Eachcitizencommissioner 19shallbearesidentofacitynotwithinacountyfornolessthantwoyearsprecedinghis 20orherappointment.Exceptforthemayor,nocommissionershallbenominatedforor 21holdanyotherelectiveorappointedpoliticaloffice.Ifanycitizencommissioneris 22nominatedfororelectedtoanyelectiveorappointedpoliticaloffice,suchcommissioner 23shallforfeittheappointmentandshallimmediatelyvacatehisorheroffice.Themayor 24ofacitynotwithinacountyshallautomaticallybeamemberoftheboard,whilethe 25remainingcommissioners,includingthenonvotingcommissioner,shallbeappointedby 26thegovernor,withtheadviceandconsentofthesenate. 27 3.Anymemberoftheboard,exceptforthemayorofacitynotwithinacounty, 28mayberemovedforcausewiththeapprovalofamajorityoftheotherboardmembers, 29butsuchmembershallfirstbepresentedwithawrittenstatementofthereasonsfor 30removalandshallhavetheopportunityforahearingbytheboardtoestablishcausefor 31removal.Thedecisionforremovalofaboardmemberisfinal.However,theremoved 32membermayappealtheirremovaltothetwenty-secondjudicialcircuitcourt. 33 4.Amajorityoftheboardshallconstituteaquorumforthetransactionof 34business,butnoactionshallbetakenbytheboardordeemedvalidunlessthree 35concurringvotesarecast. 36 5.Theboardshallhavethepowertosummonandcompeltheattendanceof 37witnessesbeforetheboardandtocompeltheproductionofdocumentsandother 38evidence,whenevernecessaryinthedischargeofitsduties,andshallhavethepowerto 39administeroathsoraffirmationstoanypersonappearingorcalledbeforeit. 40 6.Theboardshallhavethefollowingpowersandduties: 41 (1)Toreceiveinputfromthechiefofpolice,inordertoformulateandapprove 42policiesgoverningtheoperationandconductofthepermanentpoliceforcepursuantto 43section84.100; 7 (2)Onecitizencommissionershall[beappointed] serveforatermoftwoyears; 8 (3)Onecitizencommissionershall[beappointed] serveforatermofthreeyears; 9and 10 (4)Onecitizencommissionershall[beappointed] serveforatermoffouryears. 11 SS#2SCSHCS#2HB495 16 12Thenonvotingcommissionershallbeappointedbythegovernorasprovidedin 13subsection2ofsection84.020andshallserveforatermoffouryears.Theirsuccessors 14shalleachbeappointedforatermoffouryears,andsaidcommissionersshallholdofficefor 15theirtermofappointmentanduntiltheirsuccessorsshallhavebeenappointedandqualified. 16[Incaseofavacancyinsaidboardforanycausewhatsoever,itshallbefilledbyappointment 17fortheunexpiredterm,inthesamemannerasinthecaseoforiginalappointments.The 18governorshallissuecommissionstothepersonssoappointed,designatingthetimeforwhich 19theyareappointedincasetheappointmentistofillanunexpiredtermoccasionedbydeath, 20resignationoranyothercause,andwheneverthetermofofficeofanycommissionerexpires, 21theappointmentofhissuccessorshallbeforfouryears.Thecommissionersnowholding 22officesunderexistinglawsinanycityofthisstatetowhichsections84.010to84.340apply 23aretoholdtheirofficesuntiltheexpirationoftheirterms,andtheirsuccessorsareduly 24appointedandqualified] 25 2.Wheneveravacancyoccursonthecommissionforacitizencommissioneror 26nonvotingcommissioner,thegovernormayfillthevacancyfortheunexpiredtermas 27providedinsubsection2ofsection84.020. 84.100.Toenabletheboardstoperformthedutiesimposeduponthem,theyare 2herebyauthorizedandrequiredtoappoint,enrollandemploy[a]onlyonepermanentpolice 3forceforthecitieswhichtheyshallequipandarmastheymayjudgenecessary.[Exceptas 4providedbelow,]Thenumberofpatrolmentobeappointedshall[notbemorethanone 5thousandsixhundredeighty-threeofwhichnumbernotmorethantwohundredfiftyaretobe 6probationarypatrolmen.Anyincreaseinthenumberofpatrolmenauthorized,inadditionto 7thatprovidedforabove,shallbepermitteduponrecommendation] bedeterminedbythe 8boardofpolicecommissioners[, withtheapprovalofthemunicipalboardofestimateand 9apportionment.Thenumberofturnkeystobeappointedshallbesixty-five,exceptthatfor 10eachpatrolmanhereafterpromoted,demoted,removed,resignedorotherwiseseparatedfrom 11theforce,anadditionalturnkeymaybeappointed,butundernocircumstancesshallmore 12thanonehundredfiftyturnkeysbeappointed.Aseachadditionalturnkeyisappointed,the 13maximumnumberofpatrolmentobeappointedshallbereducedaccordinglysothatwhen 14onehundredfiftyturnkeyshavebeenappointed,thenumberofpatrolmentobeappointed 15shallnotbemorethanonethousandfivehundredninety-eight]. Theboardmaycontinueto 16employasmanynoncommissionedpolicecivilians,whichshallincludecitymarshals 17andparkrangers,asitdeemsnecessaryinordertoperformthedutiesimposeduponit. 84.150.Thetotalnumberofofficersandthenumberofofficersateachrankof 2thepoliceforceineachsuchcityshallbe[asfollows:onechiefofpolicewiththerankof 3colonel;lieutenantcolonels,nottoexceedfiveinnumberandothersuchranksandnumberof 4memberswithinsuchranksastheboardfromtimetotimedeemsnecessary] determinedby SS#2SCSHCS#2HB495 17 5theboardofpolicecommissioners. Theofficersofthepoliceforceshallhavecommissions 6issuedtothembytheboardsofpolicecommissioners,andthoseheretoforeandthose 7hereaftercommissionedshallservesolongastheyshallfaithfullyperformtheirdutiesand 8possessthenecessarymentalandphysicalability,andbesubjecttoremovalonlyforcause 9afterahearingbytheboard,whoareherebyinvestedwithexclusivejurisdictioninthe 10premises. 84.160.1.Asof[August28,2006] theeffectivedateofthisact,theboardofpolice 2commissionersshallhavetheauthoritytocomputeandestablishtheannualsalaryofeach 3memberofthepoliceforcewithoutreceivingpriorauthorizationfromthegeneralassembly, 4whichshallnotbelessthantheannualsalarypaidtoanymemberatthetimeofthe 5effectivedateofthisact. 6 2.Eachofficerofpoliceandpatrolmanwhoseregularassignmentrequires 7nonuniformedattiremayreceive,inadditiontohisorhersalary,anallowancenottoexceed 8threehundredsixtydollarsperannumpayablebiweekly.Notwithstandingtheprovisionsof 9subsection1ofthissectiontothecontrary,noadditionalcompensationorcompensatorytime 10offforovertime,courttime,orstandbycourttimeshallbepaidorallowedtoanyofficerof 11therankof[sergeant] lieutenantorabove.Notwithstandinganyotherprovisionoflawtothe 12contrary,nothinginthissectionshallprohibitthepaymentofadditionalcompensation 13pursuanttothissubsectiontoofficersoftheranksofsergeantsandabove,providedthat 14fundingforsuchcompensationshallnot: 15 (1)Bepaidfromthegeneralfundsofeitherthecityortheboardofpolice 16commissionersofthecity;or 17 (2)Beviolativeofanyfederallaworotherstatelaw. 18 3.Itisthedutyofthemunicipalassemblyorcommoncouncilofthecitiestomake 19thenecessaryappropriationfortheexpensesofthemaintenanceofthepoliceforcegoverned 20bytheboardofpolicecommissioners,inthemanner[hereinandhereafter] providedin 21section84.210;[ provided,thatinnoeventshallsuchmunicipalassemblyorcommoncouncil 22berequiredtoappropriateforsuchpurposes(including,butnotlimitedto,costsoffunding 23pensionsorretirementplans)foranyfiscalyearasuminexcessofanylimitationimposedby] 24except,pursuanttosubsection2ofsection21ofarticleX[,section21,]oftheMissouri 25Constitution[; andprovidedfurther,that],suchmunicipalassemblyorcommoncouncil[may] 26shallappropriateaminimumsum[inexcessofsuchlimitationforanyfiscalyearbyan 27appropriationsordinanceenactedinconformitywiththeprovisionsofthecharterofsuch 28cities] equaltothefollowingpercentagesofthecity'sgeneralrevenue: 29 (1)Twenty-twopercentfortheperiodendingDecember31,2025; 30 (2)Twenty-threepercentfortheperiodbeginningonJanuary1,2026,and 31endingonDecember31,2026; SS#2SCSHCS#2HB495 18 32 (3)Twenty-fourpercentfortheperiodbeginningonJanuary1,2027,andending 33onDecember31,2027;and 34 (4)Twenty-fivepercentbeginningonJanuary1,2028,andforallsubsequent 35years; 36 37tofundthepoliceforcegovernedbytheboardofpolicecommissioners.Anypension 38andretirementcostsshallbeexcludedfromthecalculationofexpensesforthe 39maintenanceofthepoliceforceforthepurposesoftheminimumfundingrequirements 40providedinthissubsection. 41 4.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the 42boardofpolicecommissionersshallpayadditionalcompensationforallhoursofservice 43renderedbyprobationarypatrolmen[and],patrolmen, andsergeantsinexcessofthe 44establishedregularworkingperiod,andtherateofcompensationshallbeoneandone-half 45timestheregularhourlyrateofpaytowhicheachmembershallnormallybeentitled;except 46that,thecourttimeandcourtstandbytimeshallbepaidattheregularhourlyrateofpayto 47whicheachmembershallnormallybeentitled.Nocreditshallbegivenordeductionsmade 48frompaymentsforovertimeforthepurposeofretirementbenefits. 49 5.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary, 50probationarypatrolmen[and], patrolmen, andsergeantsshallreceiveadditional 51compensationforauthorizedovertime,courttimeandcourtstandbytimewheneverthe 52totalaccumulatedtimeexceedsfortyhours.Theaccumulatedfortyhoursshallbetakenas 53compensatorytimeoffattheofficer'sdiscretionwiththeapprovalofhissupervisor. 54 6.Theallowanceofcompensationorcompensatorytimeoffforcourtstandbytime 55shallbecomputedattherateofone-thirdofonehourforeachhourspentoncourtstandby 56time. 57 7.Theboardofpolicecommissioners[may] shalleffectprogramstoprovide 58additionalcompensationtoitsemployeesforsuccessfulcompletionofacademicworkatan 59accreditedcollegeoruniversity,inamountsnottoexceedtenpercentoftheiryearlysalaries 60orforfieldtrainingofficerandleadofficerresponsibilitiesinamountsnottoexceedthree 61percentoftheiryearlysalariesforfieldtrainingofficerresponsibilitiesandanadditionalthree 62percentoftheiryearlysalariesforleadofficerresponsibilities.Theboardmaydesignateup 63toonehundredfiftyemployeesasfieldtrainingofficersanduptofiftyemployeesaslead 64officers. 65 8.Theboardofpolicecommissioners: 66 (1)Shallprovideorcontractforlifeinsurancecoverageandforinsurancebenefits 67providinghealth,medicalanddisabilitycoverageforofficersandemployeesofthe 68department; SS#2SCSHCS#2HB495 19 69 (2)Shallprovideorcontractforinsurancecoverageprovidingsalarycontinuation 70coverageforofficersandemployeesofthepolicedepartment; 71 (3)Shallprovidehealth,medical,andlifeinsurancecoverageforretiredofficersand 72employeesofthepolicedepartment.Health,medicalandlifeinsurancecoverageshallbe 73madeavailableforpurchasetothespousesordependentsofdeceasedretiredofficersand 74employeesofthepolicedepartmentwhoreceivepensionbenefitspursuanttosections86.200 75to86.364attheratethatsuchdependent'sorspouse'scoveragewouldcostunderthe 76appropriateplanifthedeceasedwereliving; 77 (4)Maypayanadditionalshiftdifferentialcompensationtomembersofthepolice 78forceforeveningandnighttourofdutyinanamountnottoexceedtenpercentoftheofficer's 79basehourlyrate. 80 9.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the 81boardofpolicecommissionersshallpayadditionalcompensationtomembersofthepolice 82forceuptoandincludingtherankofpoliceofficerforanyfullhourworkedbetweenthe 83hoursof11:00p.m.and7:00a.m.,inamountsequalto[five]tenpercentoftheofficer'sbase 84hourlypay. 85 10.Theboardofpolicecommissioners,fromtimetotimeandinitsdiscretion,may 86payadditionalcompensationtopoliceofficers,sergeantsandlieutenantsbypaying 87commissionedofficersintheaforesaidranksforaccumulated,unusedvacationtime.Any 88suchpaymentsshallbemadeinincrementsofnotlessthanfortyhours,andatrates 89equivalenttothebasestraight-timeratesbeingearnedbysaidofficersatthetimeofpayment; 90exceptthat,nosuchofficershallberequiredtoacceptpaymentforaccumulatedunused 91vacationtime. 84.170.1.Whenanyvacancyshalltakeplaceinanygradeofofficers,itshallbe 2filledfromthenextlowestgrade;provided,however,thatprobationarypatrolmenshallserve 3atleastsixmonthsassuchbeforebeingpromotedtotherankofpatrolman;patrolmenshall 4serveatleastthreeyearsassuchbeforebeingpromotedtotherankofsergeant;sergeants 5shallserveatleastoneyearassuchbeforebeingpromotedtotherankoflieutenant; 6lieutenantsshallserveatleastoneyearassuchbeforebeingpromotedtotherankofcaptain; 7andinnocaseshallthechieforassistantchiefbeselectedfrommennotmembersoftheforce 8orbelowthegradeofcaptain.Patrolmenshallserveatleastthreeyearsassuchbefore 9promotiontotherankofdetective;theinspectorshallbetakenfrommenintheranknot 10belowthegradeoflieutenant. 11 2.Theboardsofpoliceareherebyauthorizedtomakeallsuchrulesandregulations, 12notinconsistentwithsections84.010to84.340,orotherlawsofthestate,astheymayjudge 13necessary,fortheappointment,employment,uniforming,discipline,trialandgovernmentof 14thepolice.Atthetimeoftheeffectivedateofthisactanduntilsuchtimeastheboard SS#2SCSHCS#2HB495 20 15adoptsotherinvestigativeanddisciplinarypoliciesandproceduresnotinconsistentwith 16section590.502,disciplineandinvestigativeproceduresforcommissionedandcivilian 17employeesofthepoliceforceshallberegulatedbyrule7ofthepolicemanualofthe 18policedepartmentineffectasofNovember4,2013;exceptthat,whererule7isin 19conflictwithsection590.502,theboardshallcomplywiththerequirementsofsection 20590.502.Undernocircumstancesshalltheboardinitiallyorhereafteradopt 21investigativeanddisciplinaryproceduresthatdonotincludethesummaryhearing 22boardproceduresprovidedforinrule7ofthepolicemanualofthepolicedepartmentin 23effectasofNovember4,2013.Thesaidboardsshallalsohavepowertorequireofany 24officerorpolicemanbondwithsuretieswhentheymayconsideritdemandedbythepublic 25interests.Alllawfulrulesandregulationsoftheboardshallbeobeyedbythepoliceforceon 26painofdismissalorsuchlighterpunishment,eitherbysuspension,fine,reductionor 27forfeitureofpay,orotherwiseastheboardsmayadjudge. 28 3.Theauthoritypossessedbytheboardofpoliceincludes,butisnotlimitedto,the 29authoritytodelegateportionsofitspowersauthorizedinsection84.120,includingpresiding 30overadisciplinaryhearing,toahearingofficerasdeterminedbytheboard. 84.225.Anyofficerorservantofthemayororcommoncouncilormunicipal 2assemblyofthecities,orotherpersonswhatsoever,whoforciblyresistsorobstructsthe 3executionorenforcementofanyoftheprovisionsofsections84.012to84.340orrelating 4tothesame,orwhodisbursesorfailstodisburseanymoneyinviolationthereof,orwho 5hindersorobstructstheorganizationormaintenanceoftheboardofpolice 6commissionersorthepoliceforcethereinprovidedtobeorganizedandmaintained, 7orwhomaintainsorcontrolsanypoliceforceotherthantheonethereinprovidedfor,or 8whodelaysorhindersthedueenforcementofsections84.012to84.340byfailingor 9neglectingtoperformthedutiesbysuchsectionsimposeduponhimorher,shallbe 10subjecttoapenaltyofonethousanddollarsforeachoffense,recoverablebytheboard 11byactionatlawinthenameofthestate,andshallforeverthereafterbedisqualified 12fromholdingorexercisinganyofficeoremploymentwhatsoeverunderthemayoror 13commoncouncilormunicipalassemblyofsuchcities,orundersections84.012to 1484.340;providedthat,nothinginthissectionshallbeconstruedtointerferewiththe 15punishment,underanyexistingoranyfuturelawsofthisstate,ofanycriminaloffense 16thatiscommittedbythepartiesinorabouttheresistance,obstruction,hindrance, 17conspiracy,combination,ordisbursementaforesaid. 84.325.1.Atransitiondirectorshallbeappointedbythegovernortoensure 2oversightofanorderlytransitionofthecontrolofanymunicipalpoliceforcefromany 3citynotwithinacountytotheboardofpolicecommissioners.Theimplementation 4periodshallbeginontheeffectivedateofthisact,andendnolaterthanJuly1,2026. SS#2SCSHCS#2HB495 21 5Theboardofpolicecommissionersshallassumecontrolofanymunicipalpoliceforce 6establishedwithinanycitynotwithinacountyduringtheimplementationperiod, 7accordingtotheproceduresandrequirementsofthissectionandanyrulespromulgated 8undersubsection6ofthissectionandasdeterminedincoordinationwiththetransition 9director,localofficials,andtheboardofpolicecommissioners.Thepurposeofthese 10proceduresandrequirementsistoensurethecontinuityofoperationsofthemunicipal 11policeforcewithminimizeddisruptionstotheresidentsofanycitynotwithinacounty, 12toprovideforanorderlyandappropriatetransitioninthegovernanceofthepolice 13force,andtoprovideforanequitableemploymenttransitionforcommissionedand 14civilianpersonnel. 15 2.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 16subsection1ofthissection,anymunicipalpolicedepartmentwithinanycitynotwithin 17acountyshallconvey,assign,andotherwisetransfertotheboardtitleandownershipof 18allindebtednessandassets,including,butnotlimitedto,allfundsandrealandpersonal 19propertyheldinthenameoforcontrolledbythemunicipalpolicedepartment.Such 20cityshallthereafterceasetheoperationofanypolicedepartmentorpoliceforce. 21 3.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 22subsection1ofthissection,thestateshallacceptresponsibility,ownership,andliability 23assuccessor-in-interestforcontractualobligationsandotherlawfulobligationsofthe 24municipalpolicedepartment. 25 4.Theboardofpolicecommissionersshallinitiallyemploy,withoutareduction 26inrank,salary,orbenefits,allcommissionedandcivilianpersonnelofthemunicipal 27policedepartmentwhowereemployedbythemunicipalpolicedepartmentimmediately 28priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued 29yearsofservicethatsuchcommissionedandcivilianpersonnelhadwiththemunicipal 30policedepartment,aswellasallaccruedyearsofservicethatsuchcommissionedand 31civilianpersonnelhadpreviouslywiththeboardofpolicecommissioners.Such 32personnelshallbeentitledtothesameholidays,vacation,sickleave,sickbonustime, 33andannualstep-increasestheywereentitledtoasemployeesofthemunicipalpolice 34department. 35 5.Thecommissionedandcivilianpersonnelwhoretirefromservicewiththe 36municipalpolicedepartmentbeforetheboardofpolicecommissionersassumedcontrol 37ofthedepartmentundersubsection1ofthissectionshallcontinuetobeentitledtothe 38samepensionbenefitsprovidedasemployeesofthemunicipalpolicedepartmentand 39thesamebenefitssetforthinsubsection4ofthissection.Anypolicepensionsystem 40createdunderchapter86forthebenefitofapoliceforceestablishedundersections 4184.012to84.340shallcontinuetobegovernedbychapter86andshallapplytoany SS#2SCSHCS#2HB495 22 42comprehensivepolicingplanandanypoliceforceestablishedundersections84.012to 4384.340.Otherthananyprovisionthatmakeschapter86applicabletoamunicipal 44policeforceestablishedundersections84.343to84.346,nothinginsections84.012to 4584.340shallbeconstruedaslimitingorchangingtherightsorbenefitsprovidedunder 46chapter86. 47 6.Theboardofpolicecommissionersmaypromulgateallnecessaryrulesand 48regulationsfortheimplementationandadministrationofthissection.Anyruleor 49portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe 50authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis 51subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This 52sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 53generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 54disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 55rulemakingauthorityandanyruleproposedoradoptedaftertheeffectivedateofthis 56sectionshallbeinvalidandvoid. 105.726.1.Nothinginsections105.711to105.726shallbeconstruedtobroadenthe 2liabilityofthestateofMissouribeyondtheprovisionsofsections537.600to537.610,norto 3abolishorwaiveanydefenseatlawwhichmightotherwisebeavailabletoanyagency, 46 (2)Theperson'sprevioushistoryofdomesticviolence; 47 (3)Theperson'shistoryofothercriminalacts,ifany; 48 (4)Whetherthepersonhasaccesstoaweapon; 49 (5)Whetherthepersonhasthreatenedsuicideorhomicide; 50 (6)Whetherthepersonhasahistoryofmentalillnessorhasbeencivillycommitted; SS#2SCSHCS#2HB495 48 9 2.TheoffenseoftamperingwithawatersupplyisaclassEfelonywhentheoffense 10isaviolationofsubdivision(1)ofsubsection1ofthissectionandisaclassA 11misdemeanorwhentheoffenseisaviolationofsubdivision(2)ofsubsection1ofthis 12section. 590.040.1.ThePOSTcommissionshallsettheminimumnumberofhoursofbasic 2trainingforlicensureasapeaceofficernolowerthansixhundred,withthefollowing 3exceptions: 4 (1)Uptoonethousandhoursmaybemandatedforanyclassoflicenserequiredfor 5commissionbyastatelawenforcementagency; 6 (2)Asfewasonehundredtwentyhoursmaybemandatedforanyclassoflicense 7restrictedtocommissionasareservepeaceofficerwithpolicepowerslimitedtothe 8commissioningpoliticalsubdivision; 9 (3)PersonsvalidlylicensedonAugust28,2001,mayretainlicensurewithout 10additionalbasictraining; 11 (4)Personslicensedandcommissionedwithinacountyofthethirdclassification 12beforeJuly1,2002,mayretainlicensurewithonehundredtwentyhoursofbasictrainingif 13thecommissioningpoliticalsubdivisionhasadoptedanorderorordinancetothateffect; 14 (5)PersonsservingasareserveofficeronAugust27,2001,withinacountyofthe 15firstclassificationoracountywithacharterformofgovernmentandwithmorethanone 16millioninhabitantsonAugust27,2001,havingpreviouslycompletedaminimumofone 17hundredsixtyhoursoftraining,shallbegrantedalicensenecessarytofunctionasareserve 18peaceofficeronlywithinsuchcounty.Forthepurposesofthissubdivision,theterm"reserve 19officer"shallmeananypersonwhoservesinalessthanfull-timelawenforcementcapacity, 20withorwithoutpayandwho,withoutcertification,hasnopowerofarrestandwho,without 21certification,mustbeunderthedirectandimmediateaccompanimentofacertifiedpeace 22officerofthesameagencyatalltimeswhileonduty;and 23 (6)ThePOSTcommissionshallprovidefortherecognitionofbasictrainingreceived 24atlawenforcementtrainingcentersofotherstates,themilitary,thefederalgovernmentand 25territoriesoftheUnitedStatesregardlessofthenumberofhoursincludedinsuchtrainingand 26shallhaveauthoritytorequiresupplementaltrainingasaconditionofeligibilityforlicensure. 27 2.Thedirectorshallhavetheauthoritytolimitanyexceptionprovidedinsubsection 281ofthissectiontopersonsremaininginthesamecommissionortransferringtoacommission 29inasimilarjurisdiction. 30 3.Thebasictrainingofeverypeaceofficer,exceptagentsoftheconservation 31commission,shallincludeatleastthirtyhoursoftrainingintheinvestigationand 32managementofcasesinvolvingdomesticandfamilyviolence.Suchtrainingshallinclude 33instruction,specifictodomesticandfamilyviolencecases,regarding:reportwriting; SS#2SCSHCS#2HB495 49 34physicalabuse,sexualabuse,childfatalitiesandchildneglect;interviewingchildrenand 35allegedperpetrators;thenature,extentandcausesofdomesticandfamilyviolence;thesafety 36ofvictims,otherfamilyandhouseholdmembersandinvestigatingofficers;legalrightsand 37remediesavailabletovictims,includingrightstocompensationandtheenforcementofcivil 38andcriminalremedies;servicesavailabletovictimsandtheirchildren;theeffectsofcultural, 39racialandgenderbiasinlawenforcement;andstatestatutes.Saidcurriculumshallbe 40developedandpresentedinconsultationwiththedepartmentofhealthandseniorservices,the 41children'sdivision,publicandprivateprovidersofprogramsforvictimsofdomesticand 42familyviolence,personswhohavedemonstratedexpertiseintrainingandeducation 43concerningdomesticandfamilyviolence,andtheMissouricoalitionagainstdomestic 44violence. 45 4.ThebasictrainingofeverypeaceofficerfirstlicensedonorafterAugust28, 462027,shallincludeatleastsixhoursoftrainingconcerningtheprohibitionagainstracial 47profilingandsuchtrainingshallpromoteunderstandingandrespectforracialand 48culturaldifferencesandtheuseofeffective,noncombativemethodsforcarryingoutlaw 49enforcementdutiesinaraciallyandculturallydiverseenvironment.Suchtrainingshall 50includetwohoursofracialprofilingtraining,twohoursofimplicitbiastraining,and 51twohoursofde-escalationtraining. 590.208.1.Thereisherebyestablishedthe"CommitteeonSchoolSafety" 2withinthedepartmentofpublicsafety. 3 2.Thecommitteeshallconsistofthefollowingmembers: 4 (1)Uptothreerepresentativesofthedepartmentofpublicsafety; 5 (2)ArepresentativeoftheMissouriSheriff'sAssociation; 6 (3)ArepresentativeoftheMissouriMunicipalLeague; 7 (4)Arepresentativeofthedepartmentofelementaryandsecondaryeducation; 8and 9 (5)ArepresentativeoftheMissouriSchoolBoards'Association'sCenterfor 10EducationSafety. 11 3.Onememberwhorepresentsthedepartmentofpublicsafetyshallserveas 12chairofthecommittee. 13 4.Membersofthecommitteeshallservewithoutcompensationbutmaybe 14reimbursedforactualexpensesnecessarytotheperformanceoftheirofficialdutiesfor 15thecommittee. 16 5.Thecommitteeshallmeetatleastfourtimesperyear,andatleastonceper 17calendarquarter,toevaluateandestablishguidelinesforschoolsafetyconcerns, 18includingplanstopreventschoolfirearmviolence. 10 (2)Allappealsoftheorderofreleasehavebeenexhausted; 11 (3)Theindividualwasnotservinganytermofasentenceforanyothercrime 12concurrentlywiththesentenceforwhichheorsheisdeterminedtobeactuallyinnocent, 13unlesssuchindividualwasservinganotherconcurrentsentencebecausehisorherparolewas 14revokedbyacourtortheparoleboardinconnectionwiththecrimeforwhichthepersonhas 15beenexonerated.Regardlessofwhetheranyotherbasismayexistfortherevocationofthe 16person'sprobationorparoleatthetimeofconvictionforthecrimeforwhichthepersonis 17laterdeterminedtobeactuallyinnocent,whenthecourt'sortheparoleboard'ssolestated 18reasonfortherevocationinitsorderistheconvictionforthecrimeforwhichthepersonis 19laterdeterminedtobeactuallyinnocent,suchordershall,forpurposesofthissectiononly,be 20conclusiveevidencethat[their] thepersons'sprobationorparolewasrevokedinconnection 21withthecrimeforwhichthepersonhasbeenexonerated;and 22 (4)Testingorderedundersection547.035,ortestingbytheorderofanystateor 23federalcourt,ifsuchpersonwasexoneratedonorbeforeAugust28,2004,ortestingordered 24undersection650.055,ifsuchpersonwasorisexoneratedafterAugust28,2004,orafteran 25evidentiaryhearingandfindinginahabeascorpusproceedingoraproceedingheld 26pursuanttosection547.031whichdemonstratesaperson'sinnocenceofthecrimeforwhich 27thepersonisincustody. 28 29Anyindividualwhoreceivesrestitutionunderthissectionshallbeprohibitedfromseeking 30anycivilredressfromthestate,itsdepartmentsandagencies,oranyemployeethereof,orany 31politicalsubdivisionoritsemployees.Thissectionshallnotbeconstruedasawaiverof 32sovereignimmunityforanypurposesotherthantherestitutionprovidedforherein.The 33departmentofcorrectionsshalldeterminetheaggregateamountofrestitutionowedduringa 34fiscalyear.Ifinsufficientmoneysareappropriatedeachfiscalyeartopayrestitutiontosuch 35persons,thedepartmentshallpayeachindividualwhohasreceivedanorderawarding 36restitutionaproratashareoftheamountappropriated.Providedsufficientmoneysare 37appropriatedtothedepartment,theamountsowedtosuchindividualshallbepaidonJune SS#2SCSHCS#2HB495 57 38thirtiethofeachsubsequentfiscalyear,untilsuchtimeastherestitutiontotheindividualhas 39beenpaidinfull.However,noindividualawardedrestitutionunderthissubsectionshall 40receivemorethan[thirty-six] sixty-fivethousand[fivehundred] dollarsduringeachfiscal 41year.Nointerestonunpaidrestitutionshallbeawardedtotheindividual.[Noindividualwho 42hasbeendeterminedbythecourttobeactuallyinnocentshallberesponsibleforthecostsof 43careundersection217.831] However,anindividualmayalsobeawardedother 44nonmonetaryrelief,includingcounseling,housingassistance,andpersonalfinancial 45literaryassistance. 46 2.IftheresultsoftheDNAtestingconfirmtheperson'sguilt,thenthepersonfiling 47forDNAtestingundersection547.035,shall: 48 (1)BeliableforanyreasonablecostsincurredwhenconductingtheDNAtest, 49includingbutnotlimitedtothecostofthetest.Suchcostsshallbedeterminedbythecourt 50andshallbeincludedinthefindingsoffactandconclusionsoflawmadebythecourt;and 51 (2)Besanctionedundertheprovisionsofsection217.262. 52 3.Apetitionforpaymentofrestitutionunderthissectionmay[only] befiledonlyby 53theindividualdeterminedtobeactuallyinnocentortheindividual'slegalguardian.Noclaim 54orpetitionforrestitutionunderthissectionmaybefiledbytheindividual'sheirsorassigns. 55Anindividual'srighttoreceiverestitutionunderthissectionisnotassignableorotherwise 56transferrable.Thestate'sobligationtopayrestitutionunderthissectionshallceaseuponthe 57individual'sdeath.Anybeneficiarydesignationthatpurportstobequeath,assign,or 58otherwiseconveytherighttoreceivesuchrestitutionshallbevoidandunenforceable. 59 4.Anindividualwhoisdeterminedtobeactuallyinnocentofacrimeunderthis 60chaptershallautomaticallybegrantedanorderofexpungementfromthecourtinwhichheor 61shepledguiltyorwassentencedtoexpungefromallofficialrecordsallrecordationsofhisor 62herarrest,plea,trialorconviction.Uponthecourt'sgrantingoftheorderofexpungement, 63therecordsandfilesmaintainedinanyadministrativeorcourtproceedinginanassociateor 64circuitdivisionofthecourtshallbeconfidentialand[only] availableonlytothepartiesorby 65orderofthecourtforgoodcauseshown.Theeffectofsuchordershallbetorestoresuch 66persontothestatusheorsheoccupiedpriortosucharrest,pleaorconvictionandasifsuch 67eventhadnevertakenplace.Nopersonastowhomsuchorderhasbeenenteredshallbeheld 68thereafterunderanyprovisionofanylawtobeguiltyofperjuryorotherwisegivingafalse 69statementbyreasonofhisorherfailuretoreciteoracknowledgesucharrest,plea,trial, 70convictionorexpungementinresponsetoanyinquirymadeofhimorherforanypurpose 71whatsoeverandnosuchinquiryshallbemadeforinformationrelatingtoanexpungement 72underthissection. [84.175.1.Uponrecommendationofthechiefofpolice,theboard 2 mayauthorizeandprovidefortheorganizationofapolicereserveforce 3 composedofmemberswhoreceiveaserviceretirementundertheprovisions 4 ofsections86.200to86.366andwhoqualifyundertheprovisionsofsection 5 84.120.Suchreserveforceshallbeunderthecommandofthechiefofpolice 6 andshallbeprovidedtraining,equipment,uniforms,andarmsasthechief 7 shalldirectwiththeapprovaloftheboard.Membersofthereserveforceshall 8 possessallofthepowersofregularpoliceofficersandshallbesubjecttoall 9 lawsandregulationsapplicabletopoliceofficers;provided,however,thatthe 10 citycouncilorothergoverningbodyofanysuchcitymayinitsdiscretionfixa 11 totalinnumberwhichthereserveforcemaynotexceed. 12 2.Ineventofriotorotheremergenciesasdeclaredanddefinedbythe 13 mayor,inconcurrencewiththeboard,theboard,uponrecommendationofthe 14 chief,mayappointspecialofficersorpatrolmenfortemporaryservicein 15 additiontothepolicereserveforcehereinprovidedfor,butthelengthoftime 16 forwhichsuchofficersorpatrolmenshallbeemployedshallbelimitedtothe 17 timeduringwhichsuchemergencyshallexist.] [84.240.Theboardofpolicecommissionersshallestablishthe 2 Bertillonsystemofidentificationofcriminalsandothersbymeansof 3 anthropometricindications,andtheyarefurtherrequiredtoemploysuch 4 additionalassistanceasmaybenecessarytoproperlyconductandmanagethis 5 department.] [84.341.Noelectedorappointedofficialofthestateoranypolitical 2 subdivisionthereofshallactorrefrainfromactinginanymannertoimpede, 3 obstruct,hinder,orotherwiseinterferewithanymemberofamunicipalpolice 4 forceestablishedundersections84.343to84.346intheperformanceofhisor 5 herjobduties,orwithanyaspectofanyinvestigationarisingfromthe 6 performanceofsuchjobduties.Thissectionshallnotbeconstruedtoprevent 7 suchofficialsfromactingwithinthenormalcourseandscopeoftheir 8 employmentorfromactingtoimplementsections84.343to84.346.Any 9 personwhoviolatesthissectionshallbeliableforapenaltyoftwothousand 10 fivehundreddollarsforeachoffenseandshallforeverbedisqualifiedfrom 11 holdinganyofficeoremploymentwhatsoeverwiththegovernmentalentity 12 thepersonservedatthetimeoftheviolation.Thepenaltyshallnotbepaidby 13 thefundsofanycommitteeasthetermcommitteeisdefinedinsection 14 130.011.Thissectionshallnotbeconstruedtointerferewiththepunishment, SS#2SCSHCS#2HB495 59 15 underanylawsofthisstate,ofacriminaloffensecommittedbysuchofficials, 16 norshallthissectionapplytodulyappointedmembersofthemunicipalpolice 17 force,ortheirappointingauthorities,whoseconductisotherwiseprovidedfor 18 bylaw.] [84.342.1.Itshallbeanunlawfulemploymentpracticeforanofficial, 2 employee,oragentofamunicipalpoliceforceestablishedundersections 3 84.343to84.346todischarge,demote,reducethepayof,orotherwiseretaliate 4 againstanemployeeofthemunicipalpoliceforceforreportingtoany 5 superior,governmentagency,orthepresstheconductofanotheremployee 6 thatthereportingemployeebelieves,ingoodfaith,isillegal. 7 2.Anyemployeeofthemunicipalpoliceforcemaybringacauseof 8 actionforgeneralorspecialdamagesbasedonaviolationofthissection.] [84.343.1.Subjecttotheprovisionsofsections84.344to84.346,any 2 citynotwithinacountymayestablishamunicipalpoliceforceforthe 3 purposesof: 4 (1)Preservingthepublicpeace,welfare,andorder; 5 (2)Preventingcrimeandarrestingsuspectedoffenders; 6 (3)Enforcingthelawsofthestateandordinancesofthecity; 7 (4)Exercisingallpowersavailabletoapoliceforceundergenerally 8 applicablestatelaw;and 9 (5)Regulatingandlicensingallprivatewatchmen,privatedetectives, 10 andprivatepolicemenservingoractingassuchinsaidcity. 11 2.Anypersonwhoactsasaprivatewatchman,privatedetective,or 12 privatepolicemaninsaidcitieswithouthavingobtainedawrittenlicensefrom 13 saidcitiesisguiltyofaclassAmisdemeanor.] [84.344.1.Notwithstandinganyprovisionsofthischaptertothe 2 contrary,anycitynotwithinacountymayestablishamunicipalpoliceforce 3 onorafterJuly1,2013,accordingtotheproceduresandrequirementsofthis 4 section.Thepurposeoftheseproceduresandrequirementsistoprovideforan 5 orderlyandappropriatetransitioninthegovernanceofthepoliceforceand 6 provideforanequitableemploymenttransitionforcommissionedandcivilian 7 personnel. 8 2.Upontheestablishmentofamunicipalpoliceforcebyacityunder 9 sections84.343to84.346,theboardofpolicecommissionersshallconvey, 10 assign,andotherwisetransfertothecitytitleandownershipofall 11 indebtednessandassets,including,butnotlimitedto,allfundsandrealand 12 personalpropertyheldinthenameoforcontrolledbytheboardofpolice 13 commissionerscreatedundersections84.010to84.340.Theboardofpolice 14 commissionersshallexecutealldocumentsreasonablyrequiredtoaccomplish 15 suchtransferofownershipandobligations. 16 3.Ifthecityestablishesamunicipalpoliceforceandcompletesthe 17 transferdescribedinsubsection2ofthissection,thecityshallprovidethe 18 necessaryfundsforthemaintenanceofthemunicipalpoliceforce. 19 4.Beforeacitynotwithinacountymayestablishamunicipalpolice 20 forceunderthissection,thecityshalladoptanordinanceaccepting SS#2SCSHCS#2HB495 60 21 responsibility,ownership,andliabilityassuccessor-in-interestforcontractual 22 obligations,indebtedness,andotherlawfulobligationsoftheboardofpolice 23 commissionerssubjecttotheprovisionsofsubsection2ofsection84.345. 24 5.Acitynotwithinacountythatestablishesamunicipalpoliceforce 25 shallinitiallyemploy,withoutareductioninrank,salary,orbenefits,all 26 commissionedandcivilianpersonneloftheboardofpolicecommissioners 27 createdundersections84.010to84.340thatwereemployedbytheboard 28 immediatelypriortothedatethemunicipalpoliceforcewasestablished.Such 29 commissionedpersonnelwhopreviouslywereemployedbytheboardmay 30 onlybeinvoluntarilyterminatedbythecitynotwithinacountyforcause.The 31 cityshallalsorecognizeallaccruedyearsofservicethatsuchcommissioned 32 andcivilianpersonnelhadwiththeboardofpolicecommissioners.Such 33 personnelshallbeentitledtothesameholidays,vacation,andsickleavethey 34 wereentitledtoasemployeesoftheboardofpolicecommissioners. 35 6.Commissionedandcivilianpersonnelofamunicipalpoliceforce 36 establishedunderthissectionshallnotbesubjecttoaresidencyrequirementof 37 retainingaprimaryresidenceinacitynotwithinacountybutmayberequired 38 tomaintainaprimaryresidencelocatedwithinaone-hourresponsetime. 39 7.Thecommissionedandcivilianpersonnelwhoretirefromservice 40 withtheboardofpolicecommissionersbeforetheestablishmentofa 41 municipalpoliceforceundersubsection1ofthissectionshallcontinuetobe 42 entitledtothesamepensionbenefitsprovidedunderchapter86andthesame 43 benefitssetforthinsubsection5ofthissection. 44 8.Ifthecitynotwithinacountyelectstoestablishamunicipalpolice 45 forceunderthissection,thecityshallestablishaseparatedivisionforthe 46 operationofitsmunicipalpoliceforce.Thecivilservicecommissionofthe 47 citymayadoptrulesandregulationsappropriatefortheuniqueoperationofa 48 policedepartment.Suchrulesandregulationsshallreserveexclusive 49 authorityoverthedisciplinaryprocessandproceduresaffectingcommissioned 50 officerstothecivilservicecommission;however,untilsuchtimeasthecity 51 adoptssuchrulesandregulations,thecommissionedpersonnelshallcontinue 52 tobegovernedbytheboardofpolicecommissioner'srulesandregulationsin 53 effectimmediatelypriortotheestablishmentofthemunicipalpoliceforce, 54 withthepolicechiefactinginplaceoftheboardofpolicecommissionersfor 55 purposesofapplyingtherulesandregulations.Unlessotherwiseprovidedfor, 56 existingcivilservicecommissionrulesandregulationsgoverningtheappealof 57 disciplinarydecisionstothecivilservicecommissionshallapplytoall 58 commissionedandcivilianpersonnel.Thecivilservicecommission'srules 59 andregulationsshallprovidethatrecordspreparedfordisciplinarypurposes 60 shallbeconfidential,closedrecordsavailablesolelytothecivilservice 61 commissionandthosewhopossessauthoritytoconductinvestigations 62 regardingdisciplinarymatterspursuanttothecivilservicecommission'srules 63 andregulations.Ahearingofficershallbeappointedbythecivilservice 64 commissiontohearanysuchappealsthatinvolvedisciplineresultingina 65 suspensionofgreaterthanfifteendays,demotion,ortermination,butthecivil 66 servicecommissionshallmakethefinalfindingsoffact,conclusionsoflaw, 67 anddecisionwhichshallbesubjecttoanyrightofappealunderchapter536. SS#2SCSHCS#2HB495 61 68 9.Acitynotwithinacountythatestablishesandmaintainsa 69 municipalpoliceforceunderthissection: 70 (1)Shallprovideorcontractforlifeinsurancecoverageandfor 71 insurancebenefitsprovidinghealth,medical,anddisabilitycoveragefor 72 commissionedandcivilianpersonnelofthemunicipalpoliceforcetothesame 73 extentaswasprovidedbytheboardofpolicecommissionersundersection 74 84.160; 75 (2)Shallprovideorcontractformedicalandlifeinsurancecoverage 76 foranycommissionedorcivilianpersonnelwhoretiredfromservicewiththe 77 boardofpolicecommissionersorwhowereemployedbytheboardofpolice 78 commissionersandretirefromthemunicipalpoliceforceofacitynotwithina 10.Acitynotwithinacountythatestablishesamunicipalpoliceforce 92 undersections84.343to84.346shallestablishatransitioncommitteeoffive 93 membersforthepurposeof:coordinatingandimplementingthetransitionof 94 authority,operations,assets,andobligationsfromtheboardofpolice 95 commissionerstothecity;windingdowntheaffairsoftheboard;making 96 nonbindingrecommendationsforthetransitionofthepoliceforcefromthe 97 boardtothecity;andotherrelatedduties,ifany,establishedbyexecutive 98 orderofthecity'smayor.Oncetheordinancereferencedinthissectionis 99 enacted,thecityshallprovidewrittennoticetotheboardofpolice 100 commissionersandthegovernorofthestateofMissouri.Withinthirty 101 daysofsuchnotice,themayorshallappointthreememberstothecommittee, 102 twoofwhomshallbemembersofastatewidelawenforcementassociation 103 thatrepresentsatleastfivethousandlawenforcementofficers.Theremaining 104 membersofthecommitteeshallincludethepolicechiefofthemunicipal 105 policeforceandapersonwhocurrentlyorpreviouslyservedasa 106 commissionerontheboardofpolicecommissioners,whoshallbeappointed 107 tothecommitteebythemayorofsuchcity.] [84.345.1.Exceptasrequiredfortheboardofpolicecommissioners 2 toconcludeitsaffairsandpursuelegalclaimsanddefenses,uponthe 3 establishmentofamunicipalpoliceforce,thetermsofofficeofthe 4 commissionersoftheboardofpolicecreatedundersections84.020and 5 84.030shallexpire,andtheprovisionsofsections84.010to84.340shallnot 6 applytoanycitynotwithinacountyoritsmunicipalpoliceforceasofsuch 7 date.Theboardshallcontinuetooperate,ifnecessary,towinddownthe SS#2SCSHCS#2HB495 62 8 board'saffairsuntilthetransferofownershipandobligationsundersubsection 9 2ofsection84.344hasbeencompleted.Duringsuchtime,theboardofpolice 10 commissionersshalldesignateandauthorizeitssecretarytoactonbehalfof 11 theboardforpurposesofperformingtheboard'sdutiesandanyotheractions 12 incidenttothetransferandwindingdownoftheboard'saffairs. 13 2.Foranyclaim,lawsuit,orotheractionarisingoutofactions 14 occurringbeforethedateofcompletionofthetransferprovidedunder 15 subsection2ofsection84.344,thestateshallcontinuetoprovidelegal 16 representationassetforthinsection105.726,andthestatelegalexpensefund 17 shallcontinuetoprovidereimbursementforsuchclaimsundersection 18 105.726.Thissubsectionappliestoallclaims,lawsuits,andotheractions 19 broughtagainstanycommissioner,policeofficer,employee,agent, 20 representative,oranyindividualorentityactingorpurportingtoactonits 21 ortheirbehalf. 22 3.Notwithstandinganyotherprovisionoflaw,rule,orregulationto 23 thecontrary,anycitynotwithinacountythatestablishesamunicipalpolice 24 forceundersections84.343to84.346shallnotberestrictedorlimitedinany 25 wayintheselectionofapolicechieforchiefofthedivisioncreatedunder 26 subsection8ofsection84.344. 27 4.Itshallbethedutyofthesheriffforanycitynotwithinacounty, 28 whenevercalleduponbythepolicechiefofthemunicipalpoliceforce,toact 29 underthepolicechief'scontrolforthepreservationofthepublicpeaceand 30 quiet;and,whenevertheexigencyorcircumstancesmay,inthepolicechief's 31 judgment,warrantit,saidpolicechiefshallhavethepowertoassumethe 32 controlandcommandofalllocalandmunicipalconservatorsofthepeaceof 33 thecity,whethersheriff,constable,policemenorothers,andtheyshallact 34 undertheordersofthesaidpolicechiefandnototherwise.] [84.346.Anypolicepensionsystemcreatedunderchapter86forthe 2 benefitofapoliceforceestablishedundersections84.010to84.340shall 3 continuetobegovernedbychapter86,andshallapplytoanypoliceforce 4 establishedundersection84.343to84.346.Otherthananyprovisionthat 5 theformmaybeconsideredbytheparoleboardforpurposesofaparole 17 determination,andindetermininganoffender'sparolereleasedateor 18 eligibilityandshallconstitutesufficientgroundsfordenialofparole. 19 5.Priortoreleaseofanyoffenderfromimprisonment,andagainprior 20 toreleasefromthejurisdictionofthedepartment,thedepartmentshallrequest 21 fromtheoffenderanassignmentoftenpercentofanywages,salary,benefits 22 orpaymentsfromanysource.Suchanassignmentshallbevalidforthelonger 23 SS#2SCSHCS#2HB495 65 4 2.Theamountofreimbursementsoughtfromanoffendershallnotbe 5 inexcessofthepercapitacostforcareformaintainingoffendersinthestate 6 correctionalcenterinwhichtheoffenderishousedfortheperiodorperiods 7 suchoffenderisanoffenderinastatecorrectionalcenter.] [217.835.1.Thecircuitcourtshallhaveexclusivejurisdictionoverall 2 proceedingsseekingreimbursementfromoffenderspursuanttotheprovisions 3 ofsections217.825to217.841.Theattorneygeneralmayfileacomplaintin 4 thecircuitcourtforthecountyorcityfromwhichaprisonerwassentencedor 5 inthecircuitcourtinthecountyorcityoftheofficeofthedirectorofthe 6 department,againstanypersonunderthejurisdictionofthedepartmentstating 7 thatthepersonisorhasbeenanoffenderinastatecorrectionalcenter,that 8 thereisgoodcausetobelievethatthepersonhasassets,andprayingthatthe 9 assetsbeusedtoreimbursethestatefortheexpensesincurredortobe 10 incurred,orboth,bythestateforthecostofcareofthepersonasanoffender. 11 2.Uponthefilingofthecomplaintundersubsection1ofthissection, 12 thecourtshallissueanordertoshowcausewhytheprayerofthecomplainant 13 shouldnotbegranted.Thecomplaintandordershallbeserveduponthe 14 personpersonally,or,ifthepersonisconfinedinastatecorrectionalcenter,by 15 registeredmailaddressedtothepersonincareofthechiefadministratorofthe 16 statecorrectionalcenterwherethepersonishoused,atleastthirtydaysbefore 17 thedateofhearingonthecomplaintandorder. 18 3.Atthetimeofthehearingonthecomplaintandorder,ifitappears 19 thatthepersonhasanyassetswhichoughttobesubjectedtotheclaimofthe 20 statepursuanttotheprovisionsofsections217.825to217.841,thecourtshall 21 issueanorderrequiringanyperson,corporation,orotherlegalentity
