FIRST REGULAR SESSION SENATE BILL NO. 584 103RD GENERAL ASSEMBLY INTRODUCED BY SENATOR GREGORY (21). 2128S.01I KRISTINA MARTIN, Secretary AN ACT To repeal section 311.520, RSMo, and to enact in lieu thereof one new section relating to fees for the inspection and gauging of malt liquors. Be it enacted by the General Assembly of the State of Missouri, as follows: Section A. Section 311.520, RSMo, is repealed and one new 1 section enacted in lieu thereof, to be known as section 311.520, 2 to read as follows:3 311.520. 1. As used in this section, the following 1 terms shall mean: 2 (1) "American brewery", the land and buildings located 3 in the United States of America where malt liquors are 4 produced and packaged; 5 (2) "Foreign import malt liquor" , malt liquor 6 manufactured and imported from outside the United States of 7 America. 8 2. For all tax years beginning on or after January 1, 9 2026, the director of revenue shall collect the sum of sixty - 10 two cents per barrel as a charge for the inspect ion and 11 gauging of all malt liquors [, the director of revenue shall 12 collect] manufactured in an American brewery and the sum of 13 one dollar and eighty -six cents per barrel as a charge for 14 the inspection and gauging of all foreign import malt liquor. 15 3. Every manufacturer, out -state solicitor, and 16 wholesale dealer licensed under this chapter shall make a 17 true duplicate invoice of the same, showing the date, amount 18 SB 584 2 and value of each class of such liquors shipped or 19 delivered, and the country of o rigin for all foreign import 20 malt liquors and retain a duplicate thereof, subject to the 21 use and inspection of the director of revenue and supervisor 22 of liquor control and their representatives for two years. 23 4. The director of revenue and supervi sor of liquor 24 control may promulgate all necessary rules and regulations 25 for the administration of this section. Any rule or portion 26 of a rule, as that term is defined in section 536.010, that 27 is created under the authority delegated in this section 28 shall become effective only if it complies with and is 29 subject to all of the provisions of chapter 536 and, if 30 applicable, section 536.028. This section and chapter 536 31 are nonseverable and if any of the powers vested with the 32 general assembly pursuan t to chapter 536 to review, to delay 33 the effective date, or to disapprove and annul a rule are 34 subsequently held unconstitutional, then the grant of 35 rulemaking authority and any rule proposed or adopted after 36 August 28, 2025, shall be invalid and void . 37
