1010 To repeal section 210.1012, RSMo, and to enact in lieu thereof one new section relating to
1111 emergency notification systems, with penalty provisions.

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Section 210.1012, RSMo, is repealed and one 1
1515 new section enacted in lieu thereof, to be known as section 2
1616 210.1012, to read as follows:3
1717 210.1012. 1. There is hereby created a statewide 1
1818 program called the "Amber Alert System" referred to in this 2
1919 section as the "system" to aid in the identification and 3
2020 location of an abducted child or an abducted or missing 4
2121 Black youth. 5
2222 2. For the purposes of this section, the following 6
2323 terms mean: 7
2424 (1) "Abducted child" [means], a child whose 8
2525 whereabouts are unknown and who is: 9
2626 [(1)] (a) Less than eighteen years of age and 10
2727 reasonably believed to be the victim of the crime of 11
2828 kidnapping or kidnapping in the first degree as defined by 12
2929 section 565.110 as determined by local law enforcement; 13
3030 [(2)] (b) Reasonably believed to be the victim of the 14
3131 crime of child kidnapping as defined by section 565.115 as 15
3232 determined by local law enforcement; or 16
3333 [(3)] (c) Less than eighteen years of age and at least 17
3434 fourteen years of age and who, if under the age of fourteen, 18 SB 611 2
3535 would otherwise be reasonably believed to be a victim of 19
3636 child kidnapping as defined by section 565.115 as dete rmined 20
3737 by local law enforcement ; 21
3838 (2) "Abducted or missing Black youth", a Black 22
3939 individual whose whereabouts are unknown and who is: 23
4040 (a) Less than twenty-five years of age and reasonably 24
4141 believed to be the victim of the offense of kidnapping or 25
4242 kidnapping in the first degree as defined by section 565.110 26
4343 as determined by local law enforcement; 27
4444 (b) Reasonably believed to be the victim of the 28
4545 offense of child kidnapping as defined by section 565.115 as 29
4646 determined by local law enforcem ent; 30
4747 (c) Less than twenty-five years of age and at least 31
4848 fourteen years of age and who, if under the age of fourteen, 32
4949 would otherwise be reasonably believed to be a victim of 33
5050 child kidnapping as defined by section 565.115 as determined 34
5151 by local law enforcement; or 35
5252 (d) Reasonably believed to be a victim of an offense 36
5353 of trafficking pursuant to sections 566.206, 566.209, 37
5454 566.210, or 566.211. 38
5555 3. The department of public safety shall develop 39
5656 regions to provide the system. The department of public 40
5757 safety shall coordinate local law enforcement agencies and 41
5858 public commercial television and radio broadcasters to 42
5959 provide an effective system. In the event that a local law 43
6060 enforcement agency opts not to set up a system and an 44
6161 abduction occurs within the jurisdiction, it shall notify 45
6262 the department of public safety who will notify local media 46
6363 in the region. 47
6464 4. The Amber alert system shall include all state 48
6565 agencies capable of providing urgent and timely information 49
6666 to the public together with broadcasters and other private 50 SB 611 3
6767 entities that volunteer to participate in the dissemination 51
6868 of urgent public information. At a minimum, the Amber alert 52
6969 system shall include the department of public safety, 53
7070 highway patrol, department of tr ansportation, department of 54
7171 health and senior services, and Missouri lottery. 55
7272 5. The department of public safety shall have the 56
7373 authority to notify other regions upon verification that the 57
7474 criteria established by the oversight committee has been m et. 58
7575 6. Participation in an Amber alert system is entirely 59
7676 at the option of local law enforcement agencies and 60
7777 federally licensed radio and television broadcasters. 61
7878 7. Any person who knowingly makes a false report that 62
7979 triggers an alert pursu ant to this section is guilty of a 63
8080 class A misdemeanor. 64
