1010 To repeal section 311.355, RSMo, and to enact in lieu thereof one new section relating to rebate

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Section 311.355, RSMo, is repealed and one new 1
1515 section enacted in lieu thereof, to be known as section 311.355, 2
1616 to read as follows:3
1717 311.355. 1. Manufacturers of intoxicating liquor 1
1818 [other than beer or wine ] shall be permitted to offer 2
1919 consumer cash rebate coupons as provided in this subsection: 3
2020 (1) Consumer cash rebate coupons may be published or 4
2121 advertised by manufacturers in newspapers, magazines and 5
2222 other mass media; 6
2323 (2) Coupon advertisements may list the amount of the 7
2424 cash rebate, but not the retail price of the intoxicating 8
2525 liquor after the rebate; 9
2626 (3) Applications for cash rebates must be made 10
2727 directly from the consumer to the manufacturer, and not 11
2828 through retailers or wholesalers; 12
2929 (4) Cash rebates must be made directly to consumers by 13
3030 manufacturers; 14
3131 (5) Wholesalers and manufacturers may deliver cash 15
3232 rebate coupons to retailers, either for distribution at the 16
3333 point of sale or in connection with packaging. 17 SB 515 2
3434 2. Manufacturers of intoxicating liquor [including 18
3535 beer and wine] may offer coupons redeemable for nonalcoholic 19
3636 merchandise, except that such redeemable coupons must be 20
3737 made available without a purchase requirement to consumers 21
3838 at the point of sale, or by request through the mail, or at 22
3939 the retailer's cash register. Redeemable coupons may be 23
4040 published or advertised by manufacturers in newspapers, 24
4141 magazines and other mass media. Advertisements must state 25
4242 that no purchase is required to obtain the nonalcoholic 26
4343 merchandise and provide information on the procedure to 27
4444 obtain such merchandise. The retail value of the 28
4545 nonalcoholic merchandise shall not be stated in t he 29
4646 advertisement or on the product. Wholesalers and 30
4747 manufacturers may deliver these redeemable coupons at the 31
4848 point of sale or in connection with packaging. 32
