BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein: ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext 2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe 3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for 4adoptionorrejection,thefollowingamendmenttoArticleXIVoftheConstitutionofthestate 5ofMissouri: SectionA.Sections1and2,ArticleXIV,ConstitutionofMissouri,arerepealedand 2twonewsectionsadoptedinlieuthereof,tobeknownasSections1and2,toreadasfollows: Section1.1.Purposes. 2 Thissectionisintendedtopermitstate-licensedphysiciansandnursepractitionersto 3recommendmarijuanaformedicalpurposestopatientswithseriousillnessesandmedical 4conditions.Thesectionallowspatientswithqualifyingmedicalconditionstherightto 5discussfreelywiththeirphysiciansandnursepractitionersthepossiblebenefitsofmedical 6marijuanause,therightoftheirphysiciansandnursepractitionerstoprovideprofessional 7adviceconcerningthesame,andtherighttousemedicalmarijuanafortreatmentunderthe 8supervisionofaphysicianornursepractitioner. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 9 ThissectionisintendedtomakeonlythosechangestoMissourilawsthatare 10necessarytoprotectpatients,theirprimarycaregivers,andtheirphysiciansandnurse 11practitionersfromcivilandcriminalpenalties,andtoallowforthelimitedlegalproduction, 12distribution,saleandpurchaseofmarijuanaformedicaluse.Thissectionisnotintendedto 13changecurrentcivilandcriminallawsgoverningtheuseofmarijuanafornonmedical 14purposes.Thesectiondoesnotallowforthepublicuseofmarijuanaanddrivingunderthe 15influenceofmarijuana. 16 2.Definitions. 17 (1)"Administer"meansthedirectapplicationofmarijuanatoaqualifyingpatientby 18wayofanyofthefollowingmethods: 19 (a)Ingestionofcapsules,teas,oils,andothermarijuana-infusedproducts; 20 (b)Vaporizationorsmokingofdriedflowers,buds,plantmaterial,extracts,oils,and 21othermarijuana-infusedproducts; 22 (c)Applicationofointmentsorbalms; 23 (d)Transdermalpatchesandsuppositories; 24 (e)Consumingmarijuana-infusedfoodproducts;or 25 (f)Anyothermethodrecommendedbyaqualifyingpatient'sphysicianornurse 26practitioner. 27 (2)"Church"meansapermanentbuildingprimarilyandregularlyusedasaplaceof 28religiousworship. 29 (3)"Daycare"meansachild-carefacility,asdefinedbysection210.201,RSMo,or 30successorprovisions,thatislicensedbythestateofMissouri. 31 (4)"Department"meansthedepartmentofhealthandseniorservices,oritssuccessor 32agency. 33 (5)"Entity"meansanaturalperson,corporation,professionalcorporation,nonprofit 34corporation,cooperativecorporation,unincorporatedassociation,businesstrust,limited 35liabilitycompany,generalorlimitedpartnership,limitedliabilitypartnership,jointventure,or 36anyotherlegalentity. 37 (6)"Floweringplant"meansamarijuanaplantfromthetimeitexhibitsthefirstsigns 38ofsexualmaturitythroughharvest. 39 (7)"Infusedpreroll"meansaconsumableorsmokablemarijuanaproduct,generally 40consistingof:(1)awraporpaper,(2)driedflower,buds,and/orplantmaterial,and(3)a 41concentrate,oilorothertypeofmarijuanaextract,eitherwithinoronthesurfaceofthe 42product.Infusedprerollsmayormaynotincludeafilterorcrutchatthebaseoftheproduct. 43 (8)"Marijuana"or"marihuana"meansCannabisindica,Cannabissativa,and 44Cannabisruderalis,hybridsofsuchspecies,andanyotherstrainscommonlyunderstood 45withinthescientificcommunitytoconstitutemarijuana,aswellasresinextractedfromthe HJR72 2 46marijuanaplantandmarijuana-infusedproducts."Marijuana"or"marihuana"donotinclude 47industrialhemp,asdefinedbyMissouristatute,orcommoditiesorproductsmanufactured 48fromindustrialhemp. 49 (9)"Marijuana-infusedproducts"meansproductsthatareinfused,dipped,coated, 50sprayed,ormixedwithmarijuanaoranextractthereof,including,butnotlimitedto,products 51thatareabletobevaporizedorsmoked,edibleproducts,ingestibleproducts,topicalproducts, 52suppositories,andinfusedprerolls. 53 (10)"Medicalfacility"meansanymedicalmarijuanacultivationfacility,medical 54marijuanadispensaryfacility,ormedicalmarijuana-infusedproductsmanufacturingfacility, 55asdefinedinthissection. 56 (11)"Medicalmarijuanacultivationfacility"meansafacilitylicensedbythe 57departmenttoacquire,cultivate,process,package,storeonsiteoroffsite,transporttoor 58from,andsellmarijuana,marijuanaseeds,andmarijuanavegetativecuttings(alsoknownas 59clones)toamedicalmarijuanadispensaryfacility,medicalmarijuanatestingfacility,medical 60marijuanacultivationfacility,ortoamedicalmarijuana-infusedproductsmanufacturing 61facility.Amedicalmarijuanacultivationfacility'sauthoritytoprocessmarijuanashall 62includetheproductionandsaleofprerolls,butshallnotincludethemanufactureof 63marijuana-infusedproducts. 64 (12)"Medicalmarijuanadispensaryfacility"meansafacilitylicensedbythe 65departmenttoacquire,process,package,storeonsiteoroffsite,sell,transporttoorfrom,and 66delivermarijuana,marijuanaseeds,marijuanavegetativecuttings(alsoknownasclones), 67marijuana-infusedproducts,anddrugparaphernaliausedtoadministermarijuanaasprovided 68forinthissectiontoaqualifyingpatient,aprimarycaregiver,anywhereonthelicensed 69propertyortoanyaddressasdirectedbythepatientorprimarycaregiver,solongasthe 70addressisalocationallowingforthelegalpossessionofmarijuana,anothermedical 71marijuanadispensaryfacility,amarijuanatestingfacility,amedicalmarijuanacultivation 72facility,oramedicalmarijuana-infusedproductsmanufacturingfacility.Dispensaryfacilities 73mayreceivetransactionordersatthedispensaryinperson,byphone,orviatheinternet, 74includingfromathirdparty.Amedicalmarijuanadispensaryfacility'sauthoritytoprocess 75marijuanashallincludetheproductionandsaleofprerolls,butshallnotincludethe 76manufactureofmarijuana-infusedproducts. 77 (13)"Medicalmarijuana-infusedproductsmanufacturingfacility"meansafacility 78licensedbythedepartmenttoacquire,process,package,storeonsiteoroffsite,manufacture, 79transporttoorfrom,andsellmarijuana-infusedproductstoamedicalmarijuanadispensary 80facility,amarijuanatestingfacility,amedicalmarijuanacultivationfacility,ortoanother 81medicalmarijuana-infusedproductsmanufacturingfacility. HJR72 3 82 (14)"Marijuanatestingfacility"meansafacilitycertifiedbythedepartmentto 83acquire,test,certify,andtransportmarijuana,includingthoseoriginallylicensedasamedical 84marijuanatestingfacility. 85 (15)"Medicaluse"meanstheproduction,possession,delivery,distribution, 86transportation,oradministrationofmarijuanaoramarijuana-infusedproduct,ordrug 87paraphernaliausedtoadministermarijuanaoramarijuana-infusedproduct,forthebenefitof 88aqualifyingpatienttomitigatethesymptomsoreffectsofthepatient'squalifyingmedical 89condition. 90 (16)"Nursepractitioner"meansanindividualwhoislicensedandingoodstandingas 91anadvancedpracticeregisterednurse,orsuccessordesignation,underMissourilaw. 92 (17)"Owner"meansanindividualwhohasafinancial(otherthansecurityinterest, 93lien,orencumbrance)orvotinginterestintenpercentorgreaterofamarijuanafacility. 94 (18)"Physician"meansanindividualwhoislicensedandingoodstandingtopractice 95medicineorosteopathyunderMissourilaw. 96 (19)"Physicianornursepractitionercertification"meansadocument,whether 97handwritten,electronicorinanothercommonlyusedformat,signedbyaphysicianoranurse 98practitionerandstatingthat,inthephysician'sornursepractitioner'sprofessionalopinion,the 99patientsuffersfromaqualifyingmedicalcondition. 100 (20)"Preroll"meansaconsumableorsmokablemarijuanaproduct,generally 101consistingof:(1)awraporpaperand(2)driedflower,buds,and/orplantmaterial.Prerolls 102mayormaynotincludeafilterorcrutchatthebaseoftheproduct. 103 (21)"Primarycaregiver"meansanindividualtwenty-oneyearsofageorolderwho 104hassignificantresponsibilityformanagingthewell-beingofaqualifyingpatientandwhois 105designatedassuchontheprimarycaregiver'sapplicationforanidentificationcardunderthis 106sectionorinotherwrittennotificationtothedepartment. 107 (22)"Qualifyingmedicalcondition"meanstheconditionof,symptomsrelatedto,or 108side-effectsfromthetreatmentof: 109 (a)Cancer; 110 (b)Epilepsy; 111 (c)Glaucoma; 112 (d)Intractablemigrainesunresponsivetoothertreatment; 113 (e)Achronicmedicalconditionthatcausessevere,persistentpainorpersistent 114musclespasms,includingbutnotlimitedtothoseassociatedwithmultiplesclerosis,seizures, 115Parkinson'sdisease,andTourette'ssyndrome; 116 (f)Debilitatingpsychiatricdisorders,including,butnotlimitedto,posttraumatic 117stressdisorder,ifdiagnosedbyastatelicensedpsychiatrist; 118 (g)Humanimmunodeficiencyvirusoracquiredimmunedeficiencysyndrome; HJR72 4 119 (h)Achronicmedicalconditionthatisnormallytreatedwithaprescription 120medicationthatcouldleadtophysicalorpsychologicaldependence,whenaphysicianor 121nursepractitionerdeterminesthatmedicaluseofmarijuanacouldbeeffectiveintreatingthat 122conditionandwouldserveasasaferalternativetotheprescriptionmedication; 123 (i)Anyterminalillness;or 124 (j)Intheprofessionaljudgmentofaphysicianornursepractitioner,anyother 125chronic,debilitatingorothermedicalcondition,including,butnotlimitedto,hepatitisC, 126amyotrophiclateralsclerosis,inflammatoryboweldisease,Crohn'sdisease,Huntington's 127disease,autism,neuropathies,sicklecellanemia,agitationofAlzheimer'sdisease,cachexia, 128andwastingsyndrome. 129 (23)"Qualifyingpatient"meansanindividualdiagnosedwithatleastonequalifying 130medicalcondition. 131 (24)"Undulyburdensome"(whenreferringtoafacilitylicenseeorcertificateholder) 132meansthemeasuresnecessarytocomplywiththerulesorordinancesadoptedpursuanttothis 133sectionsubjectthepartytosuchahighinvestmentorexpenseofmoney,time,oranyother 134resourceorassetthatareasonablyprudentbusinesspersonwouldnotoperatethefacility;and 135(whenreferringtoqualifyingpatients,primarycaregivers,physicians,nursepractitioners,or 136otherparty)"undulyburdensome"meansthemeasuresnecessarytocomplywiththerulesor 137ordinancesadoptedpursuanttothissectionunderminethepurposeofthissection. 138 3.CreatingPatientAccesstoMedicalMarijuana. 139 (1)Incarryingouttheimplementationofthissection,thedepartmentshallhavethe 140authorityto: 141 (a)Grantorrefusestatelicensesandcertificationsforthecultivation,manufacture, 142dispensing,sale,testing,tracking,andtransportationofmarijuanaandmarijuana-infused 143productsformedicaluse,asprovidedbythissectionandgenerallaw;suspend,imposean 144authorizedfine,restrict,orrevokesuchlicensesandcertificationsuponaviolationofthis 145section,generallaw,orarulepromulgatedpursuanttothissection;andimposeany 146administrativepenaltyauthorizedbythissectionoranygenerallawenactedorrule 147promulgatedpursuanttothissection,solongasanyprocedurerelatedtoasuspensionor 148revocationincludesareasonablecureperiod,notlessthanthirtydays,priortothesuspension 149orrevocation,exceptininstanceswherethereisacredibleandimminentthreattopublic 150healthorpublicsafety. 151 (b)Promulgaterulesandemergencyrulesnecessaryfortheproperregulationand 152controlofthecultivation,manufacture,dispensing,andsaleofmarijuanaformedicaluseand 153fortheenforcementofthissectionsolongaspatientaccessisnotrestrictedunreasonablyand 154suchrulesarereasonablynecessaryforpatientsafetyortorestrictaccesstoonlylicensees 155andqualifyingpatients. HJR72 5 156 (c)Developsuchforms,certificates,licenses,identificationcards,andapplicationsas 157arenecessaryfor,orreasonablyrelatedto,theadministrationofthissectionoranyofthe 158rulespromulgatedunderthissection. 159 (d)Requireaseed-to-saletrackingsystemthattracksmedicalmarijuanafromeither 160theseedorimmatureplantstageuntilthemedicalmarijuanaormedicalmarijuana-infused 161productissoldtoaqualifyingpatientorprimarycaregivertoensurethatnomedical 162marijuanagrownbyamedicalmarijuanacultivationfacilityormanufacturedbyamedical 163marijuana-infusedproductsmanufacturingfacilityissoldorotherwisetransferredexceptbya 164medicalmarijuanadispensaryfacility.Thedepartmentshallcertify,ifpossible,atleasttwo 165commerciallyavailablesystemstolicenseesascompliantwithitstrackingstandardsand 166issuestandardsforthecreationoruseofothersystemsbylicensees. 167 (e)Issuestandardsforthesecuretransportationofmarijuanaandmarijuana-infused 168products.Thedepartmentshallcertifyentitieswhichdemonstratecompliancewithits 169transportationstandardstotransportmarijuanaandmarijuana-infusedproductstoorfroma 170medicalmarijuanacultivationfacility,amedicalmarijuana-infusedproductsmanufacturing 171facility,amedicalmarijuanadispensaryfacility,amarijuanatestingfacility,oranotherentity 172withatransportationcertification.Thedepartmentshalldeveloporadoptfromanyother 173governmentalagencysuchsafetyandsecuritystandardsasarereasonablynecessaryforthe 174transportationofmarijuanaandmarijuana-infusedproducts.Anyentitylicensedorcertified 175pursuanttothissectionshallbeallowedtotransportandstoremarijuana,marijuanaseeds, 176marijuanavegetativecuttings(alsoknownasclones)andmarijuana-infusedproductsfor 177purposesrelatedtotransportationincompliancewithdepartmentregulationsonstorageof 178marijuanaandmarijuana-infusedproducts. 179 (f)Thedepartmentmaychargeafeenottoexceed$5,000foranycertificationissued 180pursuanttothissection. 181 (g)Prepareandtransmitannuallyapubliclyavailablereportaccountingtothe 182governorfortheefficientdischargeofallresponsibilitiesassignedtothedepartmentunder 183thissection. 184 (h)Establishalotteryselectionprocesstoselectmedicalmarijuanalicenseeand 185certificateapplicants,onlyincaseswheremoreapplicantsapplythantheminimumnumberof 186licensesorcertificatesascalculatedbythissection.Tobeeligibleforthemedicalmarijuana 187licenselotteryprocess,anapplicantcannothaveanownerwhohaspleadedorbeenfound 188guiltyofadisqualifyingfelony.A"disqualifyingfelonyoffense"isaviolationof,and 189convictionorguiltypleato,stateorfederallawthatis,orwouldhavebeen,afelonyunder 190Missourilaw,regardlessofthesentenceimposed,unlessthedepartmentdeterminesthat: 191 a.Theperson'sconvictionwasforamarijuanaoffense,otherthanprovisionof 192marijuanatoaminor;or HJR72 6 193 b.Theperson'sconvictionwasforanon-violentcrimeforwhichheorshewasnot 194incarceratedandthatismorethanfiveyearsold;or 195 c.Morethanfiveyearshavepassedsincethepersonwasreleasedfromparoleor 196probation,andheorshehasnotbeenconvictedofanysubsequentfelonycriminaloffenses. 197 Thedepartmentmayconsultwithandrelyontherecords,advice,and 198recommendationsoftheattorneygeneralandthedepartmentofpublicsafety,ortheir 199successorentities,incarryingouttheprovisionsofthissubdivision. 200 Inestablishingalotteryselectionprocesstoselectmedicalmarijuanalicenseeand 201certificateapplicantsandawardinglicensesandcertificates,thedepartmentmayconsultor 202contractwithotherpublicagencieswithrelevantexpertise.Thedepartmentshallliftorease 203anylimitonthenumberoflicenseesorcertificateholdersinordertomeetthedemandfor 204marijuanaformedicalusebyqualifyingpatients. 205 (2)Thedepartmentshallissueanyrulesoremergencyrulesnecessaryforthe 206implementationandenforcementofthissectionandtoensuretherightto,availability,and 207safeuseofmarijuanaformedicalusebyqualifyingpatients.Indevelopingsuchrulesor 208emergencyrules,thedepartmentmayconsultwithotherpublicagencies.Inadditiontoany 209otherrulesoremergencyrulesnecessarytocarryoutthemandatesofthissection,the 210departmentmayissuerulesoremergencyrulesrelatingtothefollowingsubjects: 211 (a)Compliancewith,enforcementof,orviolationofanyprovisionofthissectionor 212anyruleissuedpursuanttothissection,includingproceduresandgroundsfordenying, 213suspending,imposinganauthorizedfine,andrestricting,orrevokingastatelicenseor 214certificationissuedpursuanttothissection,solongasanyprocedurerelatedtoasuspension 215orrevocationincludesareasonablecureperiod,notlessthanthirtydays,priortothe 216suspensionorrevocation,exceptininstanceswherethereisacredibleandimminentthreatto 217publichealthorpublicsafety; 218 (b)Specificationsofdutiesofofficersandemployeesofthedepartment; 219 (c)Instructionsorguidanceforlocalauthoritiesandlawenforcementofficers; 220 (d)Requirementsforinspections,investigations,searches,seizures,andsuch 221additionalenforcementactivitiesasmaybecomenecessaryfromtimetotime; 222 (e)Asotherwiseauthorizedbythissectionorgenerallaw,administrativepenalties 223andpoliciesforusebythedepartment; 224 (f)Prohibitionofmisrepresentationandunfairpractices; 225 (g)Controlofinformationalandproductdisplaysonlicensedpremisesprovidedthat 226therulesmaynotpreventorunreasonablyrestrictappropriatesignsonthepropertyofthe 227medicalmarijuanadispensaryfacility,productdisplayandexaminationbythequalifying 228patientand/orprimarycaregiver,listingsinbusinessdirectoriesincludingphonebooks, 229listingsinmarijuana-relatedormedicalpublications,orthesponsorshipofhealthornotfor HJR72 7 230profitcharityoradvocacyevents.[While] Thedepartmentshallhavethegeneralpowerto 231regulatetheadvertisingandpromotionofmarijuanasales[, underallcircumstances,anysuch 232regulationshallbenomorestringentthancomparablestateregulationsontheadvertisingand 233promotionofalcoholsales]. Thedepartmentshalladoptruleswithrestrictionsonthe 234advertisingandpromotionofmarijuanasalesthatareatleastasstringentasthe 235restrictionsontheadvertisingandpromotionofcigarettesimposedbyfederallawsand 236regulations; 237 (h)Developmentofindividualidentificationcardsforowners,officers,managers, 238contractors,employees,andothersupportstaffofentitieslicensedorcertifiedpursuanttothis 239section,includingafingerprint-basedfederalandstatecriminalrecordcheckinaccordance 240withU.S.PublicLaw92-544,oritssuccessorprovisions,asmayberequiredbythe 241departmentpriortoissuingacardandprocedurestoensurethatcardsfornewapplicantsare 242issuedwithinfourteendays.Applicantslicensedpursuanttothissectionshallsubmit 243fingerprintstotheMissouristatehighwaypatrolforthepurposeofconductingastateand 244federalfingerprint-basedcriminalbackgroundcheck.TheMissouristatehighwaypatrol,if 245necessary,shallforwardthefingerprintstotheFederalBureauofInvestigation(FBI)forthe 246purposeofconductingafingerprint-basedcriminalbackgroundcheck.Fingerprintsshallbe 247submittedpursuanttosection43.543,RSMo,oritssuccessorprovisions,andfeesshallbe 248paidpursuanttosection43.530,RSMo,oritssuccessorprovisions.Unlessotherwise 249requiredbylaw,noindividualshallberequiredtosubmitfingerprintsmorethanonce; 250 (i)Securityrequirementsforanypremiseslicensedorcertifiedpursuanttothis 251section,including,ataminimum,lighting,physicalsecurity,video,alarmrequirements,and 252otherminimumproceduresforinternalcontrolasdeemednecessarybythedepartmentto 253properlyadministerandenforcetheprovisionsofthissection,includingreporting 254requirementsforchanges,alterations,ormodificationstothepremises; 255 (j)Regulationofthestorageof,warehousesfor,andtransportationofmarijuanafor 256medicaluse; 257 (k)Sanitaryrequirementsfor,including,butnotlimitedto,thepreparationofmedical 258marijuana-infusedproducts; 259 (l)Thespecificationofacceptableformsofpictureidentificationthatamedical 260marijuanadispensaryfacilitymayacceptwhenverifyingasale; 261 (m)Labelingandpackagingstandards; 262 (n)Recordstobekeptbylicenseesandtherequiredavailabilityoftherecords; 263 (o)Statelicensingprocedures,includingproceduresforrenewals,reinstatements, 264initiallicenses,andthepaymentoflicensingfees; 265 (p)Thereportingandtransmittaloftaxpayments; HJR72 8 266 (q)Authorizationforthedepartmentofrevenuetohaveaccesstolicensing 267informationtoensuretaxpaymentandtheeffectiveadministrationofthissection;and 268 (r)Suchothermattersasarenecessaryforthefair,impartial,stringent,and 269comprehensiveadministrationofthissection. 270 (3)Thedepartmentshallissuerulesoremergencyrulesforamedicalmarijuanaand 271medicalmarijuana-infusedproductsindependenttestingandcertificationprogramfor 272medicalmarijuanalicenseesandrequiringlicenseestotestmedicalmarijuanausingoneor 273moreimpartial,independentlaboratoriestoensure,ataminimum,thatproductssoldfor 274humanconsumptiondonotcontaincontaminantsthatareinjurioustohealth,toensurecorrect 275labelingandmeasurepotency.Thedepartmentshallnotrequireanymedicalmarijuanaor 276medicalmarijuana-infusedproductstobetestedmorethanoncepriortosale. 277 (4)Thedepartmentshallissuerulesoremergencyrulestoprovideforthe 278certificationofandstandardsformarijuanatestingfacilities,includingtherequirementsfor 279equipmentandqualificationsforpersonnel,butshallnotrequirecertificateholderstohave 280anyfederalagencylicensingorhaveanyrelationshipwithafederallylicensedtestingfacility. 281Thedepartmentshallcertify,ifpossible,atleasttwoentitiesasmarijuanatestingfacilities. 282Nomarijuanatestingfacilityshallbeownedbyanentityorentitiesundersubstantially 283commoncontrol,ownership,ormanagementasamedicalmarijuanacultivationfacility, 284medicalmarijuana-infusedproductmanufacturingfacility,ormedicalmarijuanadispensary 285facility. 286 (5)Anyinformationreleasedbythedepartmentrelatedtopatientsmayonlybefora 287purposeauthorizedbyfederallawandthissection,includingverifyingthatapersonwho 288presentedapatientidentificationcardtoastateorlocallawenforcementofficialislawfullyin 289possessionofsuchcard.BeginningDecember8,2022,allpublicrecordsproducedor 376plants,sixnonfloweringmarijuanaplants(overfourteeninchestall),andsixclones(plants HJR72 11 377underfourteeninchestall)fortheexclusiveuseofthatqualifyingpatient.Thecardshallbe 378validforthreeyearsfromitsdateofissuanceandshallberenewablewiththesubmittalofa 379neworupdatedphysicianornursepractitionercertification.Thedepartmentshallchargea 380feeforthecardoffiftydollars,withsuchratetobeincreasedordecreasedeachyearbythe 381percentageofincreaseordecreasefromtheendofthepreviouscalendaryearofthe 382ConsumerPriceIndex,orsuccessorindexaspublishedbytheU.S.DepartmentofLabor,or 383itssuccessoragency. 384 (13)Thedepartmentmaysetalimitontheamountofmarijuanathatmaybe 385purchasedbyoronbehalfofasinglequalifyingpatientinathirty-dayperiod,providedthat 386limitisnotlessthansixouncesofdried,unprocessedmarijuana,oritsequivalent.Anysuch 387limitshallnotapplytoaqualifyingpatientwithwrittencertificationfromaphysicianornurse 388practitionerthattherearecompellingreasonswhythequalifyingpatientneedsagreater 389amountthanthelimitestablishedbythedepartment. 390 (14)Thedepartmentmaysetalimitontheamountofmarijuanathatmaybe 391possessedbyoronbehalfofeachqualifyingpatient,providedthatlimitisnotlessthana 392sixty-daysupplyofdried,unprocessedmarijuana,oritsequivalent.Aprimarycaregivermay 393possessaseparatelegallimitforeachqualifyingpatientundertheircareandaseparatelegal 394limitforthemselvesiftheyareaqualifyingpatient.Qualifyingpatientscultivatingmarijuana 395formedicalusemaypossessuptoaninety-daysupply,solongasthesupplyremainson 396propertyundertheircontrol.Anysuchlimitshallnotapplytoaqualifyingpatientwith 397writtencertificationfromanindependentphysicianornursepractitionerthatthereare 398compellingreasonsforadditionalamounts.Possessionofbetweenthelegallimitandupto 399twicethelegallimitshallsubjectthepossessortodepartmentsanctions,includingan 400administrativepenaltyofuptotwohundreddollarsandlossoftheirpatientidentificationcard 401foruptoayear.Purposefullypossessingamountsinexcessoftwicethelegallimitshallbe 402punishableasaninfractionunderapplicablelaw. 403 (15)Thedepartmentmayrestricttheaggregatenumberoflicensesgrantedfor 404medicalmarijuanacultivationfacilitiesandcomprehensivemarijuanacultivationfacilities 405authorizedbysection2combined,provided,however,thatthenumbermaynotbelimitedto 406fewerthanonelicensepereveryonehundredthousandinhabitants,oranyportionthereof,of 407thestateofMissouri,accordingtothemostrecentcensusoftheUnitedStates.Adecreasein 408thenumberofinhabitantsinthestateofMissourishallhavenoimpact. 409 (16)Thedepartmentmayrestricttheaggregatenumberoflicensesgrantedfor 410medicalmarijuana-infusedproductsmanufacturingfacilitiesandcomprehensivemarijuana- 411infusedproductsmanufacturingfacilitiesauthorizedbysection2combined,provided, 412however,thatthenumbermaynotbelimitedtofewerthanonelicensepereveryseventy 413thousandinhabitants,oranyportionthereof,ofthestateofMissouri,accordingtothemost HJR72 12 414recentcensusoftheUnitedStates.Adecreaseinthenumberofinhabitantsinthestateof 415Missourishallhavenoimpact. 416 (17)Thedepartmentmayrestricttheaggregatenumberoflicensesgrantedfor 417medicalmarijuanadispensaryfacilitiesandcomprehensivemarijuanadispensaryfacilities 418authorizedbysection2combined,provided,however,thatthenumbermaynotbelimitedto 419fewerthantwenty-fourlicensesineachUnitedStatescongressionaldistrictinthestateof 420Missouripursuanttothemapofeachoftheeightcongressionaldistrictsasdrawnand 421effectiveonDecember6,2018.Futurechangestotheboundariesoforthenumberof 422congressionaldistrictsshallhavenoimpact. 423 (18)Thedepartmentshallbeginacceptinglicenseandcertificationapplicationsfor 424medicalmarijuanadispensaryfacilities,marijuanatestingfacilities,medicalmarijuana 425cultivationfacilities,medicalmarijuana-infusedproductsmanufacturingfacilities,seed-to- 426saletrackingsystems,andfortransportationofmarijuananolaterthantwohundredforty 427daysafterDecember6,2018.Applicationsforlicensesandcertificationsunderthissection 428shallbeapprovedordeniedbythedepartmentnolaterthanonehundredfiftydaysaftertheir 429submission.Ifthedepartmentfailstocarryoutitsnondiscretionarydutytoapproveordeny 430anapplicationwithinonehundredfiftydaysofsubmission,anapplicantmayimmediately 431seekacourtordercompellingthedepartmenttoapproveordenytheapplication. 432 (19)Qualifyingpatientsunderthissectionshallobtainanidentificationcardorcards 433fromthedepartment.Thedepartmentshallchargeafeeoftwenty-fivedollarspercard.Such 434feemaybeincreasedordecreasedeachyearbythepercentageofincreaseordecreasefrom 435theendofthepreviouscalendaryearoftheConsumerPriceIndex,orsuccessorindexas 436publishedbytheU.S.DepartmentofLabororitssuccessoragency.Cardsshallbevalidfor 437threeyearsandmayberenewedwithanewphysicianornursepractitionercertification. 438Uponreceivinganapplicationforaqualifyingpatientidentificationcardorqualifyingpatient 439cultivationidentificationcard,thedepartmentshall,withinthirtydays,eitherissuethecardor 440provideawrittenexplanationforitsdenial.Ifthedepartmentfailstodenyandfailstoissuea 441cardtoaneligiblequalifyingpatientwithinthirtydays,thentheirphysicianornurse 442practitionercertificationshallserveastheirqualifyingpatientidentificationcardorqualifying 443patientcultivationidentificationcardforuptooneyearfromthedateofphysicianornurse 444practitionercertification.Allinitialapplicationsfororrenewalsofaqualifyingpatient 445identificationcardorqualifyingpatientcultivationidentificationcardshallbeaccompanied 446byaphysicianornursepractitionercertificationthatislessthanthirtydaysold. 447 (20)Primarycaregiversunderthissectionshallobtainanidentificationcardfromthe 448department.Cardsshallbevalidforthreeyears.Thedepartmentshallchargeafeeof 449twenty-fivedollarspercard.Suchfeemaybeincreasedordecreasedeachyearbythe 450percentageofincreaseordecreasefromtheendofthepreviouscalendaryearofthe HJR72 13 451ConsumerPriceIndex,orsuccessorindexaspublishedbytheU.S.DepartmentofLabor,or 452itssuccessoragency.Uponreceivinganapplicationforaprimarycaregiveridentification 453card,thedepartmentshall,withinthirtydays,eitherissuethecardorprovideawritten 454explanationforitsdenial. 455 (21)ExceptasotherwiseprovidedinthisArticle,allmarijuanaformedicalusesold 456inMissourishallbecultivatedinalicensedmedicalmarijuanacultivationfacilitylocatedin 457Missouri. 458 (22)ExceptasotherwiseprovidedinthisArticle,allmarijuana-infusedproductsfor 459medicalusesoldinthestateofMissourishallbemanufacturedinamedicalmarijuana- 460infusedproductsmanufacturingfacility. 461 (23)Thedenialofalicense,licenserenewal,oridentificationcardbythedepartment 462shallbeappealabletotheadministrativehearingcommission,oritssuccessorentity. 463Followingtheexhaustionofadministrativereview,denialofalicense,licenserenewal,or 464identificationcardbythedepartmentshallbesubjecttojudicialreviewasprovidedbylaw. 465 (24)Noelectedofficialshallinterferedirectlyorindirectlywiththedepartment's 466obligationsandactivitiesunderthissection. 467 (25)Thedepartmentshallnothavetheauthoritytoapplyorenforceanyunduly 468burdensomeruleorregulationoradministrativepenaltyuponanyoneormorelicenseesor 469certificateholders,anyqualifyingpatients,ortheirprimarycaregivers,oracttoundermine 470thepurposesofthissection. 471 4.TaxationandReporting. 472 (1)Ataxisleviedupontheretailsaleofmarijuanaformedicalusesoldatmedical 473marijuanadispensaryfacilitieswithinthestate.Thetaxshallbeatarateoffourpercentof 474theretailprice.Thetaxshallbecollectedbyeachlicensedmedicalmarijuanadispensary 475facilityandpaidtothedepartmentofrevenue.Afterretainingnomorethantwopercentfor 476itsactualcollectioncosts,amountsgeneratedbythemedicalmarijuanatangiblepersonal 477propertyretailsalestaxleviedinthissectionshallbedepositedbythedepartmentofrevenue 478intotheMissouriveterans'healthandcarefund.Licensedentitiesmakingretailsaleswithin 479thestateshallbeallowedapprovedcreditforreturnsprovidedthetaxwaspaidonthe 480returneditemandthepurchaserwasgiventherefundorcredit. 481 (2)Thereisherebycreatedinthestatetreasurythe"MissouriVeterans'Healthand 482CareFund",whichshallconsistoftaxesandfeescollectedunderthissection.Thestate 483treasurershallbecustodianofthefund,andheorsheshallinvestmoniesinthefundinthe 484samemannerasotherfundsareinvested.Anyinterestandmoniesearnedonsuch 485investmentsshallbecreditedtothefund.Notwithstandinganyotherprovisionoflaw,any 486moniesremaininginthefundattheendofabienniumshallnotreverttothecreditofthe 487generalrevenuefund.Thecommissionerofadministrationisauthorizedtomakecash HJR72 14 488operatingtransferstothefundforpurposesofmeetingthecashrequirementsofthe 489departmentinadvanceofitreceivingannualapplication,licensing,andtaxrevenue,withany 490suchtransferstoberepaidasprovidedbylaw.Thefundshallbeadedicatedfundandshall 491standappropriatedwithoutfurtherlegislativeactionasfollows: 492 (a)First,tothedepartment,anamountnecessaryforthedepartmenttocarryoutthis 493section,includingrepaymentofanycashoperatingtransfers,paymentsmadethroughcontract 494oragreementwithotherstateandpublicagenciesnecessarytocarryoutthissection,anda 495reservefundtomaintainareasonableworkingcashbalanceforthepurposeofcarryingout 496thissection; 497 (b)Next,theremainderofsuchfundsshallbetransferredtotheMissouriveterans 498commissionforhealthandcareservicesformilitaryveterans,includingthefollowing 499purposes:operations,maintenanceandcapitalimprovementsoftheMissouriveteranshomes, 500theMissouriserviceofficer'sprogram,andotherservicesforveteransapprovedbythe 501commission,including,butnotlimitedto,healthcareservices,mentalhealthservices,drug 502rehabilitationservices,housingassistance,jobtraining,tuitionassistance,andhousing 503assistancetopreventhomelessness.TheMissouriveteranscommissionshallcontractwith 504otherpublicagenciesforthedeliveryofservicesbeyonditsexpertise. 505 (c)Allmoniesfromthetaxesauthorizedunderthissubsectionshallprovide 506additionaldedicatedfundingforthepurposesenumeratedaboveandshallnotreplaceexisting 507dedicatedfunding. 508 (3)Forallretailsalesofmarijuanaformedicaluse,arecordshallbekeptbytheseller 509whichidentifies,bysecureandencryptedpatientnumberissuedbythesellertothequalifying 510patientinvolvedinthesale,allamountsandtypesofmarijuanainvolvedinthesaleandthe 511totalamountofmoneyinvolvedinthesale,includingitemizations,taxescollectedandgrand 512totalsaleamounts.Allsuchrecordsshallbekeptonthepremisesinareadilyavailable 513formatandbemadeavailableforreviewbythedepartmentandthedepartmentofrevenue 514uponrequest.Suchrecordsshallberetainedforfiveyearsfromthedateofthesale. 515 (4)Thetaxleviedpursuanttothissubsectionisseparatefrom,andinadditionto,any 516generalstateandlocalsalesandusetaxesthatapplytoretailsales,whichshallcontinuetobe 517collectedanddistributedasprovidedbygenerallaw. 518 (5)Exceptasauthorizedinthissubsection,noadditionaltaxesshallbeimposedon 519thesaleofmarijuanaformedicaluse. 520 (6)ThefeesandtaxesprovidedforinthisArticleXIV,Section1shallbefully 521enforceablenotwithstandinganyotherprovisioninthisConstitutionpurportedlyprohibiting 522orrestrictingthetaxesandfeesprovidedforherein. HJR72 15 523 (7)Theunexpendedbalanceexistinginthefundshallbeexemptfromtheprovisions 524ofsection33.080,RSMo,oritssuccessorprovisions,relatingtothetransferofunexpended 525balancestothegeneralrevenuefund. 526 (8)FortaxpayersauthorizedtodobusinesspursuanttothisArticle,theamountthat 527wouldhavebeendeductedinthecomputationoffederaltaxableincomepursuantto26U.S.C. 528Section280EoftheInternalRevenueCodeasineffectonJanuary1,2021,orsuccessor 529provisions,butisdisallowedbecausecannabisisacontrolledsubstanceunderfederallaw, 530shallbesubtractedfromthetaxpayer'sfederaladjustedgrossincome,indeterminingthe 531taxpayer'sMissouriadjustedgrossincome. 532 5.AdditionalPatient,Physician,NursePractitioner,CaregiverandProvider 533Protections. 534 (1)Exceptasprovidedinthissection,thepossessionofmarijuanainquantitiesless 535thanthelimitsofthissection,orestablishedbythedepartment,andtransportationof 536marijuanabythequalifyingpatientorprimarycaregivershallnotsubjectthepossessorto 537arrest,criminalorcivilliability,orsanctionsunderMissourilaw,providedthatthepossessor 538producesondemandtotheappropriateauthorityavalidqualifyingpatientidentificationcard; 539avalidqualifyingpatientcultivationidentificationcard;avalidphysicianornurse 540practitionercertificationwhilemakingapplicationforanidentificationcard;oravalid 541primarycaregiveridentificationcard.Productionoftherespectivesubstantiallyequivalent 542identificationcardorauthorizationissuedbyanotherstateorpoliticalsubdivisionofanother 543stateshallalsomeettherequirementsofthissubdivisionandshallallowforthepurchaseof 544medicalmarijuanaforusebyanon-residentpatientfromamedicalmarijuanadispensary 545facilityaspermittedbythissectionandincompliancewithdepartmentregulations. 546 (2)Nopatientshallbedeniedaccesstoorpriorityforanorgantransplantorother 547medicalcarebecausetheyholdaqualifyingpatientidentificationcardorusemarijuanafor 548medicaluse. 549 (3)Aphysicianornursepractitionershallnotbesubjecttocriminalorcivilliability 550orsanctionsunderMissourilawordisciplinebytheMissouristateboardofregistrationfor 551thehealingarts,theMissouristateboardofnursing,ortheirrespectivesuccessoragencies, 552forowning,operating,investingin,beingemployedby,orcontractingwithanyentity 553licensedorcertifiedpursuanttothissectionorissuingaphysicianornursepractitioner 554certificationtoapatientdiagnosedwithaqualifyingmedicalconditioninamannerconsistent 555withthissectionandlegalstandardsofprofessionalconduct. 556 (4)Ahealthcareprovidershallnotbesubjecttocivilorcriminalprosecutionunder 557Missourilaw,denialofanyrightorprivilege,civiloradministrativepenaltyorsanction,or 558disciplinaryactionbyanyaccreditationorlicensingboardorcommissionforowning, 559operating,investingin,beingemployedby,orcontractingwithanyentitylicensedorcertified HJR72 16 560pursuanttothissectionorprovidinghealthcareservicesthatinvolvethemedicaluseof 561marijuanaconsistentwiththissectionandlegalstandardsofprofessionalconduct. 562 (5)Amarijuanatestingfacilityshallnotbesubjecttocivilorcriminalprosecution 563underMissourilaw,denialofanyrightorprivilege,civiloradministrativepenaltyor 564sanction,ordisciplinaryactionbyanyaccreditationorlicensingboardorcommissionfor 565providinglaboratorytestingservicesthatrelatetothemedicaluseofmarijuanaconsistent 566withthissectionandotherwisemeetinglegalstandardsofprofessionalconduct. 567 (6)Ahealthcareprovidershallnotbesubjecttomandatoryreportingrequirements 568forthemedicaluseofmarijuanabynonemancipatedqualifyingpatientsundereighteenyears 569ofageinamannerconsistentwiththissectionandwithconsentofaparentorguardian. 570 (7)Aprimarycaregivershallnotbesubjecttocriminalorcivilliabilityorsanctions 571underMissourilawforpurchasing,transporting,oradministeringmarijuanaformedicaluse 572toaqualifyingpatientorparticipatinginthepatientcultivationofuptosixflowering 573marijuanaplants,sixnonfloweringmarijuanaplants(overfourteeninchestall),andsixclones 574(plantsunderfourteeninchestall)perpatientandnomorethantwenty-fourfloweringplants 575formorethanonequalifyingpatientinamannerconsistentwiththissectionandgenerally 576establishedlegalstandardsofpersonalorprofessionalconduct. 577 (8)NotwithstandinganyprovisionofArticleVtothecontrary,anattorneyshallnot 578besubjecttodisciplinaryactionbytheSupremeCourtofMissouri,theofficeofchief 579disciplinarycounsel,thestatebarassociation,anystateagency,oranyprofessionallicensing 580bodyforanyofthefollowing: 581 (a)Owning,operating,investingin,beingemployedby,orcontractingwith 582prospectiveorlicensedmarijuanatestingfacilities,medicalmarijuanacultivationfacilities, 583medicalmarijuanadispensaryfacilities,medicalmarijuana-infusedproductsmanufacturing 584facilities,ortransportationcertificateholders; 585 (b)Counseling,advising,and/orassistingaclientinconductpermittedbyMissouri 586lawthatmayviolateorconflictwithfederalorotherlaw,aslongastheattorneyadvisesthe 587clientaboutthatfederalorotherlawanditspotentialconsequences; (10)Nothinginthissectionshallprovideimmunityfornegligence,eithercommon 604laworstatutorilycreated,norcriminalimmunitiesforoperatingavehicle,aircraft,dangerous 605device,ornavigatingaboatundertheinfluenceofmarijuana. 606 (11)ItisthepublicpolicyofthestateofMissourithatcontractsrelatedtomarijuana 607formedicalusethatareenteredintobyqualifyingpatients,primarycaregivers,marijuana 608testingfacilities,medicalmarijuanacultivationfacilities,medicalmarijuana-infusedproducts 609manufacturingfacilities,ormedicalmarijuanadispensaryfacilitiesandthosewhoallow 610propertytobeusedbythoseentities,shouldbeenforceable.Itisthepublicpolicyofthestate 611ofMissourithatnocontractenteredintobyqualifyingpatients,primarycaregivers,marijuana 612testingfacilities,medicalmarijuanacultivationfacilities,medicalmarijuana-infusedproducts 613manufacturingfacilities,ormedicalmarijuanadispensaryfacilities,orbyapersonwho 614allowspropertytobeusedforactivitiesthatareexemptfromstatecriminalpenaltiesbythis 615section,shallbeunenforceableonthebasisthatactivitiesrelatedtomedicalmarijuanamay 616beprohibitedbyfederallaw. 617 (12)Intheprocessofrequestingasearchorarrestwarrantrelatingtotheproduction, 618possession,transportationorstorageofmarijuana,astateorlocallawenforcementofficial 619shallverifywiththedepartmentwhetherthetargetedpersonisaqualifyingpatientorprimary 620caregiverholdinganidentificationcardallowingforcultivationofmarijuanaplantsunder 621subdivision(12)ofsubsection3ofthissection,andshallinformtheissuingauthority 622accordinglywhenmakingthewarrantrequest.Evidenceofmarijuanaalone,withoutspecific 623evidenceindicatingthatthemarijuanaisoutsideofwhatislawfulformedicaloradultuse, 624cannotbethebasisforasearchofapatientornon-patient,includingtheirhome,vehicleor 625otherproperty.Lawfulmarijuanarelatedactivitiescannotbethebasisforaviolationof 626parole,probation,oranytypeofsupervisedrelease.Stateandlocallawenforcementshall 627onlyhaveaccesstosuchdepartmentinformationasisnecessarytoconfirmwhetherthe 628targetedpersonholdsregistrationcard. 629 (13)Registeredqualifyingpatientsonbondforpre-trialrelease,onprobation,or 630otherformofsupervisedreleaseshallnotbeprohibitedfromlegallyusingalawfulmarijuana 631productasatermorconditionofrelease,probation,orparole.Analternativesentencingdrug HJR72 18 632courtprogrammaynotprohibitindividualsunderitsjurisdictionfromusingalawful 633marijuanaproductaslongastheindividualisaregisteredqualifyingpatient. 634 (14)Afamilycourtparticipantorpartywhorequirestreatmentforaqualified 635medicalconditioninaccordancewiththissectionshallnotberequiredtorefrainfromusing 636medicalmarijuanaasatermorconditionofsuccessfulcompletionofthefamilycourt 637program.Thestatusandconductofaqualifiedpatientwhoactsinaccordancewiththis 638sectionshallnot,byitself,beusedtorestrictorabridgecustodialorparentalrightstominor 639childreninanyactionorproceedingunderthejurisdictionofafamilycourtunderchapter 640487,RSMo,includingdomesticmattersunderchapter452,RSMo,orajuvenilecourtunder 641chapter211,RSMo,orsuccessorprovisions. 642 (15)Apersonshallnotbedeniedadoption,custody,orvisitationrightsrelativetoa 643minorsolelyforconductthatispermittedbythissection. 644 (16)NopersonshallbedeniedtheirrightsunderArticle1,Section23oftheMissouri 645Constitution,orsuccessorprovisions,solelyforconductthatispermittedbythissection. 646 6.Legislation. 647 Nothinginthissectionshalllimitthegeneralassemblyfromenactinglawsconsistent 648withthissection,orotherwiseeffectuatingthepatientrightsofthissection.Thelegislature 649shallnotenactlawsthathindertherightofqualifyingpatientstoaccessmarijuanaformedical 650useasgrantedbythissection. 651 7.AdditionalProvisions. 652 (1)Nothinginthissectionpermitsapersonto: 653 (a)Consumemarijuanaformedicaluseinajailorcorrectionalfacility; 654 (b)Undertakeanytaskundertheinfluenceofmarijuanawhendoingsowould 655constitutenegligenceorprofessionalmalpractice;or 656 (c)Operate,navigate,orbeinactualphysicalcontrolofanydangerousdeviceor 657motorvehicle,aircraftormotorboatwhileundertheinfluenceofmarijuana.Notwithstanding 658theforegoing,anarrestoraconvictionofapersonwhohasavalidqualifyingpatient 659identificationcardforanyapplicableoffensesshallrequireevidencethatthepersonwasin 660factundertheinfluenceofmarijuanaatthetimethepersonwasinactualphysicalcontrolof 661thedangerousdeviceormotorvehicle,aircraftormotorboatandnotsolelyonthepresenceof 662tetrahydrocannabinol(THC)orTHCmetabolites,oracombinationthereof,intheperson's 663system;or 664 (d)Bringaclaimagainstanyemployer,formeremployer,orprospectiveemployer 665forwrongfuldischarge,discrimination,oranysimilarcauseofactionorremedy,basedonthe 666employer,formeremployer,orprospectiveemployerprohibitingtheemployee,former 667employee,orprospectiveemployeefrombeingundertheinfluenceofmarijuanawhileat HJR72 19 668workordiscipliningtheemployeeorformeremployee,uptoandincludingterminationfrom 669employment,forworkingorattemptingtoworkwhileundertheinfluenceofmarijuana. 670 (2)Nomedicalmarijuanacultivationfacility,marijuanatestingfacility,medical 671marijuanadispensaryfacility,ormedicalmarijuana-infusedproductsmanufacturingfacility, 672orentitywithatransportationcertificationshallbeowned,inwholeorinpart,orhaveasan 673officer,director,boardmember,manager,oremployee,anyindividualwithadisqualifying 674felonyoffense.A"disqualifyingfelonyoffense"isaviolationof,andconvictionorguilty 675pleato,stateorfederallawthatis,orwouldhavebeen,afelonyunderMissourilaw, 676regardlessofthesentenceimposed,unlessthedepartmentdeterminesthat: 677 (a)Theperson'sconvictionwasforthemedicaluseofmarijuanaorassistinginthe 678medicaluseofmarijuana;or 679 (b)Theperson'sconvictionwasforanonviolentcrimeforwhichheorshewasnot 680incarceratedandthatismorethanfiveyearsold;or 681 (c)Morethanfiveyearshavepassedsincethepersonwasreleasedfromparoleor 682probation,andheorshehasnotbeenconvictedofanysubsequentcriminaloffenses. 683 Thedepartmentmayconsultwithandrelyontherecords,adviceand 684recommendationsoftheattorneygeneralandthedepartmentofpublicsafety,ortheir 685successorentities,inapplyingthissubdivision. 686 (3)Nomedicalmarijuanacultivationfacility,medicalmarijuanadispensaryfacility, 687ormedicalmarijuana-infusedproductsmanufacturingfacilityshallmanufacture,packageor 688labelmarijuanaormarijuana-infusedproductsinafalseormisleadingmanner.Noperson 689shallsellanyproductinamannerdesignedtocauseconfusionbetweenamarijuanaor 690marijuana-infusedproductandanyproductnotcontainingmarijuana.Aviolationofthis 691subdivisionshallbepunishablebyanappropriateandproportionaldepartmentsanction,upto 692andincludinganadministrativepenaltyoffivethousanddollarsandlossoflicense. 693 (4)Allediblemarijuana-infusedproductsshallbesoldinindividual,child-resistant 694containersthatarelabeledwithdosageamounts,instructionsforuse,andestimatedlengthof 695effectiveness.Allmarijuanaandmarijuana-infusedproductsshallbesoldincontainers 696clearlyandconspicuouslylabeledasmandatedbythedepartmentascontaining"Marijuana", 697ora"Marijuana-InfusedProduct".Violationofthisprohibitionshallsubjecttheviolatorto 698departmentsanctions,includinganadministrativepenaltyoffivethousanddollars. 699 (5)Noindividualshallserveastheprimarycaregiverformorethansixqualifying 700patients.Noprimarycaregivercultivatingmarijuanaformorethanonequalifyingpatient 701mayexceedatotaloftwenty-fourfloweringplants. 702 (6)Apersonwhosmokesmedicalmarijuanainapublicplace,otherthaninanarea 703licensedforsuchactivitybythedepartmentorbylocalauthoritieshavingjurisdictionover HJR72 20 704thelicensingorpermittingofsaidactivity,issubjecttoacivilpenaltynotexceedingone 705hundreddollars. 706 (7)Nopersonshallextractresinsfrommarijuanausingdangerousmaterialsor 707combustiblegaseswithoutamedicalmarijuana-infusedproductsmanufacturingfacility 708license.Violationofthisprohibitionshallsubjecttheviolatortodepartmentsanctions, 709includinganadministrativepenaltyofonethousanddollarsforapatientorprimarycaregiver 710andtenthousanddollarsforafacilitylicenseeand,ifapplicable,lossoftheiridentification 711card,certificate,orlicenseforuptooneyear. 712 (8)Allqualifyingpatientcultivationshalltakeplaceinanenclosed,lockedfacility 713thatisequippedwithsecuritydevicesthatpermitaccessonlybythequalifyingpatientorby 714suchpatient'sprimarycaregiver.Twoqualifyingpatients,whobothholdvalidqualifying 715patientcultivationidentificationcards,mayshareoneenclosed,lockedfacility.Primary 716caregiverscultivatingmarijuanaformorethanonequalifyingpatientmaycultivateeach 717respectivequalifyingpatient'sfloweringplantsinasingle,enclosedlockedfacilitysubjectto 718thelimitsofsubsection3,paragraph12. 719 (9)Nomedicalmarijuanacultivationfacility,medicalmarijuanadispensaryfacility, 720medicalmarijuana-infusedproductsmanufacturingfacility,marijuanatestingfacility,or 721entitywithatransportationcertificationshallassign,sell,give,lease,sublicense,orotherwise 722transferitslicenseorcertificatetoanyotherentitywithouttheexpressconsentofthe 723department,nottobeunreasonablywithheld. 724 (10)(a)Unlessallowedbythelocalgovernment,nonewmedicalmarijuana 725cultivationfacility,marijuanatestingfacility,medicalmarijuanadispensaryfacility,or 726medicalmarijuana-infusedproductsmanufacturingfacilityshallbeinitiallysitedwithinone 727thousandfeetofanythen-existingelementaryorsecondaryschool,childday-carecenter,or 728church.Inthecaseofafreestandingfacility,thedistancebetweenthefacilityandtheschool, 729daycare,orchurchshallbemeasuredfromtheexternalwallofthefacilitystructureclosestin 730proximitytotheschool,daycare,orchurchtotheclosestpointofthepropertylineofthe 731school,daycare,orchurch.Iftheschool,daycare,orchurchispartofalargerstructure,such 732asanofficebuildingorstripmall,thedistanceshallbemeasuredtotheentranceorexitofthe 733school,daycare,orchurchclosestinproximitytothefacility.Inthecaseofafacilitythatis 734partofalargerstructure,suchasanofficebuildingorstripmall,thedistancebetweenthe 735facilityandtheschool,daycare,orchurchshallbemeasuredfromthepropertylineofthe 736school,daycare,orchurchtothefacility'sentranceorexitclosestinproximitytotheschool, 737daycare,orchurch.Iftheschool,daycare,orchurchispartofalargerstructure,suchasan 738officebuildingorstripmall,thedistanceshallbemeasuredtotheentranceorexitofthe 739school,daycare,orchurchclosestinproximitytothefacility.Measurementsshallbemade 740alongtheshortestpathbetweenthedemarcationpointsthatcanbelawfullytraveledbyfoot. HJR72 21 741Nolocalgovernmentshallprohibitmedicalmarijuanacultivationfacilities,marijuanatesting 742facilities,medicalmarijuana-infusedproductsmanufacturingfacilities,ormedicalmarijuana 743dispensaryfacilities,orentitieswithatransportationcertificationeitherexpresslyorthrough 744theenactmentofordinancesorregulationsthatmaketheiroperationundulyburdensomein 745thejurisdiction.However,localgovernmentsmayenactordinancesorregulationsnotin 746conflictwiththissection,orwithregulationsenactedpursuanttothissection,governingthe 747time,place,andmannerofoperationofsuchfacilitiesinthelocality.Alocalgovernment 748mayestablishcivilpenaltiesforviolationofanordinanceorregulationsgoverningthetime, 749place,andmannerofoperationofamedicalmarijuanacultivationfacility,marijuanatesting 750facility,medicalmarijuana-infusedproductsmanufacturingfacility,medicalmarijuana 751dispensaryfacility,orentityholdingatransportationcertificationthatmayoperateinsuch 752locality. 753 (b)Theonlylocalgovernmentordinancesorregulationsthatarebindingonamedical 754facilityarethoseofthelocalgovernmentwherethemedicalfacilityisphysicallylocated. 755 (11)UnlesssupersededbyfederallaworanamendmenttothisConstitution,a 756physicianornursepractitionershallnotcertifyaqualifyingconditionforapatientbyany 757meansotherthanprovidingaphysicianornursepractitionercertificationforthepatient, 758whetherhandwritten,electronic,orinanothercommonlyusedformat. 759 (12)Aphysicianornursepractitionershallnotissueacertificationforthemedical 760useofmarijuanaforanonemancipatedqualifyingpatientundertheageofeighteenwithout 761thewrittenconsentofthequalifyingpatient'sparentorlegalguardian.Thedepartmentshall 762notissueaqualifyingpatientidentificationcardonbehalfofanonemancipatedqualifying 763patientundertheageofeighteenwithoutthewrittenconsentofthequalifyingpatient'sparent 764orlegalguardian.Suchcardshallbeissuedtooneoftheparentsorguardiansandnotdirectly 765tothepatient.Onlyaparentorguardianmayserveasaprimarycaregiverfora 766nonemancipatedqualifyingpatientundertheageofeighteen.Onlythequalifyingpatient's 767parentorguardianshallpurchaseorpossessmedicalmarijuanaforanonemancipated 768qualifyingpatientundertheageofeighteen.Aparentorguardianshallsupervisethe 769administrationofmedicalmarijuanatoanonemancipatedqualifyingpatientundertheageof 770eighteen. 771 (13)Nothinginthissectionshallbeconstruedasmandatinghealthinsurance 772coverageofmedicalmarijuanaforqualifyingpatientuse. 773 (14)Realandpersonalpropertyusedinthecultivation,manufacture,transport, 774testing,distribution,sale,andadministrationofmarijuanaformedicaluseorforactivities 775otherwiseincompliancewiththissectionshallnotbesubjecttoassetforfeituresolely 776becauseofthatuse. HJR72 22 777 (15)Unlessafailuretodosowouldcauseanemployertoloseamonetaryor 778licensing-relatedbenefitunderfederallaw,anemployermaynotdiscriminateagainsta 779personinhiring,terminationoranytermorconditionofemploymentorotherwisepenalizea 780person,ifthediscriminationisbaseduponeitherofthefollowing: 781 (a)Theperson'sstatusasaqualifyingpatientorprimarycaregiverwhohasavalid 782identificationcard,includingtheperson'slegaluseofalawfulmarijuanaproductoffthe 783employer'spremisesduringnonworkinghours,unlessthepersonwasundertheinfluenceof 784medicalmarijuanaonthepremisesoftheplaceofemploymentorduringthehoursof 785employment;or 786 (b)Apositivedrugtestformarijuanacomponentsormetabolitesofapersonwhohas 787avalidqualifyingpatientidentificationcard,unlessthepersonused,possessed,orwasunder 788theinfluenceofmedicalmarijuanaonthepremisesoftheplaceofemploymentorduringthe 789hoursofemployment. 790 Nothinginthissubdivisionshallapplytoanemployeeinapositioninwhichlegaluse 791ofalawfulmarijuanaproductaffectsinanymanneraperson'sabilitytoperformjob-related 792employmentresponsibilitiesorthesafetyofothers,orconflictswithabonafideoccupational 793qualificationthatisreasonablyrelatedtotheperson'semployment. 794 (16)Theenactmentofsection2ofthisArticleandconcurrentamendmentstosection 7951ofthisArticleshallhavenoeffectuponanyvalidcontract,claim,orcauseofaction 796institutedpriortotheeffectivedateofthissection. 797 8.FederalLegalization. 798 Iffederallaw,rules,orregulationsareamendedtoallowtheinterstatecommerceof 799marijuanaormarijuana-infusedproductsortheimportationorexportationofmarijuanaor 800marijuana-infusedproductsintooroutofthestateofMissouri,theprovisionsandintentof 801thissectionshall,totheextentpossible,remaininfulleffect,unlessexplicitlypreemptedby 802suchfederallaw,rule,orregulation.Iffederallaw,rules,orregulationsareamendedas 803providedabove,anymarijuanaormarijuana-infusedproductsimportedintothisstateshallbe 804subjecttothesametestingstandardsandseedtosaletrackingsystemrequiredunderthis 805sectionformarijuanaandmarijuana-infusedproductsproducedwithinthestate.Unless 806federallaw,rules,orregulationsexplicitlyrequireotherwise,noentityshallsell,transport, 807produce,distribute,deliver,orcultivatemarijuanaormarijuana-infusedproductswithoutan 808applicablelicenseorcertificateasrequiredunderthissection.Inaddition,anyrawbiomass 809ofmarijuanaormarijuanaflowerimportedfromout-of-stateshallbereceivedonlybya 810licensedcultivationfacility,whileallbatchoil,infusedmarijuanaproductsandanymarijuana 811productinanyotherformshallbereceivedonlybyalicensedmanufacturingfacility. 812 9.Severability. HJR72 23 813 Theprovisionsofthissectionareseverable,andifanyclause,sentence,paragraphor 814sectionofthismeasure,oranapplicationthereof,isadjudgedinvalidbyanycourtof 815competentjurisdiction,theotherprovisionsshallcontinuetobeineffecttothefullestextent 816possible. Section2.1.Purpose. 2 Thepurposeofthissectionistomakemarijuanalegalunderstateandlocallawfor 3adultstwenty-oneyearsofageorolder,andtocontrolthecommercialproductionand 4distributionofmarijuanaunderasystemthatlicenses,regulates,andtaxesthebusinesses 5involvedwhileprotectingpublichealth.Theintentistopreventarrestandpenaltyfor 6personalpossessionandcultivationoflimitedamountsofmarijuanabyadultstwenty-one 7yearsofageorolder;removethecommercialproductionanddistributionofmarijuanafrom 8theillicitmarket;preventrevenuegeneratedfromcommerceinmarijuanafromgoingto 9criminalenterprises;preventthedistributionofmarijuanatopersonsundertwenty-oneyears 10ofage;preventthediversionofmarijuanatoillicitmarkets;protectpublichealthbyensuring 11thesafetyofmarijuanaandproductscontainingmarijuana;andensurethesecurityof 12marijuanafacilities.Tothefullestextentpossible,thissectionshallbeinterpretedin 13accordancewiththepurposeandintentsetforthinthissection. 14 2.Definitions. 18 (1)"Church"meansapermanentbuildingprimarilyandregularlyusedasaplaceof 19religiousworship. 20 (2)"Comprehensivefacility"meansacomprehensivemarijuanacultivationfacility, 21comprehensivemarijuanadispensaryfacility,oracomprehensivemarijuana-infusedproducts 22manufacturingfacility. 23 (3)"Comprehensivemarijuanacultivationfacility"meansafacilitylicensedbythe 24departmenttoacquire,cultivate,process,package,storeonsiteoroffsite,transporttoor 25from,andsellmarijuana,marijuanaseeds,marijuanavegetativecuttings(alsoknownas 26clones)toamedicalfacility,comprehensivefacility,ormarijuanatestingfacility.A 27comprehensivemarijuanacultivationfacilityneednotsegregateoraccountforitsmarijuana 28productsaseithernon-medicalmarijuanaormedicalmarijuana.Acomprehensivemarijuana 29cultivationfacility'sauthoritytoprocessmarijuanashallincludethecreationofprerolls,but 30shallnotincludethemanufactureofmarijuana-infusedproducts. 31 (4)"Comprehensivemarijuanadispensaryfacility"meansafacilitylicensedbythe 32departmenttoacquire,process,package,storeonsiteoroffsite,sell,transporttoorfrom,and 33delivermarijuana,marijuanaseeds,marijuanavegetativecuttings(alsoknownasclones), HJR72 24 34marijuana-infusedproducts,anddrugparaphernaliausedtoadministermarijuanaasprovided 35forinthissectiontoaqualifyingpatientorprimarycaregiver,asthosetermsaredefinedin 36section1ofthisArticle,ortoaconsumer,anywhereonthelicensedpropertyortoany 37addressasdirectedbythepatient,primarycaregiver,orconsumerandconsistentwiththe 38limitationsofthisArticleandasotherwiseallowedbylaw,toacomprehensivefacility,a 39marijuanatestingfacility,oramedicalfacility.Comprehensivedispensaryfacilitiesmay 40receivetransactionordersatthedispensarydirectlyfromtheconsumerinperson,byphone, 41orviatheinternet,includingfromathirdparty.Acomprehensivemarijuanadispensary 42facilityneednotsegregateoraccountforitsmarijuanaproductsaseithernon-medical 43marijuanaormedicalmarijuana,butshallcollectallappropriatetangiblepersonalproperty 44salestaxforeachsale,assetforthinthisArticleandprovidedforbygeneralorlocallaw.A 45comprehensivemarijuanadispensaryfacility'sauthoritytoprocessmarijuanashallinclude 46thecreationofprerolls. 47 (5)"Comprehensivemarijuana-infusedproductsmanufacturingfacility"meansa 48facilitylicensedbythedepartmenttoacquire,process,package,store,manufacture,transport 49toorfromamedicalfacility,comprehensivefacility,ormarijuanatestingfacility,andsell 50marijuana-infusedproducts,prerolls,andinfusedprerollstoamarijuanadispensaryfacility,a 51marijuanatestingfacility,oranothermarijuana-infusedproductsmanufacturingfacility.A 52comprehensivemarijuana-infusedproductsmanufacturingfacilityneednotsegregateor 53accountforitsmarijuanaproductsaseithernon-medicalmarijuanaormedicalmarijuana. 54 (6)"Consumer"meansapersonwhoisatleasttwenty-oneyearsofage. 55 (7)"Daycare"meansachild-carefacility,asdefinedbysection210.20l,RSMo,or 56successorprovisions,thatislicensedbythestateofMissouri. 57 (8)"Department"meansthedepartmentofhealthandseniorservices,oritssuccessor 58agency. 59 (9)"Entity"meansanaturalperson,corporation,professionalcorporation,nonprofit 60corporation,cooperativecorporation,unincorporatedassociation,businesstrust,limited 61liabilitycompany,generalorlimitedpartnership,limitedliabilitypartnership,jointventure,or 62anyotherlegalentity. 63 (10)"Floweringplant"meansamarijuanaplantfromthetimeitexhibitsthefirst 64signsofsexualmaturitythroughharvest. 65 (11)"Infusedpreroll"meansaconsumableorsmokablemarijuanaproduct,generally 66consistingof:(l)awraporpaper,(2)driedflower,buds,and/orplantmaterial,and(3)a 67concentrate,oilorothertypeofmarijuanaextract,eitherwithinoronthesurfaceofthe 68product.Infusedprerollsmayormaynotincludeafilterorcrutchatthebaseoftheproduct. 69 (12)"Localgovernment"means,inthecaseofanincorporatedarea,avillage,town, 70orcityand,inthecaseofanunincorporatedarea,acounty. HJR72 25 71 (13)"Marijuana"or"marihuana"meansCannabisindica,Cannabissativa,and 72Cannabisruderalis,hybridsofsuchspecies,andanyotherstrainscommonlyunderstood 73withinthescientificcommunitytoconstitutemarijuana,aswellasresinextractedfromthe 74marijuanaplantandmarijuana-infusedproducts."Marijuana"or"marihuana"donotinclude 75industrialhemp,asdefinedbyMissouristatute,orcommoditiesorproductsmanufactured 76fromindustrialhemp. 77 (14)"Marijuanaaccessories"meansanyequipment,product,material,or 78combinationofequipment,products,ormaterials,whichisspecificallydesignedforusein 79planting,propagating,cultivating,growing,harvesting,manufacturing,compounding, 80converting,producing,processing,preparing,testing,analyzing,packaging,repackaging, 81storing,containing,ingesting,inhaling,orotherwiseintroducingmarijuanaintothehuman 82body. 83 (15)"Marijuanafacility"meansacomprehensivemarijuanacultivationfacility, 84comprehensivemarijuanadispensaryfacility,marijuanatestingfacility,comprehensive 85marijuana-infusedproductsmanufacturingfacility,microbusinesswholesalefacility, 86microbusinessdispensaryfacility,oranyothertypeofmarijuana-relatedfacilityor 87businesslicensedorcertifiedbythedepartmentpursuanttothissection,butshallnot 88includeamedicalfacilitylicensedundersectionlofthisArticle. 89 (16)"Marijuana-infusedproducts"meansproductsthatareinfused,dipped,coated, 90sprayed,ormixedwithmarijuanaoranextractthereof,including,butnotlimitedto,products 91thatareabletobevaporizedorsmoked,edibleproducts,ingestibleproducts,topicalproducts, 92suppositories,andinfusedprerolls. 93 (17)"Marijuanamicrobusinessfacility"meansafacilitylicensedbythedepartment 94asamicrobusinessdispensaryfacilityormicrobusinesswholesalefacility,asdefinedinthis 95section. 96 (18)"Microbusinessdispensaryfacility"meansafacilitylicensedbythedepartment 97toacquire,process,package,storeonsiteoroffsite,sell,transporttoorfrom,anddeliver 98marijuana,marijuanaseeds,marijuanavegetativecuttings(alsoknownasclones),marijuana- 99infusedproducts,anddrugparaphernaliausedtoadministermarijuanaasprovidedforinthis 100sectiontoaconsumer,qualifyingpatient,asthattermisdefinedinsection1ofthisArticle,or 101primarycaregiver,asthattermisdefinedinsectionlofthisArticle,anywhereonthelicensed 102propertyortoanyaddressasdirectedbytheconsumer,qualifyingpatient,orprimary 103caregiverand,consistentwiththelimitationsofthisArticleandasotherwiseallowedbylaw, 104amicrobusinesswholesalefacility,oramarijuanatestingfacility.Microbusinessdispensary 105facilitiesmayreceivetransactionordersatthedispensarydirectlyfromtheconsumerin 106person,byphone,orviatheinternet,includingfromathirdparty.Amicrobusiness 107dispensaryfacility'sauthoritytoprocessmarijuanashallincludethecreationofprerolls. HJR72 26 108 (19)"Microbusinesswholesalefacility"meansafacilitylicensedbythedepartment 109toacquire,cultivate,process,package,storeonsiteoroffsite,manufacture,transporttoor 110from,deliver,andsellmarijuana,marijuanaseeds,marijuanavegetativecuttings(alsoknown 111asclones),andmarijuana-infusedproductstoamicrobusinessdispensaryfacility,other 112microbusinesswholesalefacility,ormarijuanatestingfacility.Amicrobusinesswholesale 113facilitymaycultivateupto250floweringmarijuanaplantsatanygiventime.A 114microbusinesswholesalefacility'sauthoritytoprocessmarijuanashallincludethecreationof 115prerollsandinfusedprerolls. 116 (20)"Marijuanatestingfacility"meansafacilitycertifiedbythedepartmentto 117acquire,test,certify,andtransportmarijuana,includingthoseoriginallycertifiedasamedical 118marijuanatestingfacility. 119 (21)"Owner"meansanindividualwhohasafinancial(otherthanasecurityinterest, 120lien,orencumbrance)orvotinginterestintenpercentorgreaterofamarijuanafacility. 121 (22)"Preroll"meansaconsumableorsmokablemarijuanaproduct,generally 122consistingof:(l)awraporpaperand(2)driedflower,buds,and/orplantmaterial.Prerolls 123mayormaynotincludeafilterorcrutchatthebaseoftheproduct. 124 (23)"Undulyburdensome"meansthatthemeasuresnecessarytocomplywiththe 125rulesorordinancesadoptedpursuanttothissectionsubjectlicenseesorpotentiallicenseesto 126suchahighinvestmentofmoney,time,oranyotherresourceorassetthatareasonably 127prudentbusinesspersonwouldnotoperatethemarijuanafacility. 128 3.Limitations. 129 (1)ExceptasotherwiseprovidedinthisArticle,thissectiondoesnotpreclude,limit, 130oraffectlawsthatassignliabilityrelativeto,prohibit,orotherwiseregulate: 131 (a)Deliveryordistributionofmarijuanaormarijuanaaccessories,withorwithout 132consideration,toapersonyoungerthantwenty-oneyearsofage; 133 (b)Purchase,possession,use,ortransportofmarijuanaormarijuanaaccessoriesbya 134personyoungerthantwenty-oneyearsofage; 135 (c)Consumptionofmarijuanabyapersonyoungerthantwenty-oneyearsofage; 136 (d)Operatingorbeinginphysicalcontrolofanymotorvehicle,train,aircraft, 137motorboat,orothermotorizedformoftransportwhileundertheinfluenceofmarijuana. 138Notwithstandingtheforegoing,aconvictionofapersonwhoisatleasttwenty-oneyearsof 139ageforanyapplicableoffensesshallrequireevidencethatthepersonwasinfactunderthe 140influenceofmarijuanaatthetimethepersonwasinphysicalcontrolofthemotorizedformof 141transportandnotsolelyonthepresenceoftetrahydrocannabinol(THC)orTHCmetabolites, 142oracombinationthereof,intheperson'ssystem; HJR72 27 143 (e)Consumptionofmarijuanawhileoperatingorbeinginphysicalcontrolofamotor 144vehicle,train,aircraft,motorboat,orothermotorizedformoftransportwhileitisbeing 145operated; 146 (f)Smokingmarijuanawithinamotorvehicle,train,aircraft,motorboat,orother 147motorizedformoftransportwhileitisbeingoperated; 148 (g)Possessionorconsumptionofmarijuanaorpossessionofmarijuanaaccessories 149onthegroundsofapublicorprivatepreschool,elementaryorsecondaryschool,institutionof 150highereducation,inaschoolbus,oronthegroundsofanycorrectionalfacility; 151 (h)Smokingmarijuanainalocationwheresmokingtobaccoisprohibited; 152 (i)Consumptionofmarijuanainapublicplace,otherthaninanarealicensedbythe 153authoritieshavingjurisdictionoverthelicensingand/orpermittingofsaidactivity,assetforth 154insubsection5ofthissection; 155 (j)Conductthatendangersothers; 156 (k)Undertakinganytaskwhileundertheinfluenceofmarijuana,ifdoingsowould 157constitutenegligence,recklessness,orprofessionalmalpractice;or 158 (l)Performingsolvent-basedextractionsonmarijuanausingsolventsotherthan 159water,glycerin,propyleneglycol,vegetableoil,orfood-gradeethanol,unlesslicensedforthis 160activitybythedepartment. 161 (2)Thissectiondoesnotlimitanyprivileges,rights,immunities,ordefensesofa 162personorentityasprovidedinsectionlofthisArticle,oranyotherlawofthisstateallowing 163fororregulatingmarijuanaformedicaluse. 164 (3)Thissectiondoesnotrequireanemployertopermitoraccommodateconduct 165otherwiseallowedbythissectioninanyworkplaceorontheemployer'sproperty.This 166sectiondoesnotprohibitanemployerfromdisciplininganemployeeforworkingwhileunder 167theinfluenceofmarijuana.Thissectiondoesnotpreventanemployerfromrefusingtohire, 168discharging,disciplining,orotherwisetakinganadverseemploymentactionagainstaperson 169withrespecttohire,tenure,terms,conditions,orprivilegesofemploymentbecausethat 170personwasworkingwhileundertheinfluenceofmarijuana. 171 (4)Thissectionallowsanentitytoprohibitorotherwiselimittheconsumption, 172cultivation,distribution,processing,sale,ordisplayofmarijuana,marijuana-infused 173products,andmarijuanaaccessoriesonprivatepropertytheentityowns,leases,occupies, 174ormanages,exceptthataleaseagreementexecutedaftertheeffectivedateofthissectionmay 175notprohibitatenantfromlawfullypossessingandconsumingmarijuanabymeansotherthan 176smoking. 177 (5)Theenactmentofthissectionandallconcurrentamendmentstosection1ofthis 178Articleshallhavenoeffectuponanyvalidcontract,claim,orcauseofactioninstitutedprior 179totheeffectivedateofthissection. HJR72 28 180 4.RegulationofMarijuana. 181 (1)Incarryingouttheimplementationofthissectionandasconditionedherein,the 182departmentshallhavetheauthorityto: 183 (a)Grantorrefusestatelicensesforthecultivation,manufacture,dispensing,andsale 184ofmarijuana;suspend,restrict,orrevokesuchlicensesuponaviolationofthissectionora 185rulepromulgatedpursuanttothissection;andimposeanyreasonableadministrativepenalty 186authorizedbythissectionoranygenerallawenactedorrulepromulgatedpursuanttothis 187section,solongasanyprocedurerelatedtoasuspensionorrevocationincludesareasonable 188cureperiod,notlessthanthirtydays,priortothesuspensionorrevocation,exceptininstances 189wherethereisacredibleandimminentthreattopublichealthorpublicsafety; 190 (b)Promulgaterulesandemergencyrulesnecessaryfortheproperregulationand 191controlofthecultivation,manufacture,dispensing,andsaleofmarijuanaandforthe 192enforcementofthissectionsolongassuchrulesarereasonableandnotundulyburdensome; 193 (c)Developsuchforms,certificates,licenses,identificationcards,andapplicationsas 194arenecessaryfor,orreasonablyrelatedto,theadministrationofthissectionoranyofthe 195rulespromulgatedunderthissection; 196 (d)Requireaseed-to-saletrackingsystemthattracksmarijuanafromeithertheseed 197orimmatureplantstageuntilthemarijuanaormarijuana-infusedproductissoldtoaqualified 198patient,primarycaregiver,orconsumertoensurethatnomarijuanagrownbyamedical 199marijuanacultivationfacility,comprehensivemarijuanacultivationfacility,ormicrobusiness 200wholesalefacility,ormanufacturedbyamedicalmarijuana-infusedproductsmanufacturing 201facility,acomprehensivemarijuana-infusedproductsmanufacturingfacility,ora 202microbusinesswholesalefacilityissoldorotherwisetransferredtoaconsumer,qualified 203patient,orprimarycaregiverexceptbyamedicalmarijuanadispensaryfacility,a 204comprehensivedispensaryfacility,oramicrobusinessdispensaryfacility.Thedepartment 205shallcertifyallcommerciallyavailabletrackingsystemsthatarecompliantwithitstracking 206standardsandissuestandardsforthecreationoruseofothersystemsbylicensees; 207 (e)Issuestandardsforthesecuretransportationofmarijuanaandmarijuana-infused 208products.Thedepartmentshallcertifyentitiesthatdemonstratecompliancewithits 209transportationstandardstotransportmarijuanaandmarijuana-infusedproductstoorfroma 210comprehensivefacility,medicalfacility,microbusinessfacility,anotherentitywitha 211transportationcertification,oranyentitylicensedpursuanttoparagraph(g)ofthis 212subdivision.Thedepartmentshalldeveloporadoptfromanyothergovernmentalagency 213suchsafetyandsecuritystandardsasarereasonablynecessaryforthetransportationand 214temporarystorageofmarijuanaandmarijuana-infusedproducts.Anyentitylicensedor 215certifiedpursuanttothissectionshallbeallowedtotransportitsowninventoryandproducts 216incompliancewithdepartmenttransportationrulesandstoremarijuanaandmarijuana- HJR72 29 217infusedproductsforthepurposesrelatedtotransportationincompliancewithdepartment 218regulationsonsecurestorageofmarijuanaandmarijuana-infusedproducts; 219 (f)Promulgaterulesandemergencyrulesspecifictothelicensing,regulation,and 220oversightofmarijuanamicrobusinessfacilities; 221 (g)Providefortheissuanceofadditionaltypesorclassesoflicensestooperate 222marijuana-relatedbusinessesthat: 223 a.Allowforonlytransportation,delivery,orstorageofmarijuana;or 224 b.Areintendedtofacilitatescientificresearchoreducation. 225 (h)Prepareandtransmitannuallyapubliclyavailablereportaccountingtothe 226governor,thegeneralassembly,andthepublicfortheefficientdischargeofall 227responsibilitiesassignedtothedepartmentunderthissection.Thereportshallprovide 228aggregatedataforeachtypeoflicense(medical,comprehensive,andmicrobusiness)and 229facility(dispensary,cultivation,manufacturers,wholesalers).Onlynon-identifying 230informationshallbeprovidedregardinganymarijuanafacilityowners; 231 (i)Establishalotteryselectionprocesstoselectcomprehensivefacilitylicenses, 232certificateholders,marijuanamicrobusinesslicensees,butnotmedicalfacilitylicenseesthat 233areconvertingtocomprehensivelicensespursuanttothissubsection.Tobecomeeligiblefor 234anylicenselotteryselectionprocess,anownercannothavepleadedguiltyorbeenfound 235guiltyofadisqualifyingfelony,asthattermisdefinedinsubsection9ofthissection. 236 (j)Indevelopingalotteryselectionprocesstoawardlicensesandcertificates,the 237departmentmayconsultorcontractwithotherpublicagencieswithrelevantexpertise. 238 (k)Whilenotrequiredasaprerequisitetoparticipationinacomprehensivelicense 239lottery,everycomprehensivelicenseapplicantshallsubmittothedepartmentavoluntaryplan 240topromoteandencourageparticipationintheregulatedmarijuanaindustrybypeoplefrom 241communitiesthathavebeendisproportionatelyimpactedbymarijuanaprohibition.Theplan 242mayincludestrategiestoaddressgeographicaldefinedcommunitiesthathavebeen 243disproportionatelyimpactedbymarijuanaprohibition;provideforownershipopportunities 244fordisproportionatelyimpactedcommunities;andprovideforemployment,supplier,and 245vendoropportunitiesforindividualsandbusinessesincommunitiesthathavebeen 246disproportionatelyimpactedbymarijuanaprohibition.Iflicensed,anyvoluntaryapplicant 247planshallbeenforceablebythedepartment. 248 (l)Notwithstandingothergrantsofauthorityherein,neitherthedepartmentnorany 249governmentalbodymayrestricttheproductionoruseofmarijuanaandmarijuana-infused 250productsbasedsolelyuponTHCcontent. 251 (m)Setalimitontheamountofmarijuanathatmaybepurchasedinasingle 252transactionprovidedthatlimitisnotlessthanthreeouncesofdried,unprocessedmarijuana, 253oritsequivalent. HJR72 30 254 (n)Regulatetheadvertisingandpromotionofmarijuanasales[, butanysuch 255regulationshallbenomorestringentthancomparablestateregulationsontheadvertisingand 256promotionofalcoholsales]. Thedepartmentshalladoptruleswithrestrictionsonthe 257advertisingandpromotionofmarijuanasalesthatareatleastasstringentasthe 258restrictionsontheadvertisingandpromotionofcigarettesimposedbyfederallawsand 259regulations. 260 (2)Thedepartmentshallissue,ataminimum,thesamenumberofcomprehensive 261marijuanacultivationfacilitylicensesaswereauthorizedorissuedformedicalmarijuana 262cultivationfacilitiesundersection1ofthisArticleasofDecember7,2022,thesamenumber 263ofcomprehensivemarijuana-infusedproductsmanufacturingfacilitylicensesaswere 264authorizedorissuedformedicalmarijuana-infusedproductsmanufacturingfacilitiesunder 265section1ofthisArticleasofDecember7,2022,thesamenumberofcomprehensive 266marijuanadispensaryfacilitylicenseswiththesamecongressionaldistributionrequirements 267aswereauthorizedorissuedformedicalmarijuanadispensaryfacilitiesundersectionlofthis 268ArticleasofDecember7,2022,inadditiontotheminimumnumberofmarijuana 269microbusinesslicensesasarerequiredunderthissection.Thedepartmentmayliftorease 270anylimitonthenumberoflicenseesorcertificateholdersinordertomeetthedemandfor 271marijuanainthestateandtoensureacompetitivemarketwhilealsopreventinganover- 272concentrationofmarijuanafacilitieswithintheboundariesofanyparticularlocal 273government. 274 (3)Ifcomprehensivefacilitylicensesbecomeavailablebecausethenumberoftotal 275issuedlicensesinanyrespectivecategoryfallsbelowtheminimumrequiredunderthis 276sectionorthedepartmentdeterminesmorecomprehensivefacilitylicensesarenecessaryto 277meettherequirementsofsubdivision(2)ofthissubsection,thedepartmentshallawardby 278lotteryatleastfiftypercentofanynewlicensesavailabletosatisfytheminimumrequirement 279toapplicantswhoareownersofamarijuanamicrobusinessfacilitythathasbeeninoperation 280foratleastoneyearandisingoodstandingwiththedepartmentandisotherwisequalifiedfor 281thelicense. 282 (4)Thedepartmentmayissueanyrulesoremergencyrulesnecessaryforthe 283implementationandenforcementofthissectionandtoensuretherightto,availability,and 284safeuseofmarijuanabyconsumers.Indevelopingsuchrulesoremergencyrules,the 285departmentmayconsultorcontractwithotherpublicagencies.Inadditiontoanyotherrules 286oremergencyrulesnecessarytocarryoutthemandatesofthissection,thedepartmentshall 287issuerulesoremergencyrulesrelatingtothefollowingsubjects: 288 (a)Proceduresforissuingalicenseandforrenewing,suspending,andrevokinga 289license,solongasanyprocedurerelatedtoasuspensionorrevocationincludesareasonable HJR72 31 290cureperiod,notlessthanthirtydays,priortothesuspensionorrevocation,exceptininstances 291wherethereisacredibleandimminentthreattopublichealthorpublicsafety; 292 (b)Requirementsandstandardsforsafecultivation,processing,anddistributionof 293marijuanaandmarijuana-infusedproductsbymarijuanafacilities,includinghealthstandards 294toensurethesafepreparationofmarijuana-infusedproducts; 295 (c)Testing,packaging,andlabelingstandards,procedures,andrequirementsfor 296marijuanaandmarijuana-infusedproductsandarequirementthatarepresentativesampleof 297marijuanabetestedbyamarijuanatestingfacilitytoensurepublichealth; 298 (d)Labelingstandardsthatprotectpublichealthbyrequiringthelistingof 299pharmacologicallyactiveingredients,including,butnotlimitedto,tetrahydrocannabinol 300(THC),cannabidiol(CBD),andothercannabinoidcontent,theTHCandothercannabinoid 301amountinmilligramsperserving,thenumberofservingsperpackage,andquantitylimitsper 302saletocomplywiththeallowablepossessionamount; 303 (e)Requirementsthatpackagingandlabelsshallnotbemadetobeattractiveto 304children,requiredwarninglabels,andthatmarijuanaandmarijuana-infusedproductsbesold 305inresealable,child-resistantpackagingtoprotectpublichealth; 306 (f)Securityrequirements,includinglighting,physicalsecurity,andalarm 307requirements,andrequirementsforsecurelytransportingmarijuanabetweenmarijuana 308facilities; 309 (g)Recordkeepingrequirementsformarijuanafacilitiesandmonitoringrequirements 310totrackthetransferofmarijuanabylicensees; 370greenhousefacilityusingacombinationofnaturalandartificiallightingmaybelimitedby 371thedepartment,attheelectionofthelicensee,totwothousandeighthundredfloweringplants 372orthirtythousandsquarefeetoffloweringplantcanopy.Thelicenseshallbevalidforthree 373yearsfromitsdateofissuanceandshallberenewable,exceptforgoodcause.The 416amicrobusinesswholesalefacility.Amarijuanamicrobusinessfacilitylicenseemayengage 417inalloftheactivitiesallowedunderthelicenseoritmayapplyforandengageinasubsetof 418theactivitiesallowediftheapplicantorlicenseholdersochooses.Amicrobusiness 419wholesalefacilitymaycultivate,process,manufacture,transport,andsellmarijuanaand 420marijuana-infusedproductstoanyothermarijuanamicrobusinessfacility.Amicrobusiness 421dispensaryfacilitylicenseemayacquirefromanyothermicrobusinessfacility,process, 422package,deliver,andsellmarijuanaandmarijuana-infusedproductstoanyothermarijuana 423microbusinessfacility,ordirectlytoqualifiedpatients,theirprimarycaregiver,orconsumers. 424Amarijuanamicrobusinesslicenseshallbevalidforthreeyearsfromitsdateofissuanceand 425shallberenewable,exceptforgoodcause.Thedepartmentshallchargeeachapplicantafee 426ofonethousandfivehundreddollarsperlicenseapplicationandforeachsubsequentlicense 427renewalapplicationthereafter.Anyapplicantthatmeetsthecriteriatoapplyforamarijuana 428microbusinessfacilitylicensebutisnotchosenbythelotterysystemmayhavetheir 429applicationfeerefunded.Oncegranted,thedepartmentshallchargeeachlicenseeanannual 430feeofonethousandfivehundreddollarsperfacilitylicense,butthereshallbenoannualfee 431assessedforthefirstyearoflicensure.Applicationandlicensefeesshallbeincreasedor 432decreasedeachyearbythepercentageofincreaseordecreasefromtheendoftheprevious 433calendaryearoftheConsumerPriceIndex,orsuccessorindexaspublishedbytheU.S. 434DepartmentofLabor,oritssuccessoragency.Anentitymaynotbeanownerofmorethan 435onemarijuanamicrobusinessfacilitylicense.Anownerofamarijuanamicrobusinessfacility 436maynotalsobeanownerofanotherlicensedmarijuanafacilityormedicalfacilityregulated 437underthisArticle.However,theownerofamarijuanamicrobusinessfacilitymayapplyfora HJR72 35 438licenseorlicensesforothermarijuanaormedicalmarijuanafacilitiesunderthisArticle.If 439grantedoneormoreoftheselicenses,themarijuanamicrobusinessfacilityownershall 440transitiontootherlicensedoperationsonareasonablypracticaltimetableestablishedbythe 441department,andsurrenderitsmarijuanamicrobusinessfacilitylicensetothedepartmentfor 442issuancetoanapplicantforamarijuanamicrobusinessfacility.Inadditiontoother 443requirementsestablishedbythissection,anapplicantforamarijuanamicrobusinesslicense 444shallbemajorityownedbyindividualswhoeachmeetatleastoneofthefollowing 445qualifications: 446 (a)Haveanetworthoflessthan$250,000andhavehadanincomebelowtwo 447hundredandfiftypercentofthefederalpovertylevel,orsuccessorlevel,assetforthinthe 448applicablecalendaryear'sfederalpovertyincomeguidelinespublishedbytheU.S. 449DepartmentofHealthandHumanServicesoritssuccessoragency,foratleastthreeofthe 450tencalendaryearspriortoapplyingforamarijuanamicrobusinessfacilitylicense;or 451 (b)Haveavalidservice-connecteddisabilitycardissuedbytheUnitedStates 452DepartmentofVeteransAffairs,orsuccessoragency;or 453 (c)Beapersonwhohasbeen,orapersonwhoseparent,guardianorspousehasbeen 454arrestedfor,prosecutedfor,orconvictedofanon-violentmarijuanaoffense,exceptfora 455convictioninvolvingprovisionofmarijuanatoaminor,oraconvictionofdrivingunderthe 456influenceofmarijuana.Thearrest,charge,orconvictionmusthaveoccurredatleastoneyear 457priortotheeffectivedateofthissection;or 458 (d)ResideinaZIPcodeorcensustrackareawhere: 459 a.Thirtypercentormoreofthepopulationlivesbelowthefederalpovertylevel;or 460 b.Therateofunemploymentisfiftypercenthigherthanthestateaveragerateof 461unemployment;or 462 c.Thehistoricrateofincarcerationformarijuana-relatedoffensesisfiftypercent 463higherthantheratefortheentirestate;or 464 (e)Graduatedfromaschooldistrictthatwasunaccredited,orhadasimilarsuccessor 465designation,atthetimeofgraduation,orhaslivedinazipcodecontaininganunaccredited 466schooldistrict,orsimilarsuccessordesignation,forthreeofthepastfiveyears. 467 (13)Thedepartmentmayrestricttheaggregatenumberoflicensesgrantedfor 468marijuanamicrobusinessfacilities,provided,however,thatthenumbermaynotbelimitedto 469fewerthanthefollowingnumberoflicensesineachUnitedStatescongressionaldistrictinthe 470stateofMissouripursuanttothemapofeachoftheeightcongressionaldistrictsasdrawnand 471effectiveonDecember6,2018: 472 (a)Six,oncethedepartmentbeginsissuinglicensesformarijuanamicrobusiness 473facilitiesunderthissubsection,atleasttwoofwhichshallbeamicrobusinessdispensary 474facility,andatleastfourofwhichwillbeamicrobusinesswholesalefacility.Thedepartment HJR72 36 475shallissuethefirstgroupofmicrobusinesslicensesnolaterthanthreehundreddaysafterthe 476effectivedateofthissection; 477 (b)Anadditionalsixfollowingthefirsttwohundredandseventydaysafterthe 478departmentbeginsissuinglicensesformarijuanamicrobusinessfacilitiesunderthis 479subsection,atleasttwoofwhichshallbeamicrobusinessdispensaryfacility,andatleast 480fourofwhichwillbeamicrobusinesswholesalefacility,butonlyafterthechiefequity 481officer,orhisorherdesignee,conductsareviewandcertifiesthatpreviousmicrobusiness 482licenseswereawardedtoandarebeingoperatedbyeligibleapplicantsingoodstanding;and 483 (c)Anadditionalsixafterthefirstfivehundredandforty-eightdaysafterthe 484departmentbeginsissuinglicensesformarijuanamicrobusinessfacilitiesunderthis 485subsection,atleasttwoofwhichshallbeamicrobusinessdispensaryfacility,andatleast 486fourofwhichwillbeamicrobusinesswholesalefacility,butonlyafterthechiefequity 487officer,orhisorherdesignee,conductsareviewandcertifiesthatpreviousmicrobusiness 488licenseswereawardedtoandarebeingoperatedingoodstandingbyeligibleapplicants. 489 Futurechangestotheboundariesorthenumberofcongressionaldistrictsshallhave 490noimpactonmicrobusinesslicensenumbersordistribution.Theeligibilityreviewsetforth 491inthissubdivisionshallbeconductedbythechiefequityofficerwithinsixtydaysofissuance 492ofthelicenses.Thechiefequityofficershallpublishinamanneravailabletothepublicthe 493resultsofthereviewthatcontainsonlyaggregateinformationonlicenseeeligibilitycriteria. 494 (14)Within60daysaftertheeffectivedateofthissection,thedepartmentshall 495appointachiefequityofficer.Thechiefequityofficershallassistwiththedevelopmentand 496implementationofprogramstoinformthepublicoftheopportunitiesavailabletothose 497peoplewhomeetthecriteriasetforthinparagraph(12)ofthissubsection.Thechiefequity 498officershallestablishpubliceducationprogrammingandtargetedtechnicalassistance 499programmingdedicatedtoprovidingcommunitiesthathavebeenimpactedbymarijuana 500prohibitionwithinformationdetailingthelicensingprocessandinformingindividualsofthe 501supportandresourcesthattheofficecanprovidetoindividualsandentitiesinterestedin 502participatinginactivitylicensedunderthisArticle.Thechiefequityofficershallprovidea 503reporttothedepartment,nolaterthanJanuaryl,2024,andannuallythereafter,oftheirand 504thedepartment'sactivitiesinensuringcompliancewiththeapplicantcriteriasetforthin 505paragraph(12)ofthissubsection,andthedepartmentshallprovidesuchreporttothe 506legislature.Thechiefequityofficermayonlyberemovedforcauseandthedepartmentshall 507notinterferewiththeofficer'slawfulofficialactivitiesunderthissection. 508 (15)Anymedicalmarijuanacultivationfacility,medicalmarijuanadispensary 509facility,andmedicalmarijuana-infusedproductsmanufacturingfacility,holdinganactive 510facilitylicenseundersection1ofthisArticleshallhavetherighttoconverttheirlicensetoa 511comprehensivemarijuanalicense,andanyentitycertifiedbythedepartmenttoconduct HJR72 37 512medicalmarijuanatesting,transportationorseed-to-saletracking,asoftheeffectivedateof 513thissectionshallbedeemedcertifiedtoconductthoseactivitieswithrespecttoallmarijuana; 514 (16)Upontheeffectivedateofthissection,anyexistingmedicalfacilitylicenseemay 515requestitsmedicalfacilitylicenseconverttothatofacomprehensivefacilitylicense. 516Conversionrequestsnotprocessedwithinsixtydaysofdepartmentreceiptshallbedeemed 517approved. 518 (17)Withtheexceptionofmicrobusinesslicenses,andconsistentwithanylimitations 519setforthinthissection,forthefirstfivehundredandforty-eightdaysafterthedepartment 520beginsissuinglicensesformarijuanafacilitiesunderthissection,thedepartmentmayonly 521issuealicense: 522 (a)Foracomprehensivemarijuanacultivationfacilitytoanentityholdingamedical 523marijuanacultivationfacilitylicenseissuedpursuanttosectionlofthisArticleseekingto 524convertitslicensuretothatofacomprehensivemarijuanacultivationfacilityatthesame 525location; 526 (b)Foracomprehensivemarijuanadispensaryfacilitytoanentityholdingamedical 527marijuanadispensaryfacilitylicenseissuedpursuanttosection1ofthisArticleseekingto 528convertitslicensuretothatofacomprehensivemarijuanadispensaryfacilityatthesame 529location;and 530 (c)Foracomprehensivemarijuana-infusedproductsmanufacturingfacilitytoan 531entityholdingamedicalmarijuana-infusedproductsmanufacturingfacilitylicenseissued 532pursuanttosectionlofthisArticleseekingtoconvertitslicensuretothatofacomprehensive 533marijuanainfusedproductsmanufacturingfacilityatthesamelocation. 534 (18)Thedepartmentshallissuealicensetoeachrequestforaconversiontoa 535comprehensivemarijuanafacilitylicensepursuanttosubdivision(15)ofthissubsectionifthe 536applicantisingoodstandingwiththedepartment. 537 (19)Notwithstandingtheprovisionsofsection1ofthisArticle,ifanexistingmedical 538marijuanadispensaryfacilityislocatedinajurisdictionthatprohibitsnon-medicalretail 539marijuanafacilitiesunderthissection,orisotherwisepreventedfromoperatinga 540comprehensivemarijuanadispensaryfacilityatthesamelocationastheexistingmedical 541marijuanadispensaryfacility,themedicalmarijuanadispensaryfacilitymayapplytothe 542departmentforacomprehensivemarijuanadispensarylicensepursuanttosubdivision(15)of 543thissubsectioninanewlocationwithinthesamecongressionaldistrict,andsuchapplication 544shallbegrantedsolongasthenewlocationmeetsalltherequirementsofthissectionand 545departmentregulations. 546 (20)Inadditiontotheforegoing,ifthedepartmenthasreasontobelievethatthe 547conversionofamedicalfacilityintoacomprehensivefacilitymightlimitorrestrictaccessto 548anadequatesupplyofmarijuanaandmarijuana-infusedproductsatareasonablecostto HJR72 38 549qualifyingpatients,asdefinedinsectionlofthisArticle,thedepartmentmayrequestaplan 550fromthemedicalfacilitylicenseewhichexplainshowtheapplicantwouldserveboththe 551medicalandadult-usemarkets,whilemaintainingadequatesupplyatareasonablecostto 552qualifyingpatients. 553 (21)Comprehensivemarijuanafacilitieslicensedtodistributemarijuana, 554marijuana-infusedproducts,andmarijuanaaccessoriesdirectlytoconsumerspursuantto 555thissectionmayalsodistributemarijuana,marijuana-infusedproducts,andmarijuana 556accessoriestoqualifyingpatientsandprimarycaregiversconsistentwithsection1ofthis 557Articleanddepartmentregulation. 558 (22)Thedepartmentmaychargeafeenottoexceedtwothousandfivehundred 559dollarsforanycertificationissuedpursuanttothissection.Thisfeelimitationshallbe 560increasedordecreasedeachyearbythepercentageofincreaseordecreasefromtheendofthe 561previouscalendaryearoftheConsumerPriceIndex,orsuccessorindexaspublishedbythe 562U.S.DepartmentofLabor,oritssuccessoragency. 563 (23)WithinthirtydaysofDecember8,2022,thedepartmentshallmakeavailableto 564thepublicapplicationformsandapplicationinstructionsforpersonalcultivationregistration 565cards.WithinsixtydaysofDecember8,2022,thedepartmentshallbeginaccepting 566applicationsforsuchregistrationcards. 567 (24)Exceptforgoodcause,apersonatleasttwenty-oneyearsofagemayobtaina 568registrationcardfromthedepartmenttocultivateuptosixfloweringmarijuanaplants,six 569nonfloweringmarijuanaplants(overfourteeninchestall),andsixclones(plantsunder 570fourteeninchestall)fornon-commercialuse,provided: 571 (a)Theplantsandanymarijuanaproducedbytheplantsinexcessofthreeouncesare 572keptatoneprivateresidence,areinalockedspace,andarenotvisiblebynormal,unaided 573visionfromapublicplace;and 574 (b)Notmorethantwelvefloweringmarijuanaplantsarekeptinoronthegroundsof 575aprivateresidenceatonetime. 576 Thecardshallbevalidfortwelvemonthsfromitsdateofissuanceandshallbe 577renewable.Thedepartmentshallchargeanannualfeeforthecardofonehundreddollars, 578withsuchratetobeincreasedordecreasedeachyearbythepercentageofincreaseor 579decreasefromtheendofthepreviouscalendaryearoftheConsumerPriceIndex,or 580successorindexaspublishedbytheU.S.DepartmentofLabor,oritssuccessoragency. 581 (25)AllmarijuanasoldinMissouripursuanttothissectionshallbecultivatedin 582Missouri. 583 (26)Allmarijuana-infusedproductssoldinMissouripursuanttothissectionshallbe 584manufacturedinMissouri. HJR72 39 585 (27)Thedenialofalicenseorlicenserenewalbythedepartmentshallbeappealable. 586Theapplicantmaychoosetochallengeanydenialbythedepartmentthroughthe 587administrativehearingcommission,orsuccessorentity.Pursuanttosection536.l00, 588RSMo,oritssuccessorprovisions,anylicenseewhohasexhaustedalladministrative 589remediesprovidedbylawandwhoisaggrievedbyafinaldecisioninacontestedcaseis 590entitledtojudicialreview. 591 (28)Noelectedofficialshallinterferedirectlyorindirectlywiththedepartment's 592obligationsandactivitiesunderthissection. 593 (29)Tominimizethepotentialforunduepoliticalinfluenceinawardinglicenses,the 599marijuanafacilitiesandcertificationspursuanttothissection. 600 (31)Thedepartmentshallnothavetheauthoritytopromulgate,apply,orenforceany 657facilitystructureclosestinproximitytotheschool,daycare,orchurchtotheclosestpointof 658thepropertylineoftheschool,daycare,orchurch.Iftheschool,daycare,orchurchispartof HJR72 41 659alargerstructure,suchasanofficebuildingorstripmall,thedistanceshallbemeasuredto 660theentranceorexitoftheschool,daycare,orchurchclosestinproximitytothefacility.Inthe 670prohibitmarijuanafacilitiesorentitieswithatransportationcertificationeitherexpresslyor 671throughtheenactmentofordinancesorregulationsthatmaketheiroperationunduly 672burdensomeinthejurisdiction.However,localgovernmentsmayenactordinancesor 673regulationsnotinconflictwiththissection,orwithregulationsenactedpursuanttothis 674section,governingthetime,place,andmannerofoperationofsuchfacilitiesinthelocality. 675Alocalgovernmentmayestablishcivilpenaltiesforviolationofanordinanceorregulations 676governingthetime,place,andmannerofoperationofamarijuanafacilityorentityholdinga 677transportationcertificationthatmayoperateinsuchlocality. 678 (6)Localgovernmentsmayenactordinancesorregulationsnotinconflictwiththis 679section,orwithregulationsenactedpursuanttothissection,governing: 680 (a)Thetimeandplacewheremarijuanamaybesmokedinpublicareaswithinthe 681locality;and 682 (b)Theconsumptionofmarijuana-infusedproductswithindesignatedareas, 683includingthepreparationofculinarydishesorbeveragesbylocalrestaurantsforon-site 684consumptiononthesamedayitisprepared. 685 6.TaxationandReporting. 686 (1)Ataxshallbeleviedupontheretailsaleofnon-medicalmarijuanasoldto 687consumersatmarijuanafacilitieslicensedpursuanttothissectionwithinthestate.Thetax 688shallbeatarateofsixpercentoftheretailprice.Thetaxshallbecollectedbyeachlicensed 689retailmarijuanafacilityandpaidtothedepartmentofrevenue.Afterretainingnomorethan 690twopercentofthetotaltaxcollectedoritsactualcollectioncosts,whicheverisless,amounts 691generatedbythemarijuanatangiblepersonalpropertyretailsalestaxleviedinthissection 692shallbedepositedbythedepartmentofrevenueintotheveterans,health,andcommunity 693reinvestmentfundcreatedunderthissubsection.Licensedentitiesmakingnon-medicalretail 694saleswithinthestateshallbeallowedapprovedcreditforreturnsprovidedthetaxwaspaidon HJR72 42 695thereturneditemandthepurchaserwasgiventherefundorcredit.Thistaxshallnotapplyto 696medicalmarijuanadispensedtoaregisteredqualifyingpatientorcaregiver. 697 (2)Thereisherebycreatedinthestatetreasurythe"Veterans,Health,and 698CommunityReinvestmentFund"whichshallconsistoftaxesandfeescollectedunderthis 699section.Thestatetreasurershallbecustodianofthefund,andheorsheshallinvestmoniesin 700thefundinthesamemannerasotherfundsareinvested.Anyinterestandmoneysearnedon 701suchinvestmentsshallbecreditedtothefund.Notwithstandinganyotherprovisionoflaw, 702anymoniesremaininginthefundattheendofabienniumshallnotreverttothecreditofthe 703generalrevenuefund.Thecommissionerofadministrationisauthorizedtomakecash 704operatingtransferstothefundforpurposesofmeetingthecashrequirementsofthe 705departmentinadvanceofitreceivingapplication,licensing,andtaxrevenue,withanysuch 706transferstoberepaidasprovidedbylaw.Thefundshallbeadedicatedfundandshallbe 707distributedasfollows: 708 (a)First,asdeterminedbyappropriation,tothedepartmentanamountnecessaryfor 709thedepartmenttocarryoutitsresponsibilitiesunderthissection,includingrepaymentofany 710cashoperatingtransfers,paymentsmadethroughcontractoragreementwithotherstateand 711publicagenciesnecessarytocarryoutthissection,andareservefundtomaintaina 712reasonableworkingcashbalanceforthepurposeofcarryingoutthissection; 713 (b)Second,asdeterminedbyappropriation,togovernmentalentitiesinamounts 714necessaryforcarryingoutresponsibilitiesintheexpungementofcriminalhistoryrecords 715underthissection; 716 (c)Next,theremainingfundbalanceshallbedistributedinthirdsasfollows: 717 a.One-thirdoftheremainderofthefundbalanceshallbetransferredtotheMissouri 718veteranscommissionandalliedstateagencies,asdeterminedbyappropriation,exclusively 719forhealthcareandotherservicesformilitaryveteransandtheirdependentfamilies; 720 b.One-thirdoftheremainderofthefundbalancetothedepartmenttoprovidegrants 721toagenciesandnot-for-profitorganizations,whethergovernmentorcommunity-based,to 722increaseaccesstoevidence-basedlow-barrierdrugaddictiontreatment,prioritizingmedically 723proventreatmentandoverdosepreventionandreversalmethodsandpublicorprivate 724treatmentoptionswithanemphasisonreintegratingrecipientsintotheirlocalcommunities,to 725supportoverdosepreventioneducation,andtosupportjobplacement,housing,and 726counselingforthosewithsubstanceusedisorders.Agenciesandorganizationsserving 727populationswiththehighestratesofdrug-relatedoverdoseshallbeprioritizedtoreceivethe 728grants;and 729 c.One-thirdoftheremainderofthefundbalancetotheMissouripublicdefender 730system.AnymoneyscreditedtotheMissouripublicdefendersystemshallbeusedonlyfor 731legalassistanceforlow-incomeMissourians,shallnotbedivertedtoanyotherpurpose. HJR72 43 732 (d)Allmoniesfromthetaxesandfeesauthorizedhereundershallprovidenewand 733additionalfundingforthepurposesenumeratedaboveandshallnotreplaceexistingfunding. 734 (e)Theunexpendedbalanceexistinginthefundshallbeexemptfromtheprovisions 735ofsection33.080,RSMo,oritssuccessorprovisions,relatingtothetransferofunexpended 736balancestothegeneralrevenuefund. 737 (3)Forallretailsalesofmarijuana,arecordshallbekeptbythesellerofallamounts 738andtypesofmarijuanainvolvedinthesaleandthetotalamountofmoneyinvolvedinthe 739sale,includingitemizations,taxescollected,andgrandtotalsaleamounts.Allsuchrecords 740shallbekeptonthepremisesinareadilyavailableformatandbemadeavailableforreview 741bythedepartmentandthedepartmentofrevenueuponrequest.Suchrecordsshallbe 742retainedforfiveyearsfromthedateofthesale. 743 (4)Thetaxleviedpursuanttothissubsectionisseparatefromandinadditiontoany 744generalstateandlocalsalesandusetaxesthatapplytoretailsales,whichshallcontinuetobe 745collectedanddistributedasprovidedbygenerallaw. 746 (5)PursuanttoArticleIII,Section49ofthisConstitution,thegoverningbodyofany 747localgovernmentisauthorizedtoimpose,byordinanceororder,anadditionalsalestaxinan 748amountnottoexceedthreepercentonalltangiblepersonalpropertyretailsalesofadultuse 749marijuanasoldinsuchpoliticalsubdivision.Thetaxauthorizedbythisparagraphshallbein 750additiontoanyandallothertangiblepersonalpropertyretailsalestaxesallowedbylaw, 751exceptthatnoordinanceororderimposingatangiblepersonalpropertyretailsalestaxunder 752theprovisionsofthisparagraphshallbeeffectiveunlessthegoverningbodyofthepolitical 753subdivisionsubmitstothevotersofthepoliticalsubdivision,atamunicipal,countyorstate 754general,primaryorspecialelection,aproposaltoauthorizethegoverningbodyofthe 755politicalsubdivisiontoimposeatax.Anyadditionallocalretailsalestaxshallbecollected 756pursuanttogenerallawsforthecollectionoflocalsalestaxes. 757 (6)ExceptasauthorizedinthisArticle,noadditionaltaxesshallbeimposedonthe 758saleofmarijuana. 759 (7)Thefeesandtaxesprovidedforinthissectionshallbefullyenforceable 760notwithstandinganyotherprovisioninthisConstitutionpurportedlyprohibitingorrestricting 761thetaxesandfeesprovidedforherein. 762 (8)FortaxpayersauthorizedtodobusinesspursuanttothisArticle,theamountthat 763wouldhavebeendeductedinthecomputationoffederaltaxableincomepursuantto26U.S.C. 764Section280EoftheInternalRevenueCodeasineffectonJanuary1,2021,orsuccessor 765provisions,butisdisallowedbecausecannabisisacontrolledsubstanceunderfederallaw, 766shallbesubtractedfromthetaxpayer'sfederaladjustedgrossincome,indeterminingthe 767taxpayer'sMissouriadjustedgrossincome. 768 7.AdditionalProtections. HJR72 44 769 (1)Amarijuanatestingfacilityshallnotbesubjecttocivilorcriminalprosecution 770underMissourilaw,denialofanyrightorprivilege,civiloradministrativepenaltyor 771sanction,ordisciplinaryactionbyanyaccreditationorlicensingboardorcommissionfor 772providinglaboratorytestingservicesthatrelatetomarijuanaconsistentwiththissectionand 773otherwisemeetinglegalstandardsofprofessionalconduct. 774 (2)NotwithstandinganyprovisionofArticleVtothecontrary,anattorneyshallnot 775besubjecttodisciplinaryactionbytheSupremeCourtofMissouri,theofficeofchief 776disciplinarycounsel,thestatebarassociation,anystateagencyoranyprofessionallicensing 777bodyforanyofthefollowing: 778 (a)Owning,operating,investingin,beingemployedby,orcontractingwith 779prospectiveorlicensedmarijuanatestingfacilities,marijuanacultivationfacilities,marijuana 780dispensaryfacilities,marijuana-infusedproductsmanufacturingfacilities,marijuana 781microbusinessfacilities,ortransportationcertificateholders; 782 (b)Counseling,advising,and/orassistingaclientinconductpermittedbyMissouri 783lawthatmayviolateorconflictwithfederalorotherlaw,aslongastheattorneyadvisesthe 784clientaboutthatfederalorotherlawanditspotentialconsequences; 785 (c)Counseling,advising,and/orassistingaclientinconnectionwithapplyingfor, 786owning,operating,orotherwisehavinganylegal,equitable,orbeneficialinterestin 787marijuanatestingfacilities,marijuanacultivationfacilities,marijuanadispensaryfacilities, 788marijuana-infusedproductsmanufacturingfacilities,marijuanamicrobusinessfacilities,or 789transportationcertificates;or 790 (d)Counseling,advisingorassistingaqualifyingpatient,primarycaregiver, 791physician,nursepractitioner,healthcareprovider,consumer,orotherclientrelatedtoactivity 792thatisnolongersubjecttocriminalpenaltiesunderMissourilawpursuanttothisArticle. 793 (3)Actionsandconductbymarijuanafacilitieslicensedorotherwisecertifiedbythe 794department,ortheiremployeesoragents,aspermittedbythissectionandincompliancewith 795departmentregulationsandotherstandardsoflegalconduct,shallnotbesubjecttocriminal 796orcivilliabilityorsanctionsunderMissourilaw,exceptasprovidedforbythissection. 797 (4)Thedepartmentmaynotpromulgatearulethatrequiresaconsumertoprovidea 798marijuanafacilitywithidentifyinginformationotherthanidentificationtodeterminethe 799consumer'sage. 800 (5)ItisthepublicpolicyofthestateofMissourithatcontractsrelatedtomarijuana 801thatareenteredintobymarijuanafacilitiesandthosewhoallowpropertytobeusedbythose 802entitiesshouldbeenforceable.ItisthepublicpolicyofthestateofMissourithatnocontract 803enteredintobymarijuanafacilities,orbyapersonwhoallowspropertytobeusedfor 804activitiesthatareexemptfromstatecriminalpenaltiesbythissection,shallbeunenforceable 805onthebasisthatactivitiesrelatedtomarijuanamaybeprohibitedbyfederallaw. HJR72 45 806 (6)Priortorequestingasearchorarrestwarrantrelatingtocultivationofmarijuana 807plants,astateorlocallawenforcementofficialshallverifywiththedepartmentwhetherthe 808targetedpersonholdsaregistrationcardallowingforcultivationoffloweringmarijuana 809plantsunderthissection,andshallinformtheissuingauthoritywhenmakingthewarrant 810request.Evidenceofmarijuanaalone,withoutspecificevidenceindicatingthatthemarijuana 811isoutsideofwhatislawfulformedicaloradultuse,cannotbethebasisforasearchofa 812patientornon-patient,includingtheirhome,vehicleorotherproperty.Lawfulmarijuana 813relatedactivitiescannotbethebasisforaviolationofparole,probation,oranytypeof 814supervisedrelease.Stateandlocallawenforcementshallhaveaccesstosuchdepartment 815informationasisnecessarytoconfirmwhetherthetargetedpersonholdsaregistrationcard. 816Eachtimeastateorlocallawenforcementofficerexecutesasearchwarrantauthorizingentry 817uponpremisesforanallegedmarijuanaoffense,theofficermustfirstknockorannouncetheir 818presenceorpurposepriortoenteringthepremises. 819 (7)(a)Afterexecutingasearchwarrantforanallegedmarijuanaoffense,or 820conductingawarrantlesssearchforanallegedmarijuanaoffense,theofficershallreportthe 821followinginformationtotheagencythatemploystheofficer: 822 a.Thereasonsforthewarrantor,inthecaseofawarrantlesssearch,adetailed 823accountofeithertheprobablecauseorexigentcircumstances,ifany,whichleadtothe 824warrantlesssearch; 825 b.Whetheranymarijuanawasdiscoveredduringthecourseofthesearch; 826 c.Whetheranymarijuanawasseizedduringthesearch,andifso,theamountseized; 827 d.Whetheranyothercontrabandwasdiscoveredorseizedinthecourseofthesearch, 828andifseized,adescriptionofthecontraband; 829 e.Adescriptionofthetacticsusedbylawenforcementtoentertheproperty; 830 f.Whetheranarrestwasmadeasaresultofthesearch;and 831 g.Ifanarrestwasmade,thecrimesuspected. 832 (b)Eachlawenforcementagencyshallcompilethedatadescribedinparagraph(a)of 833thissubdivisionforthecalendaryearintoareportandshallsubmitthereporttotheattorney 834generalnolaterthanMarchfirstofthefollowingcalendaryear.Theattorneygeneralshall 835determinetheformatthatalllawenforcementagenciesshallusetosubmitthereport. 836 (c)Theattorneygeneralshallsubmitasummaryoftheannualreportsoflaw 837enforcementagenciestothegovernor,thegeneralassembly,andeachlawenforcement 838agencynolaterthanJunefirstofeachyear.Thesummaryshallincludethetotalnumberof 839suchwarrantsexecutedbyeachagencyinthepreviouscalendaryearforallegedmarijuana 840offenses,andacompilationoftheinformationreportedbylawenforcementagenciespursuant 841toparagraph(b)ofthissubdivision. 842 8.Legislation. HJR72 46 843 Nothinginthissectionshalllimitthegeneralassemblyfromenactinglawsconsistent 844withthepurposesandprovisionsofthissection. 845 9.AdditionalProvisions. 846 (1)Noownerofamarijuanafacilityorentitywithatransportationcertificationshall 847beanindividualwithadisqualifyingfelonyoffense.A"disqualifyingfelonyoffense"isa 848violationof,andconvictionorguiltypleato,stateorfederallawthatis,orwouldhavebeen,a 849felonyunderMissourilaw,regardlessofthesentenceimposed,unlessthedepartment 850determinesthat: 851 (a)Theperson'sconvictionwasforamarijuanaoffensethathasbeenexpungedoris 852currentlyeligibleforexpungementunderthissection;or 853 (b)Theperson'sconvictionwasforanon-violentcrimeforwhichheorshewasnot 854incarceratedandthatismorethanfiveyearsold;or 855 (c)Morethanfiveyearshavepassedsincethepersonwasreleasedfromparoleor 856probation,andheorshehasnotbeenconvictedofanysubsequentfelonycriminaloffenses. 857 Thedepartmentmayconsultwithandrelyontherecords,advice,and 858recommendationsoftheattorneygeneralandthedepartmentofpublicsafety,ortheir 859successorentities,incarryingouttheprovisionsofthissubdivision. 860 (2)OwnerslicensedpursuanttothissectionshallsubmitfingerprintstotheMissouri 861statehighwaypatrolforthepurposeofconductingastateandfederalfingerprint-based 862criminalrecordcheckinaccordancewithU.S.PublicLaw92-544,oritssuccessor 863provisions.TheMissouristatehighwaypatrol,ifnecessary,shallforwardthefingerprintsto 864theFederalBureauofInvestigation(FBI)forthepurposeofconductingafingerprint-based 865criminalbackgroundcheck.Fingerprintsshallbesubmittedpursuanttosection43.543, 866RSMo,oritssuccessorprovisions,andfeesshallbepaidpursuanttosection43.530,RSMo, 867oritssuccessorprovisions.Unlessotherwiserequiredbylaw,noindividualshallberequired 868tosubmitfingerprintsmorethanonce. 869 (3)Nomarijuanafacilityshallmanufacture,package,orlabelmarijuanaor 870marijuana-infusedproductsinafalseormisleadingmanner.Nopersonshallsellanyproduct 871inamannerdesignedtocauseconfusionbetweenmarijuanaoramarijuana-infusedproduct 872andanyproductnotcontainingmarijuana.Aviolationofthissubdivisionshallbepunishable 873byanappropriateandproportionaldepartmentsanction,uptoandincludinganadministrative 874penaltyoffivethousanddollarsandlossoflicense. 875 (4)Nomarijuanafacilitymaysellediblemarijuana-infusedcandyinshapesor 876packagesthatareattractivetochildrenorthatareeasilyconfusedwithcommerciallysold 877candythatdoesnotcontainmarijuana.Aviolationofthissubdivisionshallbepunishableby 878anappropriateandproportionaldepartmentsanction,uptoandincludinganadministrative 879penaltyoffivethousanddollarsandlossoflicense. HJR72 47 880 (5)Allmarijuanaandmarijuana-infusedproductsshallbesoldinindividual, 881child-resistantcontainersthatarelabeledwithservingamounts,instructionsforuse,and 882estimatedlengthofeffectiveness.Allmarijuanaandmarijuana-infusedproductsshallbesold 883incontainersclearlyandconspicuouslylabeled,asmandatedbythedepartment,ascontaining 884"Marijuana"ora"Marijuana-InfusedProduct".Violationofthissubdivisionshallsubjectthe 885violatortodepartmentsanctions,includinganadministrativepenaltyoffivethousanddollars. 886 (6)Amarijuanafacilitymaynotallowcultivation,manufacturing,sale,ordisplayof 887marijuana,marijuana-infusedproducts,ormarijuanaaccessoriestobevisiblefromapublic 888placeoutsideofthemarijuanafacilitywithouttheuseofbinoculars,aircraft,orotheroptical 889aids. 890 (7)Amarijuanafacilitymaynotcultivate,manufacture,test,sell,orstoremarijuana 891atanylocationotherthanaphysicaladdressapprovedbythedepartmentandwithinan 892enclosedareathatissecuredinamannerthatpreventsaccessbypersonsnotpermittedbythe 893marijuanafacilitytoaccessthearea. 894 (8)Amarijuanafacilityshallsecureeveryentrancetothefacilitysothataccessto 895areascontainingmarijuanaisrestrictedtoemployeesandotherpersonspermittedbythe 896marijuanafacilitytoaccesstheareaandtoagentsofthedepartmentorstateandlocallaw 897enforcementofficersandemergencypersonnelandshallsecureitsinventoryandequipment 898duringandafteroperatinghourstodeterandpreventtheftofmarijuana,marijuana-infused 899products,andmarijuanaaccessories. 900 (9)Nomarijuanafacilitymayrefuserepresentativesofthedepartmenttherightto 901inspectthelicensedpremisesortoauditthebooksandrecordsofthemarijuanafacility.A 902facilitythatholdslicensesissuedundersections1and2ofthisArticleshallcomplywith 903inspectionregulationsandstandardsissuedpursuanttobothsections. 904 (10)Nomarijuanafacility,orentitywithacertification,shallassign,sell,give,lease, 905sublicense,orotherwisetransferitslicenseorcertificatetoanyotherentitywithoutthe 906expressconsentofthedepartment,nottobeunreasonablywithheld. 907 (11)Realandpersonalpropertyusedinthecultivation,manufacture,transport, 908testing,distribution,sale,andadministrationofmarijuanaforactivitiesotherwisein 909compliancewiththissectionshallnotbesubjecttoassetforfeituresolelybecauseofthatuse. 910 (12)Nopersonshallextractresinsfrommarijuanausingdangerousmaterialsor 911combustiblegaseswithoutamedicalmarijuana-infusedproductsmanufacturingfacility 912license,marijuana-infusedproductsmanufacturingfacilitylicense,oramarijuana 913microbusinesswholesalefacilitylicense.Violationofthisprohibitionshallsubjectthe 914violatortodepartmentsanctions,includinganadministrativepenaltyofonethousanddollars 915foranindividualandtenthousanddollarsforafacilitylicenseeand,ifapplicable,lossof 916certificateorlicenseforuptooneyear. HJR72 48 917 10.PersonalUseofMarijuana. 918 (1)Subjecttothelimitationsinsubsection3ofthissection,thefollowingactsbya 919personatleasttwenty-oneyearsofagearenotunlawfulandshallnotbeanoffenseunder 920statelaworthelawsofanylocalgovernmentwithinthestateorbeabasistoimposeacivil 921fine,penalty,orsanction,orbeabasistodetain,search,orarrest,orotherwisedenyanyright 922orprivilege,ortoseizeorforfeitassetsunderstatelaworthelawsofanylocalgovernment: 923 (a)Purchasing,possessing,consuming,using,ingesting,inhaling,processing, 924transporting,deliveringwithoutconsideration,ordistributingwithoutconsiderationthree 925ouncesorlessofdried,unprocessedmarijuana,oritsequivalent; 926 (b)Possessing,transporting,planting,cultivating,harvesting,drying,processing,or 927manufacturinguptosixfloweringmarijuanaplants,sixnonfloweringmarijuanaplants(over 928fourteeninchestall),andsixclones(plantsunderfourteeninchestall)providedthepersonis 929registeredwiththedepartmentforcultivationofmarijuanaplantsunderthissection, 930provided: 931 a.Theplantsandanymarijuanaproducedbytheplantsinexcessofthreeouncesare 932keptatoneprivateresidence,areinalockedspace,andarenotvisiblebynormal,unaided 933visionfromapublicplace;and 934 b.Notmorethantwicethenumberofallowableplantsunderparagraph(b)ofthis 935subdivisionarekeptinoronthegroundsofaprivateresidenceatonetime. 936 (c)Assistinganotherpersonwhoisatleasttwenty-oneyearsofagein,orallowing 937propertytobeusedfor,anyoftheactspermittedbythissection;and 938 (d)Purchasing,possessing,using,delivering,distributing,manufacturing, 939transferring,orsellingtopersonstwenty-oneyearsofageoroldermarijuanaaccessories. 940 (2)Apersonwho,pursuanttothissection,cultivatesmarijuanaplantsthatarevisible 941bynormal,unaidedvisionfromapublicplaceissubjecttoacivilpenaltynotexceedingtwo 942hundredandfiftydollarsandforfeitureofthemarijuana. 943 (3)Apersonwho,pursuanttothissection,cultivatesmarijuanaplantsthatarenot 944keptinalockedspaceissubjecttoacivilpenaltynotexceedingtwohundredandfiftydollars 945andforfeitureofthemarijuana. 946 (4)Apersonwhosmokesmarijuanainapublicplace,otherthaninanarealicensed 947forsuchactivitybytheauthoritieshavingjurisdictionoverthelicensingand/orpermittingof 948saidactivity,issubjecttoacivilpenaltynotexceedingonehundreddollars. 949 (5)Apersonwhoisundertwenty-oneyearsofagewhopossesses,uses,ingests, 950inhales,transports,deliverswithoutconsiderationordistributeswithoutconsiderationthree 951ouncesorlessofmarijuana,orpossesses,deliverswithoutconsideration,ordistributes 952withoutconsiderationmarijuanaaccessoriesissubjecttoacivilpenaltynottoexceedone HJR72 49 953hundreddollarsandforfeitureofthemarijuana.Anysuchpersonshallbeprovidedtheoption 954ofattendinguptofourhoursofdrugeducationorcounselinginlieuofthefine. 955 (6)Subjecttothelimitationsofthissection,apersonwhopossessesnotmorethan 956twicetheamountofmarijuanaallowedpursuanttothissubsection,producesnotmorethan 957twicetheamountofmarijuanaallowedpursuanttothissubsection,deliverswithoutreceiving 958anyconsiderationorremunerationtoapersonwhoisatleasttwenty-oneyearsofagenot 959morethantwicetheamountofmarijuanaallowedbythissubsection,orpossesseswithintent 960todelivernotmorethantwicetheamountofmarijuanaallowedbythissubsection: 961 (a)Forafirstviolation,issubjecttoacivilinfractionpunishablebyacivilpenaltynot 962exceedingtwohundredandfiftydollarsandforfeitureofthemarijuana; 963 (b)Forasecondviolation,issubjecttoacivilinfractionpunishablebyacivilpenalty 964notexceedingfivehundreddollarsandforfeitureofthemarijuana; 965 (c)Forathirdorsubsequentviolation,issubjecttoamisdemeanorpunishablebya 966finenotexceedingone-thousanddollarsandforfeitureofthemarijuana; 967 (d)Apersonundertwenty-oneyearsofageissubjecttoacivilpenaltynottoexceed 968twohundredandfiftydollars.Anysuchpersonshallbeprovidedtheoptionofattendingup 969toeighthoursofdrugeducationorcounselinginlieuofthefine;and 970 (e)Inlieuofpayment,penaltiesunderthissubsectionmaybesatisfiedbythe 971performanceofcommunityservice.Therateofpay-downassociatedwithsaidserviceoption 972willbethegreaterof$15ortheminimumwageineffectatthetimeofjudgment. 973 (7)(a)Anypersoncurrentlyincarceratedinaprison,jailorhalfwayhouse,whether 974bytrialoropenornegotiatedplea: 975 a.Whowouldnothavebeenguiltyofanadultorjuvenileoffense,hadsections1and 9762ofthisArticlebeenineffectatthetimeoftheoffense;or 977 b.Whowouldhavebeenguiltyofalesseradultorjuvenileoffensehadsections1and 9782ofthisArticlebeenineffectatthetimeoftheoffense;or 979 c.Whoisservingasentenceforamarijuanaoffensewhichisamisdemeanor,aclass 980Efelony,oraclassDfelony,orsuccessordesignations,involvingpossessionofthreepounds 981orlessofmarijuana,excludingoffensesinvolvingdistributionordeliverytoaminor,any 982offensesinvolvingviolence,oranyoffenseofoperatingamotorvehiclewhileunderthe 983influenceofmarijuana; 984 985maypetitionthesentencingcourttovacatethesentence,orderimmediatereleasefrom 986incarcerationandothersupervisionbythedepartmentofcorrections,andtheexpungementof 987allgovernmentrecordsofthecase.Suchexpungementfromallgovernmentrecordsshallbe 988grantedforalloftheperson'sapplicablemarijuanaoffenses,absentgoodcausefordenial. 989Theeffectofsuchordersshallbetorestoresuchpersontothestatusthepersonoccupiedprior HJR72 50 990tosucharrest,pleaorconvictionandasifsucheventhadnevertakenplace,andthe 991convictionandsentenceshallbevacatedaslegallyinvalid.Nopersonforwhomsuchorder 992hasbeenenteredshallbeheldthereafterunderanyprovisionofanylawtobeguiltyof 993perjuryorotherwisegivingafalsestatementbyreasonoftheperson'sfailuretoreciteor 994acknowledgesucharrest,plea,trial,conviction,orexpungementinresponsetoanyinquiry 995madeofthepersonforanypurposewhatsoever,andnosuchinquiryshallbemadefor 996informationrelatingtoanexpungement.Thecourtshallnotassessanyfilingfeeforthese 997filings.Theofficeofthestatepublicdefendershallprepareandmakereadilyavailableand 998accessibleapleadingformthatmaybefiledproseforthispurpose.Thecircuitcourtsofthe 999stateshallalsomakereadilyavailableandaccessiblethispleadingform.Withinninetydays 1000oftheeffectivedateofthissection,thesentencingcourtshallcompletetheadjudicationfor 1001allcasesinvolvingonlymisdemeanormarijuanaoffenses.Withinonehundredandeighty 1002daysoftheeffectivedateofthissection,thesentencingcourtshallcompletetheadjudication 1003forallcasesinvolvingclassE,orsuccessordesignation,felonymarijuanaoffensesand,if 1004applicable,anyadditionalmarijuanamisdemeanoroffensesbysuchoffenders.Withintwo 1005hundredandseventydaysoftheeffectivedateofthissection,thesentencingcourtshall 1006completetheadjudicationforallclassD,orsuccessordesignation,felonycasesinvolving 1007threepoundsorlessofmarijuana,aswellasanylessermarijuanaoffensesbysuchoffenders, 1008ifapplicable.Thisshallnotapplytooffenseswhileoperatingacommercialmotorvehicleas 1009definedin49CFR390.5,oritssuccessorprovisions,ininterstateorintrastatetransportation 1010unlessotherwiseexemptedasfoundinsection307.400,RSMo,oritssuccessorprovisions. 1011 (b)Anypersoncurrentlyonprobationorparoleforamarijuanalawviolation, 1012whetherbytrialoropenornegotiatedplea: 1013 a.Whowouldnothavebeenguiltyofanadultorjuvenileoffense,hadsections1and 10142ofthisArticlebeenineffectatthetimeoftheoffense;or 1015 b.Whowouldhavebeenguiltyofalesseradultorjuvenileoffensehadsections1and 10162ofthisArticlebeenineffectatthetimeoftheoffense;or 1017 c.Whowasconvictedorpleadguiltytoamarijuanaoffensewhichisamisdemeanor, 1018aclassEfelony,oraclassDfelony,orsuccessordesignations,involvingthepossessionof 1019threepoundsorlessofmarijuana,excludingdistributionordeliverytoaminororanyoffense 1020ofoperatingamotorvehiclewhileundertheinfluenceofmarijuana; 1021 1022shall,upontheeffectivedateofthissection,havetheirsentenceautomaticallyvacatedbythe 1023sentencingcourt,whichshallordertheimmediateterminationofsupervisionbythe 1024departmentofcorrections,andtheexpungementofallgovernmentrecordsofthecase.Such 1025expungementfromallgovernmentrecordsshallbegrantedforalloftheperson'sapplicable 1026marijuanaoffenses,absentgoodcausefordenial.Theeffectofsuchordersshallbetorestore HJR72 51 1027suchpersontothestatusthepersonoccupiedpriortosucharrest,pleaorconvictionandasif 1028sucheventhadnevertakenplace,andtheconvictionandsentenceshallbevacatedaslegally 1029invalid.Nopersonforwhomsuchorderhasbeenenteredshallbeheldthereafterunderany 1030provisionofanylawtobeguiltyofperjuryorotherwisegivingafalsestatementbyreasonof 1031theperson'sfailuretoreciteoracknowledgesucharrest,plea,trial,conviction,or 1032expungementinresponsetoanyinquirymadeofthepersonforanypurposewhatsoever,and 1033nosuchinquiryshallbemadeforinformationrelatingtoanexpungement.Thecourtshall 1034notassessanyfilingfeeforthesecases.Thisshallnotapplytooffenseswhileoperatinga 1035commercialmotorvehicleasdefinedin49CFR390.5,oritssuccessorprovisions,in 1042circuitcourtsofthisstateshallordertheexpungementofcriminalhistoryrecordsforall 1043personsnolongerincarceratedorunderthesupervisionofthedepartmentofcorrectionsbut 1044whohavecompletedtheirsentenceforanyfelonymarijuanaoffensesandanymarijuana 1045offensesthatwouldnolongerbeacrimeaftertheeffectivedatesofsections1and2ofthis 1046Article,excludingdistributionordeliverytoaminor,anysuchoffensesinvolvingviolence,or 1047anyoffenseofoperatingamotorvehiclewhileundertheinfluenceofmarijuana.Forallclass 1048A,classBandclassC,orsuccessordesignations,felonymarijuanaoffenses,andforallclass 1049D,orsuccessordesignation,felonymarijuanaoffensesforpossessionofmorethanthree 1050poundsofmarijuana,thecircuitcourtsofthisstateshallorderexpungementofcriminal 1051historyrecordsuponthecompletionoftheperson'sincarceration,includinganysupervised 1052probationorparole.Forthepurposesofthissubdivision,"criminalhistoryrecord"meansall 1053informationdocumentinganindividual'scontactwiththecriminaljusticesystem,including 1054dataregardingidentification,arrestorcitation,arraignment,judicialdisposition,custody,and 1055supervision. 1056 (b)Anexpungementordershallbelegallyeffectiveimmediatelyandtheperson 1057whoserecordisexpungedshallbetreatedinallrespectsasifheorshehadneverbeen 1058arrested,convicted,orsentencedfortheoffense,andtheconvictionandsentenceshallbe 1059vacatedaslegallyinvalid.Thecourtshallissueanordertoexpungeallrecordsandfiles 1060relatedtothearrest,citation,investigation,charge,adjudicationofguilt,criminal 1061proceedings,andprobationrelatedtothesentence.Thecourtshallprovidenoticeofthe 1062expungementtothepersonwhoisthesubjectoftherecordattheperson'slastknownaddress, 1063thearrestingagency,prosecutingattorneys,centralstatedepositoryofcriminalrecords,and HJR72 52 1064anyotherentitythatmayhavearecordrelatedtotheordertoexpunge.Thecentralstate 1065depositoryofcriminalrecordsshallprovidenoticeoftheexpungementtotheFederalBureau 1066oflnvestigation'sNationalCrimeInformationCenter,oritssuccessoragency.Thecourtshall 1067issuethepersonacertificatestatingthattheoffenseforwhichthepersonwasconvictedhas 1068beenexpungedandthatitseffectistoannultherecordofarrest,conviction,andsentence. 1069 (c)Theeffectofsuchexpungementshallbetorestoresuchpersontothestatusthe 1070personoccupiedpriortosucharrest,plea,orconvictionandasifsucheventhadnevertaken 1071place.Suchpersonshallnotberequiredtoacknowledgetheexistenceofsuchacriminal 1072historyrecordoranswerquestionsabouttherecordinanyapplicationforemployment, 1073license,orcivilrightorprivilegeorinanappearanceasawitnessinanyproceedingor 1074hearing,andmaydenytheexistenceoftherecordregardlessofwhetherthepersonhas 1075receivednoticefromthecourtthatanexpungementorderhasbeenissuedontheperson's 1076behalf. 1077 (d)Nopersonshallbeprosecutedagainforanyoffensewhichhasbeenvacatedor 1078expunged. 1079 (e)Thecourtshallkeepaspecialindexofcasesthathavebeenexpungedtogether 1080withtheexpungementorderandthecertificateissuedpursuanttothissubsection.Theindex 1081shalllistonlythenameofthepersonconvictedoftheoffense,hisorherdateofbirth,the 1082docketnumber,andthecriminaloffensethatwasthesubjectoftheexpungement.Thespecial 1083indexandrelateddocumentsshallbeconfidentialandshallbephysicallyandelectronically 1084segregatedinamannerthatensuresconfidentialityandthatlimitsaccesstoauthorized 1085persons.Thecourtmaypermitspecialaccesstotheindexandthedocumentsforresearch 1086purposespursuanttotherulesforpublicaccesstocourtrecords.Theindexanddocuments 1087madeavailablebythecourtmaynotincludeanyidentifyinginformation. 1088 (9)Apersoncurrentlyunderparole,probation,orotherstatesupervision,orreleased 1089awaitingtrialorotherhearing,maynotbepunishedorotherwisepenalizedbasedsolelyon 1090conductthatispermittedbythissection. 1091 (10)Noconductpermittedbythissectionshallconstitutethebasisfordetention, 1092search,orarrest;andexceptwhenlawenforcementisinvestigatingwhetherapersonis 1093operatingamotorvehicle,train,aircraft,motorboat,orothermotorizedformoftransport 1094whileundertheinfluenceofmarijuana,theodorofmarijuanaorburntmarijuana,the 1095possessionorsuspicionofpossessionofmarijuanawithoutevidenceofaquantityinexcessof 1096thelawfulamount,orthepossessionofmultiplecontainersofmarijuanawithoutevidenceof 1097quantityinexcessofthelawfulamountshallnotindividuallyorincombinationwitheach 1098otherconstitutereasonablyarticulablesuspicionofacrime.Marijuanaandmarijuana-infused 1099productsaspermittedbythissectionarenotcontrabandnorsubjecttoseizure. HJR72 53 1100 (11)Apersonshallnotbedeniedeligibilityinpublicassistanceprogramsorpublic 1101benefitsbasedsolelyonconductthatispermittedbythisArticle,unlessrequiredbyfederal 1102law. 1103 (12)NopersonshallbedeniedtheirrightsunderArticle1,Section23oftheMissouri 1104Constitution,solelyforconductthatispermittedbythissection. 1105 (13)Nopersonshallbedeniedparentalrights,custodyof,orvisitationwithaminor 1106childbyastateorlocalgovernmentexecutiveagencybasedsolelyonconductthatis 1107permittedbythissection,unlesstheperson'sbehaviorissuchthatitcreatesanunreasonable 1108dangertoaminorchildthatcanbeestablishedbyclearandconvincingevidence. 1109 11.InterstateCommerce. 1110 Iffederallaw,rules,orregulationsareamendedtoallowtheinterstatecommerceof 1111marijuanaormarijuana-infusedproductsortheimportationorexportationofmarijuanaor 1112marijuana-infusedproductsintooroutofthestateofMissouri,theprovisionsandintentof 1113thissectionshall,totheextentpossible,remaininfulleffect,unlessexplicitlypreemptedby 1114suchfederallaw,rule,orregulation.Iffederallaw,rules,orregulationsareamendedas 1115providedabove,anymarijuanaormarijuana-infusedproductsimportedintothisstateshallbe 1116subjecttothesametestingstandardsandseed-to-saletrackingsystemrequiredunderthis 1117sectionformarijuanaandmarijuana-infusedproductsproducedwithinthestate.Unless 1118federallaw,rules,orregulationsexplicitlyrequireotherwise,noentityshallsell,transport, 1119produce,distribute,deliver,orcultivatemarijuanaormarijuana-infusedproductswithoutan 1120applicablelicenseorcertificateasrequiredunderthissection.Inaddition,anyrawbiomass 1121ofmarijuanaormarijuanaflowerimportedfromout-of-stateshallbereceivedonlybya 1122licensedcultivationfacility,whileallbatchoil,infusedmarijuanaproductsandanymarijuana 1123productinanyotherformshallbereceivedonlybyalicensedmanufacturingfacility. 1124 12.Severability. 1125 Theprovisionsofthissectionareseverable,andifanyclause,sentence,paragraphor 1126sectionofthismeasure,oranapplicationthereof,isadjudgedinvalidbyanycourtof 1127competentjurisdiction,theotherprovisionsshallcontinuetobeineffecttothefullestextent 1128possible. 1129 13.EffectiveDate. 1130 Theprovisionsofthissectionshallbecomeeffectivethirtydaysaftertheelection,as 1131providedbythisConstitution. ✔ HJR72 54
