AN ACT 
To amend chapter 167, RSMo, by adding thereto one new section relating to lactating students. 
 
Be it enacted by the General Assembly of the State of Missouri, as follows: 
     Section A.  Chapter 167, RSMo, is amended by adding thereto 1 
one new section, to be known as section 167.955, to read as 2 
follows:3 
     167.955.  1.  A public school or charter school shall 1 
provide reasonable accommodations to a lactating student on 2 
school campus to express breast milk, breastfeed, or address 3 
other breastfeeding needs, including, but not limited to, 4 
the following: 5 
     (1)  Permission to bring a breast pump and any other 6 
equipment used to express breast milk to school; 7 
     (2)  Access to a private and secure room other than a 8 
restroom to express breas t milk or breastfeed an infant 9 
child; 10 
     (3)  Access to a power source for a breast pump or any 11 
other equipment used to express breast milk; 12 
     (4)  Access to a place to safely store breast milk, 13 
including, but not limited to, a refrigerator or cool er in: 14 
     (a)  A nurse's office; 15 
     (b)  A teachers' lounge; or 16 
     (c)  Another private location or location with limited 17 
accessibility in which the breast milk may be safely 18 
secured; and 19   SB 343 	2 
     (5)  Access to a location to clean a breast pump and 20 
any other equipment used to express breast milk at school. 21 
     2.  A public school or charter school shall: 22 
     (1)  Ensure that a lactating student shall be provided 23 
a reasonable amount of time to accommodate the need to 24 
express breast milk; and 25 
     (2)  Provide that a student shall not incur an academic 26 
penalty as a result of the use, during the school day, of 27 
the reasonable accommodations provided pursuant to 28 
subsection 1 of this section. 29 

