AN ACT 
To repeal section 210.1012, RSMo, and to enact in lieu thereof one new section relating to 
emergency notification systems, with penalty provisions. 
 
Be it enacted by the General Assembly of the State of Missouri, as follows: 
     Section A.  Section 210.1012, RSMo, is repealed and one 1 
new section enacted in lieu thereof, to be known as section 2 
210.1012, to read as follows:3 
     210.1012.  1.  There is hereby created a statewide 1 
program called the "Amber Alert System" referred to in this 2 
section as the "system" to aid in the identification and 3 
location of an abducted child or an abducted or missing 4 
Black youth. 5 
     2.  For the purposes of this section, the following  6 
terms mean: 7 
      (1)  "Abducted child" [means], a child whose  8 
whereabouts are unknown and who is: 9 
     [(1)] (a)  Less than eighteen years of age and 10 
reasonably believed to be the victim of the crime of 11 
kidnapping or kidnapping in the first degree as defined by 12 
section 565.110 as determined by local law enforcement; 13 
     [(2)] (b)  Reasonably believed to be the victim of the 14 
crime of child kidnapping as defined by section 565.115 as 15 
determined by local law enforcement; or 16 
     [(3)] (c)  Less than eighteen years of age and at least 17 
fourteen years of age and who, if under the age of fourteen, 18   SB 611 	2 
would otherwise be reasonably believed to be a victim of 19 
child kidnapping as defined by section 565.115 as dete rmined  20 
by local law enforcement ; 21 
     (2)  "Abducted or missing Black youth", a Black 22 
individual whose whereabouts are unknown and who is: 23 
     (a)  Less than twenty-five years of age and reasonably 24 
believed to be the victim of the offense of kidnapping or  25 
kidnapping in the first degree as defined by section 565.110 26 
as determined by local law enforcement; 27 
     (b)  Reasonably believed to be the victim of the 28 
offense of child kidnapping as defined by section 565.115 as 29 
determined by local law enforcem ent; 30 
     (c)  Less than twenty-five years of age and at least 31 
fourteen years of age and who, if under the age of fourteen, 32 
would otherwise be reasonably believed to be a victim of 33 
child kidnapping as defined by section 565.115 as determined 34 
by local law enforcement; or 35 
     (d)  Reasonably believed to be a victim of an offense 36 
of trafficking pursuant to sections 566.206, 566.209, 37 
566.210, or 566.211. 38 
     3.  The department of public safety shall develop 39 
regions to provide the system.  The department of public  40 
safety shall coordinate local law enforcement agencies and 41 
public commercial television and radio broadcasters to 42 
provide an effective system.  In the event that a local law 43 
enforcement agency opts not to set up a system and an 44 
abduction occurs within the jurisdiction, it shall notify 45 
the department of public safety who will notify local media 46 
in the region. 47 
     4.  The Amber alert system shall include all state 48 
agencies capable of providing urgent and timely information 49 
to the public together with broadcasters and other private 50   SB 611 	3 
entities that volunteer to participate in the dissemination 51 
of urgent public information.  At a minimum, the Amber alert 52 
system shall include the department of public safety, 53 
highway patrol, department of tr ansportation, department of 54 
health and senior services, and Missouri lottery. 55 
     5.  The department of public safety shall have the 56 
authority to notify other regions upon verification that the 57 
criteria established by the oversight committee has been m et. 58 
     6.  Participation in an Amber alert system is entirely 59 
at the option of local law enforcement agencies and 60 
federally licensed radio and television broadcasters. 61 
     7.  Any person who knowingly makes a false report that 62 
triggers an alert pursu ant to this section is guilty of a 63 
class A misdemeanor. 64 

