59-41 6.Anyactionchallengingthevalidityofanystatelawrelatingtoreproductive
60-42healthcareshallbebroughtintheCircuitCourtofColeCounty,Missouri.Ifsuch

41+22contrary,itshallbeillegalinthisstatetoprovidereproductivehealthcare,oranyother
42+23healthcarerelatingtoreproductivehealthcare,toaminorchildwithouttheprior
43+24notificationandinformedconsentofthechild'sparentorguardian,exceptinthecaseof
44+25medicalemergency.
45+26 5.Noabortionshallbeperformedorinduceduponawomanbasedonaprenatal
46+27diagnosis,test,orscreeningindicatingadisabilityinanunbornchild,exceptincasesof
47+28afetalanomaly.
48+29 6.Nopublicfundsshallbeexpendedforthepurposeofperforming,inducing,or
49+30otherwiseassistinganyabortion,exceptincasesofmedicalemergency,fetalanomaly,
50+31rape,orincest,orasotherwiseauthorizedbylaw.
51+32 7.Exceptincasesofamedicalemergencyinwhichconsentcannotbeobtained,
52+33noabortionshallbeperformedorinduceduponawomanwithouthervoluntaryand
53+34informedconsent,givenfreelyandwithoutcoercion.Inthecaseofaminorunderthe
54+35ageofeighteenyears,nopersonshallknowinglyperformorinduceanabortion,except
55+36incasesofamedicalemergencyinwhichconsentcannotbeobtained,unlessthe
56+37attendingphysicianhasobtained:(1)thewrittenconsentoftheminorandaparent,
57+38managingconservator,orlegalguardian;and(2)documentationoftheconsentis
58+39retainedintheminor'smedicalrecord.Thegeneralassemblymayenactlawstoprovide
59+40fortherightofaminortoconsenttoanabortionasgrantedbyacourtorder.
60+41 8.Fetalorganharvestingafteranabortionisnotpermittedunderany
61+42circumstances.
62+43 9.Awoman'sabilitytoaccesshealthcareincasesofmiscarriages,ectopic
63+44pregnancies,andothermedicalemergenciesshallnotbeinfringedbythestate.
64+45 10.Nogendertransitionsurgeriesshallbeknowinglyperformedonchildren
65+46undereighteenyearsofage,andnocross-sexhormonesorpuberty-blockingdrugsshall
66+47beknowinglyprescribedoradministeredforthepurposeofgendertransitionto
67+48childrenundereighteenyearsofage.Theprovisionsofthissectionshallnotapplyto

69+50verifiabledisorderofsexdevelopmentortotreatanyinfection,injury,disease,or

71+52 11.Anyactionchallengingthevalidityofanystatelawrelatingtoreproductive
72+53healthcareshallbebroughtintheCircuitCourtofColeCounty,Missouri.Ifa
73+54pleading,writtenmotion,orotherpaperdrawingintoquestiontheconstitutionalityofa
74+55statestatutedoesnotincludethestate,oneofitsagencies,oroneofitsofficersor
75+56employeesinanofficialcapacity,thepartybringingtheactionshallfileanoticeof
76+57constitutionalquestionandserveitontheattorneygeneralandtheattorneygeneral
77+58shallhavetherighttointerveneinthelitigation.
78+59 12.Thegeneralassemblyshallhavetheauthoritytoenactlawstocarryoutthe

114+3 2.TheGovernmentshallnotdenyorinfringeuponaperson's

116+5 carryoutdecisionsaboutallmattersrelatingtoreproductivehealthcare,
117+6 includingbutnotlimitedtoprenatalcare,childbirth,postpartumcare,birth
118+7 control,abortioncare,miscarriagecare,andrespectfulbirthingconditions.
119+8 3.Therighttoreproductivefreedomshallnotbedenied,interfered
120+9 with,delayed,orotherwiserestrictedunlesstheGovernmentdemonstratesthat
121+10 suchactionisjustifiedbyacompellinggovernmentalinterestachievedbythe
122+11 leastrestrictivemeans.Anydenial,interference,delay,orrestrictionofthe
123+12 righttoreproductivefreedomshallbepresumedinvalid.Forpurposesofthis
124+13 Section,agovernmentalinterestiscompellingonlyifitisforthelimited
125+14 purposeandhasthelimitedeffectofimprovingormaintainingthehealthofa
126+15 personseekingcare,isconsistentwithwidelyacceptedclinicalstandardsof
127+16 practiceandevidence-basedmedicine,anddoesnotinfringeonthatperson's

131+20 providedthatundernocircumstanceshalltheGovernmentdeny,interfere
132+21 with,delay,orotherwiserestrictanabortionthatinthegoodfaithjudgmentof
133+22 atreatinghealthcareprofessionalisneededtoprotectthelifeorphysicalor
134+23 mentalhealthofthepregnantperson.
135+24 5.Nopersonshallbepenalized,prosecuted,orotherwisesubjectedto
136+25 adverseactionbasedontheiractual,potential,perceived,orallegedpregnancy
137+26 outcomes,includingbutnotlimitedtomiscarriage,stillbirth,orabortion.Nor
138+27 shallanypersonassistingapersoninexercisingtheirrighttoreproductive
139+28 freedomwiththatperson'sconsentbepenalized,prosecuted,orotherwise
140+29 subjectedtoadverseactionfordoingso.
141+30 6.TheGovernmentshallnotdiscriminateagainstpersonsprovidingor
142+31 obtainingreproductivehealthcareorassistinganotherpersonindoingso.
143+32 7.IfanyprovisionofthisSectionortheapplicationthereoftoanyone
144+33 ortoanycircumstanceisheldinvalid,theremainderofthoseprovisionsand
145+34 theapplicationofsuchprovisionstoothersorothercircumstancesshallnotbe
