140.984.1.Theincomeofalandbankagencyshallbeexemptfromalltaxationby
2thestateandbyanyofitspoliticalsubdivisions.Uponacquiringtitletoanyrealestate,aland
3bankagencyshallimmediatelynotifythecountyassessorandthecountycollectorofsuch
4ownership;alltaxes,specialtaxes,fines,andfeesonsuchrealestateshallbedeemedsatisfied
5bytransfertothelandbankagency;andsuchpropertyshallbeexemptfromalltaxation
6duringthelandbankagency'sownershipthereof,inthesamemannerandtothesameextent
7asanyotherpubliclyownedrealestate.Uponthesaleorotherdispositionofanyrealestate
HB717 2 8heldbyit,thelandbankagencyshallimmediatelynotifythecountyassessorandthecounty
9collectorofsuchchangeofownership.However,thatsuchtaxexemptionforimprovedand
10occupiedrealpropertyheldbythelandbankagencyasalessorpursuanttoagroundlease
11shallterminateuponthefirstoccupancy,andthelandbankagencyshallimmediatelynotify
12thecountyassessorandthecountycollectorofsuchoccupancy.
13 2.Alandbankagencymayacquirerealpropertybygift,devise,transfer,exchange,
14foreclosure,purchase,orpursuanttosections141.560to141.580orsection141.821,excepta
15landbankagencyshallnotacquirepropertylocatedpartiallyorwhollyoutsidetheboundaries
16ofthecountyormunicipalitythatestablishedsuchlandbankagency.[Forpurchasesofreal
17propertynotmadethroughforeclosureorpursuanttosections141.560to141.580,aland
18bankagencymayonlypurchaserealpropertyifsuchpropertyisadjacenttorealproperty

20 3.Alandbankagencymayacquirepropertybypurchasecontracts,leasepurchase
21agreements,installmentsalescontracts,andlandcontractsandmayaccepttransfersfrom
22politicalsubdivisionsuponsuchtermsandconditionsasagreedtobythelandbankagency
23andthepoliticalsubdivision.Alandbankagencymay[, forthepurposeofaddingtoaparcel
24alreadyownedbythelandbankagency,]bidonanyparcelofrealestateofferedforsale,
25offeredataforeclosuresaleundersections140.220to140.250,offeredatasaleconducted

27141.550.Notwithstandinganyotherlawtothecontrary,anypoliticalsubdivisionmay
28transfertothelandbankagencyrealpropertyandinterestsinrealpropertyofthepolitical
29subdivisiononsuchtermsandconditionsandaccordingtosuchproceduresasdeterminedby
30thepoliticalsubdivision.
31 4.Alandbankagencyshallmaintainallofitsrealpropertyinaccordancewiththe
32lawsandordinancesofthejurisdictionsinwhichtherealpropertyislocated.
33 5.Uponissuanceofadeedtoaparcelofrealestatetoalandbankagencyunder
34subsection4ofsection140.250,subsection5ofsection140.405,othersaleconductedunder
35section140.190,140.240,or140.250,orsection141.550,thelandbankagencyshallpayonly
36theamountofthelandbankagency'sbidthatexceedstheamountofalltaxbillsincludedin
37thejudgment,interest,penalties,attorney'sfees,taxes,andcoststhenduethereon.Ifthereal
38estateisacquiredinadelinquentlandtaxauctionundersubsection4ofsection140.250,
39subsection5ofsection140.405,orothersaleconductedundersection140.190,140.240,or
40140.250,suchexcessshallbeappliedanddistributedinaccordancewithsection140.230.If
41therealestateisacquiredinadelinquentlandtaxauctionundersection141.550,suchexcess
42shallbeappliedanddistributedinaccordancewithsubsections3and4ofsection141.580,
43exclusiveofsubdivision(3)ofsubsection3ofsection141.580.Uponissuanceofadeed,the
44countycollectorshallmarkthetaxbillsincludedinthejudgmentas"cancelledbysaletothe

46amount,interest,penalties,attorney'sfees,andcosts,onthecountycollector'sbooksandin
47thecountycollector'sstatementswithanyothertaxingauthorities.
48 6.Alandbankshallnotownrealpropertyunlessthepropertyiswhollylocated
49withintheboundariesofthecountyormunicipalitythatestablishedthelandbankagency.
50 7.Withinoneyearoftheeffectivedateoftheordinance,resolution,orrulepassed
51establishingamunicipallandbankagencyundersubsection2ofsection140.981,thetitleto
52anyrealpropertythatislocatedwhollywithinthemunicipalitythatcreatedthelandbank
53agencyandthatisheldbyalandtrustcreatedundersubsection1ofsection141.821shallbe
54transferredbydeedfromthelandtrusttosuchlandbankagency,atthelandbankagency's
55request.
140.985.1.Alandbankagencyshallholdinitsownnameallrealpropertyacquired
2bysuchlandbankagencyirrespectiveoftheidentityofthetransferorofsuchproperty.
3 2.Alandbankagencyshallmaintainandmakeavailableforpublicreviewand
4inspectionaninventoryandhistoryofallrealpropertythelandbankagencyholdsor
5formerlyheld.Thisinventoryandhistoryshallbeavailableonthelandbankagency's
6websiteandincludeataminimum:
7 (1)Whetheraparcelisavailableforsale;
8 (2)Theaddressoftheparcelifanaddresshasbeenassigned;
9 (3)Theparcelnumberifnoaddresshasbeenassigned;
10 (4)Themonthandyearthataparcelenteredthelandbankagency'sinventory;
11 (5)Whetheraparcelhassold;
12 (6)Ifaparcelhassold,thenameofthepersonorentitytowhichitwassold;and
13 (7)Whethertheparcelwasacquiredbythelandbankagencythroughjudicial
14foreclosure,nonjudicialforeclosure,donation,orsomeothermanner.
15 3.Thelandbankagencyshalldetermineandsetforthinpoliciesandproceduresthe
16generaltermsandconditionsforconsiderationtobereceivedbythelandbankagencyforthe
17transferofrealpropertyandinterestsinrealproperty.Considerationmaytaketheformof
18monetarypaymentsandsecuredfinancialobligations,covenants,andconditionsrelatedtothe
19presentandfutureuseoftheproperty;contractualcommitmentsofthetransferee;andsuch
20otherformsofconsiderationasthelandbankagencydeterminestobeinthebestinterestof
21thelandbankagency.
22 4.Alandbankagencymayconvey,exchange,sell,transfer,grant,releaseand
23demise,pledge,andhypothecateanyandallinterestsin,upon,ortopropertyofthelandbank
24agency.Alandbankagencymaygiftanyinterestin,upon,ortopropertytothecountyor
25municipalitythatestablishedthelandbankagency.
HB717 4 26 5.Acountyormunicipalitymay,initsresolution,ordinance,orrulecreatingaland
27bankagency,establishahierarchicalrankingofprioritiesfortheuseofrealproperty
28conveyedbysuchlandbankagency,including,butnotlimitedto:
29 (1)Useforpurelypublicspacesandplaces;
30 (2)Useaswildlifeconservationareas;
31 (3)Useasagreenfieldarea;and
32 (4)Toreturntoprivateuse.

34Ifacountyormunicipality,initsresolution,ordinance,orrulecreatingalandbankagency,
35establishesprioritiesfortheuseofrealpropertyconveyedbythelandbankagency,such
36prioritiesshallbeconsistentwithandnomorerestrictivethanmunicipalplanningandzoning
37ordinances.
38 6.Thelandbankagencymaydelegatetoofficersandemployeestheauthorityto
39enterintoandexecuteagreements,instrumentsofconveyance,andallotherrelated
40documentspertainingtotheconveyanceofpropertybythelandbankagency.
41 7.[Anypropertysoldbyalandbankagencythatwasacquiredthroughpurchase,
42transfer,exchange,orgiftshallbesold.
43 8.]Whenanyparcelofrealestateacquiredbyalandbankagencyissoldorotherwise
44disposedofbysuchlandbankagency,theproceedstherefromshallbeappliedanddistributed
45inthefollowingorder:
46 (1)Tothepaymentoftheexpensesofthesale;
47 (2)Tofulfilltherequirementsoftheresolution,indenture,orotherfinancing
48documentsadoptedorenteredintoinconnectionwithbonds,notes,orotherobligationsofthe
49landbankagency,totheextentthatsuchrequirementsmayapplywithrespecttosuchparcel
50ofrealestate;
51 (3)Tothelandbankagencytopaythesalariesandotherexpensesofsuchlandbank
52agencyandofitsemployeesasprovidedforinitsannualbudget;and
53 (4)Anyfundsinexcessofthosenecessarytomeettheexpensesoftheannualbudget
54ofthelandbankagencyinanyfiscalyearandareasonablesumtocarryoverintothenext
55fiscalyeartoassurethatsufficientfundswillbeavailabletomeetinitialexpensesforthat
56nextfiscalyearshallbepaidtotherespectivetaxingauthoritiesthat,atthetimeofthe
57distribution,aretaxingtherealpropertyfromwhichtheproceedsarebeingdistributed.The
58distributionsshallbeinproportiontotheamountsofthetaxesleviedonthepropertiesbythe
59taxingauthorities.DistributionshallbemadeonJanuaryfirstandJulyfirstofeachyear,and
60atsuchothertimesasthelandbankagencymaydetermine.

13 3.Ifalandbankagencysellsorotherwisedisposesofaparcelofrealestateheldby
14it,anylandtaxesassessedagainstsuchparcelforthethreetaxyearsfollowingsuchsaleor
15dispositionbysuchlandbankagencythatarecollectedbythecountycollectorinacalendar
16yearandnotrefunded,lessthefeesprovidedundersection52.260andsubsection4ofthis
17sectionandlesstheamountstobedeductedundersection137.720,shallbedistributedbythe
18countycollectortosuchlandbankagencynolaterthanMarchfirstofthefollowingcalendar
19year,providedthatlandtaxesimpoundedundersection139.031orotherwisepaidunder
20protestshallnotbesubjecttodistributionunderthissubsection.Anyamountrequiredtobe
21distributedtoalandbankagencyunderthissubsectionshallbesubjecttooffsetforamounts
22previouslydistributedtosuchlandbankagencythatwereassessed,collected,ordistributedin
23error.
24 4.Inadditiontoanyotherprovisionsoflawrelatedtocollectionfees,thecounty
25collectorshallcollectonbehalfofthecountyafeeoffourpercentofreserveperiodtaxes
26collectedandsuchfeescollectedshallbedepositedinthecountygeneralfund.
27 5.Ifacountyhasestablishedalandbankagencyundersubsection1ofsection
28140.981,thecollectormaycollectonbehalfofthecountyafeeforthecollectionof
29delinquentandbacktaxesofuptofivepercentonallsumscollectedtobeaddedtothefaceof
30thetaxbillandcollectedfromthepartypayingthetax.Allfeescollectedunderthe
31provisionsofthissubsectionshallbepaidtothelandbankagencyestablishedunder
32subsection1ofsection140.981.
