1010 To repeal section 192.769, RSMo, relating to mammograms.

1212 Be it enacted by the General Assembly of the State of Missouri, as follows:
1313 Section A. Section 192.769, RSMo, is repealed, to read as 1
1414 follows:2
1515 [192.769. 1. On completion of a 1
1616 mammogram, a mammography facility certified by 2
1717 the United States Food and Drug Administration 3
1818 (FDA) or by a certification age ncy approved by 4
1919 the FDA shall provide to the patient the 5
2020 following notice: 6
2121 "If your mammogram demonstrates that you 7
2222 have dense breast tissue, which could hide 8
2323 abnormalities, and you have other risk factors 9
2424 for breast cancer that have been identif ied, you 10
2525 might benefit from supplemental screening tests 11
2626 that may be suggested by your ordering 12
2727 physician. Dense breast tissue, in and of 13
2828 itself, is a relatively common condition. 14
2929 Therefore, this information is not provided to 15
3030 cause undue concern, but rather to raise your 16
3131 awareness and to promote discussion with your 17
3232 physician regarding the presence of other risk 18
3333 factors, in addition to dense breast tissue. A 19
3434 report of your mammography results will be sent 20
3535 to you and your physician. You should contact 21
3636 your physician if you have any questions or 22
3737 concerns regarding this report.". 23
3838 2. Nothing in this section shall be 24
3939 construed to create a duty of care beyond the 25
4040 duty to provide notice as set forth in this 26
