11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
---|
12 | 12 | | Section A. Section 3 3.290, RSMo, is repealed and one new 1 |
---|
13 | 13 | | section enacted in lieu thereof, to be known as section 33.290, 2 |
---|
14 | 14 | | to read as follows:3 |

15 | 15 | | 33.290. 1. Within two weeks after the approval of the 1 |
---|
16 | 16 | | appropriation acts by the governor, each department shall 2 |
---|
17 | 17 | | submit to the budget director a work program and requested 3 |
---|
18 | 18 | | allotments of appropriations by quarterly periods for the 4 |
---|
19 | 19 | | first fiscal year of the biennium. Such requested 5 |
---|
20 | 20 | | allotments shall show how the department proposes to 6 |
---|
21 | 21 | | classify its expenditures for various purpos es and objects 7 |
---|
22 | 22 | | of expenditure within each such quarterly period for the 8 |
---|
23 | 23 | | fiscal year. Such allotment requests and the allotments as 9 |
---|
24 | 24 | | approved shall be in such form and in such detail as the 10 |
---|
25 | 25 | | budget director shall direct. Such allotments shall be 11 |
---|
26 | 26 | | subject to approval by the governor in such detail as he may 12 |
---|
27 | 27 | | determine except that the allotments of the departments not 13 |
---|
28 | 28 | | directly under the control of the governor shall be subject 14 |
---|
29 | 29 | | to approval only as to the total allotment for each 15 |
---|
30 | 30 | | quarter. At the end of any quarterly period any department 16 |
---|
31 | 31 | | may make changes in the allotments for the remaining periods 17 |
---|
32 | 32 | | upon approval of the governor. At the end of any quarterly 18 SB 678 2 |

33 | 33 | | period the governor may revise the allotments of any 19 |
---|
34 | 34 | | department, and if it shall appear that rev enues in any fund 20 |
---|
35 | 35 | | for the fiscal year will fall below the estimated revenues 21 |
---|
36 | 36 | | for such fund to such extent that the total revenues of such 22 |
---|
37 | 37 | | fund will be less than the appropriations from such fund, 23 |
---|
38 | 38 | | then and in such case, the governor shall reduce the 24 |
---|
39 | 39 | | allotments of appropriations from such fund to any 25 |
---|
40 | 40 | | department or departments so that the total of the 26 |
---|
41 | 41 | | allotments for the fiscal year will not exceed the total 27 |
---|
42 | 42 | | estimated revenue of the fund at any such time. Each such 28 |
---|
43 | 43 | | department shall in its requested al lotments set aside three 29 |
---|
44 | 44 | | percent of the appropriations as a reserve fund which shall 30 |
---|
45 | 45 | | be subject to expenditure only with approval of the 31 |
---|
46 | 46 | | governor; provided, that this shall not apply to amounts for 32 |
---|
47 | 47 | | personal service to pay salaries fixed by law. On or before 33 |
---|
48 | 48 | | June first of the first fiscal year of the biennium, similar 34 |
---|
49 | 49 | | work programs and requested allotments of the appropriation 35 |
---|
50 | 50 | | for the second fiscal year of the biennium shall be 36 |
---|
51 | 51 | | submitted to the budget director. Such requests and 37 |
---|
52 | 52 | | allotments shall be subject to the same approval, 38 |
---|
53 | 53 | | limitations and changes as those for the first year. 39 |
---|
54 | 54 | | 2. At the end of each quarterly period, each 40 |
---|
55 | 55 | | department shall submit to the budget director the number of 41 |
---|
56 | 56 | | permanent full-time positions which have been vacant for 42 |
---|
57 | 57 | | ninety days or more in such form and in such detail as the 43 |
---|
58 | 58 | | budget director shall direct, and the governor shall reduce 44 |
---|
59 | 59 | | the total of the allotments for the fiscal year to the 45 |
---|
60 | 60 | | department in order to account for the vacant positions. 46 |
