13 | 13 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |

14 | 14 | | Section A. Section 311.355, RSMo, is repealed and one new 1 |
---|
15 | 15 | | section enacted in lieu thereof, to be known as section 311.355, 2 |

16 | 16 | | to read as follows:3 |

17 | 17 | | 311.355. 1. Manufacturers of intoxicating liquor 1 |

18 | 18 | | [other than beer or wine ] shall be permitted to offer 2 |
---|
19 | 19 | | consumer cash rebate coupons as provided in this subsection: 3 |
---|
20 | 20 | | (1) Consumer cash rebate coupons may be published or 4 |
---|
21 | 21 | | advertised by manufacturers in newspapers, magazines and 5 |
---|
22 | 22 | | other mass media; 6 |
---|
23 | 23 | | (2) Coupon advertisements may list the amount of the 7 |
---|
24 | 24 | | cash rebate, but not the retail price of the intoxicating 8 |
---|
25 | 25 | | liquor after the rebate; 9 |
---|
26 | 26 | | (3) Applications for cash rebates must be made 10 |
---|
27 | 27 | | directly from the consumer to the manufacturer, and not 11 |
---|
28 | 28 | | through retailers or wholesalers; 12 |

29 | 29 | | (4) Cash rebates must be made directly to consumers by 13 |

31 | 31 | | (5) Wholesalers and manufacturers may deliver cash 15 |

32 | 32 | | rebate coupons to retailers, either for distribution at the 16 |

35 | 35 | | beer and wine] may offer coupons redeemable for nonalcoholic 19 |

36 | 36 | | merchandise, except that such redeemable coupons must be 20 |

37 | 37 | | made available without a purchase requirement to consumers 21 |
---|
38 | 38 | | at the point of sale, or by request through the mail, or at 22 |
---|
39 | 39 | | the retailer's cash register. Redeemable coupons may be 23 |
---|
40 | 40 | | published or advertised by manufacturers in newspapers, 24 |
---|
41 | 41 | | magazines and other mass media. Advertisements must state 25 |
---|
42 | 42 | | that no purchase is required to obtain the nonalcoholic 26 |
---|
43 | 43 | | merchandise and provide information on the procedure to 27 |
---|
44 | 44 | | obtain such merchandise. The retail value of the 28 |

45 | 45 | | nonalcoholic merchandise shall not be stated in t he 29 |

46 | 46 | | advertisement or on the product. Wholesalers and 30 |
