| 8 | 8 | | To amend chapter 167, RSMo, by adding thereto one new section relating to lactating students. |

| 10 | 10 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 11 | 11 | | Section A. Chapter 167, RSMo, is amended by adding thereto 1 |
|---|
| 12 | 12 | | one new section, to be known as section 167.955, to read as 2 |
|---|
| 13 | 13 | | follows:3 |
|---|
| 14 | 14 | | 167.955. 1. A public school or charter school shall 1 |
|---|
| 15 | 15 | | provide reasonable accommodations to a lactating student on 2 |
|---|
| 16 | 16 | | school campus to express breast milk, breastfeed, or address 3 |
|---|
| 17 | 17 | | other breastfeeding needs, including, but not limited to, 4 |
|---|
| 18 | 18 | | the following: 5 |
|---|
| 19 | 19 | | (1) Permission to bring a breast pump and any other 6 |
|---|
| 20 | 20 | | equipment used to express breast milk to school; 7 |
|---|
| 21 | 21 | | (2) Access to a private and secure room other than a 8 |
|---|
| 22 | 22 | | restroom to express breas t milk or breastfeed an infant 9 |
|---|
| 23 | 23 | | child; 10 |
|---|
| 24 | 24 | | (3) Access to a power source for a breast pump or any 11 |
|---|
| 25 | 25 | | other equipment used to express breast milk; 12 |
|---|
| 26 | 26 | | (4) Access to a place to safely store breast milk, 13 |
|---|
| 27 | 27 | | including, but not limited to, a refrigerator or cool er in: 14 |
|---|
| 28 | 28 | | (a) A nurse's office; 15 |
|---|
| 29 | 29 | | (b) A teachers' lounge; or 16 |
|---|
| 30 | 30 | | (c) Another private location or location with limited 17 |
|---|
| 31 | 31 | | accessibility in which the breast milk may be safely 18 |
|---|

| 33 | 33 | | (5) Access to a location to clean a breast pump and 20 |
|---|
| 34 | 34 | | any other equipment used to express breast milk at school. 21 |

| 36 | 36 | | (1) Ensure that a lactating student shall be provided 23 |
|---|
| 37 | 37 | | a reasonable amount of time to accommodate the need to 24 |
|---|
| 38 | 38 | | express breast milk; and 25 |
|---|
| 39 | 39 | | (2) Provide that a student shall not incur an academic 26 |
|---|
| 40 | 40 | | penalty as a result of the use, during the school day, of 27 |
|---|
| 41 | 41 | | the reasonable accommodations provided pursuant to 28 |
|---|
| 42 | 42 | | subsection 1 of this section. 29 |
