JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmenttoArticleIVoftheConstitution
ofMissouri,byadoptingonenewsectionrelatingtopermissiblelobbyingactivities.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIVoftheConstitutionofthestate
5ofMissouri:
SectionA.ArticleIV,ConstitutionofMissouri,isamendedbyadoptingonenew
2section,tobeknownasSection55,toreadasfollows:
Section55.1.AfterDecember3,2026,nopersonwhohasservedasanelected
2officialunderorwasemployedasahigh-levelofficialormid-levelofficialbythe
3executivebranchshall:
4 (1)Act,serve,orregisterasapaidlobbyist;
5 (2)Engageincontractnegotiationswiththeexecutivebranchentitytheperson
6previouslyservedifsuchcontractscouldreasonablybenefitfromprivilegedaccess,
7knowledge,orrelationshipsestablishedduringsuchexecutivebranchservice;
8 (3)Participateinanyconsultantrolethatdirectlyleveragespriorexecutive
9branchserviceforprivategainonmatterscloselytiedtodecisionstheycontributedto
10withintheiragencyordepartment;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 11 (4)Solicitprospectiveemployersorclientstorepresentasapaidlobbyistduring
12thetimeofsuchserviceoremployment;or
13 (5)Actinsuchawayduringthetimeofsuchserviceoremploymentthatcould
14beconstruedassimilartoorthesameastheactionsofapaidlobbyist.
15 2.Anyformerelectedofficial,high-levelofficial,ormid-levelofficialofthe
16executivebranchwhobeginsemploymentwithanentitythatcontractsordealsdirectly
17withtheexecutivebranchentitywheresuchofficialwaselectedoremployedduringhis
18orherexecutivebranchserviceshalldisclosesuchemploymenttotheMissouriethics
19commissionwithinthirtydays.
20 3.TheMissouriethicscommissionshallretaindisclosuresreceivedunder
21subsection2ofthissectionandshallmakesuchdisclosuresaccessibletothepubliconits
22website.
23 4.Asusedinthissection,thefollowingtermsshallmean:
24 (1)"High-levelofficial",adirectorordeputydirectorofanyagencyor
25department,thechairofanycommission,oranyotherseniorexecutivepositionwith
26substantialdecision-makingauthority;
27 (2)"Mid-levelofficial",anyemployeeinsupervisoryorregulatoryroleswithin
28theexecutivebranchwhodirectlyreportstoahigh-levelofficialandpossesses
29significantauthorityoverpolicydecisionsoroperations.
