JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections30(a)and30
(b)ofArticleIVoftheConstitutionofMissouri,andadoptingtwonewsectionsin
lieuthereofrelatingtothestateroadfund.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIVoftheConstitutionofthestate
5ofMissouri:
SectionA.Sections30(a)and30(b),ArticleIV,ConstitutionofMissouri,are
2repealedandtwonewsectionsadoptedinlieuthereof,tobeknownasSections30(a)and30
3(b),toreadasfollows:
Section30(a).1.Ataxuponormeasuredbyfuelusedforpropellinghighwaymotor
2vehiclesshallbeleviedandcollectedasprovidedbylaw.Anyamountofthetaxcollected
3withrespecttofuelnotusedforpropellinghighwaymotorvehiclesshallberefundedbythe
4stateinthemannerprovidedbylaw.Theremainingnetproceedsofthetax,afterdeducting
5actualcostsofcollectionofthedepartmentofrevenue(butafterJune30,2005,notmorethan
6threepercentoftheamountcollected)andrefundsforoverpaymentsanderroneouspayments
7ofsuchtaxaspermittedbylaw,shallbeapportionedanddistributedbetweenthecounties,

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 8citiesandthestatehighwaysandtransportationcommissionashereinafterprovidedandshall
9standappropriatedwithoutlegislativeactionforthefollowingpurposes:
10 (1)Tenpercentoftheremainingnetproceedsshallbedepositedinaspecialtrustfund
11knownasthe"CountyAidRoadTrustFund".Inaddition,beginningJuly1,1994,an
12additionalfivepercentoftheremainingnetproceedswhichisderivedfromthedifference
13betweentheamountreceivedfromataxrateequaltothetaxrateineffectonMarch31,1992,
14andthetaxrateineffectonandafterJuly1,1994,shallalsobedepositedinthecountyaid
15roadtrustfund,andofsuchmoneysgeneratedbythisadditionalfivepercent,fivepercent
16shallbeapportionedanddistributedsolelytocitiesnotwithinanycountyinthisstate.After
17suchdistributiontocitiesnotwithinanycounty,theremainingproceedsinthecountyaid
18roadtrustfundshallbeapportionedanddistributedtothevariouscountiesofthestateonthe
19followingbasis:One-halfontheratiothatthecountyroadmileageofeachcountybearstothe
20countyroadmileageoftheentirestateasdeterminedbythelastavailablereportofthestate
21highwaysandtransportationcommissionandone-halfontheratiothattheruralland
22valuationofeachcountybearstotherurallandvaluationoftheentirestateasdeterminedby
23thelastavailablereportofthestatetaxcommission,exceptthatcountyroadmileagein
24incorporatedvillages,townsorcitiesandthelandvaluationinincorporatedvillages,townsor
25citiesshallbeexcludedinsuchdetermination,exceptthat,iftheassessedvaluationofrural
26landsinanycountyislessthanfivemilliondollars,thecountyshallbetreatedashavingan
27assessedvaluationoffivemilliondollars.Thefundsapportionedanddistributedtoeach
28countyshallbededicated,usedandexpendedbythecountysolelyfortheconstruction,
29reconstruction,maintenanceandrepairsofroads,bridgesandhighways,andsubjecttosuch
30otherprovisionsandrestrictionsasprovidedbylaw.Themoneysgeneratedbytheadditional
31fivepercentoftheremainingnetproceedswhichisderivedfromthedifferencebetweenthe
32amountreceivedfromataxrateequaltothetaxrateineffectonMarch31,1992,andthetax
33rateineffectonandafterJuly1,1994,shallnotbeusedorexpendedforequipment,
34machinery,salaries,fringebenefitsorcapitalimprovements,otherthanroadsandbridges.In
35countieshavingthetownshipformofcountyorganization,thefundsdistributedtosuch
36countiesshallbeexpendedsolelyunderthecontrolandsupervisionofthecounty
37commission,andshallnotbeexpendedbythevarioustownshipslocatedwithinsuch
38counties."Ruralland"asusedinthissectionshallmeanalllandlocatedwithinanycounty,
39exceptlandinincorporatedvillages,towns,orcities.
40 (2)Fifteenpercentoftheremainingnetproceedsshallbeapportionedanddistributed
41tothevariousincorporatedcities,townsandvillageswithinthestatesolelyforconstruction,
42reconstruction,maintenance,repair,policing,signing,lightingandcleaningroadsandstreets
43andforthepaymentofprincipalandinterestonindebtednessonaccountofroadandstreet
44purposes,andtheusethereofbeingsubjecttosuchotherprovisionsandrestrictionsas
HJR21 2 45providedbylaw.Theamountapportionedanddistributedtoeachcity,townorvillageshall
46bebasedontheratiothatthepopulationofthecity,townorvillagebearstothepopulationof
47allincorporatedcities,townsorvillagesinthestatehavingalikepopulation,asshownbythe
48lastfederaldecennialcensus,providedthatanycity,townorvillagewhichhadamotorfuel
49taxpriortotheadoptionofthissectionshallannuallyreceivenotlessthananamountequalto
50thenetrevenuederivedtherefromintheyear1960;[and]
51 (3)Onepercentoftheremainingnetproceedsshallbeapportionedand
52distributedtothecountiesbasedontheratioofthenumberofacresofpropertyassessed
53asagriculturalinacountytothenumberofacresofpropertyassessedasagriculturalin
54thestate;and
55 (4)Alltheremainingnetproceedsinexcessofthedistributionstocounties,andto
56cities,townsandvillagesunderthissectionshallbeapportioned,distributedanddepositedin
57thestateroadfundandshallbeexpendedandusedsolelyasprovidedinsubsection1of
58section30(b)ofArticleIVofthisConstitution.
59 2.Thedirectorofrevenueofthestateshallmaketheapportionment,distributionand
60depositofthefundsmonthlyinthemannerrequiredhereby.
61 3.Exceptfortaxesorlicenseswhichmaybeimposeduniformlyonallmerchantsor
62manufacturersbaseduponsales,orwhichuniformlyapplyadvaloremtothestocksof
63merchantsormanufacturers,nopoliticalsubdivisioninthisstateshallcollectanytax,excise,
64licenseorfeeupon,measuredbyorwithrespecttotheimportation,receipt,manufacture,
65storage,transportation,saleoruse,onorafterthefirstdayofthemonthnextfollowingthe
66adoptionofthissectionoffuelusedforpropellingmotorvehicles,unlessthetax,excise,
67licenseorfeeisapprovedbyavoteofthepeopleofanycity,townorvillagesubsequenttothe
68adoptionofthissection,byatwo-thirdsmajority.Allfundscollectedshallbeusedsolelyfor
69construction,reconstruction,maintenance,repair,policing,signing,lighting,andcleaning
70roadsandstreetsandforthepaymentandinterestonindebtednessincurredonaccountof
71roadandstreetpurposes.
72 4.Thenetproceedsoffueltaxesapportioned,distributedanddepositedunderthis
73sectiontothestateroadfund,counties,cities,townsandvillagesshallnotbeincludedwithin
74thedefinitionof"totalstaterevenues"insection17ofarticleXofthisconstitutionnorbe
75consideredasan"expenseofstategovernment"asthattermisusedinsection20ofarticleX
76ofthisconstitution.
Section30(b).1.Forthepurposeofconstructingandmaintaininganadequatesystem
2ofconnectedstatehighwaysallstaterevenuederivedfromhighwayusersasanincidentto
3theiruseorrighttousethehighwaysofthestate,includingallstatelicensefeesandtaxes
4uponmotorvehicles,trailersandmotorvehiclefuels,andupon,withrespectto,oronthe
5privilegeofthemanufacture,receipt,storage,distribution,saleorusethereof(excepting
HJR21 3 6thoseportionsofthesalestaxonmotorvehiclesandtrailerswhicharenotdistributedtothe
7stateroadfundpursuanttosubsection2ofthissection30(b)andfurtherexceptingall
8propertytaxes),lessthe(1)actualcostofcollectionofthedepartmentofrevenue(butnotto
9exceedthreepercentoftheparticulartaxorfeecollected),(2)actualcostofrefundsfor
10overpaymentsanderroneouspaymentsofsuchtaxesandfeesandmaintainingretirement
11programsaspermittedbylawand(3)actualcostofthestatehighwaypatrolinadministering
12andenforcinganystatemotorvehiclelawsandtrafficregulations,shallbedepositedinthe
13stateroadfundwhichisherebycreatedwithinthestatetreasury[andstandappropriated
14withoutlegislativeaction] tobeusedandexpendedbythehighwaysandtransportation
15commission, pursuanttoanappropriationbythegeneralassembly,forthefollowing
16purposes,andnoother:
17 First,tothepaymentoftheprincipalandinterestonanyoutstandingstateroadbonds.
18Thetermstateroadbondsinthissection30(b)meansanybondsorrefundingbondsissuedby
19thehighwaysandtransportationcommissiontofinanceorrefinancetheconstructionor
20reconstructionofthestatehighwaysystem.
21 Second,tomaintainabalanceinthestateroadfundintheamountdeemednecessary
22tomeetthepaymentoftheprincipalandinterestofanystateroadbondsforthenext
23succeedingtwelvemonths.
24 Theremainingbalanceinthestateroadfundshallbeusedandexpended[inthesole
25discretionofandunderthesupervisionanddirectionofthehighwaysandtransportation
26commission] forthefollowingstatehighwaysystemusesandpurposesandnoother:
27 (1)Tocompleteandwidenorotherwiseimproveandmaintainthestatehighway
28systemheretoforedesignatedandlaidoutunderexistinglaws;
29 (2)Toreimbursethevariouscountiesandotherpoliticalsubdivisionsofthestate,
30exceptincorporatedcitiesandtowns,formoneyexpendedbythemintheconstructionor
31acquisitionofroadsandbridgesnoworhereaftertakenoverbythehighwaysand
32transportationcommissionaspermanentpartsofthestatehighwaysystem,totheextentof
33thevaluetothestateofsuchroadsandbridgesatthetimetakenover,notexceedinginany
34casetheamountexpendedbysuchcountiesandsubdivisionsintheconstructionor
35acquisitionofsuchroadsandbridges,exceptthatthehighwaysandtransportation
36commissionmay,initsdiscretion,repay,oragreetorepay,anycashadvancedbyacounty
37orsubdivisiontoexpeditestateroadconstructionorimprovement;
38 (3)Inthediscretionofthecommissiontoplan,locate,relocate,establish,acquire,
39constructandmaintainthefollowing:
40 (a)interstateandprimaryhighwayswithinthestate;
41 (b)supplementarystatehighwaysandbridgesineachcountyofthestate;
HJR21 4 42 (c)statehighwaysandbridgesin,toandthroughstateparks,publicareasand
43reservations,andstateinstitutionsnoworhereafterestablishedtoconnectthesamewiththe
44statehighways,andalsonational,stateorlocalparkways,travelways,tourways,with
45coordinatedfacilities;
46 (d)anytunnelorinterstatebridgeorpartthereof,wherenecessarytoconnectthestate
47highwaysofthisstatewiththoseofotherstates;
48 (e)anyhighwaywithinthestatewhennecessarytocomplywithanyfederallawor
49requirementwhichisorshallbecomeaconditiontothereceiptoffederalfunds;
50 (f)anyhighwayinanycityortownwhichisfoundnecessaryasacontinuationofany
51stateorfederalhighway,oranyconnectiontherewith,intoandthroughsuchcityortown;and
52 (g)additionalstatehighways,bridgesandtunnels,eitherincongestedtrafficareasof
53thestateorwhereneededtofacilitateandexpeditethemovementofthroughtraffic.
54 (4)Toacquirematerials,equipmentandbuildingsandtoemploysuchpersonnelas
55necessaryforthepurposesdescribedinthissubsection1;[and]
56 (5)Forsuchotherpurposesandcontingenciesrelatingandappertainingtothe
57constructionandmaintenanceofsuchstatehighwaysystemasthehighwaysand
58transportationcommissionmaydeemnecessaryandproper; and
59 (6)Thestatewidetransportationimprovementprogram,oranysuccessor
60document,shallbeusedtoestablishprioritiesforprojectandprogramfundingforthe
61departmentoftransportation.
62 2.(1)Thestatesalestaxuponthesaleofmotorvehicles,trailers,motorcycles,
63mopedsandmotortricyclesattherateprovidedbylawonNovember2,2004,isleviedand
64imposedbythissectionuntiltherateischangedbylaworconstitutionalamendment.
65 (2)One-halfoftheproceedsfromthestatesalestaxonallmotorvehicles,trailers,
66motorcycles,mopedsandmotortricyclesshallbededicatedforhighwayandtransportation
67useandshallbeapportionedanddistributedasfollows:tenpercenttothecounties,fifteen
68percenttothecities,twopercenttobedepositedinthestatetransportationfund,whichis
69herebycreatedwithinthestatetreasurytobeusedinamannerprovidedbylawandseventy-
70threepercenttobedepositedinthestateroadfund.Theamountsapportionedanddistributed
71tothecountiesandcitiesshallbefurtherallocatedandusedasprovidedinsection30(a)of
72thisarticle.Theamountsallocatedanddistributedtothehighwaysandtransportation
73commissionforthestateroadfundshallbeusedasprovidedinsubsection1ofthissection30
74(b).Thesalestaxeswhichareapportionedanddistributedpursuanttothissubdivision(2)
75shallnotincludethosetaxesleviedandimposedpursuanttosections43(a)or47(a)ofthis
76article.Theterm"proceedsfromthestatesalestax"asusedinthissubdivision(2)shallmean
77andincludeallrevenuesreceivedbythedepartmentofrevenuefromthesaidsalestax,
78reducedonlybyrefundsforoverpaymentsanderroneouspaymentsofsuchtaxaspermitted
HJR21 5 79bylawandactualcostsofcollectionbythedepartmentofrevenue(butnottoexceedthree
80percentoftheamountcollected).
81 (3)(i)FromandafterJuly1,2005,throughJune30,2006,twenty-fivepercentofthe
82remainingone-halfoftheproceedsofthestatesalestaxonallmotorvehicles,trailers,
83motorcycles,mopedsandmotortricycleswhichisnotdistributedbysubdivision(2)of
84subsection2ofthissection30(b)shallbedepositedinthestateroadbondfundwhichis
85herebycreatedwithinthestatetreasury;(ii)fromandafterJuly1,2006,throughJune30,
862007,fiftypercentoftheaforesaidone-halfoftheproceedsofthestatesalestaxonallmotor
87vehicles,trailers,motorcycles,mopedsandmotortricycleswhichisnotdistributedby
88subdivision(2)ofsubsection2ofthissection30(b)shallbedepositedinthestateroadbond
89fund;(iii)fromandafterJuly1,2007,throughJune30,2008,seventy-fivepercentofthe
90aforesaidone-halfoftheproceedsofthestatesalestaxonallmotorvehicles,trailers,
91motorcycles,mopedsandmotortricycleswhichisnotdistributedbysubdivision(2)of
92subsection2ofthissection30(b)shallbedepositedinthestateroadbondfund;and(iv)from
93andafterJuly1,2008,onehundredpercentoftheaforesaidone-halfoftheproceedsofthe
94statesalestaxonallmotorvehicles,trailers,motorcycles,mopedsandmotortricycleswhich
95isnotdistributedbysubdivision(2)ofsubsection2ofthissection30(b)shallbedepositedin
96thestateroadbondfund.Moneysdepositedinthestateroadbondfundareherebydedicated
97toandshallonlybeusedtofundtherepaymentofbondsissuedbythehighwaysand
98transportationcommissiontofundtheconstructionandreconstructionofthestatehighway
99systemortofundrefundingbonds,exceptthatafterJanuary1,2009,thatportionofthe
100moneysinthestateroadbondfundwhichthecommissionerofadministrationandthe
101highwaysandtransportationcommissioneachcertifyisnotneededtomakepaymentsupon
102saidbondsortomaintainanadequatereserveformakingfuturepaymentsuponsaidbonds
103maybeappropriatedtothestateroadfund.Thehighwaysandtransportationcommission
104shallhaveauthoritytoissuestateroadbondsfortheusessetforthinthissubdivision(3).The
105netproceedsreceivedfromtheissuanceofsuchbondsshallbepaidintothestateroadfund
106andshallonlybeusedtofundconstructionorreconstructionofspecificprojectsforpartsof
107thestatehighwaysystemasdeterminedbythehighwaysandtransportationcommission.The
108moneysdepositedinthestateroadbondfundshallonlybewithdrawnbyappropriation
109pursuanttothisconstitution.Noobligationforthepaymentofmoneyssoappropriatedshall
110bepaidunlessthecommissionerofadministrationcertifiesitforpaymentandfurthercertifies
111thattheexpenditureisforausewhichisspecificallyauthorizedbytheprovisionsofthis
112subdivision(3).Theproceedsofthesalestaxwhicharesubjecttoallocationanddepositinto
113thestateroadbondfundpursuanttothissubdivision(3)shallnotincludetheproceedsofthe
114salestaxleviedandimposedpursuanttosections43(a)or47(a)ofthisarticlenorshallthey
115includetheproceedsofthatportionofthesalestaxapportioned,distributedanddedicatedto
HJR21 6 116theschooldistricttrustfundonNovember2,2004.Theterm"proceedsfromthestatesales
117tax"asusedinthissubdivision(3)shallmeanandincludeallrevenuesreceivedbythe
118departmentofrevenuefromthesaidsalestax,reducedonlybyrefundsforoverpaymentsand
119erroneouspaymentsofsuchtaxaspermittedbylawandactualcostsofcollectionbythe
120departmentofrevenue(butnottoexceedthreepercentoftheamountcollected).
121 3.AfterJanuary1,1980,anyincreaseinstatelicensefeesandtaxesonmotor
122vehicles,trailers,motorcycles,mopedsandmotortricyclesotherthanthosetaxesdistributed
123pursuanttosubsection2ofthissection30(b)shallbedistributedasfollows:tenpercenttothe
124counties,fifteenpercenttothecitiesandseventy-fivepercenttobedepositedinthestateroad
125fund.Theamountsdistributedshallbeapportionedanddistributedtothecountiesandcities
126asprovidedinsection30(a)ofthisarticle,tobeusedforhighwaypurposes.
127 4.Themoneysapportionedordistributedunderthissectiontothestateroadfund,the
128statetransportationfund,thestateroadbondfund,counties,cities,townsorvillagesshallnot
129beincludedwithinthedefinitionof"totalstaterevenues"asthattermisusedinsection17of
130ArticleXofthisconstitutionnorbeconsideredasan"expenseofstategovernment"asthat
131termisusedinsection20ofarticleXofthisconstitution.
