BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section313.820,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection313.820,toreadasfollows: 313.820.1.(1)Anexcursionboatlicenseeshallpaytothecommissionanadmission 2feeof[two]fourdollarsforeachpersonembarkingonanexcursiongamblingboat[witha 3ticketofadmission]. Onedollarofsuchfeeshallbedepositedtothecreditofthegaming 4commissionfundasauthorizedpursuanttosection313.835,[and]onedollarofsuchfeeshall 5notbeconsideredstatefundsandshallbepaidtothehomedockcityorcounty, andtwo 6dollarsofsuchfeeshallbepaidtotheveteranscommissioncapitalimprovementtrust 7fundbeginningontheeffectivedateofthissection. Subjecttoappropriation,onecentof 8suchfeedepositedtothecreditofthegamingcommissionfundmaybedepositedtothecredit 9ofthecompulsivegamblersfundcreatedpursuanttotheprovisionsofsection313.842. 10Nothinginthissectionshallprecludeanylicenseefromcharginganyamountdeemed 11necessaryforaticketofadmissiontoanypersonembarkingonanexcursiongamblingboat. 12Ifticketsareissuedwhicharegoodformorethanoneexcursion,theadmissionfeeshallbe 13paidtothecommissionforeachpersonusingtheticketoneachexcursionthattheticketis 14used.Iffreepassesorcomplimentaryadmissionticketsareissued,theexcursionboat 15licenseeshallpaytothecommissionthesamefeeuponthesepassesorcomplimentarytickets 16asiftheyweresoldattheregularandusualadmissionrate;however,theexcursionboat 17licenseemayissuefee-freepassestoactualandnecessaryofficialsandemployeesofthe EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18licenseeorotherpersonsactuallyworkingontheexcursiongamblingboat.Theissuanceof 19fee-freepassesissubjecttotherulesofthecommission,andalistofallpersonstowhomthe 20fee-freepassesareissuedshallbefiledwiththecommission. 21 (2)Thecommissionshall,withinthefirstthreemonthsofeachcalendaryear, 22adjusttheadmissionfeeestablishedinsubdivision(1)ofthissubsectioninaccordance 23withthefederalBureauofLaborStatisticsconsumerpriceindexandshallplacethe 24revisedfeeineffectatthebeginningoftheimmediatelyfollowingfiscalyear. 25 2.Alllicenseesaresubjecttoallincometaxes,salestaxes,earningstaxes,usetaxes, 26propertytaxesoranyothertaxorfeenoworhereafterlawfullyleviedbyanypolitical 27subdivision;however,nootherlicensetax,permittax,occupationtax,excursionfee,ortaxes 28orfeesshallbeimposed,leviedorassessedexclusivelyuponlicenseesbyapolitical 29subdivision.Allstatetaxesnotconnecteddirectlytogamblinggamesshallbecollectedby 30thedepartmentofrevenue.Notwithstandingtheprovisionsofsection32.057tothecontrary, 31thedepartmentofrevenuemayfurnishandthecommissionmayreceivetaxinformationto 32determineifapplicantsorlicenseesarecomplyingwiththetaxlawsofthisstate;however, 33anytaxinformationacquiredbythecommissionshallnotbecomepublicrecordandshallbe 34usedexclusivelyforcommissionbusiness. ✔ HB84 2
