4subscriber'smonthlybilltooffsetthesubscriber'sretailelectricbill;

7subscribersreceiveabillcreditfortheelectricitygeneratedbasedonthesizeofthe

16 (f)Creditssomeoralloftheelectricitygeneratedfromacommunitysolar

25hundredpercentofthefederalpovertyleveloreightypercentofthemedianincomeof
26thecountyinwhichthecustomerislocated,whicheverishigher.Ownersormanagers
27ofapartmentbuildingsorrentalunitsthatservelow-incomecustomersmaybe
28consideredlow-incomecustomersiffiftypercentormoreofthetenantsqualifyunder
29thisdefinition.Further,certainentities,organizations,andinstitutionsthatarefocused
30onsocialwelfareandthatservethelow-incomecustomercommunitymayalsoqualify,
31including,butnotlimitedto:homelessshelters,halfwayhouses,soupkitchens,foster
32homes,orphanages,andothersimilarorganizations;
33 (6)"Retailelectricsupplier",anelectricalcorporationrateregulatedunder
34chapter386thatprovidesretailelectricserviceinthisstate;
35 (7)"Subscriber",aretailcustomerofaretailelectricsupplierwhoownsoneor
36moresubscriptionstoacommunitysolarfacilityinterconnectedwiththecustomer's
37retailelectricsupplier.Thetermincludesaretailcustomerwhoownsaportionofa
38communitysolarfacility.Asubscriber'ssubscriptionsizeshallbeonehundredpercent
39orlessoftheirtwelve-monthrollingaveragekilowatthourusageforanyonesubscriber
40meter;
41 (8)"Subscriberadministrator",anentitythatrecruitsandenrollssubscribers,
42administerssubscriberparticipationincommunitysolarfacilities,andmanagesthe
43subscriptionrelationshipbetweensubscribersandaretailelectricsupplier;
44 (9)"Subscription",acontractbetweenasubscriberandsubscriber
45administratorofacommunitysolarfacilitythatentitlesthesubscribertoabillcredit
46againstthesubscriber'sretailelectricbill;
47 (10)"Unsubscribedenergy",theoutputofacommunitysolarfacility,measured
48inkilowatthours,thatisnotallocatedtosubscribers.
49 2.Eachretailelectricsuppliershallimplementathree-yearcommunitysolar
50pilotprogramtorunduringcalendaryears2026through2028.Retailelectricsuppliers
51shallallowsubscriberadministratorsandownersoroperatorsofcommunitysolar
52facilitiestorecruitcustomersassubscribers,andshallprocesssubscribers'billcredits
53asrequiredbysubdivision(8)ofsubsection3ofthissection.Eachretailelectric
54suppliershallcontinueoperatingitscommunitysolarpilotprogramuntilthetotalsolar

56electricitysalesforthepreviousyear.
57 3.Communitysolarfacilitiesshallbeoperatedasfollows:
58 (1)Acommunitysolarfacilitymaybebuilt,owned,oroperatedbyathirdparty
59entityundercontractwithanowneroroperatorofacommunitysolarfacilityora
60subscriberadministrator.Asubscriberadministratormaycontracttoadministerbill
61creditstothesubscriber'selectricitybillgeneratedbythesubscriber'sshareofthe
62communitysolarfacility,subjecttotherequirementsofthissection.Asubscriber
63administratorthatprovidesbillcreditstoasubscriberpursuanttothissectionshallnot
64beconsideredanelectricalcorporationorpublicutilityundersection386.020for
65purposesofdeterminingjurisdictionofthecommission;
66 (2)Theowneroroperatorofacommunitysolarfacilitymayserveasa
67subscriberadministratorormaycontractwithathirdpartytoserveasasubscriber
68administratoronbehalfoftheowneroroperator.Nothinginthissectionshallpreventa
69retailelectricsupplierfromowningoroperatingacommunitysolarfacilityorfrom
70actingasasubscriberadministratoraspartofitsowncommunitysolarpilotprogram;
71 (3)Exceptasprovidedundersubdivision(4)ofthissubsection,thepricepaidfor
72asubscriptioninacommunitysolarfacilityshallnotbesubjecttoregulationbythe
73commission;
74 (4)Notlaterthanninemonthsaftertheeffectivedateofthissection,the
75commissionshallestablishthevalueofthebillcreditforeachretailelectricsupplierto
76offseteachsubscriber'sretailelectricbillforeachkilowatthoursubscribedfroma
77communitysolarfacility.Thecommissionshallestablishthebillcreditvalueinsucha
78wayastoallowforthecreation,financing,accessibility,andoperationofcommunity
79solarfacilitiesandtomaximizecustomerparticipationsoastomeetthegoaloffive
80percentofelectricitysalesperyearasrequiredbysubsection2ofthissection.The
81commissionshallestablishanadditionalbillcreditvalueforsubscriberswhoarelow-
82incomecustomersinsuchawayastoensurethatlow-incomesubscriberssavemoneyon
83theirretailelectricbills;
84 (5)Aretailelectricsuppliershallallowforthetransferabilityandportabilityof
85subscriptions,includingallowingasubscribertoretainasubscriptiontoacommunity
86solarfacilityifthesubscriberrelocateswithinthesameretailelectricsupplier'sservice
87territory;
88 (6)Onamonthlybasis,asubscriberadministratorshallupdatethesubscriber
89administrator'slistofsubscribersandprovideallofthefollowinginformationabout
90eachsubscribertotheretailelectricsupplierinastandardizedelectronicformat
91approvedbythecommissionforthepurposeofbillcredittosubscribers:

93 (b)Thekilowatthoursofelectricitygenerationattributabletoeachsubscriber;
94 (c)Ifasubscriberadministratorisusingtheretailelectricsupplier'sbilling
95methodstocollectsubscriptionfees,thesubscriptionfeeforthemonthowedbyeach
96subscribertothesubscriberadministrator;
97 (7)Asubscriberadministratororthirdpartyowningoroperatingacommunity
98solarfacilityshallnotbeconsideredaretailelectricsupplieroranelectricgeneration
99providersolelyasaresultofinvolvementwithacommunitysolarfacility;
100 (8)Dutiesofretailelectricsuppliersshallincludethefollowing:
101 (a)Onamonthlybasis,aretailelectricsuppliershallprovidetoasubscriber
102administratorareportinastandardizedelectronicformatindicatingthetotalvalueof
103thebillcreditgeneratedbythecommunitysolarfacilityinthepriormonthandthe
104amountofthebillcreditappliedtoeachsubscriber;
105 (b)Aretailelectricsuppliershallprovideabillcredittoasubscriber'snext
106monthlyelectricbillfortheproportionaloutputofacommunitysolarfacility
107attributabletothesubscriberinthesamemannerasifthesolarfacilitywerelocated
108onthecustomer'sproperty;
109 (c)Ifrequestedbyasubscriberadministrator,aretailelectricsuppliershall
110includeasubscriber'ssubscriptionfeeonthemonthlybillandforwardthecollected
111subscriptionfeestothesubscriberadministratoronamonthlybasis;
112 (d)NotlaterthanAugust28,2026,aretailelectricsuppliershallmakeavailable
113andupdate,inacommerciallyreasonablemanner,asystemmapshowingtheloadingof
114thedistributionsystemandindicatingwhereintheserviceareathedistributionsystem
115couldaccommodatenewsolargeneration;
116 (9)Compensationforretailelectricsuppliersshallbeasfollows:
117 (a)Asubscriberadministratorshallcompensatearetailelectricsupplierforthe
118retailelectricsupplier'sreasonabledirectcostsofinterconnectionofacommunitysolar
119facility.Suchcompensationshallbeintheformofaone-timepaymentupon
120interconnection;
121 (b)Aretailelectricsuppliershallbeentitledtorecoveritsreasonabledirectcosts
122ofcomplyingwiththerequirementsofthissectionandenablingacommunitysolar
123facilitywithinitsserviceterritoryincluding,butnotlimitedto:addedbillingcostsand
124addedcostsofnetmeteringandinterconnectionforcommunitysolarfacilities.Such
125reasonabledirectcostsshallbeintheformofanannualfeeinvoicedtothesubscriber
126administratorbasedonthetotalfinalsystemsizeofthecommunitysolarfacility;
127 (10)Eachcommunitysolarfacilityshallbesubscribedwithatleasttenpercent
128low-incomecustomersandtwentypercentresidentialcustomers;
HCSHB662	4 129 (11)Aretailelectricsuppliershallpurchaseunsubscribedenergyfroma
130communitysolarfacilityattheretailelectricsupplier'savoidedcostasapprovedbythe
131commission.NolaterthanninemonthsafterAugust28,2025,thecommissionshall
132promulgaterulestoimplementtheprovisionsofthissectionregardingthepurchaseof
133unsubscribedenergy;
134 (12)Noentity,affiliatedentity,orentitiesundercommoncontrolmaydevelop,
135own,oroperatemorethanonecommunitysolarfacilityonthesameparcelor
136contiguousparcelsofland.
137 4.Interconnectionstandardsforcommunitysolarfacilitiesunderonehundred
138kilowattsshallbethesameasthestandardsfornet-meteredcustomerspursuantto
139section386.890.Forsystemslargerthanonehundredkilowatts,thecommissionshall
140developtechnicalandnetmeteringinterconnectionrulesforcustomer-generators
141intendingtooperatecommunitysolarfacilitiesorrenewableonsitegeneratorsin
142parallelwiththeelectricutilitygrid,consistentwithrulesdefinedinotherstateswithin
143theserviceregionoftheregionaltransmissionorganizationthatmanagesthe
144transmissionsysteminanypartofthestate.Indevelopingitsrules,thecommission
145shallconveneastakeholderprocesstodevelopstatewidetechnicalandnetmetering
146rulesforcustomergeneratorswithsystemslargerthanonehundredkilowatts.
147 5.Thecommissionshallpromulgaterulesandregulationstoimplementthe
148provisionsofthissectionwithinninemonthsofAugust28,2025.Anyruleorportionof
149arule,asthattermisdefinedinsection536.010,thatiscreatedundertheauthority
150delegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandissubjectto
151alloftheprovisionsofchapter536and,ifapplicable,section536.028.Thissectionand
152chapter536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
153pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
154arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
155andanyruleproposedoradoptedafterAugust28,2025,shallbeinvalidandvoid.
