| 12 | 12 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 13 | 13 | | Section A. Section 192.769, RSMo, is repealed, to read as 1 |
|---|
| 14 | 14 | | follows:2 |

| 15 | 15 | | [192.769. 1. On completion of a 1 |
|---|
| 16 | 16 | | mammogram, a mammography facility certified by 2 |
|---|
| 17 | 17 | | the United States Food and Drug Administration 3 |
|---|
| 18 | 18 | | (FDA) or by a certification age ncy approved by 4 |
|---|
| 19 | 19 | | the FDA shall provide to the patient the 5 |
|---|
| 20 | 20 | | following notice: 6 |
|---|
| 21 | 21 | | "If your mammogram demonstrates that you 7 |
|---|
| 22 | 22 | | have dense breast tissue, which could hide 8 |
|---|
| 23 | 23 | | abnormalities, and you have other risk factors 9 |
|---|
| 24 | 24 | | for breast cancer that have been identif ied, you 10 |
|---|
| 25 | 25 | | might benefit from supplemental screening tests 11 |
|---|
| 26 | 26 | | that may be suggested by your ordering 12 |
|---|
| 27 | 27 | | physician. Dense breast tissue, in and of 13 |
|---|
| 28 | 28 | | itself, is a relatively common condition. 14 |
|---|
| 29 | 29 | | Therefore, this information is not provided to 15 |
|---|
| 30 | 30 | | cause undue concern, but rather to raise your 16 |
|---|
| 31 | 31 | | awareness and to promote discussion with your 17 |
|---|
| 32 | 32 | | physician regarding the presence of other risk 18 |
|---|
| 33 | 33 | | factors, in addition to dense breast tissue. A 19 |
|---|
| 34 | 34 | | report of your mammography results will be sent 20 |
|---|
| 35 | 35 | | to you and your physician. You should contact 21 |
|---|
| 36 | 36 | | your physician if you have any questions or 22 |
|---|
| 37 | 37 | | concerns regarding this report.". 23 |

| 38 | 38 | | 2. Nothing in this section shall be 24 |

| 39 | 39 | | construed to create a duty of care beyond the 25 |
|---|
| 40 | 40 | | duty to provide notice as set forth in this 26 |
