1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Section 3 3.290, RSMo, is repealed and one new 1
1313 section enacted in lieu thereof, to be known as section 33.290, 2
1414 to read as follows:3
1515 33.290. 1. Within two weeks after the approval of the 1
1616 appropriation acts by the governor, each department shall 2
1717 submit to the budget director a work program and requested 3
1818 allotments of appropriations by quarterly periods for the 4
1919 first fiscal year of the biennium. Such requested 5
2020 allotments shall show how the department proposes to 6
2121 classify its expenditures for various purpos es and objects 7
2222 of expenditure within each such quarterly period for the 8
2323 fiscal year. Such allotment requests and the allotments as 9
2424 approved shall be in such form and in such detail as the 10
2525 budget director shall direct. Such allotments shall be 11
2626 subject to approval by the governor in such detail as he may 12
2727 determine except that the allotments of the departments not 13
2828 directly under the control of the governor shall be subject 14
2929 to approval only as to the total allotment for each 15
3030 quarter. At the end of any quarterly period any department 16
3131 may make changes in the allotments for the remaining periods 17
3232 upon approval of the governor. At the end of any quarterly 18 SB 678 2
3333 period the governor may revise the allotments of any 19
3434 department, and if it shall appear that rev enues in any fund 20
3535 for the fiscal year will fall below the estimated revenues 21
3636 for such fund to such extent that the total revenues of such 22
3737 fund will be less than the appropriations from such fund, 23
3838 then and in such case, the governor shall reduce the 24
3939 allotments of appropriations from such fund to any 25
4040 department or departments so that the total of the 26
4141 allotments for the fiscal year will not exceed the total 27
4242 estimated revenue of the fund at any such time. Each such 28
4343 department shall in its requested al lotments set aside three 29
4444 percent of the appropriations as a reserve fund which shall 30
4545 be subject to expenditure only with approval of the 31
4646 governor; provided, that this shall not apply to amounts for 32
4747 personal service to pay salaries fixed by law. On or before 33
4848 June first of the first fiscal year of the biennium, similar 34
4949 work programs and requested allotments of the appropriation 35
5050 for the second fiscal year of the biennium shall be 36
5151 submitted to the budget director. Such requests and 37
5252 allotments shall be subject to the same approval, 38
5353 limitations and changes as those for the first year. 39
5454 2. At the end of each quarterly period, each 40
5555 department shall submit to the budget director the number of 41
5656 permanent full-time positions which have been vacant for 42
5757 ninety days or more in such form and in such detail as the 43
5858 budget director shall direct, and the governor shall reduce 44
5959 the total of the allotments for the fiscal year to the 45
6060 department in order to account for the vacant positions. 46
