1010 To repeal section 311.520, RSMo, and to enact in lieu thereof one new section relating to fees for
1111 the inspection and gauging of malt liquors.

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Section 311.520, RSMo, is repealed and one new 1
1515 section enacted in lieu thereof, to be known as section 311.520, 2
1616 to read as follows:3
1717 311.520. 1. As used in this section, the following 1
1818 terms shall mean: 2
1919 (1) "American brewery", the land and buildings located 3
2020 in the United States of America where malt liquors are 4
2121 produced and packaged; 5
2222 (2) "Foreign import malt liquor" , malt liquor 6
2323 manufactured and imported from outside the United States of 7
2424 America. 8
2525 2. For all tax years beginning on or after January 1, 9
2626 2026, the director of revenue shall collect the sum of sixty - 10
2727 two cents per barrel as a charge for the inspect ion and 11
2828 gauging of all malt liquors [, the director of revenue shall 12
2929 collect] manufactured in an American brewery and the sum of 13
3030 one dollar and eighty -six cents per barrel as a charge for 14
3131 the inspection and gauging of all foreign import malt liquor. 15
3232 3. Every manufacturer, out -state solicitor, and 16
3333 wholesale dealer licensed under this chapter shall make a 17
3434 true duplicate invoice of the same, showing the date, amount 18 SB 584 2
3535 and value of each class of such liquors shipped or 19
3636 delivered, and the country of o rigin for all foreign import 20
3737 malt liquors and retain a duplicate thereof, subject to the 21
3838 use and inspection of the director of revenue and supervisor 22
3939 of liquor control and their representatives for two years. 23
4040 4. The director of revenue and supervi sor of liquor 24
4141 control may promulgate all necessary rules and regulations 25
4242 for the administration of this section. Any rule or portion 26
4343 of a rule, as that term is defined in section 536.010, that 27
4444 is created under the authority delegated in this section 28
4545 shall become effective only if it complies with and is 29
4646 subject to all of the provisions of chapter 536 and, if 30
4747 applicable, section 536.028. This section and chapter 536 31
4848 are nonseverable and if any of the powers vested with the 32
4949 general assembly pursuan t to chapter 536 to review, to delay 33
5050 the effective date, or to disapprove and annul a rule are 34
5151 subsequently held unconstitutional, then the grant of 35
5252 rulemaking authority and any rule proposed or adopted after 36
5353 August 28, 2025, shall be invalid and void . 37
