10 | 10 | | To repeal section 311.520, RSMo, and to enact in lieu thereof one new section relating to fees for |

13 | 13 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
---|
14 | 14 | | Section A. Section 311.520, RSMo, is repealed and one new 1 |
---|
15 | 15 | | section enacted in lieu thereof, to be known as section 311.520, 2 |
---|
16 | 16 | | to read as follows:3 |

17 | 17 | | 311.520. 1. As used in this section, the following 1 |
---|
18 | 18 | | terms shall mean: 2 |
---|
19 | 19 | | (1) "American brewery", the land and buildings located 3 |
---|
20 | 20 | | in the United States of America where malt liquors are 4 |
---|
21 | 21 | | produced and packaged; 5 |
---|
22 | 22 | | (2) "Foreign import malt liquor" , malt liquor 6 |
---|
23 | 23 | | manufactured and imported from outside the United States of 7 |
---|
24 | 24 | | America. 8 |
---|
25 | 25 | | 2. For all tax years beginning on or after January 1, 9 |
---|
26 | 26 | | 2026, the director of revenue shall collect the sum of sixty - 10 |
---|
27 | 27 | | two cents per barrel as a charge for the inspect ion and 11 |
---|
28 | 28 | | gauging of all malt liquors [, the director of revenue shall 12 |
---|
29 | 29 | | collect] manufactured in an American brewery and the sum of 13 |
---|
30 | 30 | | one dollar and eighty -six cents per barrel as a charge for 14 |
---|
31 | 31 | | the inspection and gauging of all foreign import malt liquor. 15 |

32 | 32 | | 3. Every manufacturer, out -state solicitor, and 16 |
---|
33 | 33 | | wholesale dealer licensed under this chapter shall make a 17 |
---|
34 | 34 | | true duplicate invoice of the same, showing the date, amount 18 SB 584 2 |

35 | 35 | | and value of each class of such liquors shipped or 19 |
---|
36 | 36 | | delivered, and the country of o rigin for all foreign import 20 |
---|
37 | 37 | | malt liquors and retain a duplicate thereof, subject to the 21 |
---|
38 | 38 | | use and inspection of the director of revenue and supervisor 22 |
---|
39 | 39 | | of liquor control and their representatives for two years. 23 |
---|
40 | 40 | | 4. The director of revenue and supervi sor of liquor 24 |
---|
41 | 41 | | control may promulgate all necessary rules and regulations 25 |
---|
42 | 42 | | for the administration of this section. Any rule or portion 26 |
---|
43 | 43 | | of a rule, as that term is defined in section 536.010, that 27 |
---|
44 | 44 | | is created under the authority delegated in this section 28 |
---|
45 | 45 | | shall become effective only if it complies with and is 29 |
---|
46 | 46 | | subject to all of the provisions of chapter 536 and, if 30 |
---|
47 | 47 | | applicable, section 536.028. This section and chapter 536 31 |
---|
48 | 48 | | are nonseverable and if any of the powers vested with the 32 |
---|
49 | 49 | | general assembly pursuan t to chapter 536 to review, to delay 33 |
---|
50 | 50 | | the effective date, or to disapprove and annul a rule are 34 |
---|
51 | 51 | | subsequently held unconstitutional, then the grant of 35 |
---|
52 | 52 | | rulemaking authority and any rule proposed or adopted after 36 |
---|
53 | 53 | | August 28, 2025, shall be invalid and void . 37 |
