Be it enacted by the General Assembly of the State of Missouri, as follows: Section A. Section 192.769, RSMo, is repealed, to read as 1 follows:2 [192.769. 1. On completion of a 1 mammogram, a mammography facility certified by 2 the United States Food and Drug Administration 3 (FDA) or by a certification age ncy approved by 4 the FDA shall provide to the patient the 5 following notice: 6 "If your mammogram demonstrates that you 7 have dense breast tissue, which could hide 8 abnormalities, and you have other risk factors 9 for breast cancer that have been identif ied, you 10 might benefit from supplemental screening tests 11 that may be suggested by your ordering 12 physician. Dense breast tissue, in and of 13 itself, is a relatively common condition. 14 Therefore, this information is not provided to 15 cause undue concern, but rather to raise your 16 awareness and to promote discussion with your 17 physician regarding the presence of other risk 18 factors, in addition to dense breast tissue. A 19 report of your mammography results will be sent 20 to you and your physician. You should contact 21 your physician if you have any questions or 22 concerns regarding this report.". 23 2. Nothing in this section shall be 24 construed to create a duty of care beyond the 25 duty to provide notice as set forth in this 26 section. 27 SB 232 2 3.
