AN ACT 
To repeal section 33.290, RSMo, and to enact in lieu thereof one new section relating to 
appropriation allotments made to state departments. 
 
Be it enacted by the General Assembly of the State of Missouri, as follows: 
     Section A.  Section 3 3.290, RSMo, is repealed and one new 1 
section enacted in lieu thereof, to be known as section 33.290, 2 
to read as follows:3 
     33.290.  1.  Within two weeks after the approval of the 1 
appropriation acts by the governor, each department shall 2 
submit to the budget director a work program and requested 3 
allotments of appropriations by quarterly periods for the 4 
first fiscal year of the biennium.  Such requested  5 
allotments shall show how the department proposes to 6 
classify its expenditures for various purpos es and objects  7 
of expenditure within each such quarterly period for the 8 
fiscal year.  Such allotment requests and the allotments as 9 
approved shall be in such form and in such detail as the 10 
budget director shall direct.  Such allotments shall be 11 
subject to approval by the governor in such detail as he may 12 
determine except that the allotments of the departments not 13 
directly under the control of the governor shall be subject 14 
to approval only as to the total allotment for each 15 
quarter.  At the end of any quarterly period any department 16 
may make changes in the allotments for the remaining periods 17 
upon approval of the governor.  At the end of any quarterly 18   SB 678 	2 
period the governor may revise the allotments of any 19 
department, and if it shall appear that rev enues in any fund  20 
for the fiscal year will fall below the estimated revenues 21 
for such fund to such extent that the total revenues of such 22 
fund will be less than the appropriations from such fund, 23 
then and in such case, the governor shall reduce the 24 
allotments of appropriations from such fund to any 25 
department or departments so that the total of the 26 
allotments for the fiscal year will not exceed the total 27 
estimated revenue of the fund at any such time.  Each such  28 
department shall in its requested al lotments set aside three 29 
percent of the appropriations as a reserve fund which shall 30 
be subject to expenditure only with approval of the 31 
governor; provided, that this shall not apply to amounts for 32 
personal service to pay salaries fixed by law.  On or before  33 
June first of the first fiscal year of the biennium, similar 34 
work programs and requested allotments of the appropriation 35 
for the second fiscal year of the biennium shall be 36 
submitted to the budget director.  Such requests and  37 
allotments shall be subject to the same approval, 38 
limitations and changes as those for the first year. 39 
     2.  At the end of each quarterly period, each 40 
department shall submit to the budget director the number of 41 
permanent full-time positions which have been vacant for  42 
ninety days or more in such form and in such detail as the 43 
budget director shall direct, and the governor shall reduce 44 
the total of the allotments for the fiscal year to the 45 
department in order to account for the vacant positions. 46
