SectionA.Chapter115,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection115.972,toreadasfollows:
115.972.1.Notwithstandinganyotherprovisionoflaw,thesecretaryofstate
2shallestablishaprocesstoconductautomaticvoterregistrationandshallprovide
3recommendationstolocalelectionauthoritiesfortheautomaticregistrationofeligible
4voters.
5 2.Thefollowingactionsshallresultinanindividual'sautomaticvoter
6registrationoranupdatetotheinformationofanalreadyregisteredvoterifthe
7individualotherwisemeetstherequirementstoregistertovote:
8 (1)Completinganapplicationforaneworreneweddriver'slicense,nondriver
9identificationcard,driver'spermit,orcertificationofsuperviseddrivingthatisnota
10requestforduplicationofalostorstolencardwiththedepartmentofrevenueor
11notifyingthedepartmentinwritingofachangeinhisorhernameormailingaddress;
12 (2)Completinganapplicationforservicesorrenewalofservicesorchangeof
13addressrelatingtoservicesfromthedepartmentofsocialservices;
14 (3)Completinganapplicationforservicesorrenewalofservicesorchangeof
15addressrelatingtoservicesfromalocalhousingauthority;
16 (4)RegisteringforclassesataninstitutionoftheUniversityofMissourisystem;
17 (5)Completinganapplicationforunemploymentbenefits;or
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (6)Submittingaformbythedepartmentofcorrectionstothesecretaryofstate
19thatconfirmsanindividualhasbeendischargedfromprobation,parole,or
20incarceration;thedischargeisnonconditional;andtheindividual'splaceofresidence
21uponrelease.
22 3.Theagenciesandstatedepartmentswhoreceivetheinformationinsubsection
232ofthissectionshall,periodicallyasrequiredbyruleorpolicy,providethesecretaryof
24statewithsuchinformationasthesecretaryofstatespecifiesisnecessarytoconduct
25recommendationsforautomaticvoterregistration.
26 4.Thesecretaryofstateshallprovidelistsofnonbindingrecommendationsfor
27inclusiononvoterregistrationliststolocalelectionauthoritiesandsuchauthoritiesshall
28includesuchrecommendationsonvoterregistrationlists,subjecttoexistingverification
29proceduresfordeterminingwhetheranindividualiseligibletoregistertovoteand
30eligibletovote.Localelectionauthoritiesshallretainfulljurisdictionandpowerto
31declinetoregisterindividualsnotverifiedtobeeligibletovoteandtoremovethenames
32ofindividualswhoarenolongereligibletovotefromvoterregistrationlists.
33 5.Withintwomonthsofreceiptofaproposedvoterregistrationlist,butpriorto
34includingarecommendedindividualonavoterregistrationlist,thelocalelection
35authorityshallsendnoticeofpotentialautomaticregistrationwhichshallincludea
36postage-paidpostcardforpurposesofdecliningregistration.If,afteraperiodofone
37month,thepostcardisnotreturnedtothelocalelectionauthority,theindividual'sname
38shallbeaddedtothevoterregistrationlist,exceptthatanytimeapostcardisreceived,
39theindividual'snameshallberemovedfromthevoterregistrationlist.Thissubsection
40shallnotbeconstruedtopreventremovalfromvoterregistrationlistsbyanyother
41methodallowedunderthischapter.
42 6.Theprovisionsofthissectionallowforautomaticvoterregistrationin
43additiontoanyothermethodofregistrationallowedunderthischapterandshallnotbe
44interpretedtoinvalidateanyothermethodforvoterregistration.
45 7.Theprovisionsofthissectionwithregardtothesecretaryofstate,state
46departmentsandagencies,andlocalelectionauthoritiesshallbesubjecttothe
47appropriationandpaymentoffundsnecessarytoconductautomaticvoterregistration
48andverificationprocedures.
49 8.Thesecretaryofstatemaypromulgateallnecessaryrulesforthe
50administrationofthissection.Anyruleorportionofarule,asthattermisdefined
51insection536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
52becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
53536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable
54andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
HB702 2 55review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently
56heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
57adoptedafterAugust28,2025,shallbeinvalidandvoid.
